MARCH 16, 1994
The Regular Meeting of the McHenry City Council was called to order
by Mayor Cuda on Wednesday, March 16, 1994 at 7:30 P.M. in the Council
Room of the Municipal Center. At roll call the following Aldermen were
present: Bolger, Bates, Lawson, Baird. Locke arrived at 9:40 P.M.
Absent: None. City Staff in attendance were City Clerk Gilpin, City
Administrator Peterson, Director of Public Works Batt, Director of
Building and Zoning Lobaito. Absent: Chief Joyce, Director of Parks and
Recreation Merkel, and City Attorney McArdle.
Also in attendance were: Plan Commission members Sheppard, Buhrman,
Osmon, Siman. Absent: Carlson, Nadeau-, Addante. Zoning Board of
Appeals members: Semrow, Swierk, Tobeck, Christensen, Adamson. Absent:
Kleeman.
TEN MINUTE PUBLIC INPUT SESSION
No one signed up to speak during the ten minute public input
session.
PUBLIC HEARING
On March 2, 1994 the Council passed a motion to hold a public hearing
on March 16, 1994 to consider the exchange of real estate between the
City of McHenry and Granite Builders due to the partial construction of a
home foundation on the City's walkway located in Green Valley Subdivision
on Lot 30. Mayor Cuda asked if anyone in the audience wished to address
the Council on this exchange of land between the City of McHenry and
Granite Builders. There was no response. Mayor Cuda then closed the
public hearing. He asked if any of the Aldermen had any comments or
questions on the exchange. There was no response.
Motion by Bolger, seconded by Lawson, to pass an Ordinance
authorizing the exchange of land between the City of McHenry and McHenry
State Bank as Trustee of Green Valley, Unit 2, Lot 30; authorize the
Mayor and City Clerk to sign the Exchange Agreement, and authorize the
Mayor to sign the Quit Claim Deed as presented.
Voting Aye: Bolger, Bates, Lawson, Baird.
Voting Nay: None.
Absent: Locke.
Motion carried.
A Russian visitor, Vladimir Melnikov, was introduced to the Mayor and
✓� the City Council by Linda Usrey, his sponsoring teacher from McHenry High
School. The Council welcomed Mr. Melnikov who told the Council of his
exciting two week tour of the United States. He was given a tour of the
Municipal Center by City Administrator Peterson, and was impressed with
the building and the people he had met. He presented the Mayor with a
beautifully handcrafted wooden box highlighted with golden trim which was
an example of the work done in his home town in Russia. The Mayor
accepted the gift and told him it would be put on display in the City
trophy case as a memory of his visit to the City of McHenry.

ANNOUNCEMENT OF EXECUTIVE SESSION
Mayor Cuda announced that an Executive Session would be held at the
end of this meeting to discuss personnel and property acquisition.
JOINT MEETING BETWEEN CITY COUNCIL, PLAN COMMISSIOft AND ZONING BOARD OF
APPEALS
In order to help coordinate the development process and provide ..�
direction and feedback as a means of communication between the City
Council, Plan Commission, and Zoning Board of Appeals, a joint meeting
was being held at this time to review the rules and regulations and
statutory authority of the ZBA and the Plan Commission. Copies of State
Statutes, which provide for the creation of a Zoning Board of Appeals and
a Plan Commission, were presented to the Council for review, along with
the City's Rules and Regulations for each board.
The Zoning Board of Appeals Chairman, Harry Semrow, outlined the
procedure used by the Zoning Board of Appeals during its deliberation on
the various petitions that are presented to the board. He stressed that
the ZBA was an advisory board to the City Council and acted as a sounding
board for petitioner's concerns.
Chairman Sheppard of the Plan Commission also said that the Plan
Commission was an advisory board to the Council and she explained in
detail various aspects of the proposals brought before them as
preliminary and final plats. The Plan Commission works within the
confines of the Subdivision Control Ordinance to make sure all those
regulations are met.
Discussion ensued between the Plan Commission, Zoning Board of
Appeals members, and the City Council. Questions were raised concerning
the Pacini, Knox/Busch and Inland properties.

\. The Plan Commission mentioned that in prior years, the City Attorney
and City Engineer were in attendance at all the meetings. From what they
understood now, this administration did not want to continue that
practice. However, the Commission felt the presence of those two
professionals at their meetings was a great help in reviewing plans and
specifications.
One of the Council's concerns was whether or not concept plans should
be brought to the Council before they are brought before the Plan
Commission or Zoning Board of Appeals. Aldermen were concerned that
their wishes concerning projects would not be brought to light until
after the developer had been through the two advisory boards and they
felt at that point it might be too late to bring up their concerns, which
could change the plans as approved by the Zoning Board and Plan
Commission. Both Chairmen assured the Council that they knew they were
just advisory boards and if the Council wished to change anything, it was
up to the Council. There would be no negative reactions from the boards
in a situation such as that.
The concensus after discussion was that if the developer did bring a
concept plan to the Council, it would listen but make no comments or ask
any questions, just refer the developer to the appropriate advisory
board. The developers would be informed of this before they brought
their projects to the Council.
It was suggested that if the developer asked for a decision or wanted
feedback from the Council and continued to pursue that route, the Mayor
should stop them and inform them that the policy was NO COMMENTS, and
that would end the discussion.
Aldermen Locke arrived at 9:40 P.M.
A question arose as to whether all future projects should be brought
before the Ad Hoc Committee on Development. Some felt that the Ad Hoc
Committee had made a recommendation which was accepted by the City
Council, School Boards, Fire District, and Library District and this
should be the policy to follow, not go back to the Ad Hoc Committee with
every development that comes in. Following discussion, no decision was
made as to what route should be taken -- follow the policy or submit each
development to the Ad Hoc Committee.
Discussion was also held on whether or not a planner or planning
consultant should be employed by the City. The concensus was that the
Council would consider this at some time in the future.
City Administrator Peterson was instructed to write a summary of the
discussion at tonight's meeting. It was felt that a joint meeting such
as tonight's should be held annually to keep the lines of communication
and understanding open.
Mayor Cuda thanked all the board members for attending tonight's
meeting and presenting appropriate comments.
ANY AND ALL BUSINESS
Mayor Cuda announced that a meeting would be held on April 11, 1994
at 7:00 P.M. in City Hall to meet with business owners on Main Street
between Front Street and Crystal Lake Road, to discuss the parking
problems in that area.

10:10 P.M. to discuss personnel and property acquisition.

appointment of Mark Amore as a Communications Dispatcher for the Police
Department, effective April 4, 1994.
