President Freund presiding. a The president stated that the meeting was called for the purpose of taking e some action on the franchise of the r• McHenry Electric Light, Heat and y Power company. An ordinance repealir g an ordinance passed Oct. 8th, 1904 was presented and read as follows: An ordinance to repeal an ordinance passed October 8th, A. D. 1904 and pub- r lished October 13th, A. D. 1904, grant- ing to Stephen Reynolds, of McHenry, n McHenry county, Illinois, and to D. C. Doe and W. D. Ball, of Chicago, CookCo. Illinois, their heirs, successors, assigns, lessees or either of them a right to erect, e construct or operate an electric light plant, in the village of McHenry, county of McHenry and state of Illinois, for the purpose of lighting the streets, high- n ways, alleys, parks and other public Cplaces, in said village, and also for dis- tributing electricity for lighting and d power purposes within or adjacent to h said village and to erect masts, poles, standards, wires, lamps and other t 2• necessary appliances, fixtures and appar- atus on the highways, streets and alleys 3 of said village, necessary to carry on 50 and conduct and distribute such electri- city. WHEREAS, By an ordinance passed October 8th, A. D. 1904, there was t granted, by said Village of McHenry, to t Stephen Reynolds, D. C. Doe and W. D. t d Ball, their heirs, successors, assigns or s lessee the right to construct and operate an electric light plant, in the said vil- a g lage of McHenry, for the ,purpose speci- fied in said ordinance, with the right to �r erect masts, poles, standards, wires, lamps and other necessary appliances, fixtures and apparatus on the highways, streets and alleys of said village, as pro vided in a certain ordinance of said' village of that date, and WHEREAS, The McHenry Light, Heat and Power company has hereto- e fore under the rights and privileges granted by said ordinance, been operat- ing an electric light plant and main- j taining masts, poles, standards, wires, lamps and other necessary appliances, fixtures and apparatus on the highways, streets and alleys of said village, in 10 connection with the use and operating ,t of said electric light plant, and e WHEREAS, The said electric light plant has for a period of more than thirty days failed to furnish to the in- habitants of said village, or to the t. streets, highways, alleys and other public places, in said village, any light, f_ whatever, and WHEREAS, The failure to run and 3perate said electric light plant is not ohargable to any unavoidable or inevi- table accident, but such failure is in all things contrary to the ordinance herein - before referred to and WHEREAS, There has been other and many repeated violations of said ordinance by the said McHenry Light, Heat and Power company, and many and different failures on the part of said McHenry Light, Heat and Power company to observe and comply with the terms and provisions of the said ordinance. THEREFORE, Be it ordained by the President and Board of Trustees of said Village of McHenry, County of McHenry and State of Illinois, as follows, to -wit: Sec. 1. That an ordinance of said vil- lage passed October 8th, A. D. 1904,and published October 13th, A. D. 1904, granting to Stephen Reynolds, of said village, and to D. C. Doe and W. D. Ball, of Chica.-o, Cook county, Illinois, and to their heirs, successors, assigns or lessees or either of them the right to erect, construct or operate an electric light plant in said village of McHenry, for the purpose of lighting the streets, highways, alleys, parks, and other pub lic places in said village, and for distri- buting electricity for lighting and other power and purposes, within or adjacent to the said village, and to erect masts, poles, standards, wires, lamps and all necessary appliances, fixtures and other apparatus on the highways, streets and alleys of said village, necessary to carry out and conduct and dirtribute such electricity, be and the said ordinance hereby is repealed and all of the rights and privileges thereby granted, are hereby cancelled, revoked and annulled. Sec. 2. That this ordinance shall be in force and take effect ten days after its passage and publication, as provided by law. Paesed this 10th day of June, A. D. 1907.
