JUNE 13, 1994
The Regular Meeting of the McHenry City Council was called to order
by Mayor Cuda on Wednesday, June 13, 1994 at 7:35 P.M. in the Council
Room of the Municipal Center. At roll call the following Aldermen were
present: Bolger, Locke, Bates, Baird. Absent: Lawson. City Staff in
attendance were: City Clerk Althoff, City Administrator Peterson,
Director of Public Works Batt, Director of Building and Zoning Lobaito,
and Chief of Police Joyce. Absent: Director of Parks and Recreation
Merkle, City Attorney McArdle.

ANNUAL PREVAILING WAGE ORDINANCE
Motion by Bolger, seconded by Baird, to pass the Annual Prevailing
Wage Ordinance, as presented.
Alderman Lawson arrived at 7:38 P.M.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
TRAFFIC SIGNAL RESOLUTION AND AGREEMENT
The annexation agreement between the City of McHenry and the McHenry .,
Corporate Center stipulates that the developers are required to install a
traffic signal on Prime Parkway at Route 31, as soon as the traffic
warrants are met. Illinois Department of Transportation District
Engineer Dwayne Carlson indicated departmental approval for the traffic
signal. The developers have sought City cooperation in applying for a
50% matching grant from the Illinois Department of Transporation for
engineering and construction costs associated with this traffic signal.
The Corporate Center has agreed to pay for unreimbursed costs incurred by
the City in connection with its construction.
Motion by Locke, seconded by Bolger, to authorize staff to submit an
application on behalf of the City for a grant to construct a traffic —
signal at the intersection of Illinois Route 31 and Prime Parkway.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Locke, seconded by Bolger, to pass a resolution authorizing
the expenditure of up to $130,000 in Motor Fuel Tax Funds, which is to be
reimbursed to the City by the developers, for the installation of this
traffic signal at the intersection of Illinois Route 31 and Prime Parkway.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
City Administrator Peterson was directed to consult with City
Attorney McArdle and review the June 9, 1994 letter from Kit Carstens
which pledges reimbursement to the City for any costs associated with the
installation of this traffic signal.
COUNCIL DISCUSSIOft ON GROWTH
Joe Gann of Gann & Associates (Glen Ellyn, Illinois) and author of
the City's 1990 Development Plan was introduced. Mr. Gann outlined the
process stages and policy statements developed by the former Council. He
stressed the plan was a guide, and should be used as such to aid the
Council in other matters (i.e. zoning, subdivision, and site approvals,
capital spending, and information and data source) . A short question and
answer period followed.
Discussion then followed regarding various growth concerns;
development densities and locations, additional staff and/or support
services, and transportation needs.
Mayor Cuda requested and received Council approval to direct City
Administrator Peterson to continue interviewing City Planners, and upon
completion, make a recommendation to the Council.

COUNCIL POSITION ON POTENTIAL ISSUES AND CONCERNS OF PROPERTY AND
BUSINESS OWNERS EAST OF THE FOX RIVER
Potential questions likely to be raised by property and business
owners affected by the proposed annexation were reviewed. The following
Council positions were determined:
(1) All existing business would be allowed to continue;
(2) The least restrictive zoning classification will be
contemplated, grandfathering and all existing uses, and any
current business(s) which might require additional use
variance(s) would be accomodated;
(3) Sewer would be extended to the area, which would be paid for
with the sales tax revenue collected from these annexed
businesses. Water would not be extended at this time due to
cost restraints;
(4) There are no immediate plans to annex other areas contiguous to
the Route 120/Chapel Hill Road planned annexation.
MAYOR - STATEMENT AND REPORTS
Mayor Cuda reported that he had spoken with Jeff Ladd, the legal
counsel for Northern Illinois Medical Center. Mr. Ladd indicated the
hospital might be seeking a Hospital Overlay zoning classfication. This
request was made approximately four years ago, and denied by the Zoning
Board of Appeals. The hospital subsequently withdrew their petition, but
are now reconsidering their position.
The other party Mayor Cuda met with was David Backhaus regarding his
annexation agreement. Mayor Cuda directed Mr. Backhaus to work closely
with staff regarding the layout of Dartmoor Road. Mr. Backhaus concurred.
A meeting of the Ad Hoc Committee will be scheduled in the near
future to begin formulation of a tax abatement policy.
Mayor Cuda then questioned Director of Public Works Batt regarding
the Green Street detour. Director Batt explained how timing
opportunities with two separate contractors created a detour through an
area also under construction. The situation will be of short duration,
weather permitting.
COMMITTEE REPORTS
FINANCE COMMITTEE
Finance Committee Chairman Alderman Locke reported that the Finance
�- Committee met Monday, June 6, 1994. The minutes will be forthcoming,
however action was taken to reduce the budget, eliminating the need for a
water and sewer increase.
PARKS AND RECREATION
The Parks and Recreation Committee meeting scheduled for June 21,
1994 at 7:30 P.M. will be changed to Wednesday, June 22, 1994 at 7:30
P.M. This meeting will be held at the Mass Farm Property horse barn.
DEPARTMENT HEAD REPORTS
City Administrator Peterson requested Aldermen Baird and Bates to
meet with him in order to schedule a date for the Economic Development
Committee meeting.
Alderman Lawson was directed by City Administrator Peterson to review
— the drainage ditch operational problem in Lakeland Park and report back
to the Council.
City Administrator Peterson also presented a request to the Council
that the City lease a vehicle for his busines and personal use. He was
�- directed by Mayor Cuda to obtain specific information regarding the
lease, and report back to the Council.

NEW BUSINESS •1
Alderman Bolger reported that Joyce Sweeney of Country Club Estates
would be presenting a petition to appeal the Capital Improvement fees for
the installation of sewer An Country Club Estates. Alderman Bolger also
reported that Bob Lunkenheimer has a sinkhole in his yard, and requested
that Director of Public Works Batt handle the situation.
Alderman Baird requested the Council review the Colomer zoning
petition very closely, before the meeting Monday, June 20, 1994. _..�
Alderman Bates reported on his neighborhood meeting held Friday
evening, June 10, 1994. He is going to work together with the Public
Works Committee and come up with suggestions for stop sign placement in
the Mill Creek subdivision.
Responding to a question from Alderman Bolger, Director of Public
Works Batt reviewed the present status on the Hamlin drainage problem
adjacent to the Shepherd of the Hills Church parking lot. Director Batt
was instructed to present a proposal to the four homeowners who live east
of Green Street on Fairway, whereby the City will install a drainage pipe
if the homeowners buy the materials and hire an engineer for the project.
