Chairman Semrow c:alled the hearing to order at 7:44 p.m. The following persons were in attendance: 1. Zoning Board Members: George Cadotte, Randy Christensen, Paula Ekstrom, John Howell, Jon Meyer, Harry Semrow. Absent: Chuck Lovett. 2. Attorney for Zoning Board: David McArdle. 3. Recording Secretary: Kathleen M. Kunzer 4. City Planner: Phillip Maggio. 5. Petitioner: LaSalle Bank, F.S.B., 135 South LaSalle Street, Chicago, Illinois 60603, „� represented by Robert Lyon & Associates, Inc. 6. Attorney for Petitioner: None. 7. NOTICE OF PUBLICATION Notice of this hearing was published in the Northwest Herald on August 19, 1998. Publisher's Certificate of Publication is on file with regard to this matter in the City Clerk's Office. Notices were mailed to all owners of record of abutting properties. The subject property was posted as required by the Zoning Ordinance. An Affidavit of Service is on file with the City Clerk. LOCATION The subject property is located at the northeast corner of Richmond Road and McCullom Lake Road in the Outlot of the McHenry Commons Shopping Center. SUMMARY The Petitioners are requesting the granting of a Conditional Use Permit to allow a drive-through � banking facility on the subject property. , , Page 2 ZBA-LaSalle 9/14/98 TESTIMONY � Chairman Semrow swore in the following witnesses for the Petitioners: 1. Susan Dale, Local Bank Manager, LaSalle Bank. 2. Robert G. Lyons & Associates, Architect. 3. Hemant Shah, Project Architect for Robert G. Lyons & Associates, Inc. Mr. Lyons stated the Petitioners have met all of the Approval Criteria for the granting of a Conditional Use Permit. If there are questions of the Board, he is prepared to respond to them. QUESTIONS OF THE PETITIONER BY MEMBERS OF THE BOARD Meyer asked with regard to the Site Plan, would there be direct ingress/egress from either McCullom Lake Road or Route 31 to the facility. Lyons stated access would be through the existing entrances to the shopping center. There would be no direct access to this site from Route 31 or McCullom Lake Road. Christensen asked who would be responsible for snow removal. Dale responded if this was not taken care of by the Shopping Center, the bank would take care of snow removal. Christensen expressed concern regarding vision clearance when snow was pile from the lot. Christensen asked if storm water would be detained at the area detention basin to the east of Target. Maggio responded this property has been included in the regional detention plan and would drain to the Target Detention Basis. This would be verified by the City Engineers. Semrow went over the Approval Criteria for Conditional Use Permits as stated in the Petition. � Chairman Semrow stated, "there being no further testimony before this Board with regard to this Petition, the Board will consider this Petition at this time, unless there is a motion to recess by a member of the Board. There being no motion to recess, the Chair will entertain a motion with regard to the Petition." DELIBERATION AND RECOMMENDATION Motion by Meyer, seconded by Christensen, to recommend to the City Council that the Petitioner's request that the subject property be granted a Conditional Use Permit to allow a financial institution with a drive-through facility; and that Table 31, The Approval Criteria for Conditional Uses, Pages 357-358 of the Zoning Ordinance have been met. Voting Aye: Cadotte, Christensen, Ekstrom, Howell, Meyer, Semrow. Voting Nay: None. Not Voting: None. Abstaining: None. Absent: Lovett. SUMMARY The Petitioners are requesting the granting of a reclassification from RS-3 to C-3 Community Commercial Zoning District TESTIMONY Attorney Zanck stated the Petitioners are currently in the process of ineeting with residents of the neighborhood in an effort to ally their concerns reference this project and asked for a recess until 7:30 p.m. on Monday, October 19, 1998. MOTION TO RECESS Motion by Meyer, seconded by Ekstrom, to recess this hearing until 7:30 p.m. on Monday, October 19, 1998 in the City of McHenry Municipal Building Council Chambers.
