Be_it ordained .by the 'President ,and ..Board. of Trustees of -the Village of McHenry, Illinois, that. for _the,pur- , pose, of providing for the. licensing . and .taxing .of .theatricals, shows, amusements, and all public exhibitions for gain, in a,,j,.ust and equitable manner, the same are hereby divided into two classes, which shall- be' known•as`the 'first -and second ,clagms, as .follows: 1. AlLentertainments.,of a dramatic, operatic, .minstrel ..or vaudeville character, public readings and recitations, exhibitions of paintings or statuary, -concerts, m-asical entert'ainrnentg, pan- oramas, moving pictures, `feats of jugglery; siietght-6f-hadd-, or necromancy, and exhibitions- of- any- natural or axtifilcial 'curiosi- ties, when given, in any -theater, opera"horuse, -halt-or other"public building, •shall belong to and` -be' kn�m-wn °as •'entertain-me"nts '-6Pthe first class. 2. Circuses, -menageries,, caravans, .:side-shows and_conc;:erts, minstrel or musical entertainments :given under a covering of canvas, exhibitions of monsters or ._freaks .of nature, , merry: -go - rounds, variety shows and all other exhibitions, ;performances and entertainments,not'herein enumerated, : shall belong`to'ari' be known as,- entertainments of, the•second -class. SECTION 2. No person or ,persons within the :liwils.OfAhe village shall, give any of ,the entertainments . mentgcaned- lin..th s chapter, for gain, without -license. for that,purpose,�.first.i-tad_ avid obtained from the President, under theseal_ of .the village, .under a penalty of not less than twenty-five dollars ($25) and not ex- ceeding one hundred dollars (4100) for —each' -and every violation of this section: Provided, °that for musical parties -or concerts, dramatic, operatic or,minstrel entertainments given' -by -citizens-6f this village, not engaged in -the giving of such entertairnneilts-as a business, no licence shall -be required. SECTION 3. Each license. shall .express for what . iLisgrant- ed, and the. -time it. into continue, and the following t=,_or_iicense fee, shall be imposed upon each license-granted..as. aforesaid, .and paid to the Village Clerk on the granting of such license, as fol- lows"to wit: First. For .entertainments of the first, class, .three dollars O for every. performance or exhibition. Second. -For entertainments- of'the second ; elms the follow. - ing sums: For each circus and menagerie, ten dollars ,4MJ0)-.for each day; for each menagerie, five dollars ($5) for each day; for each side-show with any circus or menagerie, five dollars ($5) for each day; for each concert, musical or variety show or entertain- ment given under a covering of canvas, three dollars ($3) for each performance; for merry-go-rounds, three dollars ($3) for each day. SECTION 4. The Clerk shall determine in every case where application for license is made, the class to which the entertain- ment belongs, and the person or persons to whom the license may be granted shall pay the license tag fixed for such license. SECTION 5. In additioh to the license above provided for, the owner or manager of any hall, opera house or theater may take out a license for such hall, opera house or• theater, and per- sons giving entertainments of the first class only in such hall, opera house or theater during the term of such license shall be exempt from the payment of the license fee provided for in Sec- z tion Three of this Chapter. The price of such license for any such hall, opera house or, theater shall be twenty-five dollars ($25) per annum and at that rate for part of a year. Every such license shall expire on the last day of April next after its issuance. SECTION 6. No person or persons shall be allowed to give any concert or entertainment of any kind, for gain, in any licensed saloon, or in any place the entrance of which shall be through a saloon within the village, and any person or persons violating the provisions of this Section shall be fined in a sum not less than ten dollars ($10) nor exceeding fifty dollars ($50), and shall have his or her license revoked, in thN discretion of the President. SECTION r'. It shall be the duty of every proprietor or lessee of any theater, hall, opera house or other building where public entertainments are given,. before he permits any person or per- sons to use the sam(; for the purpose of giving any entertainment therein for gain, to obtain from the President the license herein required, either in his own name, or in the. name of the person proposing to give such entertainment, under a penalty of not Less than ten dollars [$10] nor more than fifty dollars [$50] for each and every violation of this Section. - SECTION 8. No chairs, stools or seats of any description shall be placed. or be permitted to remain in or across the lobby, aisles or passage -ways in any theater, hall, church or other building, when the same is being occupied by the public, under a penalty of twenty -fiver, dollars [$25] for each and every violation of this Section. , SECTION 9. It shall be the duty of all members of the police irce to see that the provisions of the foregoing section are rictly observed, and in case of any violation thereof, forthwith proceed to clear any obstructed aisles, passage -ways or lobby, id to arrest the offender or offenders. SECTION 10. It shall be the duty of every owner or lessee ' every licensed theater, hall or other building to keep and pre ,rve good order in and about his premises, and to that end he fall hire and keep at his own expense a sufficient number of Decial policemen, SECTION 11. It shall not be lawful for any person or per- )ns to stand in the lobby or outer entrance to any licensed the- te;r, hall or other building, or on the sidewalk adjacent to and 7ithin fifty feet of such entrance, after a request to move on, ia.de by the owner, lessee, of any member of the police force, nder a penalty of five dollars [$5] for each and every such offense.
