JULY 13, 1994
The Regular Meeting of the McHenry City Council was called to order
by Mayor Cuda on Wednesday, July 13, 1994 at 7:30 P.M. in the Council
Chambers of the Municipal Center. At roll call the following Aldermen
were present: Bolger, Locke, Bates, Lawson, Baird. Absent: None. City
Staff in attendance: City Clerk Althoff, City Administrator Peterson,
Chief of Police Joyce. Absent: Director of Public Works Batt, Director
of Building and Zoning Lobaito, Director of Parks and Recreation Merkel.
TEN MINUTE PUBLIC INPUT SESSION
No one signed up to speak during the ten minute public input session.
CONSENT AGENDA
Motion by Baird, seconded by Bates, to approve the Consent Agenda as
follows, with various corrections to the June 29, 1994 Council Minutes:
(1) June 29, 1994 Regular City Council Minutes;
(2) Picnic/Beer Permits;
(3) June Budget Report;
(4) June Treasurer's Report
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
EXECUTIVE SESSION - PERSONNEL MATTERS
Mayor Cuda explained that the information required to address this
personnel issue had not been received, therefore this issue will be
brought before Council at a later time.
ANY AND ALL BUSINESS WHICH MAY PROPERLY COME BEFORE COUNCIL
Alderman Bolger questioned the status of the off-street parking
proposal for Main Street. City Administrator Peterson noted that Mr.
John Swierk of 4917 Glenbrook Trail, offered to prepare a design diagram
at no cost . . . Borden Street as a southbound, one-way street.
Alderman Bolger also requested an update on the David Kotiw
easement. City Administrator Peterson indicated that we were awaiting a
title search and survey of the land in question.
Alderman_ Bolger also noted that the right-of-ways at Millstream and
Freund, and on Riverside Drive in front of the Fox Hole Pizzeria, were
`. overgrown with weeds and looked unsightly.
The drainage ditch clean-up was also discussed. Summer help appears
to have the job well in hand, however the City is experiencing some
difficulty effecting proper maintenance in Lakeland Park. Alderman Bates
and Alderman Lawson are exploring this situation.
Alderman Bolger also suggested Council consideration and/or approval
of summer applicants.
The Pacini project update revealed that Pacini has received
preliminary numbers on their traffic study, however they are still
awaiting the final report. City Administrator Peterson is still
interviewing city planners.
The prolonged construction by Berger Construction Company on Green
Street, was questioned by Alderman Bolger. City Administrator Peterson
detailed the lengthy and complex process, as well as weather constraints,
which necessitates the additional time.
Alderman Bolger, Chairman of the Public Works Committee, reminded
Aldermen and Staff of the July 14th Committee meeting devoted to hearing
residents ' comments on the McHenry Shores water company. City
Administrator Peterson noted that Mr. Mathews, owner of the McHenry
Shores Water Company, would be represented by his attorney Mr. Thomas
Nuelle of Woodstock. Background and historical data were discussed.
Alderman Baird stated his desire to assist the McHenry Shores residents
as much as possible with information dissemination.

Motion by Baird, seconded by Locke, to authorize staff to create and
print informational flyers for the McHenry Shores residents as it relates
to the McHenry Shores Water Company upon request and approval of City
Administrator Peterson and/or Alderman Baird.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
Alderman Bolger also noted that Monday, July 18th was the Zoning
Board of Appeals hearing on the Busch-Knox annexation, and urged all
Aldermen to attend and make their views known to the Board. Discussion
followed determining that this was, in fact, the appropriate time for
Council to express their concerns and ask questions.
Alderman Locke reported that he had some discussion with one of the
local bidders, and stated his desire to review the bid process in an
attempt to award bids to local businesses when possible.
The Finance Committee meeting scheduled for Friday, July 22nd will be
rescheduled due to a scheduling conflict.
Alderman Locke informed Council that he has been in contact with
Robert Bergland of Northwest Property Management. Mr. Bergland has
informed him that (1) Whispering Oaks Condominium Association will
continute with the present refuse service with North Shore Waste; (2)
Both associations will come before the Council in the near future to
present a potentially permanent solution to the drainage ditch problem.
Alderman Locke next noted that the parking lot of property located at
4213 W. Route 120 encroaches upon the Whispering Oaks park property. The
new owner, Mr. Adams, is refurbishing the building for use as a currency
exchange, and has been informed by the City to correct the problem.
Alderman Locke would like the Council and staff to review the matter and
seek an equally agreeable solution for both parties.
Alderman Bates asked whether the Admiral building clean-up at the
intersection of Route 120 and Route 31 was completed. City Administrator
Peterson replied in the affirmative.
Alderman Bates also noted that there were two stop sign requests in
front of the Public Works Committee for signs at the intersections of
Meadow and Willow, and Shore Drive and Eastern Avenue.
Discussion then followed regarding street and sidewalk repairs.
Alderman Bates requested consideration for streets in Lakeland Park. .�
Alderman Lawson concurred, and suggested a comprehensive plan be worked
out over several years as all the streets are in great need of repair's.
It was also suggested that staff research grant options which might offer
financial assistance in this regard.
Alderman Lawson requested that the Building and Zoning Committee
review the sign ordinance. As it appears, this ordinance causes new and
existing businesses much difficulty.
Alderman Bolger also requested that the Building and Zoning Committee
look into the Buss Ford request.
It was also noted that the McHenry Shores area has no sign (or signs)
posted regarding "No Swimming" or "Swim at Your Own Risk". Alderman
Locke requested that this matter be addressed.
Motion by Bates, seconded by Lawson, to adjourn.
