AGENDA ITEM SUMMARY:
At the March 4, 2024, City Council Meeting, Council agreed to amend the Concession
Agreement with All Marine Retro Rentals. Part of the agreement included a change in the Class
G liquor ordinance that now allows the sale of mixed drinks and not just beer and wine. At the
time, Deputy Clerk Johnson changed wording in one portion of the ordinance to make the
adjustment, but there was a subsection of that ordinance that no longer applies that was not
taken out. The subsection is as follows:
c. Up to six (60 days each calendar year may be specified for holding special tasting events
where the sale of any alcoholic liquor is permitted for consumption. Those dates shall be
coordinated with the office of the City Clerk.
Now that Class G licenses have the ability to sell alcoholic liquor on a regular basis, subsection c.
is now obsolete and should be taken out of the code. The attached ordinance cleans up that
language.
RECOMMENDATION:
A motion to pass An Ordinance Amending Section 4-2-6, Subsection D.7. Class G (Limited And
Package) License, of the McHenry City Code.

Ordinance No. 24-
An Ordinance Amending Section 4-2-6, Subsection D.7. Class G (Limited Service And
Package) License, of the McHenry City Code
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State
of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home
rule powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 4-2-6, Subsection D.7. Class G (Limited Service and
Package) License shall be amended as follows:
7.Class G (Limited Service And Package) License: Issuance of a Class G license shall
authorize the sale of alcoholic liquor for consumption on the premises, and the retail sale of
packaged liquor. The annual fee for such licenses shall be one thousand three hundred dollars
($1,300.00). Conditions on license are as follows:
a.This license shall be issued only for the designated area of Miller Point Park that is
identified under a valid use/permit agreement with the City.
b.No more than one Class G license shall be issued.
All sale alcoholic liquor must be in metal cans, plastic bottles or plastic cups; glass containers are
not permitted.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision
of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid,
such judgment shall not effect, impair, invalidate or nullify the remainder thereof, which
remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under
the authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.

Gill Liquor at 3702 W Elm Street has closed, and they held a Class C liquor license. Therefore, it
is recommended that the City Council pass an ordinance reducing the number of Class C liquor
licenses.

ORDINANCE NO. 24-
Amending Title 4, Chapter 2, Alcoholic Liquor, Section 6, License Classification and
Fees; Approval Authority; Limitation on Number of Licenses
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage
of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the
Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of McHenry,
McHenry County, Illinois, as follows:
SECTION 1: Section 4-2-6, subsection D-3, of the Municipal Code relating to liquor
license classifications, shall be amended as follows:
D.3. Class C (Packaged Retail) License: Issuance of a Class C license shall authorize the retail sale
of packaged alcoholic liquor only. No consumption of alcoholic liquor shall be permitted on the
premises. The annual fee for a Class C license shall be one thousand one hundred dollars
($1,100.00). No more than twenty-five (25) Class C licenses shall be in force in the City at any
time.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such
judgment shall not effect, impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby repealed to the

AGENDA ITEM SUMMARY: The McHenry Rotary Club is requesting the temporary use of
Petersen Park from Thursday, August 15, through Monday, August 20, for the annual Bands,
Brews and BBQ’s event. The actual event will take place on Friday, August 16, through Sunday,
August 19 - use of Petersen Park on the Thursday preceding and Monday after is requested to
facilitate event setup and cleanup.
BACKGROUND:
The McHenry Rotary Club has hosted the Bands, Brews and BBQ’s festival for 13 years. The
festival includes food vendors, live bands, and a raffle along with a special event liquor license to
serve beer, wine, and malt beverages. The Rotary Club has consistently met their goal of hosting
a family friendly event.
The event hours have not varied much from past years; proposed hours are Friday 4:30 PM to
11:00 PM; Saturday 3:00 PM to 11:00 PM; and Sunday 12:00 PM to 5:00 PM. Each day will include
food, live music, and beer service. A $15 donation will be requested at the gate; children 12 and
under accompanied by an adult and Armed Forces personnel in uniform will be admitted free.
ANALYSIS:
The City will have a police presence at the event to ensure public safety. The cost to provide
police services for three days is estimated at $7,500. Additional City services include the $500
park rental fee to cover the cost for the City to prepare the park for the event, as well as
incidentals such as general patrol of the washroom facilities by Parks Department staff. These
services are listed in the attached Event Schedule.

Rotary is requesting approval of a fee reduction of 50% for all reimbursable costs, which the City
has granted in previous years and typically approves for Fiesta Days. Volunteers from the Rotary
Club will operate all other aspects of the event including trash pickup, parking, stage, and sound.
Rotary has hired a local security firm to provide wrist banding for alcohol service and local
business volunteers will serve the alcohol. Alcohol ticket sales will cease 30 minutes prior to
festival closing times.
The Rotary Club will place 18” x 24” election style signage advertising the event in municipal
rights-of-way at locations authorized in the Municipal Code. The signs would be installed one
week prior to the event and removed by August 21.
RECOMMENDATION:
If City Council concurs, then it is recommended that a motion be made to grant the McHenry
Rotary Club 1) use of Petersen park to setup, host, and cleanup for the Bands, Brew & BBQ’s
festival from Thursday, August 15, through Monday, August 20; 2) special event liquor
license for the sale of beer, wine, and malt liquor with drink ticket sales to cease 30 minutes
prior to park closure; 3) a 50% reduction in charges for City services incurred as a result of
this event; and 4) permission to post temporary advertising signs in municipal rights-of-way,
to be removed no later than August 21, 2024.

Agenda Item Summary. The Wonder Lake Water Ski Show Team is requesting use of Petersen
Park for their Annual Haunted Hayride to be held on October 18, 19, 25 & 26, 2024; permission
to post temporary advertising signs in rights-of-way; and waiver of park use and sign permit fees.
Background. Hayrides will begin at 7:00 PM and close at 10:30 PM.
Advertising signs would be posted throughout the month of October in approved locations
pursuant to Municipal Code Chapter 7.50.
As in previous years, parking, loading, and unloading of the wagons will occur on the south side
of McCullom Lake Road. Additional traffic control will be utilized on McCullom Lake Road to
alert drivers of wagons crossing from the hayfield to the main driveway of the farm. The Ski
Team will be responsible for all additional costs incurred by the City for this service.
Analysis. As detailed in the attached letter of request, the Wonder Lake Ski Team is a not-for-
profit organization supporting local initiatives. Event organizers adhere to the strict guidelines
put in place by the City to hold the event creating a mutually beneficial situation for the ski team
event and the City. The event has been held without incident since 1997. For these reasons staff
has no concerns with the request as presented.
Recommendation: If City Council concurs, then it is recommended to approve the use of
Petersen Park; allow temporary signage to be posted in City rights-of way; and waive park
use and sign permit fees for the Wonder Lake Ski Show Team annual Haunted Hayride as
presented.

Agenda Item Summary: Staff is looking for authorization to extend an Exclusive Listing Agreement with
real estate agent Jack Minero of Berkshire Hathaway for the listing of the former Just For Fun Roller Rink
property located at 914 Front Street, McHenry, IL.
Background: The City of McHenry acquired the former Just For Fun Roller Rink located at 914 Front Street
through a judicial deed in early 2022. City staff and hired contractors (with the approval of City Council)
cleaned the property immediately and went through the process of obtaining an NFR letter through the
Illinois Environmental Protection Agency (IEPA) to prepare the property for redevelopment. Jack Minero
from Berkshire Hathaway was approved to be the listing agent for this property in May of 2022. Staff is
now asking for authorization to approve an extension with Mr. Minero / Berkshire Hathaway until May of
2025.
Over the last year, there have been a few interested parties in the property, most of whom were
contemplating residential use. The property is currently zoned C-5 Highway Commercial; the City Council
has expressed their desire for this property to retain that zoning, but has indicated that a mixed use
development with commercial on the first floor and residential on the second floor might be considered.
The property has been marketed at $995,000 for the last two years; however, the listing price was recently
lowered to $750,000 after the Illinois Department of Transportation (IDOT) acquired a portion of right-of-
way to accommodate the widening of Rt. 31.
If the City Council concurs, it is recommended that City Council make a motion to authorize the Mayor
to enter into an extension of an exclusive listing agreement with Jack Minero of Berkshire Hathaway
for the listing of 914 Front Street McHenry, IL for a period through May 31th, 2025.

MINUTES
REGULAR CITY COUNCIL MEETING
Monday, May 6, 2024, 7:00 p.m.
City Council Chambers, 333 S Green St, McHenry, IL 60050
Roll Call: Mayor Jett called the roll call.
Members present Alderman Santi, Alderman Glab, Alderman McClatchey, Alderwoman
Bassi, Alderman Koch, Alderwoman Miller-absent, and Mayor Jett. Others present Attorney
McArdle, Administrator Ostrovsky, Director of Community Development Polerecky, Finance
Director Lynch, Director of Parks and Recreation Hobson, Director of Economic Development
Martin, Chief of Police Birk, City Planner Sheriff-absent, Director of Public Works Wirch, Deputy
Clerk Johnson, and City Clerk Ramel.
Pledge of Allegiance: Mayor Jett led the pledge.
Presentation: Proclamation for the McHenry Garden Club- read by Mayor Jett after 20 years
of celebration of the Garden Club. The Garden Club members took several pictures to celebrate
their accomplishments.
Public Comment: The President of the Garden Club, Wanda, took time to thank the council
and spoke about going from 14 members up to 50 members she expressed her appreciation
for the evening's proclamation.
Nancy Fike spoke regarding the Landmark School and discussed the potential of the building
being an icon that identified McHenry for many years. She is hoping that the city has a vested
interest in speaking to District 15 regarding this along with including information from the
Landmark Commission to help preserve the building.
Zack Walters, a resident, spoke to The Council regarding the crosswalk between Route 120
and Oak Drive, his concern is regarding safety and feels that nobody is paying attention to how
dangerous it is when crossing there. He talked about the dangers of biking to go to the park
and would like there to be a green arrow there to help improve the situation, also noting the
history of accidents in that area with pedestrians.

A. Resolution Authorizing Continuation of the McHenry County Municipal Risk
Management Agency (Deputy Clerk Johnson)
Alderman Koch wanted to know why they chose 12 years instead of 4 years, as explained by
Deputy Clerk Johnson stated that The City is not locked in if needed, they did the 12 years so
that it did not need to be coming back every 4 years to The City. Alderman Koch stated the
doesn’t like the 12 years and would rather have a review every 4 years.
Alderwoman Bassi questioned if the rates are locked, per Deputy Clerk Johnson, the group
tries to shop around and get the best rate possible, noting he is not an expert on this matter.
A motion was made by Alderman Santi and seconded by Alderwoman Bassi to approve

C. Award a material supply contract for bulk rock salt to Morton Salt, Inc., of Chicago,
Illinois, in the amount of $92,280.00 (1,000 tons @ $92.28 per ton), and approve a
contingency allowance for a twenty percent overage on the contract in the amount of
$18,456.00. (Director Wirch)
Alderman Koch thinks the price is too high and would like to be on the list for the state bid for
salt. Director Wirch stated that just like every community they did jump in for the bid. A few
years ago they combined with Lake County, there are 60 communities together doing so. Would
be happy to look into other bids for next year.
Alderman Glab would like a comparison over the last three years from the state, as agreed by
Director Wirch.

G. Award a contract to Applied Research Associates, Inc. (ARA) in the amount of
$83,400.00 to perform the 2024 Pavement Management Study (Director Wirch)
Alderman Glab discussed the year plan and wanted to know if there could be a visual plan
since now it will be every 5 years. Stated that more than $2 Million is needed for the roads.
Would like the direction pointed at the General Fund because a lot more is needed so that we
are not spinning our wheels with the budget for the roads.
Alderman McClatchey asked about the survey process, Director Wirch explained that he was
not aware of an actual list of roads from the last 10 years. This will help see which have gotten
worse than the others to help with the evaluation.
Alderman Santi that we got on the right track doing a program like this, helps give an objective
measure of the roads
Alderwoman Bassi wanted to know if we did not spend the $83,000 and applied to the actual
road, how much could be done, per director with a quarter of a mile. This year we are doing
about 7 miles of road a year, and resurfacing every 20 years which is the direction that we are
heading, agree more funds are needed but he feels it is noticeable already.
Alderwoman Bassi stated that it is the responsibility of each Alderperson to fight for their wards
if needed. This conversation went on for some time.

I. Approve a Parks Special Use Permit Application submitted by the Pearl Street
Market for the summer markets and band concerts May 16th – September 19th from
4 pm to 9 pm each Thursday, to approve a special event liquor license in conjunction
with those events and to waive the associated fees for the reservation and the
support services (Director Hobson)
Alderwoman Bassi wanted to know will the alcohol be monitored so that it would not leave the
confined area. Director Hobson stated that they do the best that they can with the city staff,
and those that are selling, but he cannot guarantee that people will not leave the confined
areas. He also stated that there will be signs in place, there will not be staff at every entry point,
there is not enough staff.
Chief Birk, stated there have been zero issues at Miller Park, but if needed overtime could be
assigned. There will be a foot patrol there but will not be standing or stationed there.

the end of the summer season on September 29th from 1 pm – 4 pm and to waive
all associated rental and support fees for the event (Director Hobson)
Alderwoman Bassi had her questions answered above, therefore no further questions were

E. 2212 Richmond Road Use Variation
A motion to pass an ordinance granting a use variation to allow the outdoor storage of
automobiles, recreation vehicles, trailers, and equipment as the principal use on a
portion of the property located at 2212 N Richmond Road (Director Polerecky)
Alderman McClatchey is not happy with the location of this proposal. Per Director Polerecky
staff thought it would be a good location because it was hidden.
Alderman Glab has concerns about flooding in that area and wonders where the water will go,
not a good spot for it.
Nate Wiseman with Vantage Holdings stood at the podium to give more insight this is a C5
Highway commercial, that will allow outdoor storage but not as a primary use. It would be
professional storage, secure fenced, automatic gate with a code for those to enter with limited
access. Corporate focused, commercial rental and nothing short term, including fleet storage,
marinas, etc. Have had no comment in any of the surrounding companies.
Alderman Koch wanted to know if these are commercial, per the petitioner they will cater more
to corporate clients not short-term, would like to store fleets, etc.

G. 4719 Elm Street Variance and CUP
A motion to pass an ordinance granting a Variance and Conditional Use Permit to allow
an Open Sales Lot in conjunction with Automobile Sales (Director Polerecky)
Alderwoman Bassi wanted to ask the petitioner to walk her through what the concept would
look like. The West side will have a fence for safety, other than that it will be open with an office
building. The petitioner is working on the design of it, and would like it to be nice and modern
with customer parking in the front office, this will be new construction, confirmed by the
applicant as asked by Alderwoman Bassi.
Alderman Glab wanted to know how many cars will be in the lot, as of now the petitioner is
about 20 cars at this time. The property owner will maintain the right away such as any other
property owner, as confirmed by Director Polerecky.

Administrator Ostrovsky – public service recognition week, wanted to thank the staff.
Comprehensive plan workshop next Monday at 6 pm
Mayor’s Report: None
City Council Comments: Alderwoman Bassi wanted to know what overview will be allowed
to be picked up for the large garbage pickup. Per Director Wirch it will be on social media, Nixle,
and the city website. It will be unlimited bulk items that are too big for garbage bags and totes.
If not over 50 pounds or over 50 feet, the carpet needs to be rolled up. Will not take construction
debris items, appliances -e-waste, paint, batteries, and tires. It will be communicated to the
residents.
Alderwoman Bassi wanted to know who the residents call if they have issues, it was confirmed
that they can call Director Wirch.
Alderman Glab said this is a great tool for our residents and would like to see it advertised as
much as possible.
Alderman McClatchey said great jobs pick up the branches too.
Alderman Koch wanted to know if there are inspections for parks and if he could see them. Per
Director Hobson no info on the Shamrock of Fox Event just yet.

Call to Order
The Committee of the Whole of the City of McHenry, Illinois, met on Monday, May 13, 2024, at
6:00 p.m. at McHenry City Hall, 333 S. Green Street, McHenry, IL.

Public Comment

Implementation Workshop – Vision 2050 Comprehensive Plan project
Members of HDR Engineering explained where in the process we are at in the Comprehensive
Plan project. Surveys have been submitted by members of the public, and twelve strategies were
introduced that the City Council could consider. Those strategies were:
1. Develop a Citywide land Development Framework
2. Maintain Small-Town Character in New Neighborhoods
3. Increase the Diversity of McHenry’s Housing Stock to Ensure Availability of a Variety of
Housing Types and Affordability Levels
4. Prioritize the Protection, Restoration, and Expansion of Ecologically Sensitive Natural
Areas, Agricultural Lands, and Other Natural Open Spaces
5. Redevelop Large Vacant Shopping Centers to Accommodate Housing with the
Retail/Commercial Uses, and Includes Walkable Streets, Mixed-Use Buildings, and High-
Quality Public Spaces
6. Actively Recruit Businesses that Provide Entertainment and Activities for Younger
Residents (Ages 12 to 20 Years)
7. Develop a Citywide Mobility Framework to Promote a Safe and Healthy Transportation
Network by Right Sizing Roadway Designs and by Separating Vehicles from Vulnerable
Streets Users
8. Develop Additional Trail Connections and Riverwalk Segments to Create a Continuous
Trail Network Throughout the Whole City of McHenry

9. Prioritize Shared Use and Multi-Benefit Nature- Based Infrastructure Including Best
Management Practices Such as Bioswales, Bioretention, Enhanced Swales, Enhanced

10. Prioritize Water, Wastewater, Roadway Infrastructure Upgrade to Existing System Over
Service Extension and Expansion to Undeveloped Areas to Prevent Development Sprawl
and Preserve Agricultural Land and Natural Open Space
11. Support Development Around the Metra Station to Increase Ridership and Train
Frequency
12. Prioritize Catalyst Developments at Strategic Points to Encourage Developers and
Property Owners to Invest in Downtown McHenry
Council and Staff members were given the opportunity to select which strategies were important
to them by placing stickers on each strategy. Council, Staff, and invited stakeholders that were
present were divided into two separate groups. Each group worked on finding what already exists
and what needs to be done to make each strategy a reality. Once each group finished their
strategies, both groups came together to share their ideas.
A motion was made by Alderwoman Miller and seconded by Alderman Santi to adjourn to
executive session at 8:18 p.m. to discuss the purchase or lease of real property for the use of the
public body, including meetings held for the purpose of discussing whether a particular parcel
should be acquired (5 ILCS 120/2(c)(5)). Roll Call Vote: 6-Yes: Alderman Santi, Alderman Glab,
Alderman McClatchey, Alderwoman Bassi, Alderman Koch, Alderwoman Miller. 1: abstain:
Alderman Davis. Motion carried.
Mayor Jett reconvened the meeting at 8:36 p.m. Roll call: Members present: Alderman Santi,

AGENDA ITEM SUMMARY:
The original Economic Incentive Agreement between the City of McHenry and 1325 Riverside
Inc. d/b/a Whiskey Diablo required the developer of the site to obtain an occupancy permit for
the subject property no later than August 31, 2023, or the agreement would be null and void.
An amendment to the agreement was passed on August 21, 2023, to extend the deadline date
to February 28, 2024. A second amendment extended the deadline to May 28, 2024.
BACKGROUND:
Dan Hart, developer of Whiskey Diablo, received approval of an Economic Incentive Agreement
to allow for sales tax sharing in an amount not-to-exceed $45,000 on November 7, 2022, to
assist in defraying the costs of retrofitting a sprinkler system for a restaurant at 1325 N
Riverside Drive. On January 16, 2023, the agreement was amended to reduce the capital
development fees for the project.
Mr. Hart is requesting an additional 120 days from the current deadline of May 28, 2024, with a
new deadline of September 25, 2024, to obtain a certificate of occupancy. Staff believes this is
a reasonable request given delays beyond Mr. Hart’s control, and staff would therefore
recommend the agreement be modified to accommodate the September 25, 2024, date.
If the City Council concurs with staff, it is recommended that the attached Third Amendment
to the Amended Economic Incentive Agreement Between the City of McHenry and 1325
Riverside Inc. d/b/a Whiskey Diablo be approved.

Third Amendment to
Economic Incentive Agreement Between the
City of McHenry and 1325 Riverside Inc. d/b/a Whiskey Diablo
This Third Amendment to that certain Amended Economic Incentive Agreement dated
January 16, 2023 (“Original Agreement ”) is made and entered into this 20th day of May, 2024,
by and between the City of McHenry, 333 S. Green Street, McHenry County, Illinois, an Illinois
home rule municipality (“City”) and 1325 Riverside Inc. d/b/a Whiskey Diablo (“Developer”).
Recitals
A. On or about January 16, 2023, the City and Developer signed the Original
Agreement regarding redevelopment of the building at 1325 Riverside Drive, McHenry, Illinois
(“Subject Property”).
B. On or about August 21, 2023, the City and Developer signed the Amended
Agreement regarding redevelopment of the building at 1325 Riverside Drive, McHenry, Illinois
(“Subject Property”).
C. On or about December 18, 2023, the City and Developer signed the Second
Amendment to Economic Incentive Agreement regarding the development of the building at
1325 Riverside Drive, McHenry, Illinois (“Subject Property”).
D. The City is a home rule municipality and as such has the authority, pursuant to
Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970, to adopt ordinances
and to promulgate rules and regulations that pertain to its government and affairs.
E. The parties desire to make one amendment to the “Term” of the Original
Agreement, leaving in full force the balance of the Original Agreement.
Now, therefore, in consideration of the promises and agreements made herein, the
adequacy and sufficiency of which is acknowledged as received by each party hereto, it is agreed
that paragraph 6, Term, of the Original Agreement shall be amended to read as follows and the
remaining terms of the Original Agreement shall remain in full force:
6. Term. So long as the City issues an occupancy permit for the proposed restaurant and
bar by September 25, 2024, this Agreement shall be in full force and effect for a Term
commencing upon issuance of said occupancy permit and ending on the earlier to
occur of: (a) the City’s payment to the Developer of the Maximum City’s Payment
Obligation; or (b) the Permanent Closure of the proposed restaurant and bar on the
Subject Property prior to the City’s payment to Developer of the City’s Maximum
Payment Obligation. If the City has not issued said occupancy permit by September
25, 2024, this Agreement shall be deemed void. After commencement of the Term, this
Agreement shall remain in effect for enforcement and accounting purposes after the
expiration of the Term.

AGENDA ITEM SUMMARY: Staff requests that the City Council consider adoption of an
Ordinance amending Title 9, Chapter 2, Subsection A-9, Secondary Metering, of the McHenry
City Code which will prohibit secondary metering for the deduction of sanitary sewer billing
for outside water use.
BACKGROUND:
Occasionally, the City receives requests for deduction of sanitary sewer billing for outside water
use for lawn watering and pool filling. The City has always denied requests for these applications
including the installation of secondary meters on irrigation systems. The addition of secondary
meters would add maintenance and administrative costs to the Public Works and Finance
departments. The addition of secondary meters could result in discrepancies during meter
reading resulting in additional operational costs as well.
ANALYSIS: Due to the infrequency of such requests and the additional costs that would be
incurred by City departments, staff recommends that the City Council adopt an Ordinance
amending Title 9, Chapter 2, Water Use and Service Regulations, Subsection A-9, Secondary
Metering, of the McHenry City Code which will prohibit secondary metering for the
deduction of sanitary sewer billing for outside water use.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that the City Council adopt an Ordinance
amending Title 9, Chapter 2, Water Use and Service Regulations, Subsection A-9,
Secondary Metering, of the McHenry City Code which will prohibit secondary metering for
the deduction of sanitary sewer billing for outside water use.

ORDINANCE NO. 23-
Amending Title 9, Chapter 2, Water Use and Service Regulations, Subsection
A-9, Secondary Metering
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 9-2, subsection A-9, of the Municipal Code shall be amended
as follows:
9-2A-8: Secondary Metering:
No secondary metering shall be allowed for the deduction of billing for any outside
water use. This is to include but not limited to irrigation systems, pool filling and
additional lawn sprinkling.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision
of this Ordinance shall be adjudged by any Court of competent jurisdiction to be
invalid, such judgment shall not effect, impair, invalidate or nullify the remainder
thereof, which remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.
