HomeMy WebLinkAboutMinutes - 02/16/1994 - City Council REGULAR MEETING FEBRUARY 16, 1994 The Regular Meeting of the McHenry City Council was called to order by Mayor Cuda on Wednesday, February 16, 1994 at 7:30 P.M. in the Council Room of the Municipal Center. At roll call the following Aldermen were present: Bolger, Locke, Bates, Lawson, Baird. Absent: None. City Staff in attendance were City Clerk Gilpin, City Attorney McArdle, City Administrator Peterson, Director of Public Works Batt, Director of Building and Zoning John Lobaito, Chief of Police Joyce, Director of Parks and Recreation Merkel. Absent: None. BOARD OF LOCAL IMPROVEMENTS MEETING Mayor Cuda called to order the meeting of the Board of Local Improvements for the purpose of awarding the bid for construction of the Country Club Estates Sanitary Sewer Special Assessment No. 32 Project. Six bids were received for the project. City Engineers Baxter & Woodman reviewed the bids and recommended the bid be awarded to the low bidder J.R. Myers Company, Inc. of Zion, Illinois at the cost of $352,439.15. The firm is well known to Baxter & Woodman. They have satisfactorily completed a number of Baxter & Woodman design projects, including some for the City of McHenry and have an excellent reputation. Motion by Bolger, seconded by Locke to concur with the recommendation *-1 of Baxter & Woodman and award the bid for the Country Club Estates Sanitary Sewer Special Assessment Project No. 32 to the low bidder, J.R. Myers Company, Inc. in the amount of $352,439.15. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. There being no further business before the Board of Local Improvements, Mayor Cuda adjourned the meeting at 7:40 P.M. REGULAR MEETING TEN MINUTE PUBLIC INPUT SESSIOft Several members of TCI Cablevision addressed the Council to introduce themselves and explain the new program and cable installations that are to be completed this year. First to speak was Anne Meyer, General Manager, who reported on the present status of the company and the new $9 million project which is to be completed by November of 1994. Members of '1 her staff who also addressed the Council were Tim Moravek, Pat Scuffle, Kevin Mullens, and Robert Weber. At the present time the City is working with TCI Cablevision to draft a new cable franchise. Negotiations will take place shortly. BIKE PATH ROUTING PLAN Alderman Bates, Chairman of the Parks and Recreation Committee, reported on a meeting held with approximately 60 citizens concerning the proposed route for the McHenry County Conservation District Bike Path. The two proposed paths were along Lillian Street, down Crystal Lake Road; or Mill Street. Motion by Bates, seconded by Baird, to establish that the proposed bike path use the Mill Street route, which would be installed along the north side of Mill Street and cross Crystal Lake Road into Whispering Oaks Park; that a speed limit sign be placed in Whispering Oaks Park; and that a flashing warning sign be investigated for installation at the intersection of Mill Street and Crystal Lake Road. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. '1 Motion by Bolger, seconded by Lawson, to authorize the City Administrator to work with County or City engineers for striping the roadway at the intersection of Mill Street and Crystal Lake Road for safety precautions and then report back to the City Council with that information. FENCE VARIATION REQUEST Ronald Opryszek of 4826 Barnwood Court, requested a fence variation to install an eight foot stockade fence along the rear property line of his yard, which fronts onto Crystal Lake Road. Motion by Baird, seconded by Lawson, to approve the fence variation request at 4826 Barnwood Court, as presented. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. VARIOUS PARK DEPARTMENT PURCHASES A list of capital purchases, requested by the Director of Parks and Recreation for the 1994-95 Budget, was presented. Director Merkel was asking permission to seek quotes for the purchase of these items now so they can be ordered and in place for use in the Parks by early summer. He recommended these purchases be made out of the Park Capital Development Fund. Motion by Bates, seconded by Bolger, to authorize Director Merkel to obtain quotes for the various park items listed on the equipment bid request, as presented. MAYOR — STATEMENT AND REPORTS Mayor Cuda requested approval for his appointment of Debbie Lane of 3715 W. Waukegan Road, McHenry, to fill the unexpired term of Reverend Phyllis Mueller who resigned recently from the Landmark Commission. February 16, 1994 Page 5 Motion by Baird, seconded by Bolger, to approve the Mayor's appointment of Debbie Lane to the Landmark Commission to fill the unexpired term of Reverend Phyllis Mueller, which expires 4-30-94. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent: None. Motion carried. Mayor Cuda reported that a letter had been received from Dr. William Dodds, Superintendent of School District 15, requesting a meeting with the City Administrator and a representative of the Council to further discuss the issue of rental of school facilities by the Park Department. The Council agreed to send Alderman Bolger and City Administrator Peterson to the meeting with Dodds and a member of the School Board to discuss the issue. STAFF REPORTS Director of Public Works Batt reported that there have been complaints on City parking lots that have not been snow plowed by City trucks. The complaints are warranted because the City has no restrictions on parking in City lots after a snowfall, except a 2:00 to 6:00 a.m. restriction for the Riverside Drive Municipal Lot. He suggested the Council consider amending the Municipal Code, making it unlawful to park any motor vehicles between the hours of 2:00 a.m. and 6:00 a.m. on any municipal parking lot. The Aldermen indicated they would take this under consideration, but would take no action at this time. NEW BUSINESS Mayor Cuda raised the issue of the use variation, which was discussed by the Council at previous meetings. A petition would have to be drafted and presented by the City Council to the Zoning Board for a public hearing prior to the use variation being implemented. Discussion took place on the number of votes required to vote on Zoning Board recommendation approvals, and the number needed to override Zoning Board recommendations. It was pointed out that the City of McHenry's Zoning Ordinance clearly specifies the following: "In the case of a variance a vote of 2/3 of all Aldermen shall be required; to approve any application not approved by the Zoning Board of Appeals. In all other cases, the concurrence of a majority of all members then holding office on the City Council, including the Mayor, shall be required." Following further discussion, it was decided to present a petition to the Zoning Board of Appeals. Motion by Baird, seconded by Bolger, to authorize Director of Building and Zoning Lobaito to present a petition to the Zoning Board of Appeals requesting a text amendment to the Zoning Ordinance incorporating the use variation, with a provision that reserves to the City Council the right to impose such conditions or restrictions on that use as may appear necessary to minimize possible detrimental effects on the variation of other properties in the neighborhood. Voting Aye: Bolger, Locke, Lawson, Baird. Voting Nay: Bates. Absent: None. Motion carried. Motion by Lawson, seconded by Bolger, to authorize David Kruk, the petitioner of the Haystacks Manor Annexation proposal, to amend his petition, go before the Zoning Board of Appeals, request a use variation in the event the text amendment is approved by the Zoning Board of Appeals and the Council, with zoning hearing fees to be waived for the �. petitioner. Voting Aye: Bolger, Locke, Lawson. Voting Nay: Bates, Baird. Absent: None. Motion carried. February 16, 1994 Page 6 Alderman Locke, Chairman of the Finance Committee, announced that a Finance Committee meeting would be held on Monday, February 28, 1994 at 7:00 P.M. to discuss the employee benefit package. Alderman Lawson stated that he did not feel the City Council should get involved in discussions concerning the annexation of West Shore Beach at this time. He would oppose that annexation. He felt the Lakeland Park drainage problem should be resolved before considering annexation of the West Shore Beach subdivision. Alderman Baird agreed with Lawson's statement. Alderman Bates reported that a Parks and Recreation Committee meeting would be held on Tuesday, February 22, 1994 at 7:30 P.M. He also planned to hold a meeting on Thursday, February 24, 1994 at 7:30 P.M. to select a committee of Whispering Oaks residents to keep them informed of the Leather's Playground project construction.
