At roll call the following Aldermen were present: Bolger, Locke, Bates, Lawson, Baird. Absent: None. City Staff in attendance were: City Clerk Gilpin, City Administrator Peterson, City Attorney McArdle, Director of Public Works Batt, Director of Building and Zoning Lobaito, Director of Parks & Recreation Merkel. CONDITIONAL USE SIGN REQUEST BY GARY LANG Gary Lang of Pontiac, Cadillac, Subaru car dealerships, requested a conditional use to permit the re-painting of a wall mural and outdoor advertising sign at the corner of Routes 120 and 31. Director of Building and Zoning Lobaito pointed out that his office had a problem issuing new sign permits to Gary Lang since he is in violation of the temporary sign ordinance at his three business locations. He has been notified to correct them on two separate occasions, but the violation still exists. Motion by Bolger, seconded by Locke, to grant the variation request of Gary Lang, but that the "S" be removed from in front of "Route 31" on the sign. Motion by Bates, seconded by Lawson, to amend the motion by adding "contingent upon compliance of the temporary sign violation." Voting on the amendment: Voting Aye: Lawson, Bates, Bolger. Voting Nay: Baird, Locke. Absent: None. Motion carried. November 17, 1993 Page 4 Voting on the original motion, which reads "to grant the variation request of Gary Lang, but that the "S" be removed from in front of Route 31 on the sign, contingent upon compliance of the temporary sign violation. APPEAL OF FIRST CLASS AFFAIR This agenda item for the appeal of a permit application was removed from the agenda. McHENRY AREA CHAMBER OF COMMERCE REOUEST FOR USE OF PETERSEN PARK Debbie Harr, Executive Director of the McHenry Area Chamber of Commerce, and Carol Bradley, Crafts Fair Chairman, addressed the Council to request use of Petersen Park on September 18, 1994. The Chamber wishes to hold its Second Annual Country Meadows Craft Show. Ms. Bradley said that the Chamber Committees would handle all of the work involved with this project, and the only thing the City crews would be asked to do would be to mow the Park before the Craft Fair. Motion by Bolger, seconded by Baird, to approve the request of the McHenry Area Chamber of Commerce, and allow them to hold a Country Meadows Craft Show on September 18, 1994 in Petersen Park with no permit fee to be charged. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. BUSINESS EXPANSION/RETENTION SURVEY The McHenry County Economic Development Corporation wishes to conduct a business expansion/retention survey throughout the entire County to determine the current and future plans of existing businesses. The McHenry Area Chamber of Commerce agreed to conduct this survey in the City of McHenry. They asked for the City's endorsement of this project. The McHenry Area Chamber of Commerce Executive Director Debbie Harr and McHenry County Economic Development Corporation Executive Chairman Jim Allen, were present at the meeting to answer questions of the Council. Following discussion, it was the consensus of the Council that it endorses this business expansion/retention survey within the City, and asks that the survey results be presented to the Council upon completion. 1994-95 NISRA MEMBERSHIP DUES Brian Shahinian and Colleen Fitzgerald of NISRA were present to give an overview of NISRA programs during the past year. It was the NISRA Board's decision to request dues from participating municipalities at the rate of the CPI for 1992 (2.9%) plus growth. This would result in an assessment to the City for dues of $44,024.00. If just the current dues of $40,804.00 X the CPI of 2.9% were used, the membership dues would be $41,987.00. Motion by Bolger, seconded by Bates, to approve the amount of $41,987.00 for the 1994-95 NISRA membership dues, which is 2.9% of the current year's membership dues. November 17, 1993 Page 5 REFINANCING - REFUNDING BOND ISSUES This item was deferred until the December 1, 1993 meeting. RECESS Mayor Cuda called for a recess at 8:48 P.M. The meeting reconvened at 8:57 P.M. with everyone still in attendance. REVIEW 1993 SUMMER RECREATION PROGRAM Park Director Merkel and Recreation Supervisor Lorene Marcinek presented a summary of the 1993 Summer Recreation Programs. Charts and overhead graphs were presented, which displayed financial and historical information to highlight some of the key decision areas. PARKING ORDINANCES The Council approved the installation of a turnaround at the south end of Lakewood Road at a previous meeting. In order to maintain this area, it is recommended the Council pass an ordinance making the turnaround a "No Parking" area. Also, to correct a past oversight, it was recommended the Council approve a stop sign at Albany on Route 31 at the south entrance to the Tonyan Industrial Park. Motion by Bates, seconded by Lawson, to pass an ordinance creating "No Parking" in the turnaround area on Lakewood Road and to authorize installation of a stop sign at the intersection of Albany and Route 31, as presented. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. ADVERTISE FOR BIDS ON PUBLIC WORKS VEHICLES The 1993-94 Budget allows for the purchase of 5 vehicles - 4 pickup trucks which would be replacement vehicles, and one snow plow for an additional vehicle. It was recommended these vehicles be replaced so the City has reliable equipment to perform its various service functions. Motion by Locke, seconded by Lawson, to advertise for bids for five Public Works vehicles, as presented. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. DRAINAGE DITCH CLEAN-UP The Council previously discussed a number of methods to correct localized flooding problems. Much of the work has been done by Public Works crews, however, some of the work needs to be performed to reduce flooding which cannot be done by Public Works crews and needs to be contracted out. Two quotes were received regarding the drainage ditch that runs between Crystal Lake Road and Front Royal Drive. Motion by Locke, seconded by Lawson, to authorize accepting and signing a proposal to have Hughes, Inc. perform drainage ditch work on a time and materials basis on the ditch that runs between Crystal Lake Road and Front Royal Drive at a cost not to exceed $4,300.00. November 17, 1993 Page 6 RESOLUTION AUTHORIZING CITY ATTORNEY TO MAKE AN OFFER ACQUIRING CONSTRUCTION AND PERMANENT EASEMENTS FOR THE BACKHAUS PROPERTY Under an existing annexation agreement with the Backhaus property, the City is obligated to work with the owners to secure an easement for the construction of a sanitary sewer to serve the property. If necessary, eminent domain proceedings would take place. The development group of Dave Backhaus and Gerstad Builders has requested the City make a formal offer on their behalf for the purchase of a permanent and construction easement on which to construct the sanitary sewer for the Backhaus project. Attorney McArdle requested the Council consider passing a resolution authorizing him to make an offer of $6,000 to acquire the permanent easement and $1,200 for the construction easement. Following discussion, it was the consensus of the Council that Backhaus and Gerstad should attempt to obtain this easement themselves before asking the City to get the easements. It was recommended that the developers provide documentation that they have tried to secure the easements and have exhausted all avenues. Upon receipt of this documentation, the City would assist in obtaining the necessary easements. Attorney McArdle was instructed to contact Gerstad and report back to the Council. MAYOR — STATEMENT AND REPORTS Mayor Cuda reported that he and Alderman Bates had met with citizens of Ringwood on Sunday, November 7, 1993 to discuss the possibility of entering into a boundary agreement. It was just preliminary discussion COMMITTEE REPORTS Alderman Bolger, Chairman of the Public Works Committee, reported that a Committee Meeting had been held Tuesday, November 16, 1993. He would present the written minutes at the next Council meeting. He did suggest that a separate meeting should be held with the West Shore Beach residents concerning possible annexation. STAFF REPORTS Building and Zoning Director Lobaito reported that permits had been issues for three of the homes that had earnest money deposited on homes in the Oaks of McHenry. They plan to break ground immediately. Park Director Merkel announced that a Parks & Recreation Committee meeting would be held Tuesday, November 23, 1993 at 7:30 P.M. in the Parks Conference Room. City Administrator Peterson announced that Requests for Proposals on employee health insurance were to be submitted the first week in December for Council review. He also presented a memo to Aldermen suggesting that the second meeting of the month be scheduled as a workshop meeting so that a greater exchange of ideas could be pursued and issues could be explored in greater depth. The Aldermen took the matter under advisement. Peterson also reported that two bids had been received concerning completion of public improvements in the Oaks of McHenry subdivision. Gerstad Builders presented a price quote for $85,000 to complete the improvements. Another quote of $98,000 was also submitted. Motion by Lawson, seconded by Bates, to authorize Gerstad Builders to complete all outstanding public improvements work at the Oaks of McHenry, except for installation of sidewalks and parkways. Bolger suggested that the Council consider establishing a fund out of the annexation fees to pay for some of the legal and engineering fees _ when a new company or business wants to locate in the area.
