An ordinance to repeal an ordinance passed March 5, 1906, and approved March 15, 19,06, granting to the Chicago, Desplaines and Fox River railroad, its successors and assigns, the right to lay down, construct, operate, maintain,Is- pair and equip with electricity or other mechanical power, other than steam loco- motive, upon conditions stated in said ordinance, a single or double track rail- road upon and along certain streets of the village of McHenry, for the purpose of carrying freight, express, United States mail matter and passengers.. WHEREAS, The Chicago, Desplaines and Fox River railroad has failed to lay down, construct, equip or operate- a railroad in, upon or along certain streets of the village of McHenry, within the time specified in an ordinance passed March 5, 1905, granting to the Chicago, Desplaines and Fox River railroad the right to lay down, construct, maintain, operate, repair and equip with -elec- tricity or other mechanical power, other than steam locomotive, upon conditions stated in said ordinance, a single or double track railroad, therefore, BE IT RESOLVED by the president and board of trustees of the village of Mc- Henry, Illinois, as follows, to -wit: Section 1. That an ordinance of the said village passed March 5, 1906, grant- ing to the Chicago, Desplaines and Fox River railroad the right to lay down, construct, maintain; operate, repair and equip a single or double track railroad upon or along certain streets of said village of McHenry, Ills., for the pur- poee of carrying freight, express, United States mail matter and passengers, be and the said ordinance is hereby re- pealed, and all of the rights and privi- leges thereby granted are hereby can- celed, revoked and annulled. Section 2. That this ordinance shall be in force and take effect ten days after its passage and publication, as provided by law. Passed April 6, 1908. PETER J. FREUND, Village President.
