JULY 14, 1993
The Board of Local Improvements meeting was called to order by Mayor
Cuda on Wednesday, July 14, 1993. Board members in attendance were:
Alderman Bolger, Alderman Locke, Alderman Bates, Alderman Lawson, and
Alderman Baird. Also in attendance was Board Engineer Carl Moon of
Baxter & Woodman, Board Attorney David McArdle of Zukowski, Flood, Rogers
& McArdle, and Court Reporter Cheryl Barone. City staff in attendance
were: City Clerk Gilpin, City Administrator Peterson, Director of
Building and Zoning Lobaito.
HISTORY OF PROJECT
�..� Mayor Cuda announced that on May 19, 1993 the Board of Local
Improvements passed a resolution to consider construction of a local
improvement consisting of a sanitary sewer system serving portions of
Country Club Estates. The project was described by the City Engineer and
an estimate of the cost was presented. It was proposed by the Board that
the cost of the project be paid for by special assessements against the
properties benefited. The Board scheduled the Public Hearing tonight to
further consider this improvement.
PURPOSE OF MEETING
The purpose of this meeting was to conduct a Public Hearing to listen
to members of the public regarding the necessity for the improvement,
scope of the improvement, and the estimated cost of the improvement.
ATTORNEY'S REVIEW OF PROJECT
Prior to receiving questions or comments from the public, Attorney
McArdle gave a brief review of the legal steps necessary to impose this
special assessment. McArdle said the procedures that the Board of Local
Improvements needed to implement to begin this project were started
several months ago when a Resolution was passed by the Board which
included an estimate of cost prepared by the Board Engineers. A copy of
that estimate was sent to residents in the Country Club Estates.
�... The purpose of tonight's meeting was to get input from residents
involved in the project. After the hearing, if the Board feels it is
appropriate to continue with the project, it would pass a recommendation
and a resolution along with a proposed ordinance.
The Board would then recommend to the City Council passage of the
ordinance imposing the special assessment for the Country Club Estates
Subdivision. The City Council would publish those documents, along with
the cost of the project. After a 10 day period of time, the City Council
would act on that recommendation, and either accept, modify or reject it.
If the recommendation is accepted in any format, and an ordinance is
passed for the special assessment, the ordinance would in effect
authorize a petition to the Court. The Court has to review and approve
the process. The petition would then be filed with the Circuit Clerk of
McHenry County authorizing the project to go forward. At the same time,
an assessment roll is prepared which would identify each of the homes
that are proposed to be benefited by this sanitary sewer improvement.
Each of those homes would be listed along with the estiimated cost to be
assessed against each lot in the project.
A hearing would take place before a Judge. A final order would be
entered, and bids for construction would then be awarded on that final
judgment. Since there is a minor benefit to the general public for
relief of eliminating the septic systems, the Council had determined
�-- there would be a 15% public benefit which would be deducted from the
final cost. The remaining 85% of the project would then be paid for by
the benefitted property owners.
ENGINEER'S COMMENTS
Carl Moon of Baxter & Woodman, Board Engineers for the project, then
gave the scope, nature, and estimated cost of the project. He described
the project in detail and outlined the sewer installation on an area
map. Estimated construction costs were $387,835.00. Estimated cost of
the total project including interest reserve, engineering services, and
costs of making, levying and collecting the assessment was $504,185.00.
It was pointed out that final costs could not be determined until bids
were let for the construction work.

PUBLIC INPUT
Commenting from the general public on the project were George Sanger
of 3420 Fairway Drive, Frank Cuda of 3404 Fairway Drive, and Dennis
Gerstung of 206 N. Ronda Drive, all residents in the project area. Their
main concerns referred to the depth of the sanitary sewer line from
Skyway to Brittany Heights subdivision. They questioned inclusion of the
costs to increase the depth of that line into the project. Their
questions will be researched by the Attorney and Engineer prior to the
next Board of Local Improvement's meeting.
Since the method of financing has not as yet been decided and other
questions needed to be addressed, the meeting was recessed.

REGULAR MEETING
JULY 14, 1993
The Regular Meeting of the McHenry City Council was called to order
by Mayor Cuda on Wednesday, July 14, 1993 at 8:20 P.M. in the Council
Room of the Municipal Center following the Board of Local Improvements
meeting. . At roll call the following Aldermen were present: Bolger,
Locke, Bates, Lawson, Baird. Absent: None. City Staff in attendance
were City Clerk Gilpin, City Administrator Peterson, City Attorney
McArdle, Chief Joyce, Director of Public Works Batt, Director of Parks
and Recreation Merkel, and Director of Building and Zoning Lobaito.
Absent: None.
TER MINUTE PUBLIC INPUT SESSIOft
During the Ten Minute Public Input Session, Al Marciniak of
Cheerleader's Bar & Grill, asked that he be permitted to block off five
parking spaces on Riverside Drive on the east side of his building so he
could serve drinks and food during Fiesta Days on Saturday and Sunday,
July 24 and 25.
Motion by Baird, seconded by Lawson, to grant Marciniak's request to
block off five parking spaces on Riverside Drive on Saturday only for
outside sale of drinks and food.
Voting Aye: Bolger, Locke, Lawson, Baird.
Voting Nay: Bates.
Absent: None.
Motion carried.
Jim Higgins addressed the Council and spoke as a member of Concerned
Taxpayers and asked that the Council not take any formal action to
support District 156's tax increase referendum scheduled for a November
vote.

Motion by Baird, seconded by Bolger, to approve the Consent Agenda
and supplemental bill list as follows:

RIVER PARK SUBDIVISION PRELIMINARY PLAT
River Park Subdivision is located on the east side of River Road,
approximately 2000 ft. north of the Bull Valley Road bridge. The
property is located within the 1 1/2 mile jurisdiction of the City, and
is therefore subject to the City's Subdivision Control Ordinance. The
owners are proposing the development of a 41 lot subdivision on 54
acres. The Plan Commission held a meeting and voted 4-0 to approve the
preliminary plat. Attorney Dan Curran, representing developer Randy
Thelen, was in attendance to answer questions of the Council.
Mayor Cuda commented that this project had gone before the City
Council and the Plan Commission four times since August, 1992. He felt
that any objection to this project should have been brought up by the
City when the zoning hearing was held before the County Zoning Board of
Appeals. He felt it was not fair after the project had been in the
process for all of these months to now present objections to stop the
project.
Motion by Bolger, seconded by Locke, to approve the preliminary plat
of River Park subdivision, as presented.

Mayor Cuda called for a recess at 8:57 P.M. The meeting reconvened
at 9:14 P.M. , with everyone still in attendance.
TONYAN INDUSTRIAL PARK RECAPTURE AGREEMENT
Sanitary sewers have been installed in Tonyan Industrial Park by the
Tonyan Real Estate Partnership. Forty-three lots in the Industrial Park
were benefited by this installation. Installation of the sewers was
inspected and accepted by the City at its February 3, 1993 meeting. The
Agreement was also reviewed by Baxter & Woodman.
Motion by Locke, seconded by Baird, to approve the Tonyan Industrial
�.... Park Recapture Agreement as presented, and to authorize the Director of
Public Works to send a letter to all benefited properties notifying them
of the requirement to hook into the sewer system within one year of the
date of the letter.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.

AD HOC COMMITTEE RECOMMENDATION
The Ad Hoc Committee on Development had spent several months working
on an Operations Fee Schedule which would be applied to District #15,
District #156, and the Library District to offset the tax lag between the
time new homes are occupied and when the property appears on the tax
rolls. The Ad Hoc Committee presented their recommendation, and felt the
implementation of the recommendation would help to alleviate the negative
impact of new development upon the community. The Committee recommended
that the Operations Fee Schedule be adopted by the Council and asked that
it be reviewed annually in January to reflect average home sales from the
proceeding year. They also recommended that the fees take effect October
1, 1993, and that the fees be paid directly to each of the taxing
districts for which they are levied.
In attendance from the Ad Hoc Committee were Alison Smith and Lucy
Fick of School District 15, Superintendent Robert Swartzloff of District
156, and Judy Moore of the Library Board.
Motion by Bolger, seconded by Locke, to refer the Ad Hoc Committee's
recommendation to the Finance Committee for further review.
Voting Aye: Bolger, Locke.
Voting Nay: Bates, Lawson, Baird.
Absent: None.
Motion did not carry.
During the discussion, several alternatives were discussed, one being
that instead of a graduated fee, an average of the proposed graduated
fees should be charged. The proposal was $850 per unit for School
District 15, $600 per unit for District 156, and $50 per unit for the
Library District, making a total of $1,500 per unit.
Motion by Baird, seconded by Lawson, to charge an Operations Fee of
$850 per unit for School District 15, $600 per unit for School District
156, and $50 per unit for McHenry Public Library District, payable
directly to the applicable taxing district prior to issuance of an
occupancy permit by the City.
Voting Aye: Bates, Lawson, Baird.

the Operations Fee Schedule for newly annexed land on October 1, 1993.

BOAT LAUNCH BID REPORT
Only one bid was received on Friday, July 9, 1993 for the
non-motorized boat launch project. The bid received from A & K
Construction Company, Inc. from Chicago was approximately $100,000 over
the engineer's estimate. It was the recommendation of the engineers,
Smith Engineering, and of Park Director Merkel, that the bid be rejected
and the project be re-bid at a later date.
Alderman Locke left the meeting at 9:58 P.M.
Motion by Bolger, seconded by Baird, to reject the one bid and rebid --.
the Boat Launch project at a later date this fall.
Voting Aye: Bolger, Bates, Lawson, Baird.
Voting Nay: None.
Absent: Locke.

MAYOR'S - STATEMENTS AND REPORTS
Mayor Cuda announced that he had attended an EDC Meeting recently and
had been asked to get support from the City Council for the construction
of the proposed Route 420 tollway which would run along the northern
boundary of the City. He asked the Aldermen to consider it and be
prepared to vote on it at the next meeting.
Alderman Locke returned to the meeting at 10:04 P.M.
COMMITTEE REPORTS
Alderman Baird, Chairman of the Building, Zoning & Planning
Committee, reported on a Committee meeting held July 13, 1993. No
Committee recommendations were presented for Council action.
Alderman Locke, Chairman of the Finance Committee, reported on a
Committee Meeting held prior to this meeting. No Committee
recommendations were presented for Council action.
Alderman Bolger, Chairman of the Public Works Committee, reminded the
Council that a meeting of his Committee would be held on Monday, July 26,
1993 at 7:30 P.M. concerning the drainage problem in various locations
throughout the City.
Park Director Merkel asked that it be clarified in the record what
the park program fees would be for registrations, now that the school
districts are charging the City for renting their facilities.
Previously, through an intergovernmental agreement, the schools would not
charge the City for rental of their facilities, and therefore the City
would charge resident fees for persons living in school district
boundaries. Now that that agreement is no longer valid, it should be
clarified that non-resident fees will be charged for persons living in
school district boundries and outside City limits.
Motion by Locke, seconded by Bolger, that resident fees charges will
apply only to those living in city boundries, not school district
boundries. .

NEW BUSINESS
Alderman Lawson, the City's representative on the McHenry Area Youth
Commission, reported that he had been asked if the City had any objection
to having the Village of Johnsburg join the Youth Commission as a
sponsor. There was no objection from the City Council.
Alderman Locke said that Jim Higgins requested some action from the
City on his request that the City Council not pass any resolutions
supporting the District 156 tax referendum. Mayor Cuda replied that
since no information had been received by the Council on this matter, no
action would be taken at this time. If and when the matter came before
the Council, Mr. Higgins would be notified so that he could appear at
that Council meeting.
