HomeMy WebLinkAboutMinutes - 03/21/1994 - City Council SPECIAL MEETING MARCH 21, 1994 A Special Meeting of the McHenry City Council was called to order by Mayor Cuda on Monday, March 21, 1994 at 7:30 P.M. in the Council Room of the Municipal Center. At roll call the following Aldermen were present: Bolger, Locke, Bates, Lawson, Baird. Absent: None. City Staff in attendance were City Clerk Gilpin, City Administrator Peterson, City Attorney McArdle, Director of Public Works Batt, Director of Building and Zoning Lobaito, and Deputy Clerk Marth. Absent: Chief Joyce, Park Director Merkel. Mayor Cuda announced that the purpose of tonight's Special Meeting was to conduct a Public Hearing for the purpose of seeking amendments to the McHenry Corporate Center annexation agreement. The first amendment to the annexation agreement incorporates changes which affect Parcels "A", "B", and "C" shown on the concept plan. The changes are necessary to proceed with construction activity for the Brake Parts building expansion, the Follett building and the Follett expansion parcel. The amendment would affect only the properties designated as Parcels "A", "B", and "C". Approval of the amendments by the Council would allow a building permit to be issued for the Brake Parts expansion and for the �- Follett building permit which was previously issued pending approval of preliminary and final platting for Unit 3 on the Concept Plan. In attendance at the meeting were Kit Carstens, Scott Dixon, John Smith and the attorney for Prime Commercial, Daniel Curran. Mayor Cuda asked if anyone in the audience wished to make public comments concerning this amendment proposal. There was no response from the audience. Attorney Curran gave an outline of the reasons for the amendments to the Annexation Agreement. The following changes were suggested: - Exhibit B.1: Development Standards, (b): Side Yard Setback - change from 10 feet to 5 feet; (c): Rear Yard Setback - change from 10 feet to 5 feet. - B.7: Storage Areas, delete "all trash receptacles shall be confined to the rear yard of all lots"; Retain language stating that all trash receptacles, storage areas, etc. shall be screened from view from access streets and front yards of adjacent properties; Add "silos and other tall containers shall not be placed on front yards or other conspicuous locations, and shall not exceed the building height requirements listed below." - B.8: Loading, insert "Route 3111, instead of "the street"; Delete "except for buildings of less than 30,000 square feet. For buildings under 30,000 square feet, exterior docks may face streetside, but shall be set back a minimum of 70 feet from the front of the building." - B.9: Architecture, (a): Add "factory colored 'split-faced block' (or equal) is acceptable; (c) , The floor/land area ratio shall not exceed .85% (instead of .50%) . Discussion took place among the Aldermen and the petitioners on the various requests and the reason for the changes. Motion by Baird, seconded by Bolger, to close the public hearing at 8:01 P.M. Motion carried.ANY AND ALL BUSINESS Director of Buildi and Zoning Lobaito gave a report on a McHenry County Plan Staff Revie meeting he ate ended concerning the development of White Oak Ridge o Ridge Road.; This proposed development had previously been before t e City for annexation. Lobaito said the staff review meeting was very reliminary rind the project would be proceeding to the next step in the ounty's p�ocess. He will present a written "1 report to the Council. Voting Aye: Bolger, Locke, Bates, Lawson, Baird, Cuda. Voting Nay: None. Absent: None. Motion carried. ANY AND ALL BUSINESS Director of Building and Zoning Lobaito gave a report on a McHenry County Plan Staff Review meeting he attended concerning the development of White Oak Ridge on Ridge Road. This proposed development had previously been before the City for annexation. Lobaito said the staff review meeting was very preliminary and the project would be proceeding to the next step in the County's process. He will present a written report to the Council.
