Section 2 - Junk Dealer Defined. That any person who keeps a store, office, yard or place of business for the purpose of sale or storage of junk, rags, old iron or any other old metal, paper, bagging or any other similar article, is hereby defined to be a junk dealer. Section 3 - Application. Any person desiring a license shall make application therefor in writing to the i,':ayor and City Council of said City, which application shall state the name of the party desiring the same, the purpose and time for which said license is desired and the place where said applicant desired to carry on said business, and shall be a,ccornpanied by a receipt from the amity Clerk for the amount of the license fee hereinafter oro- vided. Section 4 - 2orm of License. That said license shall be issued over the name of the Cit.7 of McHenry, and under its corporate seal, and shall be execute by the City Ulerh thereof and shall state the name of the person to whom granted, the purpose of saki license, the period of time covered thereby, the place where said licensee desires to carry on said business, and the amount paid therefor, and shall contain a statement that said license is issued and accepted subject to the ordinances then in force or to become in force relating to said license or the subject matter thereof,and that the same is subject to revocation by the La.=or and the City Council of said ; ity; provided, however, that no license issued here- under shall extend beyond the lust day of the municipal year in which the same is granted, and that no license shall be construed to authorize any person to carry on such business at any other house or place than the one designated therein. .section b k evocation. The iljayor and City Council of said City shall have the right i,nd power to revoke any license issued hereunder whenever it shall appear to their s4tisfaction that the person so licensed has violated any provisions of any ordinance in force at the time of the issuigg of such license or which may become in force during the term thereof, relating to said license or the subject matter thereof. Section 6 - Bond. Every person so licensed shall at the time of receiving such license give a bond payable to the City of McHenry, with sureties to be approved by the City Council, in the penal sum of rive hundred ('500.00) D llars , cond i tione c. for the due observance of such ordinances of Phe City then in force or to become in force respecting the keeping of junk shops or junk. yards during the continuance of such license. Section 7 - License fee. Every person receiving a license for the purpose of conducting a junk yard or junk shop, shall pay therefor annually to the Uity, the sum of Twenty -rive ("126.00) ollars. Section 8 - Purchase of Certain articles Prohibited. No person licensed for the purpose afore aid shall take, receive or p r- chase in the line of his business as junk dealer any article, property Br thing knowing it to be owned or claimed by a minor, nor from any person aropear ing to be intoxicated, nor from any person known to be a thief or to have been convicted of larceny or burglary. 'ection 9 - 3ooks to be --ept. Every keeper of a junk: shop shall provide and r.eep a. book ir: which shall be legibl;; written at the time of every purchase a descr;ption of the article so pur- chased, the name and residence of the i�erson from whom such pur- chsse was made and the day and hour of said purchase. Said hook shall at all times be open to the inspection of the l,ayor or any member of the Jit,y Council. Section 10 - penalty. Any person violating the provisions of this ordinance, shall upon conviction, be fined not less than Twenty -Five ("?25.00) Dollars, nor more than One Hundred (';100.00 ) Dollars. . .:section 11 -- all . ordinances and parts of Ordinances in conflict with this ordinance are hereby repealed. ;3ection 12 - 12his ordinance shall be in full force and effect from and after its pa.ssaq:e and approval, according to law.
