JUNE 14, 1993
The Regular Meeting of the McHenry City Council was called to order by
Mayor Cuda on Monday, June 14, 1993, at 7:30 P.M. in the Council Room of
the Municipal Center. At roll call the following Aldermen were
present: Bolger, Locke, Lawson, Baird. Bates arrived at 7:38 P.M.
Absent: None. City staff in attendance were City Clerk Gilpin, City
Administrator Peterson, City Attorney McArdle, Director of Public Works
Batt, Director of Building and Zoning Lobaito, Director of Parks and
Recreation Merkel, and Chief of Police Joyce. Absent: None.
TEN MINUTE PUBLIC INPUT SESSION
During the Ten Minute Public Input Session, Anton Rebel of 4009 W. Maple
Avenue, gave a report on the June 5, 1993 Boone Creek Cleanup and thanked
everyone who participated in making the event a great success. He also
questioned whether the tornado sirens were working, and suggested that
more should be installed so that everyone in town could hear them.
CONSENT AGENDA
Motion by Bolger, seconded by Lawson, to approve the Consent Agenda as
presented, except the item concerning Resolutions in recognition of City
officials:
(1) Approved June 2, 1993 Regular City Council Meeting Minutes;
(2) Approved Tuition Reimbursement Request of Dave Bartik for Basic Code
Enforcement Techniques, $120.50;
(3) Passed Resolution for Fiesta Days Parade Route;
(4) Passed Prevailing Wage Ordinance;
(5) Approved hiring summer employees for Parks and Recreation Dept.
(6) Approved Picnic/Beer Permits;

Former officials present at the meeting to accept their Resolutions
were: Former Mayor William J. Busse, Aldermen Raymond Smith and Randy
Patterson, and Landmark Commission member Marlene Goetschel.
Mayor Cuda presented the Resolutions to each, and thanked them for
their dedication and service to the City of McHenry and its citizens.
FENCE VARIATION REQUEST
Mr. and Mrs. Otis of 5313 Shore Drive requested a fence variance to
install a split rail fence in the City's right-of-way adjacent to their
property.
Motion by Bolger, seconded by Baird, to grant the fence variation as --�
requested by Mr. and Mrs. Otis of 5313 Shore Drive to install a split
rail fence in the right-of-way due to the unusual circumstances found at
the property.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.

VACATION OF CITY RIGHT-OF-WAY ON BULL VALLEY ROAD ADJACENT TO THE FOX RIVER
Wallace W. Busse and William A. Schmiegelt requested that the City
vacate its right-of-way on the east end of Bull Valley Road adjacent
to the Fox River. They have maintained the property for 22 years, and
requested that each be deeded half of the right-of-way when it is
vacated.
Motion by Bolger, seconded by Lawson, to deny the request for
vacation of the right-of-way on the east end of Bull Valley Road, but
that the Public Works Department to instructed to post the property to
discourage negligent use of the right-of-way by outsiders.
Voting Aye: Bolger, Locke, Lawson, Baird.
Voting Nay: Bates.

ZONING BOARD RECOMMENDATION ON COONEY/ZOIA REQUEST
A request to reclassify and grant variances was made by Lee Cooney,
acting on behalf of the property owner at 1309 N. Richmond Road. The
eastern portion of the property is zoned RM-2 and the western portion is
zoned RS-4. They request a reclassification to an 0-1 district. They
also requested variances be granted in the minimum frontage allowed on
the property, as well as a variation to allow parking in the interior
side yard, and a variation to eliminate screening within the side yard.

The Zoning Board of Appeals voted 5-1 to deny the reclassification
and variances. They were concerned about the drainage onto Freund Avenue
and the ingress and egress to the property.
Motion by Locke, seconded by Bates, to postpone action on the
Cooney/Zoia request for zoning reclassification and variances until
further information is submitted regarding engineering and ingress and
egress to the property.

ACTUARIAL SERVICES FOR POLICE PENSION FUND
In order to ascertain the appropriate tax levy required by the Police
Pension Fund, the City must either use the figures prepared by the State
of Illinois Department of Insurance or conduct a study of the funds by a
qualified actuary. In 1991, the City hired Wyatt Company to perform an
actuarial study. Through that study, the City was able to levy
$41,834.00 less than what the State Department of Insurance submitted.
Norman S. Losk, Mark Doda, and Connie Losk of the Wyatt Company were in
attendance to answer questions.
Motion by Locke, seconded by Lawson, to retain the Wyatt Company to
conduct an actuarial study of the Police Pension Fund at a cost not to
exceed $3,800.00.

SUMMER RECREATION PROGRAM REVIEW
�--- Recreation Program Supervisory Lorene Marcinek gave a detailed
outline of the summer recreation programs now being conducted by the City
Park Department. The summer registration for recreation programs is the
largest of three registrations which the City conducts annually.
Following her presentation, the Council expressed its satisfaction for
the manner in which the Park Department conducts its many programs.
WATERS EDGE DRIVE REPAIR ESTIMATE
At the last meeting, the Director of Public Works was asked to obtain
a price for making street repairs to Waters Edge Drive. The engineer's
cost estimate for these repairs was $72,500.00. It was the consensus of
opinion that work on Waters Edge Drive be considered in the context of a
comprehensive review of the condition of all City streets, and that a
prioritization list be developed for another street maintenance and
improvement program in 1995. However, it was decided that Waters Edge
Drive, between Thornwood and Winslow, should have some work done to
repair the bad spots in that location.
RESOLUTION FOR OSLAD PROGRAM
Last year the City applied for a Grant from the State of Illinois
Department of Conservation, concerning a 50/50 matching Grant for the
purchase of approximately 70 acres, known as the Mass Property. On
December 21, 1992 the City was informed that its application was not
successful, however the City was encouraged to resubmit the Grant
Application this year.
Motion by Bolger, seconded by Lawson, to pass a resolution
authorizing the resubmission of a Grant Application for the purchase of
the Mass Property under the OSLAD Program.

PERMIT FOR FISH ERADICATION IN McCULLOM LAKE
On June 11, 1993, the City was notified that its application for
Clean Lakes Funds, Phase II Implementation Project for McCullom Lake was
approved. The Grant was in the amount of $182,655.00. In connection
with that Clean Lakes Grant, a permit needed to be submitted to authorize
removal of undesirable fish in McCullom Lake, as outlined in the proposed
Lake Restoration and Protection Plan.
Motion by Bates, seconded by Bolger, to authorize and approve the
permit with the Department of Conservation Division of Fisheries for
eradication of undesirable fish in McCullom Lake, which would take place
September 8 and 9, 1993.

MAYOR — STATEMENT AND REPORTS
Mayor Cuda reported that he wrote a letter to the Pioneer Center
concerning their application for a Grant to purchase Towerview Apartments
in the City for a low cost housing project. He was awaiting a response
from them.
The Mayor also submitted a format for aldermen to use for items to be
placed on all City Council and Committee agendas.
A Revolving Loan Fund Committee meeting was scheduled for Monday,
June 21, 1993 at 7:00 P.M. to discuss a revolving loan application which
was submitted for City approval.
A Parks and Recreation Committee meeting was scheduled for Tuesday,
June 22, 1993 in the Park Department Conference Room at 7:30 P.M. The
purpose of the meeting is to update new members on the Park Department
Master Plan, proposed recreation center, Leathers Park construction
project, and the McCullom Lake project.
COMMITTEE REPORTS
Alderman Locke reported on a Finance Committee meeting held June 7,
1993. Items discussed were employee health insurance, annexation fees,
1988 Waterworks and Sewerage Bond, Budget action review items, and April
30, 1993 budget report review. Executive Session was also held to
discuss a personnel matter. No Committee recommendations were brought
before the Council for action at this time.
