JUNE 12, 1995
The Regular Meeting of the McHenry City Council was called to order by Mayor
Cuda on Monday, June 12, 1995 at 7:30 P.M. in the Council Chambers of the
Municipal Building. At roll call the following Aldermen were present: Bolger, Locke,
Bates, Lawson, Baird. Absent: None. City Staff in attendance were City Clerk
Althoff, City Administrator Peterson, Director of Public Works Batt, Director of Building
and Zoning Lobaito. Absent: Director of Parks and Recreation Merkel, Chief of Police
Joyce, City Attorney McArdle.
At the beginning of the 1994 calendar year, the Council determined that the
second regularly scheduled Council meeting of each month would be utilized as a
working meeting to discuss relevant issues concerning development, planning and
other related City matters.
TEN MINUTE PUBLIC INPUT SESSION
No one signed up to speak during the Ten Minute Public Input Session.
PROPOSED REVISIONS TO SUBDIVISION CONTROL ORDINANCE
City Administrator Peterson explained that the Subdivision Control Ordinance
has been under review for a number of years and has experienced numerous drafting
revisions. Input has been provided by City Engineers Baxter &Woodman, the Director
of Public Works Fred Batt, and recently the Plan Commission. As the Subdivision
Control Ordinance is a technical document dealing with procedures and standards for
submittals, approvals, reviews and construction design elements associated with the
subdivision of property, City Administrator Peterson suggested the Council may wish
to review the ordinance in three meetings, concentrating on pages 1-20 at the first
meeting, pages 20-37 at the second meeting, and pages 37 through the end at a third
and final meeting. City Administrator Peterson also recommended that Council seek
comments from the development community, particularly on those areas which are
recommended for changes from the existing standards once Council finishes its own
._ review and approval.
Director of Public Works Batt then began the review procedure.
Page 2, Section 1 - Purpose: The changing of "sewerage" to "wastewater" in line 9;
Page 3, Section 2 -Jurisdiction and approval, Section 2.1 : after a lengthy discussion
it was the Council's consensus beginning at line 11 and continuing on to the end of
this section to remove the phrase "provided, however that a plat of subdivision may
be approved by the Mayor and City Council pursuant to the provisions of Section 5.10
hereof without Plan Commission participation."
Page 4, Section 2.5: In line 3: the addition of the words "parkways and final lift of
asphalt".
Page 4, Section 3, Section 3.1: After some discussion, it was the consensus of
Council to discuss the inclusion of the phrase "or a Planned Unit Development
(P.U.D.)" in line 3 at a later time in conjunction with the PUD Ordinance.
Page 5, Section 4, Section 4.1: As per the Plan Commission's recommendation,
Council will leave the language in this section as presented.
Page 6, Section 5.3: The last sentence in this section shall read: "fee amounts
specified below shall be deposited prior to the review of the preliminary plat."
Section 5.3.1: In line 2, after the word "economist", the phrase "in-house civil
engineer" shall be added.

Section 5.3.2: The fees shall be increased as follows: up to one acre: $500; from 1
up to 5 acres: $300/per acre or fraction thereof, but not less than $500; from 5 to 10
acres: $200 per acre or fraction thereof, but not less than $1 ,700; and 10 acres or
more: $150 per acre or fraction thereof to reflect not less than $2,700. The addition
of the words "These fees may be increased as necessary to pay for the actual cost
to the City for inspectors, engineers and other retained personnel as provided in this
Ordinance." shall also be included.
Page 7, Section 5.3.4: The phrase "in accordance with Appendix 13 as aforesaid"
shall be deleted.
Section 5.3.6: In line 3, the reference to "the City" should be defined more clearly.
Council recommended referencing a specific department head or administrative
position.
Page 8, Section 5.3.8: Shall read "The City shall give notice of the demand for
payment to the subdivider."
Section 5.3.9: In line 1, the reference to "the City" should be defined, again, more
clearly.
Section 5.3.11: In line 5, the word "may" will be changed to "shall".
Page 9, Section 5.4: Director of Public Works Batt recommended that this section be
deleted from the body of the Subdivision Control Ordinance and be drafted as an
appendix.
It was the consensus of Council to continue the discussion on the proposed
revisions to the Subdivision Control Ordinance at the July workshop meeting.
Mayor Cuda called for a recess at 9:25 P.M. The meeting was reconvened at
9:35 P.M. with everyone still in attendance.
EXECUTIVE SESSION
Motion by Bates, seconded by Locke, to go into Executive Session at 9:36 P.M.
to discuss personnel issues.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Locke, seconded by Lawson, to go back into Open Session at 10:05
P.M.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
Mayor Cuda, referencing his memo, asked for Council approval to set a special
meeting for Monday, June 19, 1995 at 7:30 P.M. This special meeting would be a
joint City Council and Zoning Board of Appeals meeting to discuss several outstanding
zoning issues with regard to the annexation of properties east of the Fox River.
Council concurred and a meeting was scheduled for Monday, June 19, 1995 at 7:30
P.M. Staff was instructed to inform all members of the Zoning Board of Appeals.

NEW BUSINESS
Alderman Bates, Chairman of the Parks and Recreation Committee, rescheduled
the Committee Meeting to Wednesday, June 14, 1995 at 7:30 P.M. He presented the
agenda.
ADJOURNMENT
Motion by Bates, seconded by Lawson, to adjourn.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
