JULY 27, 1994
The Regular Meeting of the McHenry City Council was called to order
by Mayor Cuda on Wednesday, July 27, 1994 at 7:30 P.M in the Council
' Chambers of the Municipal Center. At roll call the following Aldermen
were present: Bolger, Bates, Lawson, Locke, Baird. Absent: None. City
Staff in attendance: City Clerk Althoff, City Administrator Peterson,
City Attorney McArdle, Director of Public Works Batt, Director of
Building and Zoning Lobaito, Director of Parks and Recreation 'Merkel.
Chief of Police Joyce arrived at 8:30 P.M. Absent: None.
PUBLIC HEARING SECOND AMENDMENT TO McHENRY CORPORATE CENTER ANNEXATION
AGREEMENT
Mayor Cuda opened the Public Hearing on the Second Amendment to the
McHenry Corporate Center's Annexation Agreement at 7:37 P.M. City
Administrator Peterson reported that he and Director of Building and
Zoning Lobaito met with petitioner Gary Lang, his attorney Dan Curran,
and representatives of the Corporate Center Scott Dixon and Kit Carstens,
on Thursday morning. They discussed landscaping plans, sign plans, and
use clarification. The petitioner has requested the public hearing be
continued. Some discussion followed as to whether Mr. Lang had any prior
knowledge of what items staff would be addressing at the Thursday morning
meeting. Staff was asked to inform petitioners in the future of what
areas and issues would be addressed at subsequent meetings.
Motion by Baird, seconded by Lawson, to continue the Public Hearing
on the Second Amendment to McHenry Corporate Center's Annexation
Agreement to Wednesday, August 3, 1994 at 7:30 P.M. at which time the
Third Amendment to the Annexation Agreement Agreement was also scheduled
to be heard.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.

The regular meeting of the McHenry City Council was called to order
by Mayor Cuda at 7:41 P.M.
TEN MINUTE PUBLIC INPUT SESSION
Randy Patterson of 6322 Chickaloon Drive thanked the Council, Mayor
Cuda and the Department Heads for their assistance and support during the
Fort McHenry project. Mr. Patterson requested that the City display in
the Municipal Center lobby approximately 500 photographs taken during the
construction of Fort McHenry. Mr. Patterson was directed to make
arrangements for this display through the City Clerk's office.
CONSENT AGENDA
The July 6, 1994 minutes were withdrawn, as they were incomplete.
Alderman Bolger questioned Item #4, payment to Hampton, Lenzini, &
Renwick, engineers for the Green Street reconstruction project. He
stated that he had been receiving numerous complaints regarding the slow
construction progress and speeding vehicles on Green Street. Director of
Public Works Batt explained the project was progressing on schedule as
per the contract schedule, and would be a time-consuming lengthy job.
Mayor Cuda noted receipt of a unsigned letter complaining about the
same issues. He made a public plea for concerned citizens to sign their
names so that their comments can be personally addressed. Alderman Bates
questioned two line items on the June bills. City Administrator Peterson
answered his questions satisfactorily.
Motion by Baird, seconded by Lawson, to approve the Consent Agenda,
with the withdrawal of Item #1, the July 6, 1994 meeting minutes.

(3) Picnic/Beer Permits;
(4) Progress Payment to Hampton, Lenzini & Renwick for Engineering
Services on Green Street Reconstruction Project, Phase II,

RETENTION OF CITY PLANNER FOR PROPOSED PACINI PLANNED UNIT DEVELOPMENT
City Administrator Peterson has been interviewing City Planners as
per Council's direction in connection with the proposed planned unit
development of the Pacini property. Based on his interviews and the
proposed costs, background, and expertise of the candidates, he is
recommending the City retain Robert Grossman of Associated Planners in
Woodstock. City Administrator Peterson introduced Mr. Grossman from the
audience. Discussion as to whether a City Planner was required at this
early point in time ensued. A question and answer period with Mr.
Grossman followed. It was stated and understood by both Council and Mr.
Grossman that if Mr. Grossman's firm was retained, he would not accept
work or be contractually bound to any other developer working within the
City of McHenry. Mr. Grossman also would be required to submit copies of
`- any and all suggestions and changes on the Pacini project to staff and
Council.
Motion by Lawson, seconded by Bolger, to retain Associated Planners
of Woodstock for City planning services in conjunction with the Pacini
project, and to require Associated Planners to submit to Council and
staff any and all changes suggested in reference to this project.
Further discussion took place.
Motion by Locke, seconded by Bates, to table the previous motion
until the next Council meeting on Wednesday, August 3, 1994 at 7:30 P.M.
Further discussion ensued.
Voting on the motion to table:
Voting Aye: Bates, Locke.
Voting Nay: Baird, Lawson, Bolger.
Absent: None.
Motion failed.
Further discussion ensued regarding whether or not Mr. Grossman was
the best selection for this specific project.

Associated Planners for City planning services until the next Council
meeting on Wednesday, August 3, 1994.

Motion carried.
City Administrator Peterson suggested all Aldermen contact Mr.
Grossman and discuss any additional concerns they may have before the
next Council meeting on August 3, 1994.
SEWER CONNECTION FEE FOR PROPERTIES WITHIN THE COUNTRY CLUB ESTATES
SPECIAL ASSESSMENT AREA
The resolution to reduce sanitary sewer connection fees for residents
in the Country Club Estates subdivision from $250 to $150 was presented,
with an expiration date of January 1, 1997. City-Administrator Peterson
explained that previously the Council had frozen Capital Development fees
for the Country Club Estates subdivision with a September 30, 1997 -�
expiration date. He recommended the Council consider making the dates
for these two fees the same.
Alderman Locke left the meeting at 8:45 P.M.
Motion by Baird, seconded by Bolger, to pass the resolution reducing
the sanitary sewer connection fees from $250 to $150 for residents in the
Country Club Estates subdivision, with an expiration date of September
30, 1997.
Voting Aye: Bolger, Bates, Lawson, Baird.
Voting Nay: None.
Absent: Locke.

RESOLUTION FREEZING CAPITAL DEVELOPMENT FEES FOR THE COUNTRY CLUB
ESTATES SPECIAL ASSESSMENT PROJECT
Motion by Baird, seconded by Bolger, to pass the resolution freezing
the capital development fees at their current level until September 30,
1997, providing that the residents would receive any benefit of a future
capital development fee rate reduction.
Voting Aye: Bolger, Bates, Lawson, Baird.
Voting Nay: None.
Absent: Locke.
Motion carried.
AWARD TRANSPORTATION BIDS FOR PARKS FALL PROGRAMS
Motion by Baird, seconded by Bolger, to award the coach
transportation services for Fall Parks programs to Jones Coach in the
amount of $1,320.00 and to award bus transporation services to Barrington
Transportation in the amount of $1,010.00.
Voting Aye: Bolger, Bates, Lawson, Baird.
Voting Nay: None.
Absent: Locke.
Motion carried.
Alderman Locke returned to the meeting at 8:55 P.M.
MAYOR - STATEMENT AND REPORTS -1
Mayor Cuda requested that the letter regarding Green Street
construction he had received, signed by "Concerned Green Street
Residents" be included in Friday's agenda packet. Upon his inquiry City
Administrator Peterson informed Mayor Cuda that the letter to T.P.
Mathews from the Illinois Environmental Protection Agency had been
included in Friday's agenda packet. Mayor Cuda suggested the letter be
distributed to the residents of McHenry Shores.

At this time Alderman Baird requested use of the Municipal Classroom
for a McHenry Shores resident's meeting on Thursday, July 28, 1994 at
7:30 P.M. The Council agreed to his request.
Also to be included in Friday's packet will be a copy of a resolution
delivered by Township Supervisor Albie Adams asking the Council to
support the Township form of government. This item will be discused at
the regular City Council meeting on Wednesday, August 3, 1994.
COMMITTEE REPORTS
Chairman of the Public Works Committee, Alderman Bolger, asked the
Aldermen to review the copy of the Public Works Committee meeting minutes
of July 14, 1994 regarding the McHenry Shores Water Company.
Chairman of the Finance Committee, Alderman Locke, scheduled a
Finance Committee meeting for Wednesday, August 3, 1994 at 6:30 P.M. to
discuss possible water and sewer increases, as well as to explore
alternative means for determining sewer fees.
Chairman of the Parks and Recreation Committee, Alderman Bates,
reported that the Parks and Recreation Committee had met to review the
Fall brochure, and that with a few minor adjustments, the brochure was
approved to proceed to the printers. He scheduled the next Parks and
�., Recreation Committee Meeting for August 24, 1994 at 7:00 P.M.
STAFF REPORTS
Director of Public Works Batt informed the Council that staff had
received the report from Baxter & Woodman on the Martin Woods II
detention pond. A few details need to be addressed before final
approval. Director Batt also noted that Dick Orton's retirement party
had to be cancelled due to his son's death. Visitation is scheduled for
Saturday, July 30, 1994 between the hours of 12:00 p.m. and 3:00 p.m. at
Mark Justen Funeral Home.
Director of Parks and Recreation Merkel reported that Fiesta Day park
activities were very successful. The Parks and Recreation De artme

will begin hosting the U.S.T.A Tennis Tournament on July 2$ `194. e
two Marlin teams will be participating in the conference swim meet with
their season ending Saturday, July 30, 1994. The Parks and Recreation
Fall schedule will begin in September.
City Administrator Peterson also took this time to address the permit
request by Performance Unlimited to have a beer vendor at their August 7,
1994 Car Show. Performance Unlimited has already been granted their
`..- Petersen Park permit. A second issue that needs to be reviewed, however
is the newly acquired information regarding a "Calendar Girl Contest"
held in conjunction with the car show. Discussion followed with input
from the beer vendor Mike and Heidi Siudak. Alderman Bates noted that
allowing a beer permit for this type of event would certainly set a
dangerous precedent.
Motion by Bates, seconded by Locke, to deny to the petitioner's
request to serve beer at the Petersen Park Performance Car Show on August
7, 1994.

Staff was directed to redesign the park permit application so that
any and all events planned had to be delineated, and to check for open
liquor at Petersen Park on August 7, 1994.
As it was deemed too late to cancel the "Calendar Girl Contest"
scheduled for this year due to prior advertising, etc. it was strongly
recommended that the car show coordinator be informed that a "Calendar
Girl Contest" would not be permitted next year.
City Clerk Althoff reminded the Aldermen of pictures to be taken next
Wednesday, August 3, 1994 at 7:00 P.M. She also requested any Aldermen
planning to attend the Illinois Municipal Association's Convention in
Chicago to inform her at their earliest opportunity for registration
purposes.

NEW BUSINESS
Alderman Bolger noted the three requests for stop signs at the
intersections of Lillian and South, Meadow and Willow, Shore and
Eastern. It was determined that the police should look at these requests
and make a recommendation.
Alderman Locke directed the Public Works Department to look into
repairing the parkway at Crystal Lake Road and Kensington, and to pave a
section of Edgewater Drive. Alderman Locke also requested that the
benches be placed in Whispering Oaks Park as soon as possible.
Alderman Bates referred the issue of two vacant homes to Building and
Zoning. One is located at 1609 Meadow, and the other on Prairie Avenue.
Bates asked for and received clarification of the ordinance violation
process.
Alderman Baird scheduled a Building and Zoning Committee meeting for
Monday, August 22, 1994 at 7:00 P.M. to discuss the Building and Zoning
violation process, monotony codes, and the sign ordinance. Alderman
Lawson also noted a vacant house exists on Willow. He was informed that
Building and Zoning was aware of the home, and was addressing the matter.
Alderman Baird stated that there was to be a McHenry Shores residents
meeting, Thursday, July 28, 1994 at 7:30 P.M. in the classroom of the
Municipal Center. He also requested a status report on the Riverfront
Park Boat Launch.
Director of Parks and Recreation Merkel reported that the berms had
been seeded, and the park was scheduled for opening in mid August. The
Illinois Environmental Protection Agency had finished their inspection on
the wetlands. Security will have to be addressed, as this park must be
opened all year as per the Department of Conservation grant
specifications.
Alderman Baird then asked for Council approval to present a
resolution and individual plaques to Debbie Heisler, Debbie Glick, and
Carol Chrisman, coordinators of the Fort McHenry project, commending them
for their great efforts and success. Council concurred. A presentation
of plaques and the resolution will be coordinated through the Director of
Parks and Recreation Merkel, and done in conjunction with the formal
dedication of Fort McHenry on September 11, 1994.
Mayor Cuda also asked Director of Building and Zoning Lobaito to
address the parkways along W. Route 120, as they are in very poor shape.
In response to Mayor Cuda's question regarding whether cars and large
recreation vehicles could be parked along W. Route 120 and advertised for
sale, Director Lobaito informed him it is a permitted use in that zoning
area.
Motion by Baird, seconded by Lawson, to go into Executive Session at
9:30 P.M. to discuss potential litigation and personnel matters.

City Administrator Peterson reviewed the City of McHenry's Facilities
Planning Area. Discussion followed regarding potential annexation of
properties along North Route 31. City Administrator Peterson reported on
a meeting this afternoon with eight property owners along Route 31.
Council directed staff and Mayor to talk to the necessary parties
required to proceed with the annexations.
