AND DESIGNATING NOVEMBER 13-19, 2023 AS
NATIONAL APPRENTICESHIP WEEK IN THE CITY OF MCHENRY
WHEREAS, National Apprenticeship Week is an annual National Celebration that offers
leaders in business, labor, education, and other critical partners a chance to express their support
for apprenticeships and gives apprenticeship sponsors the opportunity to showcase their programs,
facilities and apprentices in their community; and
WHEREAS, National Apprenticeship Week is an opportunity to recognize the positive
impact apprenticeships have on youth, adults, businesses, and the economy as a whole; and
WHEREAS, This year’s theme is “Registered Apprenticeship: Superhighway to Good
Jobs;” and
WHEREAS, Weekly events highlight the benefits of apprenticeships in preparing a
highly-skilled workforce to meet the talent needs of employers across diverse industries ; and
WHEREAS, Apprenticeships are a strong career pathway that provide employees the
opportunity to earn a salary while learning the skills necessary to succeed in high -demand careers;
and

AGENDA ITEM SUMMARY: The R.I.S.E. Up Foundation is requesting the temporary use of
Petersen Park Thursday September 12, 2024, from 4:30pm – 10:30pm Friday September 13,
2024, from 4:30pm – 11pm and Saturday, September 14, 2024 from 3pm – 11:15pm for a two
day benefit concert with live music, food trucks and tents, sponsor tents, and alcohol sales. All
proceeds from the concert are to be utilized for the redesign and the installation of an inclusive
playground at Veteran’s Memorial Park.
BACKGROUND: In 2019 a new not-for-profit corporation was created in our community
“organized exclusively for charitable, education, religious or scientific purposes within the
meaning of Section 501 (c)(3) of the Internal Revenue Code specifically to fund projects for
children and their families as needed in the city of McHenry and/or McHenry County, Illinois.”
The R.I.S.E. Up Foundation stands for “Revitalize, Invest, Succeed, Encourage; as a community we
RISE to help future generations.” The Foundation was organized by Wayne and Amber Jett.
The RISE Up Foundation has contributed $400,000 in total towards the Splash pad installation at
Fort McHenry and for the redesign and construction of Miller Point Park to house the McHenry
Riverwalk Shoppes.
After taking a year off, the Foundation is once again requesting a benefit concert at Petersen Park
as the means to raise funds for the community. This year’s concert dates are proposed as
Thursday September 12th, Friday September 13th and Saturday September 14th. Thursday’s hours
are proposed at 4:30pm – 10:30pm, Friday’s hours are proposed as 4:30pm – 11pm and Saturday
proposed hours would be 3pm – 11pm. Organizers are also requesting approval of a Special
Event Liquor License for the sale of alcohol in accordance with the similar events .

ANALYSIS: The benefit concert was approved by city council for 2021 and 2022. The concert
format has not changed from previous year’s format with the exception of the request for the
addition of a Thursday evening also with a 4:30pm – 10:30pm timeframe.
The RISE up Foundation is 501(c)(3) not-for-profit corporation that is looking to independently
hold a fundraising benefit concert that will ultimately provide a large benefit to residents and to
visitors. The city has a long history or working with or partnering these type of entities to
accomplish great things in the community. Entities such as the McHenry Township Fire
Protection District Burn Camp Fundraiser, Friends of Montini concert, the McHenry Rotary Noon
and Sunrise Clubs, the Kiwanis Club, The McHenry Riverwalk Foundation and of course the
McHenry Area Chamber of Commerce. All of these have hosted events varying in size and
cooperation from the city, but all have also given back significantly to the community. In this
instance it is in the form of an improvement that has long been desired by our community.
This year’s funds are projected to go towards the implementation of an inclusive playground at
Veteran’s Memorial Park. The entire existing playground would be removed and an accessible
play structure would be introduced along with a complete rubberized play surface. Addition free
play elements would also be introduced to the playground. The design is still in development
however a rendering that closely depicts the playground is attached for review.
For the event, all net proceeds will be directed towards the City; for this reason staff is proposing
to waive all associated fees for the event as well as in-house staffing costs for the event.
Volunteers from the Rise Up Foundation will operate many aspects of the event including trash
pickup, parking, stage, and sound. Police will provide overall event security as will Fiesta Days
and Blues, Brews and BBQ’s. The Parks Department will also maintain a presence throughout the
duration of the event to assist where needed.
Any patron wishing to consume alcohol will be required to present identification and wrist
banded. Alcohol ticket sales will cease 30-minutes prior to festival closing times and actual
distribution of alcohol will cease 15 minutes prior to closing.
RECOMMENDATION:
Therefore, if Council concurs, then staff requests that a motion be made to grant the RISE Up
Foundation 1) use of Petersen park to setup, host, and cleanup for a benefit concert from
Thursday, September 12, through Saturday, September 14, 2) special event liquor license for
the sale of beer, wine, and malt liquor with drink ticket sales to cease 30 -minutes prior to park
closure, and 3) a 100% reduction of the charges for city services incurred as a result of this
event.

AGENDA ITEM SUMMARY: Included in the FY2023/24 budget is $150,000 for the burial of the
power poles behind Riverside Drive to accommodate the expansion of the Riverwalk between
the Pearl Street and Route 120 Bridges. Staff in conjunction with the McHenry Riverwalk
Foundation President John Smith have worked with HR Green and ComEd to finalize a plan and
solicit quotes for the work. There are two contracts in conjunction with the proposed work: a
contract with ComEd in the amount of $69,988.21 for the removal of the pole and transformer
and the subsequent placement of a new ground transformer. The second quote is from
Associated Electrical for running of all necessary conduit and wires from the relocated poles to
the new underground transformer as well as running new service conduit and wire to the existing
businesses. This contract is $66,500 for the ComEd conduit portion and $13,000 for the portion
to service the business. In total combined proposed work is quoted at $149,488.21.
BACKGROUND: For many years, in fact since the inception of the Riverwalk concept, there have
been discussions regarding burying the power pole with the aerial transformer behind Riverside
Drive and adjacent to the Riverwalk in that section. Discussion really began in earnest last fall as
the city completed Phase 3 of the Riverwalk from the Pearl Street Bridge to Weber’s Park. The
completion of this phase left the section between the Pearl Street Bridge and the Route 120
Bridge as the last remaining section to make a continuous walk from Weber’s Park to Green
Street.
The city staff along with the Mr. Smith and staff from HR Green have been working on this and a
definitive plan since last September. There have been innumerable meetings regarding the phase
and this challenge of the power pole and transformer in particular. ComEd representatives,
engineers, contractors, business owners and staff have met time and again to solve this issue to

everyone’s satisfaction and to do so within the budget approved by city council earlier this April.
Attached is a plan developed by HR Green and in conjunction with parameters laid forth by
ComEd that finally provides the road map to remove the aerial pole with the transformer and a
multitude of wires behind Riverside drive and replaces it with a ground transformer.
The plan calls for underground conduit (purple) both under Pearl Street and also along the river.
This conduit would be utilized by ComEd for their infrastructure providing a power feed to a
“down pole” and subsequent power to the new transformer location. A return (light blue)
conduit would provide the secondary electric service. The orange lines (by ComEd) would remain
as overhead services to the businesses. The last aspect is the (green) conduit back to serve the
businesses. These were agreed to as part of the signed easement documents for the installation
of Phase 4 of the Riverwalk.
This plan was then disseminated to four local contractors with expert knowledge in this area and
meetings scheduled with each to discuss the nuances of the project on site. One of the four
opted not to provide a quote, while the other three each did return a proposal. The chart below
breaks down the results:

In addition to the work that is the responsibility of the city listed in the paragraph and table
above, there is also pole work, wiring and feeds as well as setting the new transformer for the
underground conduit that will be performed by ComEd under the p rovided contract in the
amount of $69,988.21. In total the two amounts compiled equal $148,488.21. The City budget
for this project, as a whole, was approved by city council as an expenditure from the TIF Fund for
$150,000.
ANALYSIS: The almost impossible task of solving the plan for the removal of this power pole has
been completed and finalized with all the parties involved. The burial of this pole and
transformer clears a final roadblock for this section of the Riverwalk as well. The long-held goal
of a continuous walk along the Fox River and Boone Creek from Weber’s Park to Green Street in
finally with in sight.
John Smith in particular has fought on behalf of the city and spent countless hours to work with
staff, contractors and private businesses to have this proposal before council for consideration.
The hard work accounted for the best possible numbers for the project coming in just under
budget while also fulfilling the city’s responsibilities as laid out in the easement documents. The
city has time and again proven that the Riverwalk is symbiotic with its neighbors and this portion
and project is another prime example.
Staff is requesting the waiver of competitive bidding on this project as the nuances and
complexity of public work, working with ComEd and the work with private business required the

expertise and existing relationships to navigate, as multiple meetings were required to arrive at
a point where the contractors felt comfortable with the conditions of the requested quote.
As for timing of the project, that will be set by the availability of equipment from ComEd.
Transformers have been requiring extended period of time to acquire. It is the hope to have the
work completed by this coming spring. Again, this would set the table for the possibility of
bidding Phase 4 of the Riverwalk and beginning of construction in the coming fiscal year if city
council chose to proceed.
RECOMMENDATION:
Therefore, if Council concurs, then staff requests that a motion be made for the execution of the
contract with ComEd in the amount of $69,988.21 and 2) waive competitive bidding and accept
the low quote from Associated Electric, including the base bid, the price for the work from the
transformer to the ComEd pole and the price from the transformer to the businesses for a total
amount of $79,500 to complete the power pole burial adjacent to the proposed Phase 4 of the
Riverwalk.

CITY OF MCHENRY ("Customer") and ComEd ("Company") agree that the Company will furnish at the Customer's expense the
labor and materials necessary to do the work for the Customer on or adjacent to the Customer's premises at 1318 N
RIVERSIDE DR, RIVERWALK, MCHENRY, IL 60050, described below.
CUSTOMER WORK AGREEMENT - CUSTOMER WORK ORDER RELOCATION OF OVERHEAD TO UNDERGROUND.
CHARGES FOR REQUESTED INSTALLATION $69,988.21
The Customer agrees to pay to the Company the sum of $69,988.21, payment in full due prior to beginning of Company work.
The charges listed in this contract are for performing the work identified herein under normal field conditions. If abnormal field
conditions are encountered and additional labor and materials are required to complete the work, or if the scope of work is
altered, ComEd reserves the right to collect, and the owner agrees to pay, additional money to cover the increased costs.
The sketch, if any, attached hereto is hereby made a part of this Agreement and expressly designates ownership of the facilities
refered to.
The Total Customer Charge reflects the scope of work described in this Customer Work Agreement that will be performed by the
Company. This does not include charges for the relocation or removal of equipment owned by others, such as cable television
or communication companies, that are attached to the Company's poles. It is the Customer's responsibility to contact these
other companies to schedule the relocation or removal of their equipment from the poles. These companies will bill the
Customer separately for the work they must perform.
Work will be done during the Company's regular working hours, unless otherwise specified.
This Agreement shall be void if not accepted by the Customer within thirty days from date submited.
Transformers and metering equipment installed in conjunction with this work, shall in all cases, remain the property of the
Company.
In the event the work covered by this Agreement cannot be completed within one year from the above date as a result of delays
on the part of the Customer or because the Company has been denied access to the premises, the charge to the Customer
shall be recomputed based on the level of costs prevailing at the time of completion of the work as stipulated in the Company's
General Company Order No. 25.
This agreement is subject to the provisions of the Company's Schedule of Rates and Information and Requirements for Electric
Services as on file with the Illinois Commerce Commision.

There was also a discussion on when the first meeting should be for newly elected officials, it
is the the last meeting in April, but Administrator Morefield was not sure what it used to be.
Attorney McArdle stated that the new Mayor would not be sworn in during that April meeting.
Could take out the word “annual meeting” and could make that work so that the timeframe
could be adjusted.

Alderman McClatchey asked the petitioners what the rest of the property was going to be.
There is going to be an area for a deck, down back by the river, and also would like to add
another restaurant with the possibility of connecting to the Riverwalk.
Administrator Morefield explained the agreement items that follow video gaming.
Alderman Glab would like to create an ordinance regarding this for the future.

Motion to approve the issuance of a Class A Liquor License to SW Sales, LLC for a
business located at 4005 W. Kane Avenue, Unit L , and if approved, pass an ordinance
Amending Title 4, Chapter 2, Alcoholic Liquor, Section 6, Subsection D -1: Limitation on
Number of Licenses. (Deputy City Clerk Johnson)
Alderman Glab questioned why not these were not two items, this was an amended item, per
Administrator Morefield. Seems to be more video gaming only, and will not have support from
Alderman Glab. He also wanted to know if the gaming could be opened a year later, maybe
this is the route that it should go to see if it can survive without it, as directed towards the
council.
Alderman Santi wanted to ask the petitioner, Tom, who stood at the podium what his plan was
and talked about how they could make something different for McHenry . The petitioner
explained that he owns the International Wine and Cheese and the success that he has had
with it as well. He talked about bringing in different ideas that McHenry has not had in the town,
to draw in the residents.
Alderwoman Miller is in strong support of Tom, the petitioner, with his many years of
experience, asked about some high-end collection of bringing some of the specialty stuff per
the conversation she had with Tom. He has some opportunities to purchase things that are
different in the industry.

Discussion Item Agenda:
A. Presentations and Discussion - Cold Springs Park
Per Director Hobson two proposals were first presented in 2009 and were initially approved,
then brought back to the council, and were voted down. Then in 2022 it was brought back,
chose to move forward to come up with a new course layout further away from home. Many
are opposed to the disk golf and would like it to remain more natural with bike paths, which was
a proposal a month ago, to leave it as a passive area. He explained that each group will have
some time to further discuss, the PDGA and Friends of Cold Spring Park along with some input
if needed by The Land Conservancy.
Mike Castiglione, resident of Crystal Lake, representing the PDGA, talked about disk golf,
He presented the history and positive side of what disk golf could do for the area. He also talked
about the fact that there would not be disruption of wildlife and harm to trees during the game.
Much of the supporting documents can be viewed per the information shared by Director
Hobson.
Also speaking on behalf of the Friends of Cold Spring Park was Curt Pepe and Iver Johnson,
who discussed the importance of revitalizing the park, and how it could be done with volunteers
and at minimal costs. Would like to see it remain a park without the disk golf due to concerns
for the environment along with other factors such as parking and the traffic that could affect the
park and the adjacent neighborhood. Also, representing was Lisa Haderlein who spoke from
The Land Conservancy in regards to their efforts to support the Friends of Cold Spring Park as
well. Also represented in the information from Director Hobson.
Alderwoman Bassi asked Mike if this would be a tournament area and it was confirmed that
there are tournaments held for disk golf.
Alderwoman Miller, whose ward this is representing, is concerned about the Cold Springs, likes
to maintain natural areas and does not walk them but sees that it is overlooked, happy the land
conservatory could help, not anti-golf may not be the space for it. Too much to preserve there,
maybe need to look at other places.
Alderman McClatchey wanted to know from Director Hobson about other areas, did look today
at other places since he has gotten some feedback. Could find 9 holes.

Alderman Glab talked about the senior class that bought and gave to the school district a golf
course, and how the poles and baskets were beautiful and they had disappeared. Is there a
multi-use property that could be used that would not impact neighborhoods?
Mayor Jett talked about meeting with Mike and how they could drive around and look for other
properties. The community does need this, figure out what parks work and how they can be
funded and make it a good 18-whole course as well.
Alderman Strach talked about the annexation agreement and the earmarking of the natural
area. A disk golf environment is not a destruction of what is around nature. Cold Spring has
topography and natural structure, elevation changes are what makes this an attractive area.
Would love to find another place as well. Talked about a 9 9-hole course in a smaller footprint
and maybe double boxes could be fun as well. Disk golf is a good way to draw people outside
again, back into nature.
Alderwoman Miller that that this is a great opportunity to work with the private sector and can
work with disk golf and the nature committee. Would like to see this improved and feels strongly
about this being in her ward. Need to work together to find the right spot.
Alderman Santi asked Lisa Haderlein from The Land Conservancy, who would maintain the
park, the idea is that volunteers would be sponsored to do the restoration work and training.
There was also discussion on a connection to the bike path through the park, also pointed out
by Alderman Santi there would also be some traffic there with the bikers.
In conclusion, Mayor Jett will drive around and look for other options where the disk golf could
be placed, he had asked Alderman Strach, since he plays disk gold to go with him along with
Director Hobson.
Alderwoman Bassi stated that we needed to give the residents peace of mind that the park will
not become a disk golf, as a nod of hands. However, there is not a motion for this due to it
being a discussion item.

Provided the 1st meeting of each month.
Administrator Morefield wanted to know when to bring back the barn discussion will be after
the master plan. It was confirmed that the conversation regarding the barn will be tackled
after other discussion items.
Mayor’s Report: None
City Council Comments: Alderman Glab people having issues with Authenti x stated that
things are getting out of hand, and problems are happening per the residents next to it.
Wanted to make sure that the residents are not impacted by this since it was approved by
the council.

Per Alderman Strach stated that not all the issues are wrapped around the Authentix
residents, after reviewing the email from Chief Birk that was sent to the council.
Mayor Jett stated that they will get to the bottom of it with further review.

to Executive Session at 8:43 p.m. to 5 ILCS 120/2(c)(1) Litigation. The appointment,

AGENDA ITEM SUMMARY:
Shelly’s McHenry LLC (Corned Beef Factory) was before Council on March 20, 2023, requesting
a liquor license and video gaming at 4300 W Elm Street.
They were approved for a Class A liquor license but were denied a video gaming license by a
3-4 vote (3 ayes: McClatchey, Harding, Strach; 4 nays: Santi, Glab, Devine, Miller). With
last meeting’s approval of video gaming to SW Sales, Mayor Jett asked that the Corned
Beef Factory’s request be brought before Council again for approval.
Mayor Jett suggests that each Council member visit the Corned Beef factory in Woodstock prior
to voting on this issue. The Corned Beef Factory website can also be viewed here:

RECOMMENDATION:
A motion to approve the following:
Approve a video gaming license to Shelly’s McHenry LLC at 4300 W Elm Street, McHenry, IL,
and if approved, pass an ordinance Editing Section 4-6-8, Subsection A - Number of Licenses,
of the McHenry City Code.

Dear City Council:
We are Mitchell Voss and Chris Goluba the owners of Shelly’s Corned Beef. We are both in the
real estate industry and we are here seeking a video gaming license for our unique concept.
Product – The recipe for the corned beef that will be sold from this location was originated in
1948 and is made locally in the Fulton Market neighborhood in Chicago. Crain’s Chicago labeled
our corned beef suppliers as the “Corned Beef Kings”. The corned beef is hand trimmed and
injected with garlic, salt, water & spices and is then brined overnight. It is then sliced super thin.
The menu features house-cured corned beef, pastrami, hybrid sandwiches and grilled cheese for
the non-meat eaters. The bread is baked locally and delivered to the restaurant several times a
week. Drinks will be paired with sandwich selections.
The concept has had success in Woodstock and Carol Stream and is coming to other locations.
Similar to other locations, we intend to offer catering once the store gets up and running.
Location – The location has been approved by The Corned Beef Factory and consists of 3,420
square feet in the McHenry Shopping Center. The foot traffic from Dollar Tree, Angelo’s and
Chase Bank makes this a premier location. The restaurant has seating for 24-30 hungry customers
with an additional 6 seats at the bar. The landlord and tenant have a combined investment of
$300,000+ into this location.
The owner of the building says this storefront has been vacant since November 2019.
Operations – Although we will be involved in the operations, we partnered with an operator who
has proven himself in the hospitality industry. He owned and operated a restaurant in West Dundee
that was featured in WGN as the best of the NW Suburbs. It was also voted northern Kane County
small business of the year by the Kane County Chamber of Commerce. We hope this is the flagship
store for other corned beef locations.

ORDINANCE NO. 23-
Amending Title 4, Chapter 6, Video Gaming Terminals, Editing Section 4-6-8,
Subsection A – Number of Licenses, of the McHenry City Code
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Title 4, Chapter 6, Video Gaming Terminals , Section 4 -6-8,
Subsection A - Number of Licenses , of the Municipal Code shall be amended as follows :
4-6-8: Number of Licenses
A. The total number of location licenses for video gaming terminals issued under this
chapter shall not exceed 46.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision
of this Ordinance shall be adjudged by any Court of competent jurisdiction to be
invalid, such judgment shall not effect, impair, invalidate or nullify the remainder
thereof, which rem ainder shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.

AGENDA ITEM SUMMARY:
Youth and Family Center of McHenry County (YFC) is requesting approval of a Conditional Use
Permit to operate an assembly use at 1007-1011 N Green Street. The City of McHenry Zoning
Ordinance requires a Conditional Use Permit for operations that require regularly scheduled
gatherings/programming of more than 25 persons. YFC provides afterschool and summer school
programming with a focus on middle school and high school aged c hildren. YFC also provides free
English as a second language courses for adults.
PLANNING & ZONING COMMISSION DISCUSSION & RECOMMENDATION:
A public hearing for the request was held on October 18, 2023. At the hearing, one member from
the public spoke in regards to the former District 15 tenant and claimed high school students
were accessing his property at 3608/3606 W John Street and requested a privacy fence. The P&Z
Commission discussed the request and concluded that the source of the problem was related to
the existing high school and not relevant to the new tenant. Another property owner also
claimed issues regarding snow being pushed by the former tenant onto his property north of the
site on 3604 Main Street. The Commission also concluded that the snow issue was not related to
the current owner since YFC has only owned the property since July of 2023. Staff also reiterated
that it is unlawful for property owners to push snow into the right-of-way and onto other

properties. The petitioner also stated they are working with a snow removal company to have
the snow removed from site in order to be a good neighbor. The P&Z Commission unanimously
voted to recommend approval of the request. Staff have included a condition of approval that
restricts the assembly use of the property exclusively to Youth and Family Center of McHenry
County.
RECOMMENDATION:
If the City Council concurs, it is recommended the attached ordinance granting a Conditional
Use Permit to Youth and Family Center of McHenry County for an Assembly Use at 1007 -1011
N Green Street be approved (City Council vote-simple majority).

Chairwoman Rockweiler opened the file at 5:33 p.m. Planner Sheriff stated that all
publication requirements have been met. Guadalupe Ortz, the Executive Director, was
sworn in. She explained that they had this same conditional use on their previous property
on Elm Street and now need it at their new property on Green Street.
Planner Sheriff explained that this site is much larger than their old site with significantly
more parking. The primary services are after school programs for youth. This appears to be
a good location for this business and should not have adverse impacts on property owners.
Commissioner Locke asked for more specifics about their services. Ms. Ortiz explained that
they have prevention and intervention services through 12th grade, after school tutoring,
mentoring, and after school activities. They have a licensed social worker for intervention
for individuals or as a group. They also help adults find resources throughout the county.
They receive no state or federal funding. The McHenry County Health Board helps with
funding along with corporations and family & community foundations.
Chairwoman Rockweiler opened the public hearing portion of the meeting at 5:37 p.m.
Peter Carrol was present representing Jason Goldman, a property owner to the south of
the property in question. Their first concern comes with issues from previous occupants.
There was snow plowed onto the private property against his garage, which caused water
damage to the garage. They would like a fence required at the south end of the parking lot.
Another reason for concern is that the property can be used as a short cut for youth as
they cut through to get to the parking lot. There are also lights from the cars driving in and
out of the parking lot, which is disruptive to the quiet enjoyment of their property. A fence
would help those issues and they are requesting that this be added to the requirements for
obtaining the conditional use.

Stan Mill was sworn in by Chairwoman Rockweiler, and he explained he owns the property
to the north. He also has issues with snow being cleared in front of his driveway.
Employees also park in front of his house, which is a violation of City ordinances. Tenants
are often unable to park in front because of the employee parking there. He also doesn’t
want to see his property used as a cut through. Lights from cars are also an issue at night.
Chairwoman Rockweiler closed the public hearing portion of the meeting at 5:44 p.m.
Ms. Ortiz explained that their hours of operation are 9:00 a.m. to 5:30 p.m. Sometimes
they could be there as late as 7:00 depending on the programming. If there are people
parking in the lot after those hours, then they are not there for that business. Most youth
are not walking to the center after school. Most are dropped off by bus and then picked
up by parents. She will also work with a company that will handle the snow plowing issues.
Planner Sheriff explained that it would be up to the Commission to decide if the fence is
appropriate to put into the conditional use.
Commissioner Locke stated that the snow plowing and cut throughs are legitimate
concerns, but he doesn’t want to cause a hardship for the business. He hopes that all
parties can work together for the solution. Commissioner Bremer does not believe a fence
should be required. All other commissioners agreed that a fence should not be a required
part of the conditional use. They believe Community Development can handle any
ordinance violation complaints. Chairwoman Rockweiler agreed that a fence should not be
required, and that if it is wanted by the neighbor, then the neighbor can install their own
fence.
A motion was made by Commissioner Lehman and seconded by Commissioner Gleason to
recommend approval of Youth and Family Services of McHenry County’s request for a
Conditional Use Permit to operate an Assembly Use at 1007-1011 N Green Street, and by
making said motion, I agree that the approval criteria for Conditional Uses have been met
as outlined in the staff report. Roll Call Vote: 7-ayes: Commissioners Bremer, Rockweiler,

WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City’s home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, a petition has been filed by Youth and Family Center of McHenry County,
(“PROPERTY OWNER”), requesting approval of a conditional use permit for an assembly use at
the property commonly known as 1007-1011 N Green Street, legally described on “EXHIBIT A”,
attached hereto and incorporated herein, “SUBJECT PROPERTY”; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on October 18, 2023 in the manner prescribed by ordinance and statute, and as a
result of said hearing, the Planning and Zoning Commission did unanimously recommend to the
City Council the granting of the requested Conditional Use Permit; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zoning Commission and finds that the approval of the request is consistent with the
objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals,
and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,

Staff Comments
The following comments and conclusions are based upon staff analysis and review prior to this hearing and are
to be considered viable unless evidence is established to the contrary. Staff may have additional comments
based upon the testimony presented during the public hearing.
BACKGROUND & REQUEST SUMMARY
The petitioner, Youth & Family Center (YFC) of McHenry County, is seeking the following zoning approval(s):
• Conditional Use Permit to operate an Assembly Use at 1007-1011 N Green Street.
The subject property was formerly occupied by the School District 15 Administration Office up until this year.
The City of McHenry Zoning Ordinance requires a Conditional Use Permit for operations that require regularly
scheduled gatherings/programming of more than 25 persons. The YFC is a nonprofit organization that
provides afterschool and summer programming with a focus on middle school and high school aged children.
Their programs provide a safe environment for social, emotional, and academic growth. The YFC also provides
free English as a second language courses for adults on Wednesday nights from 6:00PM-7:30PM.
CITY OF MCHENRY ORDINANCES
• The petitioner must meet the Approval Criteria for Conditional Uses, listed in §11-15-5 of the City of
McHenry Zoning Ordinance
STAFF ANALYSIS
FUTURE LAND USE MAP RECOMMENDATION
The Future Land Use Map recommends Medium-Density Residential land use. Although not in compliance
with the Future Land Use Map recommendation, institutional/residential land use is recommended within the
vicinity of the subject property.
CURRENT LAND USE & ZONING
The subject property is currently zoned RS-4 High Density Single-Family Residential District. Assembly Uses are
allowed as a Conditional Use Permit within the underlying district. The primary concern is how the property
will interact with the surrounding single-family residential. Given the site’s former operation as an office
building, the site is equipped with 33 parking spaces which is more than enough parking to accommodate the
size of estimated potential occupancy (60 x 0.25 = 15 spaces). With an adequate amount of parking provided
onsite and majority of services provided indoors, staff does not anticipate any adverse impacts on the
adjoining property owners.
COMPREHENSIVE PLAN OBJECTIVES & POLICIES
Overall, staff believes the proposed development is consistent with the City’s Comprehensive Plan objectives
and policies. Staff comments italicized.

• Land Use, Objective – “Allow a mixture of land uses in appropriate areas to promote responsible
growth while providing a high quality of life to the residents.” (p. 27)

Staff believes the proposed use of the property to provide afterschool programming for children and
English as a second language courses for adults is supportive of promoting a high quality of life to
residents.
• Land Use, Policy – “Locate intense commercial and office uses where they will not negatively affect
residential or open space uses.” (p. 27)
The site has operated for decades as an office use and is next to the High School. Staff believes the use
of the property for afterschool services is complimentary to existing educational institutions within the
vicinity of the subject property.
STAFF SUMMARY ANALYSIS
• The site has an adequate amount of parking to accommodate the assembly use.
• The use of the property as an educational/afterschool assembly-type use matches an existing trend in
the area being next to the high school.
• Staff does not believe approval of the request would generate any adverse impacts.
If the Planning & Zoning Commission agrees with staff’s assessment, then the following motion is
recommended:
MOTION: I motion/move to recommend approval of Youth and Family Services of McHenry County’s request
for a Conditional Use Permit to operate an Assembly Use at 1007-1011 N Green Street.

APPROVAL CRITERIA FOR CONDITIONAL USES (§11-15-5). Staff comments italicized below.
A. Traffic: Any adverse impact of types or volumes of traffic flow not otherwise typical in the zoning
district has been minimized.
Staff believes there is adequate traffic infrastructure in place to service the development.
B. Environmental Nuisance: Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of
light or air, or other adverse environmental effects of a type or degree not characteristic of
permitted uses in the zoning district, have been appropriately controlled.
Staff does not believe the proposed request would generate any environmental nuisances.
C. Neighborhood Character: The proposed use will fit harmoniously with the existing natural or
manmade character of its surroundings, and with permitted uses in the zoning district. The use will
not have undue deleterious effect on the environmental quality, property values, or neighborhood
character already existing in the area or normally associated with permitted uses in the district.
The surrounding area consists of a mix of residential and educational institutions. Commercial areas
are also within walking distance of the site. Staff believes the proposed use of the site as an afterschool
assembly-type use is not out of character with the neighboring properties.
D. Public Services and Facilities: The proposed use will not require existing community facilities or
services to a degree disproportionate to that normally expected of permitted uses in the district, nor
generate disproportionate demand for new services or facilities, in such a way as to place undue
burdens upon existing development in the area.
The site is currently serviced by city water and sanitary sewer.

E. Public Safety and Health: The proposed use will not be detrimental to the safety or health of the
employees, patrons, or visitors associated with the use nor of the general public in the vicinity.
Staff believes the proposed use would not endanger local public health and safety within the vicinity of
the subject property.
F. Other Factors: The proposed use is in harmony with all other elements of compatibility pertinent to
the conditional use and its particular location.
Located next to a school, the programs provided are complimentary of the existing use(s) within the
area. Staff believes the afterschool programs and English as a second language courses provide an
inherent benefit to the overall wellbeing of the community.

AGENDA ITEM SUMMARY:
The petitioner, U-Haul, is requesting approval of a Conditional Use Permit and Final Plan Approval
for a Commercial Planned Unit Development on the property located at 2019 N Richmond Road.
The plan involves the creation of a 1.72-acre out lot to accommodate a future drive-thru
restaurant. It would also involve the expansion of the existing outside storage units along the
west side of the property. U-Haul is currently negotiating with an undisclosed drive-thru
restaurant tenant for the creation of the out lot which will be made public in the near future.
BACKGROUND:
The site was originally approved in 2016 for a Use Variation to allow a storage facility on the
former Walmart site. One of the conditions of approval required the creation of a 1 -acre out lot.
Staff have been working with U -Haul since that time to locate a viable tenant for the site. Once
the undisclosed tenant was located, it was determined that almost an additional acre for the site
was necessary to accommodate their newest drive-thru model. The petitioner is therefore
requesting approval to allow an expansion 157 storage units west while increasing the size of the
out-lot for the future tenant by 0.72 acres.

PLANNING & ZONING COMMISSION DISCUSSION & RECOMMENDATION:
A public hearing for the request was held on October 18, 2023. Staff had met prior with the
neighboring property owner Northtown Auto to address their site line concerns. The owner was
satisfied with the overall site plan but requested a more permanent solution to the existing jersey
barriers that currently blocked access to their site. Staff agreed and included conditions of
approval for U-Haul to install curbing. The P&Z Commission agreed with staff’s recommendations
and unanimously recommended approval subject to staff’s recommended conditions.
RECOMMENDATION:
If the City Council concurs, it is recommended the attached Ordinance granting Preliminary and
Final Plat of Subdivision Approval, and Final Plan Approval for a Conditional Use Permit for a
Commercial Planned Unit Development for the property located at 2019 N Richmond Road be
approved (City Council vote-simple majority).

Chairwoman Rockweiler opened the file at 6:00 p.m. Planner Sheriff stated that the
petitioner complied with the public notice requirements. Ivy Schwoch and Heather Skelton
were sworn in by Chairwoman Rockweiler. Ms. Skelton explained that they are looking to
amend some conditions from an application in 2016. They would like to add storage units
on the west side of the building and add a parcel in the parking lot. The ordinance stated
that they should have a 1 acre out lot, but they are looking to have a 1.72 acre out lot and
approval on the west side.
Planner Sheriff stated that they were originally approved for a use variance for a storage
facility. At the time there were conditions and restrictions of UHaul display parking. They
have now updated the site plan. A revised motion for tonight has been inc luded in a memo
to Commission members after a meeting was had between Staff and owners of the
business to the northwest. Northtown Auto was assured that UHaul’s expansion to the
west would not impact the visibility to their current signs. A right of easeme nt between
Northtown Auto and UHaul will also be cleaned up by having permanent barriers placed
between the businesses. The site plan for the new restaurant should be available in
November, and the business planning to come has not yet been disclosed.
Chairwoman Rockweiler opened the public hearing portion of the meeting at 6:05 p.m.
Attorney Jerome Majewski was present to represent the owners of Northtown Auto. He
explained that Northtown Auto had a productive meeting with Ross Polerecky and Cody
Sheriff to work out the main concerns. Staff was able to walk through the project and make
sure no obstructions to the signage would occur and that there would be no negative
impact on the business. He appreciated the work from Staff to address their concerns.
They are satisfied with Staff’s recommendations including permanent curbing to replace
the current cement abutments between parking lots. The public hearing portion of the
meeting was closed at 6:07 p.m.

Planner Sheriff explained that the concerns from Northtown Auto were addressed in the
updated memo in recommendations five and six. Commissioner Locke stated that it was
great that everybody got together to get concerns straightened out. All commissioners
stated that they were happy with the new plan and were pleased that issues were worked
out prior to the meeting.
A motion was made by Commissioner Locke and seconded by Commissioner Bremer to
recommend approval of the petitioner’s request for final plan approval for a Conditional
Use Permit for a commercial Planned Unit Development at the property commonly known
as 2019 N Richmond Road subject to the following conditions:
1. All development on site shall be in substantial conformance with the submitted plans.
2. The Property Owner of the mini-warehouse/storage facility shall maintain the existing
and proposed landscaping to the greatest extent possible as determined by the Zoning

FINAL PLAN APPROVAL FOR A CONDITIONAL USE PERMIT FOR A COMMERCIAL PLANNED UNIT
DEVELOPMENT FOR THE PROPERTY LOCATED AT 2019 N RICHMOND ROAD.
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City’s home rul e powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, a petition has been filed by Ivy Schwoch, representing U-Haul, (“PROPERTY
OWNER”), requesting preliminary and final plat of subdivision approval and final plan approval
for a conditional use permit for a commercial planned unit development for the property located
at 2019 N Richmond Road, legally described on “EXHIBIT A”, attached hereto and incorporated
herein, “SUBJECT PROPERTY”; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on October 18, 2023 in the manner prescribed by ordinance and statute, and as a
result of said hearing, the Planning and Zoning Commission did unanimously recommend to the
City Council the granting of the requested Preliminary and Final Plat of Subdivision and
Conditional Use Permit; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zoning Commission and finds that the approval of the request is consistent with the
objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals,
and general welfare of its residents.

Staff Comments
The following comments and conclusions are based upon staff analysis and review prior to this hearing and are
to be considered viable unless evidence is established to the contrary. Staff may have additional comments
based upon the testimony presented during the public hearing.
BACKGROUND & REQUEST SUMMARY
The petitioner, UHaul, is seeking the following zoning approval(s) for the property located at 2019 N Richmond
Road:
x Final Plat of Subdivision Approval
x Conditional Use Permit for a Commercial Planned Unit Development for the operation of a Storage
Facility/Mini-Warehouse & future Drive-Thru Restaurant
The subject property was first approved in 2016 for a Use Variance to allow a storage facility (UHaul) along
with the outdoor sale and storage of bulk fuel for the property. At the time, a condition of approval required
the creation of a 45,000 square foot outlot. However, the outlot was never created and the City commenced
enforcement activities related to the violation of the conditions of the approving ordinance. UHaul staff have
worked diligently with City staff to resolve the issue. UHaul is currently negotiating with an undisclosed entity
for the creation of a drive-thru restaurant. The outlot size has been increased from 1.03-acres to 1.72-arces
and UHaul is proposing to construct 157 new storage units along the west side of the property. A generic
drive-thru layout for Lot 2 has been included in the site plan but the configuration of Lot 2 will most likely
change depending on the future tenant. The City has approved a similar request for the new Panera Drive-
Thru which was approved for a drive-thru restaurant but allowed administrative site plan review once a tenant
was located.
When originally proposed in 2016, a major concern was the overall appearance of the staging/shunting of
vehicles within the large parking lot of the former Walmart site. Staff does not believe the shunting area is as
great of a concern due to the redevelopment of a large portion of the parking lot into a drive-thru restaurant.
However, the petitioners have informed staff they will need to revise the truck shunting area due to the
redevelopment. Staff have included as a condition of approval to allow staff review of a revised truck shunting
area.
Staff have spoken with both the adjoining property owners of Cedarhurst Assisted Living Facility and
Northtown Auto Service and Tire Center. Cedarhurst’s primary concern was the screening of the units from
view; however, a large mature tree line exists between the site and Cedarhurst which blocks the facility from
view (see image on next page). Staff have included as a condition of approval that the petitioner shall maintain
the existing tree line between Cedarhurst and the development area to the greatest extent possible.

Northtown’s primary concern was the visibility of the existing sign on McCullom Lake Road. However, staff
have ensured the property owner that the site line along McCullom Lake Road will not be compromised given
the separation distance between the units (see image below).

STAFF ANALYSIS
FUTURE LAND USE MAP RECOMMENDATION
The development is in substantial conformance with the Future Land Use Map recommendation for
commercial.
CURRENT LAND USE & ZONING
The subject property is currently zoned C-3 Community Commercial District with a Use Variance for a storage
facility/mini-warehouse. The surrounding land use primarily consists of commercial with multifamily land use
along the southside of McCullom Lake Road. Given the site was first designed to be a big-box commercial retail
site, traffic impacts will largely remain far below the original projections of the site. The primary concern is
aesthetics and screening. The original trees planted over 20 years ago now provide a large amount of
screening. Staff does not believe the storage units will create any adverse impacts on the surrounding
property owners.
The future drive-thru restaurant is located along IL-31 which is designated as a major arterial road with
average annual daily traffic counts of 22,200 vehicles. The property to the south is a gas station which is
another auto-oriented use which could be considered complimentary to the proposed drive-thru restaurant.
Staff does not believe approval of the drive-thru and storage facility expansion would create any adverse
impacts on the adjoining property owners.
COMPREHENSIVE PLAN OBJECTIVES & POLICIES
Overall, staff believes the proposed development is consistent with the City’s Comprehensive Plan objectives
and policies. Staff comments italicized.

x Land Use, Objective – “Allow a mixture of land uses in appropriate areas to promote responsible
growth while providing a high quality of life to the residents.” (p. 27)
Staff believes the addition of a drive-thru restaurant next to an arterial road is appropriate and provides
an additional future amenity that will add to the quality of life of residents.
x Land Use, Policy – “Locate intense commercial and office uses where they will not negatively affect
residential or open space uses.” (p. 27)
The site has operated for a number of years as a commercial use. The proposed storage facility/mini-
warehouse and future drive-thru restaurant will generate relatively small traffic counts in comparison
to the former use of the property as a big-box retail store. Located on a state highway and major
collector road, the proposed development should have very limited impact on any residential open
space.
x Growth, Policy – “Encourage responsible, orderly growth in the City by assisting property owners with
annexation, supporting development plans and promoting redevelopment.” (p. 28)

Staff believes approval of the request would be more in-line with the retail-oriented use desired within
the IL-31/Richmond Road corridor. The existing use of the property as a storage facility created large
empty parking areas. The proposed development should help breakup the mass of the parking lot and
add an additional commercial amenity in the City.
SSTAFF SUMMARY ANALYSIS
x The proposed use is consistent with the future land use map recommendation for commercial.
x Staff does not anticipate any adverse impacts on the adjoining property owners. Staff believes there is
adequate spacing between the proposed expansion of the storage units and the existing Northtown
Auto sign to the west.
x Staff believes the existing landscaping provides an adequate amount of screening of the storage units
from view of the Cedarhurst Assisted Living Facility.
x The truck shunting area will need to be revised once development of the outlot has commenced. Staff
is recommending as a condition of approval that the petitioner shall provide a revised plan for the
truck shunting area.

STANDARDS FOR PLANNED UNIT DEVELOPMENTS (§11-20-5). Staff comments italicized below.
A. The proposed planned unit development fulfills the objectives of the Comprehensive Plan, and other
land use policies of the City, through an innovative and creative approach to the development of
land.
Located next to a state highway, the petitioner is proposing to create an outlot with a drive-thru
restaurant. The site was formerly occupied by a big-box retail store. Although not innovative, the
development is helping fulfill objectives of the Comprehensive Plan by promoting redevelopment of
underutilized commercial space in a heavily trafficked commercial corridor.

B. The proposed planned unit development will provide walkways, driveways, streets, parking facilities,
loading facilities, exterior lighting, and traffic control devices that adequately serve the uses within
the development, promote improved access to public transportation, and provide for safe motor
vehicle, bicycle, and pedestrian traffic to and from the site.
The development will be required to provide walkways to safely navigate to the drive-thru restaurant.
Overall staff believes there are adequate automobile and pedestrian facilities available on site to
provide a safe and accessible means of navigation.
C. The proposed planned unit development will provide landscaping and screening that enhances the
City's character and livability, improves air and water quality, reduces noise, provides buffers, and
facilitates transitions between different types of uses.
The petitioner has provided a landscape plan with a variety of tree plantings and low-lying evergreen
bushes. Staff believes the petitioner is providing adequate landscaping and screening to enhance the
City’s character and livability.
D. The proposed planned unit development will provide site design and development that is based on
sustainable principles to ensure that low impact alternatives are integrated into the proposed
project.

E. The proposed planned unit development will protect the community's natural environment to the
greatest extent practical, including existing natural features, water courses, trees, and native
vegetation.
The petitioner is proposing to preserve the normal flow of surface water in compliance with the City’s
adopted Stormwater Management Ordinance.
F. The proposed planned unit development will be provided with underground installation of utilities
when feasible, including electricity, cable, and telephone, as well as appropriate facilities for storm
sewers, stormwater retention, and stormwater detention.
The petitioner is proposing to underground all required utilities. All development on site will be in
compliance with the City’s adopted Stormwater Management Ordinance.
APPROVAL CRITERIA FOR CONDITIONAL USES (11-15-5). Staff comments italicized below.
A. Traffic: Any adverse impact of types or volumes of traffic flow not otherwise typical in the zoning
district has been minimized.
Staff does not believe the proposed development would generate any adverse impacts on the
surrounding property owners. The site was originally designed for a big-box retail tenant which
generates a significant amount of vehicular traffic. In comparison, the proposed storage use and drive-
thru will generate much smaller traffic counts.
B. Environmental Nuisance: Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of
light or air, or other adverse environmental effects of a type or degree not characteristic of
permitted uses in the zoning district, have been appropriately controlled.
Staff does not believe approval of the petitioner’s request would generate any environmental
nuisances.
C. Neighborhood Character: The proposed use will fit harmoniously with the existing natural or
manmade character of its surroundings, and with permitted uses in the zoning district. The use will
not have undue deleterious effect on the environmental quality, property values, or neighborhood
character already existing in the area or normally associated with permitted uses in the district.

Staff believes the proposed development will fit harmoniously with the existing natural character of its
surroundings and have no negative impacts on the adjoining property owners. Other areas located
near the site have similar drive-thru/storage uses.
D. Public Services and Facilities: The proposed use will not require existing community facilities or
services to a degree disproportionate to that normally expected of permitted uses in the district, nor
generate disproportionate demand for new services or facilities, in such a way as to place undue
burdens upon existing development in the area.
The site is currently serviced by City water and sanitary sewer.
E. Public Safety and Health: The proposed use will not be detrimental to the safety or health of the
employees, patrons, or visitors associated with the use nor of the general public in the vicinity.
Staff does not believe the proposed use will generate any adverse impacts on public safety and health.
F. Other Factors: The proposed use is in harmony with all other elements of compatibility pertinent to
the conditional use and its particular location.
Overall, staff believes the proposed use is compatible with and complementary of the surrounding
highway commercial land use.

Agenda Item Summary
Staff is requesting approval of an invoice and a budget amendment for emergency repairs to the
boiler system located at city hall.
Background
The heating system in the municipal center consists of two boilers and a hot water loop throughout
the building. The system is original to the building with minimal upgrades since it was built in
1991. Money was set aside in this year’s budget to perform some preventative maintenance on
the system, during this maintenance and initial inspection it was determined the boiler expansion
tank and other components had failed to the point it was unsafe to operate the heating system.
McHenry Heating and Air was brought in to shut the system down and make the critical repairs.
Staff had originally budgeted $12,000 for preventive maintenance this budget year, that
maintenance and the emergency work totaled $31,116.72, therefore a budget amendment of
$19,116.72 is being requested.
Therefore, if Council concurs, it is recommended that a motion be made to (1) approve the

AGENDA ITEM SUMMARY:
The purpose of this agenda item is to discuss the 2023 Property Tax Levy and to provide City Staff
guidance on the levy amount to be requested.
Annually, prior to the end of the calendar year, the City must provide the amounts required for
the property tax levy so that the funds generated through this revenue mechanism will become
available during the 2024/2025 fiscal year. The levy request must be approved by the City Council
and submitted to the McHenry County Clerk by the last Tuesday in December (the 2 6th in 2023).
There are public notification timeframes also associated with this process. With this date as a
target, the 2023 Property Tax Resolution indicating the levy amount and Public Hearing will be
presented at the November 20, 2023 Council meeting and, upon adoption of the resolution, the
Property Tax Levy Public Hearing and consideration/adoption of the levy amount is scheduled for
the December 18, 2023 City Council meeting.
BACKGROUND/ANALYSIS:
General Fund Revenues provide the funding source for operating and capital improvement costs
for all municipal departments except for the Water and Sewer Divisions of Public Works (water
and sewer receipts and base fees) and the Recreation Center (members fees). Examples of
capital improvement costs are facility maintenance and vehicle and equipment replacements.
The table below is provided as a reminder of the sources of revenue that comprise the General
Fund, along with the budgeted dollar amounts and corresponding percentages for Fiscal Year
23/24. Again, all General Fund revenues are accounted for in one of the line items below. As
Council can see, $22,572,094 (75.8%) of General Fund Revenues are comprised of four primary

sources – Property Tax, State Sales Tax, Local Sales Tax, and State Income Tax (shaded rows). Of
these four primary sources of funding, the municipality only has the ability and authority to adjust
two – Property Tax and Local Sales Tax. These two sources represent just 29.87% of General
Fund Revenues.

With this information, and as Council considers setting the Property Tax Levy amount moving
forward, it is important to identify that the City Administration has developed the Community
Investment Plan and revenues to address the needs within this plan have been identified through
Electric and Gas Use Taxes. As Council is aware, the Community Investment Plan is a long list of
projects, many of which are high priority, and the Electric and Gas Use Tax Revenue are not
enough to fund all the capital projects. Capital projects will be moved back into later fiscal years
based on the revenue available, but we have future projects in the Route 31 widening and the
potential Streetscape program that either must be funded or are high up on the priority list. As
is identified in the Community Investment Plan, FY24/25 has a shortfall in revenue for projects in
the amount of $585,000 (City Staff will have to identify projects that have to be moved to a later
FY), there are also $18,350,000 in projects that currently do not have any funding source (which
includes $13,500,000 in Streetscape Improvements, $1,750,000 for Riverwalk Phase 4, and Route
31 Improvements in the amount of $1,000,000).
With this in mind, it was the intention to have the revenues listed above be completely for the
operations of the City and staff is still committed to recommending property tax increases when
operating revenues do not meet operating expenses. But when Capital projects arise that need
a funding source it is important to discuss what this funding source is and as stated earlier the

City only has the authority to adjust a few of the revenue sources. As is defined in the Fund
Balance and Reserve Policy when the General Fund Balance has reached a level above the 120
day reserve balance (which in 23/24 is $9,739,783) the additional funds will be assigned for
capital. If property taxes are increased and not used for operational expenses this policy will
ensure that these funds are used for the unfunded capital projects. C urrently the audit is not
completed, but it is estimated that the reserve for capital is going to be $2,700,000 and
$2,588,400 is budgeted in FY23/24 in capital from this reserve. This leaves just over $100,000 for
future projects. Also, the FY24/25 budget process has not begun yet, but increases to operational
expenses is expected (due specifically to union contracts and inflation) and revenues have begun
to level out so it will be increasingly difficult to produce a balanced operating budget which is
something City Staff has committed to.
Despite the fact that as a “Home Rule” community the City of McHenry is no longer subject to
the Property Tax Extension Limitation Law, or PTELL - which limits increases to residents’ property
taxes by preventing a local government’s property tax levy from growing at a faster pace than
the rate of inflation, or 5%, whichever is less - the City has continued to follow PTELL guidelines
for establishing the property tax levy. In fact, for the years 2011-2015 the City chose to maintain
a flat property tax levy request at the amount that was requested in 2010. In 2016, Council chose
to decrease the property tax levy request by 3%. And in 2017-2020 the levy was again maintained
flat from the 2016 reduced amount. 2021 was the first year that property taxes were increased
to the limited extension or 2.6% and in 2022 the levy was left flat at the 2021 amount.
Unfortunately, while the City has attempted to have an impact on reducing or limiting increases
to property taxes through these actions, a reduction to the City’s portion of the property tax levy
has not resulted in reductions to property tax bills. Change in EAV also drives change in the
property tax bill. When the EAV declines the tax rates must go up in order to fully fund the
property tax levy because the same amount of money needs to be collected across the new lower
values as requested by all taxing districts. For 2022, the EAV increased for the eighth consecutive
year so the tax rates for the City went down slightly lowering the City’s portion of the tax bill. In
fact, that portion of a resident’s tax bill directed to the City of McHenry was only 5.84% of the
total amount. However, this does not take into consideration actions taken by the other taxing
jurisdictions that comprise the total property tax bill. In 2023, it is estimated that the EAV will
decrease about 2.5% which could result in an increase in the property tax bills within the City
even if the levy remains flat. Of course, this will be determined by each individual parcels EAV
and some will increase and some will decrease.
Based on the totality of the information the City is allowed to set the Levy amount at any dollar
amount as a Home Rule Community. Attached are a few options including PTELL (which for 2023
the CPI-U is above 5% so the limit is 5%), a new growth increase, as well as increasing the levy by
the NISRA dues. The reason the option of the NISRA (Northern Illinois Special Recreation
Association) dues is included is due to the fact that all other communities separately levy for
these dues, but the City of McHenry has not in the past but it may be the time to change this
approach. Also important to note is that the Police Pension contribution amount has increased
by $38,911 which will lower the portion of the levy that goes to the General Fund . As a reminder

the City will still have a separate levy for the annual Pension Obligation Bond which will be
included in the Total Levy ($1,663,589 for 2023).
RECOMMENDATION:
For the 2023 tax year the inflationary rate is 6.45%, but this is capped at 5% for calculating PTELL.
The Estimated Rate Setting EAV supplied by McHenry County is estimated at 831,012,871 (a
decrease of 2.5% over 2022) and new construction is estimated at 7,190,501. PTELL calculated
with the inflationary rate and the estimated EAV equates to an Estimated Limited Extension of
$3,254,745, or a $181,844 increase over last year. This increase would result in an increase in
the City’s portion of the Property Tax Bill by a total of $20.72 for a home valued at $200,000,
and $25.91 for a home valued at $250,000. Again, total increases or decreases to the amount
of property taxes are dependent on the actions of all taxing bodies as well as changes to EAV.
As another option the levy could be increased by the NISRA dues expense which is approximately
$127,000. With this increase and the estimated EAV the Estimated Limited Extension would be
$3,201,985. This increase would result in an increase in the City’s portion of the Property Tax
Bill by a total of $16.45 for a home valued at $200,000, and $20.58 for a home valued at
$250,000.
One other option for the levy would be to increase it by new growth only. New growth figures
into the PTELL calculation by allowing communities subject to PTELL to increase the levy by more
than just the CPI-U or 5% by allowing additional increases for new construction and annexations
into the district. For the City of McHenry this new growth is 0.9%. The Estimated Limited
Extension with just new growth is $3,099,761 or a $26,860 increase over last year. This increase
would result in an increase in the City’s portion of the Property Tax Bill by a total of $8.25 for a
home valued at $200,000, and $10.33 for a home valued at $250,000.
City Staff is looking for a recommendation from the City Council on the dollar amount to be
brought to the November 20, 2023 Council Meeting and included in the 2023 Property Tax Levy
Ordinance.
