ORDINANCE NO 23-58
ORDINANCE GRANTING PRELIMINARY AND FINAL PLAT OF SUBDIVISION APPROVAL, AND
FINAL PLAN APPROVAL FOR A CONDITIONAL USE PERMIT FOR A COMMERCIAL PLANNED UNIT
DEVELOPMENT FOR THE PROPERTY LOCATED AT 2019 N RICHMOND ROAD.
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, a petition has been filed by Ivy Schwoch, representing U-Haul, ("PROPERTY
OWNER"), requesting preliminary and final plat of subdivision approval and final plan approval
for a conditional use permit for a commercial planned unit development for the property located
at 2019 N Richmond Road, legally described on "EXHIBIT A", attached hereto and incorporated
herein, "SUBJECT PROPERTY"; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on October 18, 2023 in the manner prescribed by ordinance and statute, and as a
result of said hearing, the Planning and Zoning Commission' did unanimously recommend to the
City Council the granting of the requested Preliminary and Final Plat of Subdivision and
Conditional Use Permit; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zoning Commission and finds that the approval of the request is consistent with the
objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals,
and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That the SUBJECT PROPERTY is hereby granted Preliminary and Final Plat of
Subdivision approval for the plat attached hereto in "EXHIBIT B" titled "U-Haul Subdivision of
the City of McHenry" date revised 09/18/2023.
SECTION 2: That the SUBJECT PROPERTY is hereby granted Final Plan Approval for a
Conditional Use Permit for a commercial Planned Unit Development subject to the following
conditions:
1. All development on site shall be in substantial conformance with the final plan
attached hereto in "EXHIBIT C".

2. The Property Owner of the mini-warehouse/storage facility depicted in EXHIBIT C
shall maintain the existing and proposed landscaping to the greatest extent possible
as determined by the Zoning Administrator.
3. Development of a future drive-thru restaurant on Lot 2 of the U-Haul Subdivision of
the City of McHenry depicted in EXHIBIT C shall be subject to site plan review and
approval at the discretion of the Zoning Administrator.
4. The Property Owner of the mini -warehouse -storage facility depicted in EXHIBIT C
shall provide a revised plan for the truck shunting/staging area as identified in the
original plans approved by ORD-16-1768 to be reviewed and approved at the
discretion of the zoning administrator.
5. All vehicular display parking shall be limited to the areas identified in the submitted
site plan.
6. The Property Owner of the U-Haul facility shall install concrete curbing, or other
acceptable substitution, approved at the discretion of the Zoning Administrator, to
close the two western ingress/egress points with the adjoining property located at
3800 McCullom Lake Road.
SECTION 3: In granting said Conditional Use Permit, the City Council finds that the
approval criteria for Conditional Use Permits listed in §11-15-5 and the standards for Planned
Unit Developments listed in §11-20-5 of the City of McHenry Zoning Ordinance have been met.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided by law.

ORDINANCE GRANTING PRELIMINARY AND FINAL PLAT OF SUBDIVISION APPROVAL, AND
FINAL PLAN APPROVAL FOR A CONDITIONAL USE PERMIT FOR A COMMERCIAL PLANNED UNIT
DEVELOPMEN7 FOR THE PROPERTY LOCATED AT 2019 N RICHMOND ROAD.
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City's home rule powers and functions
as granted in tkie Constitution of the State of Illinois; and
WHEREAS, a petition has been filed by Ivy Schwoch, representing U-Haul, ("PROPERTY
OWNER"), reqraesting preliminary and final plat of subdivision approval and final plan approval
for a condition:�l use permit for a commercial planned unit development for the property located
at 2019 N Richmond Road, legally described on "EXHIBIT A", attached hereto and incorporated
herein, "SUBJECT PROPERTY"; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission ori October 18, 2023 in the manner prescribed by ordinance and statute, and as a
result of said hearing, t#�e Planning and Zoning Commission did unanimously recommend to the
City Council the granting of the requested Preliminary and Final Plat of Subdivision and
Conditional Use Permit; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zpning Commission and finds that the approval of the request is consistent with the
objectives of t e City of McHenry Zoning Ordinance to protect the public health, safety, morals,
and general w Ifare of its residents.
NOW, HEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY CO NTY, ILLINOIS,AS FOLLOWS:
SECTIOM 1: That the SUBJECT PROPERTY is hereby granted Preliminary and Final Plat of
Subdivision approval for the plat attached hereto in "EXHIBIT B"titled "U-Haul Subdivision of
the City of McHenry" date revised 09/18/2023.
SECTIO 2: That the SUBJECT PROPERTY is hereby granted Final Plan Approval for a
Conditional Us Permit for a commercial Planned Unit Development subject to the following
conditions:
1. All development on site shall be in substantial conformance with the final plan
attached hereto in "EXHIBIT C".
2. The Property Owner of the mini-warehouse/storage facility depicted in EXHIBIT C
shall maintain the existing and proposed landscaping to the greatest extent possible
as determined by the Zoning Administrator.
3. Development of a future drive-thru restaurant on Lot 2 of the U-Haul Subdivision of
the City of McHenry depicted in EXHIBIT C shall be subject to site plan review and
approval at the discretion of the Zoning Administrator.
4. The Property Owner of the mini-warehouse-storage facility depicted in EXHIBIT C
shall provide a revised plan for the truck shunting/staging area as identified in the
original plans approved by ORD-16-1768 to be reviewed and approved at the
discretion of the zoning administrator.
5. All vehicular display parking shall be limited to the areas identified in the submitted
site plan.
6. The Property Owner of the U-Haul facility shall install concrete curbing, or other
acceptable substitution, approved at the discretion of the Zoning Administrator,to
close the two western ingress/egress points with the adjoining property located at
3800 McCullom Lake Road.
SECTION 3: In granting said Conditional Use Permit, the City Council finds that the
approval criteria for Conditional Use Permits listed in §11-15-5 and the standards for Planned
Unit Developments listed in §11-20-5 of the City of McHenry Zoning Ordinance have been met.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided by law.
