ORDINANCE REPEALING

CHAPTER 9, AND Ai��TDING THE
SAID CHAPTER 9 OF THE
�4UNICIPAI, CODE OF THE CI7'Y UF McH�NRY,
I ILLINOIS
BE IT ORDAINED by the City Council of the City of McHenry,
Illinois, tkiat Paragraph 1��, Article 1 of Chapter 9 be and hereby is
repealed; and
BE IT FURTHER ORDAINED tha.t Chapter 9, Article 1 of the
Municipal Code of the City of McHenry, Illinois, as revised, be
�' amended by the addition thereto of the follawing;
1l�a. It shall be unla�ful to make any excavation in,
or tunnel under any public street, alley, sidewalk, or
other public place in the City without ha.ving first
secured a permit therefor from the City Clerk, sucY�
permit to clearly speci�fy the location and nature of the
worlc to be done. At the time of making application for
such permit it shall be mandatory for applicant to file
t�ri.th the City Clerk a performance bond in a minimum
amount of �1,000.00, which bond shall guarantee to the
City of McHenry the rep lacement of all excavated material
I and resurfacing of all exca.vations in a manner like
or similar �o the condition of same as existed prior
to such excavation, all of such replacement and repair
to be done in compliance with the requixements of the
City Engineer. Al1 such repair and replacement work
shall be completed with�_n a reasonable time subsequent to
completion of underground installation.
� Any violation of this amendment shall be punishable as
provided in Paragraph 11��, Article l, Chapter 9, of the
Municipa.l Code of the City of i�IcHenry, as revised.
This ordinance shall be in full farce and effect within ten days after
its publication, as by law provided.
