At roll call the following Aldermen were present: Bolger, Donahue, Locke, Adams, Patterson, Serritella. Lieder arrived at 8:25 P.M. Absent: Smith. City Staff in attendance: City Clerk Gilpin, City Attorney Narusis, City Administrator Peterson, Director of Public Works Batt, Director of Parks and Recreation Merkel, Director of Building and Zoning Lobaito, Chief of Police Joyce. Absent: None. Mayor Busse acknowlegded the attendance of Boy Scout Troop #214 at the Council meeting, and commended them for their interest in City government. Sue Low and Trey Covalt, Co-Chairmen of the Annual Fiesta Days activities, presented the proposed schedule of events for the 1993 Fiesta Days which will run from July 17, 1993 through July 25, 1993. Motion by Bolger, seconded by Donahue, to approve the Fiesta Days Schedule for 1993, as presented, and to authorize the issuance of a beer and wine liquor license for specific events as requested. Voting Aye: Bolger, Donahue, Locke, Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith, Lieder. Motion carried. February 17, 1993 Page 4 SIGN VARIATION REQUEST Building and Zoning Director Lobaito reported that Remax Realtors had erected a wall sign without a sign permit at 4005 Kane Avenue on the Water Tower Plaza freestanding sign. James Shaid, President of Remax, requested that a variation be granted to allow the second wall sign in order to identify the business. Since it was not known if Mr. Shaid had been notified to attend this meeting, it was decided not to take any action. --� Motion by Patterson, seconded by Bolger, to defer this matter until the next meeting, when Mr. Shaid could be present, and also explain why he put up the sign before getting approval. Voting Aye: Bolger, Locke, Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith, Lieder. Abstaining: Donahue. Motion carried. ORDINANCE AMENDING MUNICIPAL CODE It was the recommendation of Building and Zoning Director Lobaito to permit prefabricated construction with independent third party inspections. The City would still maintain control over the construction methods of the assemblies, and the approval by a third party agency would be based on McHenry's building codes and subsequent amendments. Motion by Donahue, seconded by Bolger to approve the recommendation of the Building, Zoning, Planning & Development Committee to pass an ordinance amending the Municipal Code to permit prefabricated construction in the City of McHenry. Voting Aye: Bolger, Donahue,Locke, ..� Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith, Lieder. Motion carried. RESOLUTION FOR EXTENSION OF INCOME TAX SURCHARGE The Illinois Municipal League is urging municipalities to pass a resolution requesting that the income tax surcharge be permanently extended, with the proceeds to be distributed to municipal governments. The temporary income tax surcharge dedicated to local government will expire June 30 of this year. That expiration will occur unless every municipal official rises to the challenge, and joins forces to convince the Illinois General Assembly and Governor Edgar to support Illinois municipalities. In light of State mandates, the property tax cap, and the slow economy the past two years, this revenue source is critical to balancing the City of McHenry's budget. Motion by Patterson, seconded by Serritella, to pass a resolution seeking permanent extension of the Income Tax Surcharge, as presented. Voting Aye: Bolger, Donahue, Locke, Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith, Lieder. Motion carried. AWARD BID FOR SALE OF OLD CITY HALL Two bids were received at the February 3, 1993 Council meeting for the old municipal building at 1111 N. Green Street. Edward A. McGuire submitted a bid in the amount of $214,000, and Edward J. Neumann, Jr. presented a bid with three options: Option 1: Cash purchase price of $223,000; Option 2: Cash purchase price of $180,000 plus the conveyance of propery owned by Mr. Neumann to the City at 1246 N. Green Street; and Option 3: a cash price of $205,000 plus the conveyance of property owned by Mr. Neumann to the City at 1246 N. Green Street, and that the area be plaqued and dedicated to the memory of Mr. Neumann within one year of his death. In addition to these options, there were a number of other considerations in Mr. Neumann's proposal. February 17, 1993 Page 5 Motion by Bolger, seconded by Donahue, to award the bid to Edward Neumann for Option 3, subject to working out the details with the City Administrator and City Attorney. REQUEST FOR MEMBERSHIP The McHenry County Historical Society requested that the City consider membership in the Society with the cost of $500 per year. Motion by Serritella, seconded by Locke, to deny the request at this time for membership in the McHenry County Historical Society. Voting Aye: Bolger, Donahue, Locke, Patterson, Serritella. Voting Nay: Adams. Absent: Smith, Lieder. Motion carried. ORDINANCE AMENDING DUI PENALTY PROVISIONS Motion by Serritella, seconded by Patterson, to pass an ordinance amending the penalty provisions pertaining to DUI in order to provide that the municipal ordinances conform to State Statutes. Voting Aye: Bolger, Donahue, Locke, Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith, Lieder. Motion carried. REQUEST FOR UNPAID EMERGENCY LEAVE OF ABSENCE Michael Morrell of the Wastewater Division, requested an emergency leave of absence to care for his grandfather. The Personnel Code does permit leaves of absence upon Council approval. Motion by Patterson, seconded by Donahue, to grant the request of Michael Morrell for a 30-day emergency unpaid leave of absence, as presented. Voting Aye: Bolger, Donahue, Locke, Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith, Lieder. Motion carried. MAYOR - STATEMENT AND REPORTS Mayor Busse announced that the Ad Hoc Developmental Advisory Committee, composed of the two school districts, library, fire district, and City,. will meet regularly on the first Wednesday of every month at 9:00 A.M. in the Aldermen's Conference Room. Mayor Busse also announced that Meyer Material had filed tax �. objections with the County which would result in an approximate loss of $1,000 in tax money to the City of McHenry. It was the decision of the Council to continue its present policy not to file "Petitions to Intervene" on tax objections. DEPARTMENT HEAD REPORTS City Administrator Peterson reported that the McHenry Save Our Schools (SOS) organization had requested permission to use the City of McHenry Lions' sign for two weeks, and that the $40/sign fee be waived. The Lions Club already had permission to use the sign during one of the periods requested by the SOS group. February 17, 1993 Page 6 Motion by Locke, seconded by Bolger, to waive the fees for both dates requested by SOS, and to instruct Park Director Merkel to contact the Lions Club to see if something could be worked out on the double request week. Voting Aye: Bolger, Donahue, Locke, Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith, Lieder. Motion carried. Aldermen Lieder arrived at 8:25 P.M. City Administrator Peterson suggested that the Finance Committee review and make recommendations on updating and enforcing the mechanical amusement device license fees. Since the Finance Committee was busy working on the 1993-94 Fiscal Year Budget, some Aldermen felt the matter should be considered by the entire Council. Motion by Donahue, seconded by Serritella, to place the mechanical amusement device matter as an agenda item on a future Council meeting. Voting Aye: Bolger, Donahue, Lieder, Locke, Patterson, Serritella. Voting Nay: Adams. Absent: Smith. Motion carried. City Clerk Gilpin reported that Fabrik Industries at 5213 Prime Parkway, McHenry Corporate Center, had requested hook-up to the City alarm system Motion by Bolger, seconded by Donahue, to approve the request of Fabrik Industries for hook-up to the City alarm system. Voting Aye: Bolger, Donahue, Lieder, Locke, Adams, Patterson, Serritella. Voting Nay: None. Absent: Smith. Motion carried. City Clerk Gilpin announced that a lottery had been held prior to this meeting for the purpose of selecting placement on the April 20, 1993 General Consolidated Municipal Election ballot. Werth February 17, 1993 Page 7 NEW BUSINESS Alderman Serritella mentioned the number of empty gasoline service stations along Route 120. Following discussion, the City Administrator, Public Works Director and Building and Zoning Director were instructed to be alert and watchful for any problems, that might result from the abandoned gas stations. Mayor Busse distributed a letter from Zoning Board member John Swierk concerning his views on the recreational vehicle issue which had been before the Zoning Board of Appeals. Alderman Locke reported that the Advertiser Newspaper had installed newspaper box holders on posts throughout the City without permission. Motion by Locke, seconded by Serritella, to notify the Advertiser Newspaper that it is to retrieve its boxes from the posts where they had installed them, or pay fines. Voting Aye: Bolger, Donahue, Lieder, Locke, Adams, Patterson,' Serritella. Voting Nay: None. Absent: Smith. Motion carried.
