NOVEMBER 9, 1994
A Special Meeting of the McHenry City Council was called to order by
Mayor Cuda on Wednesday, November 9, 1994 at 7:30 P.M. in the Council
Chambers of the Municipal Center. At roll call the following Aldermen
were present: Bolger, Locke, Bates, Lawson. Baird arrived at 7:45 P.M.
Absent: None. City Staff in attendance were City Clerk Althoff, City
\.. Administrator Peterson, Director of Public Works Batt. Absent: Chief of
Police Joyce, Director of Building and Zoning Lobaito, Director of Parks
and Recreation Merkel, City Attorney McArdle.
Mayor Cuda announced the purpose of this meeting was a continuation
of the Executive Session from the November 2, 1994 meeting and any and
all business which may properly come before the Council.
Motion by Lawson, seconded by Locke, to go into Executive Session to
continue discussion of Personnel Matters at 7:33 P.M.
Voting Aye: Bolger, Locke, Bates, Lawson.
Voting Nay: None.
Absent: Baird.
Motion carried.
Motion by Bolger, seconded by Locke, to go back into Open Session at
10:30 P.M.
Voting Aye: Bolger, Locke, Bates, Lawson, Baird.
Voting Nay: None.
Absent: None.
Motion carried.
ANY AND ALL BUSINESS
Alderman Bates, Chairman of the Parks and Recreation Committee,
announced that a Parks & Recreation Committee meeting will be held
November 21, 1994 at 7:30 P.M.
Motion by Baird, seconded by Lawson, to hire David Herda for Streets
Superintendent at a salary of $39,208.00; to hire Daniel Marcinko as
Engineering Inspector at Grade 9, Step 3, $32,761.00; and to hire William
Regner .as a Wastewater Treatment Plant Operator I at Grade 7, Minimum
Step, $23,670.00.
Voting Aye: Bolger, Locke, Lawson, Baird.
Voting Nay: Bates.
Absent: None.
Motion carried.
Motion by Lawson, seconded by Locke, to reorganize the Parks section
�.. of the Parks and Recreation Department under the Streets Division of the
Public Works Department.
Voting Aye: Locke, Bates, Lawson, Baird.
Voting Nay: Bolger.
Absent: None.
Motion carried.
Mayor Cuda reported that he had been contacted by resident Kathy
Kuczwara of 5508 Chasefield Circle. Ms. Kuczwara informed Mayor Cuda
that according to Section 11-180 of the City of McHenry Municipal Code,
compost heaps must be contained in a rodent-proof, insect-proof closure.
She would like the City to inform all non-complying residents of this
ordinance. Determination was made to address this issue at the November
30, 1994 regularly scheduled Council meeting. City Clerk Althoff was
directed to provide Alderman Locke with the names, addresses, and phone
numbers of Ms. Kuczwara and her neighbor, Ms. Buellsbach.
Mayor Cuda then drew Council's attention to City Administrator
Peterson's memo referencing sales tax paid on leased cars. This
legislation will change the sales tax paid on leased cars from the
current practice of collecting full sales tax at the time of lease as
opposed to the legislation which has been introduced which will collect a
monthly sales tax fee. Council agreed to send letters to State
Legislators in opposition of this proposed legislation.
Alderman Baird informed the Council that resident Mary Lou Held of
McHenry Shores reported that Mr. Werth had landed his helicopter in the
ballfield next to his home. Alderman Baird requested the City look into
the legalities of this potential problem. He also requested the City
still. plan to postpone any contemplated action on a cross connection to
the McHenry Shores Water Company mains.

City Administrator Peterson reported that only nine of the original
46 delinquent special assessment property owners in McHenry Shores remain
delinquent. Five of those 9 are owned by the McHenry Shores Water
Company.
Peterson also informed Council that Jim Allen, Executive Director of the
McHenry County Economic Development Corporation, had requested the City
of McHenry provide a patrolman at the intersection of Prime Parkway and
State Route 31 between the hours of 4:00 and 6:00 P.M. Monday through
Friday, until the traffic light is installed. Mr. Allen provided a
letter from the Illinois Department of Transportation granting his
request for a reduction in speed to 45 mph from .25 miles south of Bull
Valley Road to .12 miles south of Prime Parkway until January, 1995.
Chief Joyce will be asked to review the request and make a recommendation.
Alderman Baird requested a status update on his request for a traffic
study at the intersection of Riverwood and Courtland. City Administrator
Peterson will comply.
Motion by Bates, seconded by Lawson, to adjourn the meeting.

Voting Nay: None.
Absent: None.
