ZONING BOARD OF APPEALS TO THE
CITY COUNCIL, CITY OF MCHENRY, ILLINOIS
A hearing on the above-capdoned petition was held on February 5, 1996. Chairman Semrow called the
hearing to order at 7:35 p.m. The following persons were in attendance:

Donna Tobeck. Absent: Chuck Lovett, John Swierk.

SUMMARY
`, The Petidoners are requesdng that an additional condidonal use permit be granted for the subject
property to permit the use of a rear portion of the library building as an office and storage area for
Habitat.
TESTIMONY
Chairman Semrow swore in the following witness for the Petitioners:
1) Anthony Gomez, 984 Camelot Drive Crystal Lake Illinois 60014.
Attorney Young stated that he believed the petitioners' request to be fairly straight forward and self-
explanatory. He deferred to the Board and their questions regarding the proposed conditional use. He
said that the office of Habitat has been located at a site in McHenry free-of-charge for the past year.
However, the building where the office is now located has been sold and Habitat has been required to
find an alternate location. the McHenry Library has extra space available and can accommodate the
office and storage area being requested by Habitat.
OIJESTIONS BY MEMBERS OF THE $OARD
Chairman Semrow asked the peddoner if they intended to use the rear portion of the building in which
the McHenry Library is located. Gomez said that is correct. Semrow asked Gomez to describe the
proposed Habitat use of this facility. Gomez said Habitat would like to lease 1800 square feet of the
most westerly portion of the Library building. The use in the 1800 square feet would be office and
� limited storage of building materials such as lumber, fixtures, etc. Semrow noted that Habitat is a not-
for-profit corporation whose function is to build homes for those who have no resources to do it for
themselves. Gomez said typical office hours are 10 a.m. until 2 p.m. daily with occasional meetings
in the evening. He said there are approximately 5-6 committee meetings per month plus the monthly
board meeting. He is the President of the board. There would be access to the building seven days per
week. Chairman Semrow asked if they would utilize a forklift for moving materials in and out af the
building. Gomez said all materials would be hand-camed. There would be no heavy duty storage on
the premises. In most instances, materials used in erecting a house would be delivered directly to the
site where the house is being built. The storage at this location would be mainly for tools owned by the
corporation and for specialty items which have been donated to Habitat by local business owners.
Attorney Young said there would be no negative impact upon the library facility due to the lease of the
site to Habitat. Chairman Semrow went over the Approval Criteria for Conditional Uses with the
Petidoner as stated in the Peddon.
Chairman Semrow asked the petitioner how many people typically use the office during a day. Gomez
said approximately 2-3 people per day visit the office. There would be people coming to the committee
and board meetings. Those meetings are held in the evening.
Christensen asked what types of goods are donated and would be stored on site. Gomez said there could
be some lumber, plumbing fixtures, that type of thing. Christensen asked if the tools which would be
stored on site would be electric, battery or gasoline powered. Gomez said they would be electric or
`. battery. There w<�uld be no gasoline or gasoline powered tools stored in the facility. Christensen asked
if the building is sprinklered. Lobaito said that he believed a portion of the building is sprinklered. In
any event, the petitioners would be required to meet all building code requirements. No plans have been

submitted to the huilding department as of this date. Young said there would be no storage of
`, flammable materials. They would be prohibited by the terms of the lease.
Lobaito asked of the 1800 square feet, how much would be office space. Gomez said approximateiy
one third of the space would be devoted to the office, about 600 square feet. Lobaito asked the exact
location of the space within the building. Gomez said it would be on the west side of the building.
There would be a buffer between the library use and the proposed Habitat use. Gomez said the leased
space would include an overhead door.
('LOSING STATEMENT BY PETITIONERS
Attomey Young said that the Petitioners hoped that the Board will consider their request and recommend
approval to the City Council.
Chairman Semrow said, "there being no further testimony before this Board with regard to this matter,
the Board will consider the Petition at this time, unless there is a modon to recess by a member of the
Board. There being no motion to recess, the Chair will entertain a motion with regard to the Petition."
DELIBERATION AND RECOMMENDATION
Motion by McClatchey, seconded by Tobeck to recommend to the City Council that
the Petitioners' request for a conditional use permit to allow the construction and operation of
the not-for-profit Habitat office and storage facility on the subject premises be granted; and that
the Approval Criteria for Conditional Uses, Table 31, page 357-358 of the Zoning Ordinance
have been met.

SUMMARY
� The Petitioners are requesting that the subject property be granted a Use Variance to permit the
construction and ��peration of a three-bay oil change facility on the site. The property is currendy
classified C3 Community Commercial.
MOTION TO RECES
Modon by Tobeck, seconded by Christensen to recess this hearing until Monday, February 19, 1996,
7:3Q p.m. and that the following informadon be submitted for review by the Board at least fifteen days
prior to that date:
1) Provide a survey of existing trees on the subject property, especially a11 pine trees;
2) Designate all abutting properties on site plan, including locadon of exisdng single family
residences;
3) Provide elevation drawings for all exterior walls;
4) Provide landscape plan including means of screening to west of subject property; inclade
calculations indicating that at least 10% of parking area is landscaped;
5) Provide location of all exterior doors of building on site plan;
6) Indicate location of all service bays, including cellular telephone facility service bay;
7) Provide impact on McCullom Lake Road in traffic study; provide projected traffic count entering
and leaving site from McCullom Lake Road; impact on east bound traffic on McCullom Lake
Road;
8) Provide iane configuration on site plan showing McCullom Lake Road, both lanes going east,
including stacking room;
� 9) Reduce the mouth of the access drive at rear of development so that two-way traffic is not
possible.
