JUNE 21, 1995
The Regular meeting of the McHenry City Council was called to
order by Mayor Cuda on Wednesday, June 21, 1995 at 7 : 30 P.M. in the
Council Chambers of the Municipal Center. At roll call the
following Aldermen were present : Bolger, Bates, Lawson, Baird.
Locke arrived at 8 : 15 P.M. City Staff in attendance were : City
Clerk Althoff, City Administrator Peterson, City Attorney McArdle,
Director of Building and Zoning Lobaito, Chief of Police Joyce,
Director of Parks and Recreation Merkel . Absent : Director of
Public Works Batt .
At the request of one of the Fort McHenry volunteers, Mayor
Cuda placed the presentation of the Governor' s Hometown Award by
the Fort McHenry volunteers before the Ten Minute Public Input
Session.
PRESENTATION BY PROJECT PLAYGROUND VOLUNTEERS - GOVERNOR'S HOMETOWN
AWARD
Project Playground/Fort McHenry volunteers Carol Chrisman,
Debbie Glick, and Debbie Heisler presented the First Place
Governor' s Hometown Award plaque to Mayor Cuda. The City was
awarded First Place in the General category for outstanding
volunteerism during the Fort McHenry project . The presentation was
made to the Committee in Springfield on Thursday, June 15, 1995 .
Chief of Police Joyce introduced recently hired officer
Patricia Laycock. Officer Laycock gave a brief presentation on the
D.A.R.E. program.
TEN MINUTE PUBLIC INPUT SESSION
Vincent Ciardo of 1014 Bonita Lane stated his distress and
concern over the quality and availability of water from the McHenry
Shores Water Company. A lengthy discussion followed involving
several McHenry Shores residents; William Buchanan, Mel Stiles,
Marcia Krueger, Sharon Wlezien, and Council . Council reviewed the
day' s sequence of events with regard to the McHenry Shores Water
Company' s original request for a 2-hour connection to fill their
elevated tank and regain pressure and the subsequent rejection of
City assistance. Council also reviewed the legalities of this
situation and the limitations of direct City involvement .
Alderman Locke arrived at 8 : 15 P.M.
Mayor Cuda stated the City' s willingness to supply the McHenry
Shores residents with water under emergency conditions for a
temporary period of time. Council strongly recommended with City
Attorney McArdleIs support, all residents of McHenry Shores contact
the State' s Attorney' s Office and urge them to move the McHenry
Shores Water Company court date forward from its currently
scheduled November 1st date. Staff was directed to obtain from the
McHenry County Health Department, or formulate, a fact sheet on
ways to deal with health issues arising from water shortage and
poor water quality.
PRESENTATION BY WERNER ELLMEN, HABITAT FOR HUMANITY
Werner Ellmen, President of the Northern McHenry County
Habitat for Humanity, gave a presentation to Council on his
organization' s low mortgage housing program. Mr. Ellmen stated
Habitat for Humanity is always looking for additional volunteers
and donations, although they are prohibited from accepting cash
`! donations from municipalities . The requirements for application to
the program include :
- County resident for at least one year;
- Registered voter
- 500 "sweat" equity hours (spent working on own home or
someone elses) ;
- Must be ESDA volunteer;
- There is a set parameter of income (low and high end)
Mayor Cuda called for a recess at 9 : 15 P.M. The meeting was
reconvened at 9 :25 P.M. with everyone still in attendance.

Alderman Baird requested that the June 7, 1995 Council meeting
minutes be withdrawn from the consent agenda until the motion
regarding the extension of temporary use permits for outdoor sales
could be researched.
Motion by Lawson, seconded by Baird, to approve the Consent
Agenda with the removal of the June 7, 1995 Council minutes, as
follows :
(1) May 22, 1995 Special City Council Meeting Minutes;
(2) May 31, 1995 Regular City Council Meeting Minutes;
(4) Picnic/Beer Permits;
(5) Tuition Reimbursement Request - Victor Chirio,
Introduction to Sociology, 6/5/95-7/26/95, $99 . 00;
(6) Block Party Request - Debbie Glick, 8/19/95 from 10 am to
11 pm;
(7) Block Party Request - Ron & Sue Roeser, 7/22/95 from 2 pm
to 10 pm;
(8) Request from Polish Legion of American veterans to block

Alderman Bates, noting the Bills for Approval list was
provided for review at such a late hour, requested that all bills
be held until 4 : 00 p.m. on Thursday, June 22 , 1995, giving the
Aldermen additional time for review and comment . Council
concurred.
City Administrator Peterson was directed to hold all bill
payments until 4 : 00 p.m. on Thursday, June 22, 1995 .

INLAND BUSINESS PARK - ANNEXATION, ZONING and PRELIMINARY PLAT
City Administrator Peterson explained Council had considered
the annexation and zoning of the Inland Business Park at its April
29, 1995 meeting. All issues discussed at that time had been
incorporated into a revised annexation agreement distributed for
Council review on Friday, June 16, 1995 . Only two items remain for
further discussion:
(1) The landscape entrances at Crystal Lake and Bull Valley
Roads should be limited to 2001 , keeping the larger
right-of-way at 4001 ; the annexation agreement currently
reflects 2501 . Council and Inland representatives agreed
to the change .
(2) The roadway extension from Lot 54 to the Irish Prairie
development .
City Administrator Peterson, noting the correspondence
received from the Irish Prairie Homeowner' s Association and the
Cunat Brothers stating their objection to the plan, recommended
that the City not attempt to provide additional access to the
private roads serving Irish Prairie residents . At the request of
Alderman Baird, it was suggested that the Public Works Committee
look into a possible resolution to this problem. Other recommended
changes to the annexation agreement and agreed to by Inland
representatives include :
- On page 17, Number 4 : the inclusion of language stating that
if on or before the designated three-year period the City
of McHenry gives written information that a bypass road will
be constructed, the 150-foot right-of-way necessary as
generally depicted in Exhibit C and in accordance with
engineering studies to be done by the County, will be
preserved.
- On page 11, Section 5-Development in Phases, line 14 : the
phrase "on-site stormwater detention improvements" will be
followed by language stating "unless the City directs off-
site stormwater detention improvements to a regional
detention area" .
- Under Title 3 , Section 10-Obligations of the Owners :
language referencing the letter dated June 14 , 1995 from
Pastor Robert N. Sherry of the Church of Holy Apostles to
the City Council addressing their concerns regarding
recapture agreement fees and signage regulations .
Motion by Bolger, seconded by Lawson, to pass an ordinance
authorizing the Mayor and City Clerk to execute the annexation
agreement relating to property owned by the American National Bank
and Trust Company as Trustee under Trust Agreement dated September
27, 1993 , and known as Trust No. 117509-08 .
Voting Aye : Cuda, Bolger, Locke, Bates, Lawson.
Voting Nay: Baird.

annexing approximately 200 acres owned by American National Bank &
Trust as Trustee under Trust Agreement dated September 27, 1993 and
known as Trust No. 117509-08 .

National Bank and Trust Company as Trustee under Trust Agreement
dates September 27, 1993 and know as Trust No. 117509-08 as
Business Park.

ZONING ORDINANCE TEXT AMENDMENT - REVISED PLANNED UNIT DEVELOPMENT
PROCEDURES
City Administrator Peterson explained Council had previously
considered text amendments to the City' s Zoning Ordinance regarding
the process to be used for reviewing planned unit development
projects . Subsequently, a revised Planned Unit Development
Ordinance was prepared by planning consultant Allen Kracower, along
with input from the City Attorney and City staff . The City' s
Zoning Ordinance stipulates any changes to the written procedures
must come before the Zoning Board of Appeals in the form of a
public hearing process with a recommendation back to the Council .
Changes to the Planned Unit Development Ordinance recommended by
the Zoning Boardwere distributed for Council review.
- The Zoning Board recommended that major adjustments "shall"
rather than "may" be referred to the Zoning Board for "public
hearing" , rather than "review and recommendation" . It was
Council' s consensus that referrals would be done at the discretion
of Council and the word "may" shall be retained.
- The Zoning Board recommended the elimination of a non-binding
master site plan substituting the master site plan with a binding
preliminary plan. After a lengthy discussion, it was the consensus
of Council to retain the master plan submittal . Staff was directed
to create the criteria for inclusions in the master plan submittal .
The criteria will then be reviewed by the Zoning Board of Appeals
and sent to Council for comment .
- The Zoning Board of Appeals recommended the elimination of the
terminology "special use" as referred to in the Planned Unit
Development and the substitution of the language "conditional use" .
The Zoning Board indicated this would be consistent with the
terminology used throughout the rest of the Zoning Ordinance.
Council concurred.
- The Zoning Board recommended the inclusion of a court reporter
to take complete transcripts of the proceedings at various stages
of the review process . Council concurred.
Some discussion followed regarding the role of the Plan
Commission during this process . City Administrator Peterson noted
the Plan Commission is involved in the P.U.D. process if the
subdivision of a property occurs . He also noted the Plan
Commission Chairperson is part of the technical review process .
Alderman Bates stated he had several concerns he wished to
address regarding the revised P.U.D. Ordinance . He requested,
citing the lateness of the hour, this item be deferred to the July
5, 1995 meeting as item number 1 on the agenda. Council concurred.
COMPUTER BIDS - PARKS AND RECREATION DEPARTMENT
City Administrator Peterson explained that bids for the
purchase of computer hardware for the Parks and Recreation
Department were opened on June 2, 1995 with five bids submitted.
Two of the bids were incomplete. During the bidding process, it
was brought to staff' s attention that the bid specifications were
not totally appropriate for the needs of the City of McHenry. As
all bidders did not have the same information and the bid revision
should reduce costs, it was staff' s recommendation that the bids be
rejected and that new bids be sought for the purchase of computer
hardware .

Parks and Recreation Department, with revised specifications .

REQUEST TO NAME LAKELAND PARK BASEBALL FIELD THE FRANK SWEENEY
FIELD AND HAVE IT PLAQUED AS SUCH
Chairman of the Parks and Recreation Committee, Alderman
Bates, reported that a request was brought before the Parks and
Recreation Committee by a representative of the Lakeland Park
Little League Association requesting the Committee consider naming
the Lakeland Park Baseball Field the Frank Sweeney Field, as Mr.
Sweeney was instrumental in the establishment of the Lakeland Park
baseball program. They requested the action to take place before
their August 8, 1995 annual picnic . The Parks and Recreation
Committee voted 3-0 to recommend Council rename the Lakeland Park
Baseball Field the Frank Sweeney Field. Alderman Bolger requested
this item be deferred to the July 5, 1995 meeting to do additional
research.

naming of the Lakeland Park Baseball Field the Frank Sweeney Field
to the July 5, 1995 regularly scheduled Council meeting.

CONSTRUCTION OF WASHROOMS AT WHISPERING OAKS PARK --�
Chairman of the Parks and Recreation Committee, Alderman
Bates, reported as Council had previously referred the matter of
constructing washrooms at Whispering Oaks Park to the Parks and
Recreation Committee for further review, consideration and
recommendation, the Parks and Recreation Committee considered the
matter at its June 14, 1995 meeting. Representatives from the
Project Playground Committee, Debbie Heisler, Debbie Glick and
Barbara Gilpin, were also in attendance .
Motion by Lawson, seconded by Bates, to approve the
recommendation of the Parks and Recreation Committee as follows :
(1) The installation as soon as possible of temporary port-a-
potties with decorative fencing on three sides;
(2) The playground committee obtain the services of an
architect to design permanent washroom facilities at the
northwest corner of the parking lot;
(3) The playground committee coordinate the construction of
the washroom facilities through donations, volunteer help
and staff input, including the Directors of Parks and
Recreation, Public Works and Building and Zoning; and
(4) When costs are obtained additional discussion and
consideration take place at the Council level .

RESOLUTION AUTHORIZING APPLICATION FOR GRANT TO STATE OF ILLINOIS
DEPARTMENT OF CONSERVATION UNDER ITS OSLAD PROGRAM FOR DEVELOPMENT
OF BROOKSIDE PARK
City Administrator Peterson explained that last year Council
approved a resolution authorizing the submission of a grant
application to the Illinois Department of Conservation under its
OSLAD program for the development of Brookside Park. As the City
was unsuccessful in its application, staff is recommending that the
City reapply. The Parks and Recreation Committee considered this
grant application at its June 14, 1995 meeting and recommended
Council approve a resolution applying for a grant to the State of
Illinois Department of Conservation. City Administrator Peterson
also noted the Committee recommended hiring a consultant to develop
a bid document for obtaining competitive bids to create an
underground drainage system for the soccer field areas for
Brookside Park. The Committee recommended that drainage work and
seeding of the park progress whether or not the City is successful
in securing grant funds for the development of Brookside Park.

supporting the grant application to the Illinois Department of
Conservation for the development of Brookside Park, and to
authorize staff to submit said grant application under the OSLAD
program to the Illinois Department of Conservation.

CORRECTING ORDINANCE - 1994 APPROPRIATION
City Administrator Peterson reported that the City auditors,
in reviewing the City' s finances for the year ending April 30,
1995, discovered a discrepancy in the 1994 Appropriation Ordinance.
The 1994 Appropriation Ordinance was approved in the amount of
$19, 029, 500 . 00 when the tabulation of the dollars in the ordinance
amounted to $20, 494, 500 . 00 . City Attorney McArdle researched the
issue and recommended approving an ordinance validating and
correcting the aggregate total sum of the 1994 Appropriation
Ordinance to $20, 494, 500 . 00 . This ordinance can then be published
in pamphlet form.

validating and correcting the aggregate total sum of the
Appropriation Ordinance for the fiscal year ending April 30, 1995

ANNUAL PREVAILING WAGE ORDINANCE
City Administrator Peterson explained the City must annually
approve an ordinance establishing prevailing wages for Public Works
projects performed by the City. Contractors who perform said work
must pay their employees the various wage rates established by this
ordinance .

MAYOR - STATEMENT AND REPORTS
Mayor Cuda complimented staff on their professionalism and
expertise in dealing with the McHenry Shores water shortage. He
reminded Council of the Jaycees invitation to the fireworks display
and other scheduled activities on Sunday, July 2, 1995 .
Motorola is planning a ribbon cutting ceremony for Friday,
July 7th at approximately 10 : 00 a.m.
COMMITTEE REPORTS
Alderman Bates, Chairman of the Parks and Recreation Committee
reported the Committee had met on June 14 , 1995 at 7 : 30 P.M.
Minutes were provided for Council review in Friday' s agenda packet .
STAFF REPORTS
Director of Parks and Recreation Merkel reported that all
McHenry City beaches were still closed due to an outbreak of
"swimmer' s itch" . He noted this situation was not unique to the
City of McHenry, as Crystal Lake and Lake Killarney were
experiencing the same problem. Clearance for reopening the beaches
will be given by the Northeastern Illinois Planning Commission.
Merkel requested that at that time, Council consider making the
McCullom Lake/Petersen Park beach free of charge as a measure of
good will . Merkel also reported that pool pass sales this year
have already exceeded last year' s totals .
Recreational visits to Elk Grove Village, Roselle and Wheeling
will be scheduled for Monday, July 10, 1995 .
Chief of Police Joyce requested Council pass a resolution
approving the Fiesta Days parade route for Sunday, July 23 , 1995 .
