At roll call the following Aldermen were present: Bolger, Locke, Bates, Lawson, Baird. Absent: None. City Staff in attendance were City Clerk Althoff, City Administrator Peterson, Director of Building and Zoning Lobaito, Director of Public Works Batt, Chief of Police Joyce, and Melissa Cooney, sitting in for City Attorney McArdle. Absent: Director of Parks and Recreation Merkel. PUBLIC HEARING - ANNEXATION AND ZONING - INLAND BUSINESS PARK Mayor Cuda opened the Public Hearing on the annexation and zoning of a 201- acre business park owned by Inland Development at 7:31 P.M. Tom Zanck, Attorney for Inland, requested the public hearing be continued to April 19, 1995 at 7:30 P.M. Motion by Baird, seconded by Bolger, to continue the Public Hearing on the annexation and zoning of Inland Development's 201-acre business park on April 19, 1995 at 7:30 P.M. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. Mayor Cuda adjourned the public hearing- until April 19, 1995 at 7:30 P.M. TEN MINUTE PUBLIC INPUT SESSION Anton Rebel of 4009 Maple Avenue read two letters recently published in the Northwest Herald against further growth in McHenry County. He stated his own opposition to uncontrolled growth. Tom Batt of 4305 W. Shamrock Lane, the President of Irish Prairie Homeowner's Association, respectfully requested that the homeowners of Irish Prairie be included in the development process and/or discussions of Inland's proposed business park. A written request was also presented to the City Clerk for inclusion in the official records. FIESTA DAYS UPDATE Chamber President Phil Bartmann informed Council that in consideration of Bob Kirschner's concerns regarding the restoration of McCullom Lake, the proposed water ski show was removed from this year's schedule of events. The parade will begin one hour earlier at 1 :00 P.M. and the parade route will be reversed. Six drum and bugle corps have committed to perform. Mayor Cuda also stated his desire and availability to meet with the holders of liquor licenses along the parade route to work out an amicable solution regarding liquor service during the Fiesta Days parade. A boat show, although not the wood classic invitational, as per past years, will be hosted by Dobyn's House. Discussion followed regarding the possibility of a circus parade the day of the circus performance. Details will be worked out with staff and presented to Council. Voting Nay: None. Absent: None. March 29, 1995 Page 6 AWARD OF BIDS - 1995 SIDEWALK PROGRAM Sidewalk bid specifications were advertised and mailed to contractors. A total of nine bids was received on March 14, 1995, with the low bidder, Colella Concrete, Inc, submitting a bid price of $138,062.57. As there was substantial variance in the _ bid prices, a review of the low bidder's qualifications and contact with other municipal sidewalk replacement program representatives was undertaken. It is the staff's recommendation to award the 1995 Sidewalk Program to Colella Concrete, Inc, in the amount of $138,062.57; and that Council should consider increasing the City's portion of the contract another $40,000. Discussion followed regarding the inclusion of Kane Avenue in the expanded sidewalk program. Determination was made to spend the added monies on other areas until a better solution could be agreed upon for Kane Avenue. Motion by Lawson, seconded by Bates, to award the 1995 Sidewalk Program to Colella Concrete, Inc. in the amount of $178,062.57, which includes an increase of $40,000 for additional sidewalks to be determined by Public Works Director Batt. work to the contract. Director of Public Works Batt was instructed to present a list of the additional areas to be included in the expanded sidewalk program. AWARD OF BID - WARNING SIREN Previously, the City received bids for the purchase and installation of warning sirens to be installed at the elevated water tower site in the Tonyan Industrial Park. All bids were rejected at the February 15, 1995 Council meeting. Director of Public Works Batt was instructed to meet with the three bidders to review the bidding process in order to ensure uniform bids. The project was rebid with the low bidder, Braniff Communications of Crestwood, Illinois, submitting a bid price of $11,840.97. It is staff's recommendation to award the emergency siren bid to Braniff Communications of Crestwood, Illinois in the amount of $11,840.97. Specifications require the warning siren be installed within 30 days of the award. Motion by Baird, seconded by Lawson, to award the emergency warning siren contract to Braniff Communications of Crestwood, Illinois in the amount of $11,840.97. AWARD OF BID - AUDIT SERVICES Council authorized staff at its February 1 , 1995 meeting, to solicit audit proposals for the year ending April 30, 1995, with options for 1996 and 1997. Notification was printed in the Northwest Herald and proposals were sent to a number of firms as well. A total of seven proposals was received. Four firms, Bark Associates, Eder, Reidel, & Company, Evoy, Kamschulte, Jacobs & Co., and Pandolfi, Topolski, Wiess, & Co., Ltd. were interviewed. Interviews concentrated upon each firm's qualifications, scope of services, assigned personnel, reporting format, timeliness of audit completion, commitment to profession, and ability to provide other services if requested. It is staff's recommendation, based upon the proposal, the interview, and a submission of municipal audit work, that Eder, Reidel, & Co. be retained to perform the City's audit for the year ending April 30, 1995; and that options for performing the audit for the years ending 1996 and 1997 be contingent uc-., Pr-' =,--'sfactory performance. March 29, 1995 Page 7 Motion by Lawson, seconded by Bolger, to award the audit services of City funds to Eder, Reidel & Co. for the year ending April 30, 1995, with an option for performing the audit for the years ending 1996 and 1997 contingent upon timely and satisfactory performance. AWARD OF BID - ADA COMPLIANCE FOR PARKS FACILITIES Bid specifications were advertised and sent to over ten contractors for activities for coming into compliance with the Americans With Disabilities Act (ADA) requirements. Six bids were received ranging in price from $55,800 to $81 ,584. The low bidder in the amount of $55,800 was William Tonyan & Sons. It is staff's recommendation to award the bid to William Tonyan & Sons. Motion by Baird, seconded by Lawson, to award the Americans With Disabilities Act (ADA) compliance bid for park facilities to William Tonyan & Sons in the amount of $55,800. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. AWARD OF BID - RIDGEVIEW DRIVE WATER AND SEWER EXTENSION City Administrator Peterson explained that the City was awarded a $315,000 grant from the State for the extension of water and sewer lines along Ridgeview Drive as part of the economic development incentive package to Motorola for their location in the McHenry Corporate Center. Six bids were received, with the low bidder, Contour Contracting, submitting a bid price of $174,387.00. It is staff's recommendation to award the sanitary sewer extension and water main extension to Contour Contracting in the amount of $174,387.00. Motion by Bolger, seconded by Lawson, to award the Ridgeview Drive water and sewer extension contract to Contour Contracting in the amount of $174,387.00 to be paid with grant funds from the Illinois Department of Commerce and Community Affairs and the McHenry Corporate Center. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. RESOLUTION AUTHORIZING SALE OF CITY PROPERTY City Administrator Peterson reported that as per Council authorization, the City wishes to sell real estate in an effort to promote the economic development activity of the Green Street downtown commercial business district. The resolution authorizes the sale of approximately 1/2 acre of property. Motion by Baird, seconded by Lawson, to pass a resolution declaring approximately 1/2 acre of property which is currently used for parking in the Green Street parking lot for sale to McHenry Savings Bank for $83,500.00. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. March 29, 1995 Page 8 Mayor Cuda noted that he and Alderman Bolger had talked individually to the Green Street merchants and found all were in favor of the sale. AMENDMENT TO LEAF BURNING ORDINANCE Mayor Cuda stated that as per Council direction, staff has drafted a leaf burning ordinance for Council consideration. He opened the floor to comments. Thomas McCarthy, Chairman of the City's Environmental Advisory Commission, stated his belief that this ordinance was a step in the right direction, but the ultimate goal should be to ban burning altogether. Discussion ensued regarding the burning of paper, and stating a specific distance away from any structure. Alderman Bolger expressed his belief that not enough alternatives had yet been investigated, particularly vacuuming. Motion by Lawson, seconded by Baird, to pass a leaf burning ordinance, as presented, amending the current regulation incorporating the following changes: (1) Deleting the words "leaves or" in the first sentence of Section 10-19; (2) Deleting the words "provided that" in the second sentence of Section 10-19; (3) Stating a distance of "10 feet away from any structure" in the second sentence of Section 10-19; and (4) Changing the word "of" to "after" in the phrase "of a rain" in the second sentence of Section 10-19. (5) Setting the time frame for burning leaves on weekends in October and November and from April 15 to May 15. Further discussion followed. Tom Hagy of 122 Ronda Avenue addressed Council, stating his distress that this _ ordinance compacts 365 days of burning into 24 days. Mr. Hagy reminded Council of the many alternatives available as opposed to burning. Alice Howenstine, member of the Environmental Advisory Commission,stated that the 24-day limit will help educate McHenry residents in the available alternatives to burning (i.e. recycling, composting, mulching, etc.). She stated the current ordinance was a step in the right direction. Clerk Althoff called for the vote on the motion: Voting Aye: Locke, Bates, Lawson, Baird. Voting Nay: Bolger. Absent: None. TRAFFIC ORDINANCE AMENDMENTS TO REDUCE SPEED LIMITS ON GREEN STREET AND CRYSTAL LAKE ROAD City Administrator Peterson explained that as has been discussed by Council on a number of occasions, the two ordinances presented would reduce speed limits on Green Street and Crystal Lake Road. Motion by Baird, seconded by Locke, to pass an ordinance, as presented, creating a 30 MPH speed limit on Green Street, from Anne Street to Bull Valley Road, and to reduce the speed limit on Green Street from 45 MPH to 35 MPH from Bull Valley Road south to 135 feet south of Forest Road; and to reduce the speed limit on Crystal Lake Road from 45 MPH to 35 MPH from Lillian Street to Bull Valley Road. March 29, 1995 Page 9 LIQUOR LICENSE ORDINANCE AMENDMENT City Administrator Peterson explained as per Council direction, staff has drafted an ordinance with the following changes regarding liquor licenses: (1) An automatic reduction in the number of outstanding liquor licenses in any class, should a current liquor licensee become ineligible to hold such a license for any reason, and; (2) Liquor licenses may only be issued for one location as described on each liquor license application. Motion by Baird, seconded by Locke, to pass an ordinance, as presented, amending the current liquor license ordinance incorporating the following changes: (1) An automatic reduction in the number of outstanding liquor licenses in any class, should a current liquor licensee become ineligible to hold such a license for any reason, and; (2) Liquor licenses may only be issued for one location as described on each liquor license application. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. MAYOR'S STATEMENTS AND REPORT Mayor Cuda reminded Council to contact City Clerk Althoff if attending the Saturday, April 1, 1995 recreational center visits, and the Wednesday, April 5 Motorola visit. COMMITTEE REPORTS Chairman of the Finance Committee, Alderman Locke, reported that the Finance Committee had met Tuesday, March 28, 1995. The Committee's recommendations regarding the 1995-96 Employee Wage and Benefit Package will be presented in Executive Session for full Council consideration. Chairman of the Building and Zoning Committee, Alderman Baird, reported that the Building and Zoning Committee had met, and a tree preservation ordinance will be presented for full Council consideration at a regularly scheduled Council meeting. STAFF REPORTS Director of Building and Zoning Lobaito reported that District 156 has requested a waiver of the $360 filing fee and the $100 sign deposit fee associated with the conditional use permit application for plans to construct a board of education building on the West Campus site. They are not requesting a waiver for the $250 retained personnel fee. Motion by Baird, seconded by Lawson, to waive the zoning filing fees and sign deposit fee in the amount of $460.00 for School District 156 associated with their conditional use request for a Board of Education building at West Campus. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. Superintendent Swartzloff has also requested the City consider assisting with the extension of water service to the new building. He also asked for _ authorization to make the regular semi-annual loan payment to First National Bank of McHenry. Determination was made to meet with the employee representatives at 7:00 P.M. next Wednesday, April 5, 1995, prior to the regularly scheduled Council meeting to present the following approved employee wage and benefit package as given: (1) 4.0% wage adjustment to pay grade. (2) Implementation of a 10-year step system with placement of current employees in the next higher step of the range. (3) Elimination of longevity for all employees effective 5/1/96. Longevity will be replaced by a pool of performance money (2.0% of base department pay) for which all non-contract employees would be eligible in 1 .0% increments up to a maximum 4.0%. (4) Elimination of $300 additional compensation, replaced with 50/50 split between City and employees from any year-end health insurance savings. Contract employees eligible pending negotiations. (5) Increase accumulation of sick day bank for employee use only from 100 to an unlimited number of days. Pay for accumulated sick days may only be received at retirement or after 12 years of service. Terminated employees are not eligible for this benefit. (6) Purchase of bottled water for employees.
