Home My WebLink AboutOrdinances - n/a - 01/17/1959 - Creating Planning Commission � AN ORDINANCE CREATING A PLAN COMMISSION FOR THE CITY OF McHENRY, ILLINOIS B� IT ORDAINED Uy the City Council of the City of McHenry, County of McHenry, Illinois : SECTION 1: Purpose In order that adequate provisions be made for the preparation of a comprehensive city plan for the guidance, direction and control of the growth and development of the City of McHenry, a Plan Commis- sion, which shall be a department of the city government, is hereby created under authority of an act of the General Assembly of the State of Illinois entitled "The Revised Cities and � Villages Act'' approved August 15, 1941 and effec- tive January 1, 1942, and as amended. SECTION 2: Membership Said plan commission shall consist of seven (7) members to include the following: The Mayor and the President of the board of 1oca1 improvements shall be ex-officio members of said plan commission, with power to vote; and six (6) other members , citizens of the plan area appointed by the Mayor, on the basis of their particular fitness for their duty on said plan commission, and subject to the approval of the City Council. � SECTION 3: Term of Office IEx-officio members shall serve for the term of their elective office. Of the six (6) appointed citizen members two (2) shall serve for a period of three (3) years, two (2) for a period of two (2) years and two (2) for a perio d of one (1) year. Thereaf ter, such appointed citizen members shall serve for a period of three (3) years. ; Vacancies shall be filled by appointments for ' I unexpired terms only. All members of the Commis- sion shall serve without compensation, except 1 a that, if the City Council deems it advisable, the Secretary may receive such compensation as I may be fixed from time to time by said City I Council and provided for in the appropriation �! ordinance. a. OOZE & KINNE ; ATTORNEYS �' 1 12 E.ELM STREET { McHENRY,ILLINOIS MCHENRY 1580 ,'i� �� II � SECTION 4: Procedure Immediately following their appointment, the members of the Flan Commission shall meet, i organize, elect such officers as it may deem � necessary, and adopt and later change or alter, � rules and regulations of organization and procedure consistent with city ordinances and state laws. The commission shall keep written records of its proceedings , which shall be open at a11 times to public inspection. The Commission shall also file an annual report with the Ma.yor and City Council, setting forth its transactions and recommendations. SECTION 5: Powers and Duties I ; � � (a) To prepare and recommend to the City � Council of McHenry a plan or plans for the development and redevelopment of said City � and contiguous unincorporated territory not E more than one and one-half miles beyond the corporate limits of said City and not included in any other municipality. Such a plan or � plans when adopted by the City Council shall be � � known as the official plan, or part thereof, � � of McHenry. Such plan or plans ma.y be adopted � � in whole or in separate geographical or � ' functional parts, each of which, when adopted � shall be the official plan, or part thereof, j of McHenry. i ' To provide for the health, safety, comfort and ` convenience of the inhabitants of McHenry and ; contiguous territory, such plan or plans shall � ; establish reasonable standards of design for j subdivisions and for resubdivisions of unimproved j land and of areas subject to redevelopment, E including reasonable requirements for public I � streets, alleys , ways for public service facili- I � ties , partks , playgrounds , school grounds , and i other public grounds. j I I(b) To prepare and recommend to the City Council i of McHenry from time to time, such changes in the � plan or any part thereof as may be deemed neces- , sary by the City Council or by the Plan Commission. � I � (c) To prepare and recommend to the City Council � from time to time, plans and/or recommenda.tions for I specific improvements in pursuance of such official plan. � OOZE & KINNE �� ATTORNEYS (d) To give aid to the officials of the City of �" 112 E.ELM STREET � McHenry, charged with the direction of pro j ects I MCHENRY,ILLINOIS i,i MCHENRY 7580 I� i �^� i � �' for improvements embraced within the official plan, to further the making of such improvements , and generally to promote the realization of the official plan. j �(e) To arrange and conduct any form of publicity relative to its activities for the general pur- pose of public understanding. (f) To cooperate with municipal or regional planning commissions and other agencies or groups to further the local planning program ; and to assure harmonious and integrated planning j for the area. � (f) To exercise such other powers germane to the powers granted under authority of an act of the General Assembly of the State of I1linois entitled � "The Revised Cities and Villages Act°1 approved August 15 , 1941, and effective January 1, 1942, � as amended, as ma.y be conferred by the City ; Council of McHenry. � � SECTION 6: Land Subdivision or Re-Subdivision � Following the adoption of an official plan, or part thereof, in the manner prescribed in this j Act, no map or plat of any subdivision or re- ! subdivision presented for record, affecting land � within the corporate limits of the City of McHenry, on in contiguous territory outside of � and distant not more than one and one-half miles from such limits and not included in any other ! municipality, shall be entitled to record or �, shall be valid unless the subdivision thereon �� shall provide for streets , alleys , and public grounds in conformity with any requirements � ! applicable thereto of such official plan, or i� part thereof. ; � SECTION 7: Improvements ' I i � The City Clerk shall furnish the P1an Commission for its consideration a copy of all ordinances , plans and data relative to public improvements � { of any nature. If said Plan Commission shall deem it advisable ta secure technical advice or services , it may be done upon authority from the City Council and appropriations by the City Council therefore. i SECTION 9: Effective Date This ordinance shall be in full force and effect on and after its passage and approval into law. � , !
