At roll call the following Aldermen were present : Bolger, Locke, Bates, Lawson, Baird. Absent : None. City. Staff in attendance were City Clerk Althoff, City Administrator Peterson, City Attorney McArdle, Director of Building and Zoning Lobaito, Director of Public Works Batt . Absent : Chief of Police Joyce, Director of Parks and Recreation Merkel. TEN MINUTE PUBLIC INPUT SESSION No one signed up to speak during the ten minute public input session. Absent : None. Motion carried. December 21, 1994 Page 5 CONDITIONAL USE PERMIT - 1011 N. GREEN STREET - McHENRY SCHOOL DISTRICT 15 and McHENRY PUBLIC LIBRARY DISTRICT McHenry School District 15 and McHenry Public Library District are seeking a conditional use permit for the purpose of housing District 15' s administrative in the former library building located at 1011 N. Green Street . The Zoning Board of Appeals voted 5-0 at their December 5, 1994 meeting to approve the conditional use permit, allowing the operation of McHenry School District 15' s administrative offices at the 1011 N. Green Street address . City Administrator Peterson noted that the use of the 1011 N. Green Street building as the administrative offices for School District 15 would have a favorable impact upon the parking situation on Main Street where District 15 currently occupies the building. Motion by Baird, seconded by Lawson, to accept the Zoning Board of Appeals' recommendation and pass an ordinance granting a conditional use permit to allow the operation of McHenry School District 15' s administrative offices at 1011 N. Green Street, the former Library building. Voting Aye : Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent : None. Motion carried. VARIANCE REQUEST - 3512 & 3516 W. PEARL STREET, McHENRY STATE BANK AND REZONING REQUEST - 3512 W. PEARL STREET. McHENRY STATE BANK McHenry State Bank respresentives, Chief Executive Officer William Cowlin and President Mel Prust, were seeking reclassification of property located at 3516 W. Pearl Street from RS-4 High Density Single Family District to C-4 Downtown Commercial District to expand the existing employee parking lot located at 3512 W. Pearl Street. In addition, the petitioners are seeking a variance as to the landscaping requirements stated in the City' s Zoning Ordinance in order to eliminate the parking island strips and reduce the criteria for the residential and parking screening strips. a.. Mr. Cowlin also stated his intent to provide the City with an agreement reviewed and approved by the Mayor and City Attorney stating that no type of structure shall be constructed on this property, with the exception of a small storage shed which would be allowed by ordinance. The agreement will be a covenant tied to the property so that any new owner would be restricted and be bound by, this agreement . City Administrator Peterson explained that it was staff' s recommendation to grant the screening variance for the residential and parking screening at a height of 3-4 feet, as it was felt that the security of the area would be adversely affected if the 5-7 foot height requirement were enforced. The bank has agreed to the 3-4 foot stipulation. Motion by Baird, seconded by Locke, to acknowledge the Zoning Board of Appeals' 0-5 non-recommendation, and pass an ordinance rezoning the 3516 W. Pearl Street property from RS-4 High Density Single Family District to C-4 Downtown Commercial District . Voting Aye : Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None . Absent : None . December 21, 1994 Page 6 ­*N Motion by Baird, seconded by Bolger, to acknowledge the ZBA' s 0-5 non-recommendation and pass an ordinance granting variances for the properties located at 3512 and 3516 W. Pearl Street to eliminate the parking island strip requirement, reduce residential screening to a minimum of 4 feet and provide parking screening as approved by the Director of Building and Zoning. Voting Aye : Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent : None. --- Motion carried. SIGN VARIANCE REQUEST - PEKING CHINA RESTAURANT, 4621 W. ELM STREET The petitioner and owner of the Peking China Restaurant, Pen Cheng Chow, was in attendance. Director of Building and Zoning Lobaito explained that Mr. Chow was seeking a variance to permit the installation of a second wall sign on his building. He noted that this sign would be located on the east wall, facing the off- street parking area. The size of this additional wall sign would be 62 square feet . The accumulated area of both signs would be 89 square feet, below the maximum allowable wall sign area of 121 square feet . Mr. Chow also agreed to work with his landlord and the Director of Building and Zoning to increase the amount of green landscaping on the property along Route 120 . Motion by Bolger, seconded by Locke, to grant a sign variance request, permitting the installation of a second wall sign on the east wall of the building housing the Peking China Restaurant located at 4621 W. Elm Street. Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent : None. Motion carried. SIGN VARIANCE REQUEST - McHENRY LUMBER AND HARDWARE, 4030 W. MAIN STREET Bill Diesel, owner and petitioner of McHenry Lumber Company, was in attendance . Mr. Diesel explained he was seeking three variances: (1) to install an additional 56 square foot wall sign -1 on the west side of the building which faces Crystal Lake Road; the second and third variance would allow for a 2016" free-standing sign and display board for advertising sales . These two variances are needed because the property is zoned I-1 Industrial . Signs of this type are not permitted in Industrial zoned districts . Director of Building and Zoning Lobaito noted that this lumber yard pre-dates current zoning ordinances and would only be permitted in the C-5 zoning district today. Mr. Diesel also agreed to the removal of five existing signs, including: 4 ' X 4' "Copies - 5 Cents" 2' X 4' "Propane Cylinders Exchanged" 2' X 3" "Senco Authorized Dealer" 1' X 2' "Concrete Products" 5' X 5' 116 X 6 Pine" It is staff' s recommendation to grant all three variances . Motion by Baird, seconded by Locke, to grant a variance for the installation of an additional 56 square foot wall sign on the west side of McHenry Lumber' s building, which faces Crystal Lake Road, and to grant the two sign variances for a 2016" free-standing sign and display board for advertising sales, subject to the removal of -� 5 existing signs . December 21, 1994 Page 7 Some Discussion followed regarding the possibility of rezoning this property to C-5 Highway Commercial . It was determined because of other existing I-1 businesses located in the immediate area, to leave the current zoning classficiation of McHenry Lumber in place . PRELIMINARY AND FINAL PLAT OF ENDEAN'S SUBDIVISION Attorney for the petitioner, Joe Gottemoller, was in attendance. Attorney Gottemoller explained that the property in question was located on the north side of McCullom Lake Road, approximately 2/5 of a mile east of Ringwood Road. The property contains approximately 5 .2 acres, and is proposing a subdivision of 2 lots . The property is currently improved with a single family home which is served by well and septic. The Plan Commission voted 6-0 to recommend approval of this 2-lot subdivision, subject to the dedication of a 50-foot right-of-way for roadway purposes . Motion by Bolger, seconded by Lawson, to accept the Plan Commission' s recommendation and approve the tentative and final plat of the Endean subdivision, subject to a 50-foot right-of-way dedication for roadway purposes . Voting Aye : Bolger, Locke, Lawson, Bates, Baird. Voting Nay: None. Absent : None. Motion carried. TRAFFIC CONTROL SIGNAL - COURTLAND TRAIL AND DRIFTWOOD TRAIL City Administrator Peterson stated that the Police Department had conducted their inspection of the stated intersection, and recommended the placement of a "Yield" sign based upon the location. of the intersection and the volume of traffic observed. Alderman Baird stated his support for a stop sign because of the. intersection' s proximity to a school and poor visability. Motion by Baird, seconded by Locke, to pass an ordinance placing a stop sign on Courtland Trail at the intersection with Driftwood Trail . Voting -Aye: Bolger, Locke, Lawson, Bates, Baird. Voting Nay: None. NNW- Absent : None. Motion carried. ORDINANCE ADDING STOP SIGNS IN THE McHENRY CORPORATE CENTER City Administrator Peterson explained that as the McHenry Corporate Center now has intersecting streets, it is necessary to add the appropriate stop signs. Motion by Lawson, seconded by Bolger, to pass an ordinance adding stop signs at the following intersection: Corporate Drive southbound at Prime Parkway Ridgeview Drive southbound at Prime Parkway Miller Parkway, northbound and southbound, at Prime Parkway Voting Aye: Bolger, Locke, Lawson, Bates, Baird. Voting Nay: None. Absent : None. Motion carried. December 21, 1994 Page 8 REPLACEMENT OF FOUR POLICE VEHICLES City Administrator Peterson noted that four of the 13 police department vehicles needed to be replaced. The State Contract for Police Vehicles for 1995 Chevy Caprices has been received. Designated 1995 Chevy Caprice police vehicles are $14, 535 . 66 . Designated 1995 unmarked Chevy Caprice police vehicles are $14, 559 . 10 . City Administrator Peterson explained that local dealer Gary Lang Chevrolet is authorized to sell vehicles under the State Purchase this year. It is recommended that the purchase of four police vehicles be awarded to Gary Lang Chevrolet based upon their proposal of $58, 150 . 57. This expenditure will be included in the 1995-96 Budget . Motion by Bolger, seconded by Lawson, to authorize and include in the 1995-96 Budtet the purchase of three designated police vehicles in the amount of $43, 591 . 98, and one unmarked Chevrolet Caprice in the amount of $14, 559 . 10, totaling a full purchase price of $58, 150 . 57 from Gary Lang Chevrolet . Voting Aye : Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None. Absent : None. Motion carried. AMENDMENT OF RETAINED PERSONNEL ORDINANCE City Administrator Peterson explained that with the recent hiring of an engineering inspector, a change in the retained personnel ordinance is necessary in order to reimburse the City for costs associated with inspections of public improvements associated with subdivisions and development. It is the staffs recommendation to bill for inspections of public improvements, review of plats, and other matters that are specifically attributable to development . It is recommended these inspections of public improvements be billed at the rate of $25 . 00 per hour, and $37 . 50 per overtime hour during the period of January 1, 1995 through December 31, 1995 . Motion by Bolger, seconded by Baird, to pass an ordinance amending `the City' s retained personnel provisions allowing the City -1 to bill for the time spent by the newly hired engineering inspector to review public improvements . Voting Aye: Bolger, Locke, Bates, Lawson, Baird. Voting Nay: None . Absent : None. Motion carried. Mayor Cuda noted Mr. Chris Newkirk of Granite Builders, Inc . in attendance. He asked Council' s permission to address Mr. Newkirk' s request at this time. Council concurred. Mr. Newkirk stated that Council had at its November 2, 1994 meeting agreed to grant him the opportunity to ask for an extension of his letter of credit on Green Valley Units I, II and III if he showed good faith in his attempt to complete the public improvements. Director of Public Works Batt verified that Mr. Newkirk had in fact completed the sidewalk on the north side of Turnberry, with the exception of two small sections that were scheduled for completion on Thursday, December 20, 1994 . Mr. Newkirk also distributed copies of his contract with Curran Contracting to put on the asphalt surface in the Spring of 1995 . He respectfully requested an extension of his letter of credit until June 30, 1995 . Some discussion followed --� regarding the completion of sidewalks on the south side of Turnberry. Alderman Baird asked for an extension only until May 30, 1995 . Mr. Newkirk concurred. December 21, 1994 Page 9 Motion by Bolger, seconded by Locke, to extend the letter of credit for Green Valley Units I, II and III until May 30, 1995 for completion of public improvements. Voting Aye : Bolger, Locke, Lawson, Bates, Baird. Voting Nay: None. Absent : None. Motion carried. Alderman Lawson asked that as long as weather permitted, the completion of the public improvements should continue. It was noted that when the Subdivision Control Ordinance is updated and amended the issue of when public improvements are to be completed should be addressed. Consideration should be given to setting a completion time equal to a stated percentage of the subdivision' s buildout . MAYOR'S STATEMENT AND REPORTS Mayor Cuda drew the Council' s attention to the November 16, 1994 letter from the Illinois Department of Transportation stating their intent to improve Illinois Route 120 from Route 47 to Route 31 . The Illinois Department of Transportation has also asked for input from the City of McHenry to incorporate local improvements into this project and their desire for any pedestrian and/or bicycle accomodations . City Administrator Peterson was directed to contact IDOT and determine the availability of a respresentative to attend a future Council meeting. He was also asked to draft a position paper analyzing all potential traffic improvements for Council review. -- COMMITTEE REPORTS Alderman Bates scheduled a Parks and Recreation Committee meeting for Monday, January 9, 1995 at 7 :30 P.M. He will submit the agenda on January 4, 1995 . Alderman Bolger reported that Mrs. Denise Kaufman of the 1200 block of South Green Street had contacted him requesting a reduction in the speed limit along that section of the road near the Pebble Creek Subdivision. Director of Public Works Batt stated that a municipality cannot arbitrarily reduce speed limits, `. warrants must be met . It was determined that a speed study would be conducted along the 1200 block of South Green Street, as well as on Crystal Lake Road from Kensington Drive to Bull Valley Road, to determine if these areas meet the warrants for a reduction in the allowable speed limit . STAFF REPORTS City Administrator Peterson drew Council' s attention to the report on the building permit activity in McHenry County. City Clerk Althoff requested Council permission to allow Frank Lamonita to temporarily use the classroom at the Municipal Center to host 4- H meetings from 7 : 00 p.m. - 8 : 00 p.m. the third Monday of January, February, and March. Council concurred with this request . In response to the December 17, 1994 Northwest Herald article entitled, "Municipalities Have Advantage in Fringe Zoning" , distributed by Alderman Locke, City Administrator Peterson was directed to draft a letter to the County Board and the Governor stating the City of McHenry' s objection to allowing the County to object to reclassifications of property that occur within 1 . 5 miles of the limits of a municipality. The draft should be included for `- the Aldermen' s review in the next agenda packet . It was also suggested that a City representative attend the January 4, 1995 legislative breakfast where this issue will be discussed. December 21, 1994 Page 10 Alderman Baird requested a status report on the east of the Fox River annexation proceedings. City Administrator Peterson noted that progress was being made, however details needed to be worked out with the Zoning Board of Appeals on how to handle the 70+ petitions before proceeding further. Alderman Locke noted his concern over the excessive absenteeism of many of the Zoning Board of Appeals and Plan Commission members at their respective board meetings. Mayor Cuda responded that letters had already been sent to several members informing them of the Council' s concern and their expectation of either compliance or resignation. Alderman Bates requested a Building and Zoning Committee meeting be scheduled sometime in January, as he would like to share with this committee the comments he received from the Plan Commission when he attended their December 8, 1994 meeting.
