MONDAY, DECEMBER 13, 1993
The Regular Meeting of the McHenry City Council was called to order
by Mayor Cuda on Monday, December 13, 1993 at 7:30 P.M. in the Council
Chambers of the Municipal Center. At roll call the following Aldermen
were in attendance: Bolger, Locke, Bates, Lawson, Baird. Absent:
None. City Staff in attendance: Deputy Clerk Marth, City Administrator
Peterson, City Attorney McArdle, Director of Public Works Batt. Director
of Building & Zoning Lobaito arrived at 7:40 p.m. Absent: City Clerk
Gilpin, Chief Joyce, Director of Parks & Recreation Merkel.

VARIANCE REQUEST - 5200 SHORE DR. , KEITH & MIRIAM SCHMITT-STRONG,
INCREASE PERMITTED SIZE OF GARAGE
The Petitioners, Keith and Miriam Schmitt-Strong, are requesting a
minor variance to allow construction of a three car 896 square foot
garage on their property. The maximum permitted size is 700 square
feet. The Zoning Board of Appeals recommended approval of the variance
at the zoning hearing on November 22, 1993 with the stipulation that
Petitioners be required to install overhead doors on the garage with a
maximum height of 7 feet. Letters of support were received from
adjoining neighbors.
Motion by Bolger, seconded by Lawson, to accept the recommendation
of the Zoning Board of Appeals and pass an ordinance granting a variance
to allow construction of an 896 square foot garage at 5200 Shore Drive
with the requirement that Petitioners, Keith & Miriam Schmitt-Strong,
install overhead doors on said garage with a maximum height of 7 feet.

McDONALD'S FINAL PLAT
The Final Plat of Subdivision for McDonald's located at the
northeast corner of Illinois Route 31 (Front Street) and Bull Valley
Road was recommended for approval by the Plan Commission at their
meeting of November 18, 1993 pending annexation.
Motion by Baird, seconded by Lawson, to accept the recommendation of
the Plan Commission and approve the Final Plat of McDonald's Subdivision
at the northeast corner of Illinois Route 31 and Bull Valley Road
contingent upon execution of the Annexation Agreement as approved at the
Council meeting of September 29, 1993.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.

TEXT AMENDMENT TO THE ZONING ORDINANCE
After reviewing and discussing a report from the Zoning Board of
Appeals regarding a requested change in zoning from RS-4 to C-4 by the
owner of Dobyn's House Restaurant, the City Council directed the City
Attorney to prepare a petition for a text amendment of the Zoning
Ordinance. The proposed text amendment was considered by the Zoning
Board of Appeals on November 22, 1993. The Zoning Board did not
recommend approval of the text amendment and stated in their report that
they wished to see no more properties included in C-4 zoning. The City
Attorney, at the Zoning Board's request, drafted an ordinance that would
not allow future expansion of C-4 zoning. The City Attorney also
drafted an ordinance along the lines of the text amendment presented to
the Zoning Board, as requested by the Council. This text amending
ordinance would modify the permitted and conditional uses in C-4
Commercial Districts as intended by the Zoning Ordinance and as stated
in the recent 1990 edition of the City's Development Plan (Comprehensive
Plan) to improve and develop the older business districts.
Motion by Locke, seconded by Bolger, to pass an ordinance in
accordance with the text amendment proposed by the Council and presented
to the Zoning Board of Appeals, with the addition of "Catering
Establishments" to the Permitted Uses in Group L of Table 7 and deleted
from the Conditional Uses in Group M of Table 7.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.

MAYOR - STATEMENT AND REPORTS
The Mayor announced that he and the City Administrator would be
meeting with developers and their attorneys on the following properties:
- Inland property on McCullom Lake Road;
- Pacini property on Bull Valley Road and Route 31;
- Knox-Busch on Bull Valley and Green Street.
COMMITTEE REPORTS
Bates reminded the Aldermen of the Parks & Recreation Committee
meeting for 7:30 p.m. on December 21 at the Lakeland Park Community
Center.
STAFF REPORTS
Batt announced that the new stoplight at Crystal Lake Road and
Lillian will be activated December 14, 1993.

Peterson reported on the public hearing that he and the Mayor
attended where they presented the Resolution passed by the Council
objecting to the PACE Dial-a-Ride funding cuts proposed by the RTA.
Peterson stated that based on the attendance and the testimony given at
the hearing, he was hopeful that the RTA will change their funding
allocation and get the lost funding restored.
Peterson stated that he called PACE on the 1994 contract (which he
presented) and they are willing to extend the City's contract for a one
month period under the current terms and conditions of our Dial-a-Ride
program, until a final funding decision is made by the RTA. Peterson
asked that the Dial-a-Ride contract be extended for the one month from
January 1 to January 31, 1994 on the same basis as last year's dollars
with a 3.9% increase for the service provider (which becomes effective
January 1) and with the same 30-70 split we now have. This one-month
period would cost the City $2,816.00 with the 3.9% increase.
Discussion followed on the 30 day contract with the 3.9% increase
and whether to fund it, find another provider or cut service.
Motion by Lawson, seconded by Bolger, to extend the PACE Dial-a-Ride
contract with the 3.9% service provider increase from January 1 to
January 31, 1994.
Voting Aye: Bolger, Bates, Lawson, Baird.
Voting Nay: Locke.

Motion carried.
NEW BUSINESS
Baird expressed concern over the possibility of mis-communication
between the Boards of the City, mainly the Plan Commission and Zoning
Board. It was suggested that one of the Council's future workshop
meetings be a joint meeting with the Zoning Board and Plan Commission.
