MEL ILiG WEDNESDAY, MARCH 31, 1993 In the absence of Mayor Busse, the Regular Meeting of the McHenry City Council was called to order by Mayor ProTem Raymond Smith on Wednesday, March 31, 1993 at 7:30 P.M. in the Council Room of the Municipal Center. At roll call the following Aldermen were present: Bolger, Donahue, Locke, Lieder, Smith, Adams, Patterson, Serritella. Absent: Mayor Busse. City Staff in attendance were: City Clerk Gilpin, Police Chief Joyce, City Administrator Peterson. Absent: City Attorney Narusis, Park Director Merkel, Public Works Director Batt, and Director of Building and Zoning Lobaito. TEN MINUTE PUBLIC INPUT SESSION During the ten minute public input session, Jim Higgins of Whispering Oaks Subdivision, complained about people taking down signs on his and his neighbor's lawns, which were against passage of the District 15 school referendum. He asked if people could be arrested for taking this action and what complaint could be filed against them. Chief Joyce responded that they could be charged with criminal damage to property if a complaint was signed. Vicki Allen presented a petition with over 400 signatures asking for a change in the issuance of beer permits during children's sports oriented events, picnics, and for all events where children might be present. The petition was turned over to the City Administrator. SUPPLEMENTAL MFT RESOLUTION A Supplemental MFT Resolution for $95,000, which included $50,000 for the joint purchase of rock salt with the State of Illinois, was submitted for approval for the 1993-94 season. Motion by Bolger, seconded by Donahue, to pass the Supplemental MFT Resolution for 1993-94 in the amount of $95,000 for the joint purchase of rock salt with the State of Illinois. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Paterson, Serritella. �-- Voting Nay: None. Absent: None. Motion carried.. SCAVENGER LICENSES REQUEST Browning-Ferris Industries requested the issuance of two .licenses to operate scavenger services in the City for the collection of refuse from multi-family and non-residential locations. Browning-Ferris is a large waste hauler from Waukegan. They had submitted a Certificate of Insurance and the required bond with their request. Motion by Serritella, seconded by Bolger, to approve the request of Browning-Ferris Industries for two scavenger licenses, subject to proof of their vehicles passing the State safety inspection. Voting :dye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. HIGH SCHOOL REQUEST FOR TRAFFIC CONTROL SERVICES McHenry High School District 156 submitted a letter requesting the `-- City to provide traffic control services at West Campus before and after school each day. Currently, the McHenry Police Officer's Association contracts with the high school to picvide these services at the rate of $25.00lhour. Typically, traffic control services are not performed by on-duty police officers, a: their presence during the re(uested times cannot be guaranteed in case more pressing police business arises. It was the recommendation of the Chief of Police that the City not take on this responsibility. It was mentioned that the City is undertaking the cost of doing reconstruction work on Crystal Lake Road this summer which will create safer ingress and egress to the high school property. Based on this fact, it was decided to take no action on the request at this time. March 31, 1993 Page 2 Motion by Bolger, seconded by Patterson, to defer action on the request of McHenry High School District 156 for traffic control services at West Campus. Voting Aye: Bolger, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: Donahue. Absent: None. Motion carried. MOSOUITC CONTROL AGREENISNT In past years, the City has participated with Mcfel.r3 'Township to provide mosquito control services in the City. Clarke Outdoor Spraying Company was chosen to provide these services. McHenry Township was again asking if the City wanted to participate this year. The cost would be $2,820.00 for the 1993 season. Clarke Outdoor Spraying also submitted a contract for mosquito control services for the Nunda Township portion of the City. That amount was $966.72. Motion by Patterson, seconded by Serritella, to enter into an agreement with McHenry Township to provide mosquito control services at a cost not to exceed $2,820.00 for the 1993 season, and to enter into a contract with Clarke Outdoor Spraying for mosquito control services for the Nunda Township portion of the City at a cost not to exceed $967.00. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. MAYOR STATEMENT AND REPORTS Mayor ProTem Smith reported that he recently heard that the old City Council table and chairs were purchased by Mark Justen during the City auction for excess property. Justen donated those items to the City Council of a small town in Arkansas. They were very happy to receive the furniture and related that the Judge is now using the Mayor's chair for his seat in Court. DEPARTMENT HEAD REPORTS City Administrator Peterson reported that TCI Cablevision had requested him to announce that they are looking for someone to operate a video camera for the City Council meetings so they can be shown on the local cable station. Peterson also asked that he be given authorization to call a Letter of Credit from Home by Hemphill if a satisfactory performance bond is not submitted by April 5, 1993. The LOC expires April 17, 1993, and the public improvements in the subdivision have not as yet been completed. Hemphill had been notified and had responded that they would have a Performance Bond on file with the City before April 5, 1993. However, to protect the City's interest in making sure the public improvements are completed, Attorney Narusis strongly recommended that the City Council authorize Peterson to present the expiring Letter of Credit before the expiration date if there is a delay in securing the required Guarantee Bond. Motion by Lieder, seconded by Patterson, to authorize the City Administrator to give notice and proceed accordingly to draw on the Home by Hemphill Letter of Credit if an appropriate Performance Bond is not received from Hemphill by April 5, 1993. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. The City Clerk requested that a motion be made to ratify and confirm the Mayor's appointment of Special Counsel to represent the City in the police unionization matter. i March 31, 1993 Page 3 Motion by Serritella, seconded by Bolger, to ratify and confirm the Mayor's appointment of Special Counsel Seyfarth, Shaw, Fairweather, & Geraldson to represent the City in the police unionization matter. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. Tag Day requests for local organizations were submitted for approval. Motion by Serritella, seconded by Patterson, to approve the Tag Day Schedule as presented. Voting Aye: Bolger, Donahue, Lieder, Locke, Smith, Adams, Patterson, Serritella. Voting Nay: None. Absent: None. Motion carried. COMMITTEE REPORTS Alderman Lieder, Chairman of the Finance Committee, reported that the Committee had reviewed salary and fringe benefit requests of employee representatives at its last meeting. The Committee's recommendation will be brought to the full Council in Executive Session at the next meeting. A Finance Committee meeting was scheduled for Tuesday, April 6, 1993 at 7:00 A.M. to review requests of department heads for their fiscal year budgets. Budget documents were distributed to Aldermen at this Council meeting. They were asked to review the material, and if there were any questions, to contact Peterson or Lieder. Lieder said he hopes to have the preliminary budget before the Council on April 14, 1993. Another Finance Committee meeting was scheduled for Wednesday, April 7, 1993 at 7:00 P.M. to discuss the Developer Donation issue. Alderman Bolger reported that he would bring the Public Works Committee's recommendations to the Council at the next meeting. NEW BUSINESS City Clerk Gilpin announced that the Citizens Education Committee had requested that they be allowed to place a blue ribbon somewhere on the Municipal Center site to signify the City's support of the District 15 upcoming referendum. No action was taken. Alderman Adams requested that Park Director Merkel look at Weber's .Park in relation to clean-up of the site. Alderman Patterson asked Plan Commission Chairman Sheppard if the attendance record of Commission members was a problem. She indicated it was not. Serritella asked that the Public Works Department be reminded to keep a watchful eye on the creek running through Lakeland Park because of the high flow of water coming through the Lakeland Park area. Alderman Locke asked that parking permits be discussed at the next meeting for the retail office and hotel areas on Main Street. ADJOURNMENT Motion by Adams, seconded by Patterson, to adjourn.
