ZONING BOARD OF APPEALS TO THE
CITY COUNCIL, CITY OF MCHENRY, ILLINOIS
A Public Hearing on the above-captioned Petition was held on November 15, 1999.
Chairman Semrow called the hearing to order at 7:33 p.m. The following persons were
in attendance:
1. Zoning Board Members: Steve Doherty, Paula Ekstrom, Jon Meyer, Harry
Semrow. Absent: George Cadotte, Darick Franzen, John Howell.
2. Attorney for Zonin� Board: David McArdle.
3. Recording Secretary: Kathleen M. Kunzer
4. City Planner: Phillip Maggio.
`-- 5. Petitioner: John Dierker, 5502 Windhaven Trail, McHenry IL 60050.
6. Attorney for Petitioner: None.
7. City Council Members/Staff: Code Compliance Inspector Dunne.
8. Court Reporter: None.
9. Registered Observers/Objectors: None.
NOTICE OF PUBLICATION
Notice of this Public Hearing was published in the Northwest Herald on October 28,
1999. Notices were hand delivered to abutting property owners. Certificate of
Publication and an affidavit of notification are on file in the Office of the City Clerk.

The subject property is located 5502 Windhaven Trail, McHenry IL 60050.
SUMMARY
The Petitioner is seeking a variation as to the corner sideyard setback requirements
of the ordinance to permit a 1.5 foot encroachment.

TESTIMONY
`- Chairman Semrow swore in the following witness for the Petitioner:
■ John C�ierker, .
Mr. Dierk?r stated he is seeing a variance to permit the construction of a masonry
fireplace and chimney on his property. The fireplace chimney, if constructed, would
encroach 1.5 feet into the required corner sideyard. The variance requested is to
permit this 1.5 foot encroachment.
QUESTIONS BY MEMBERS OF THE BOARD
There were no questions by members of the Board.
Chairman Semrow stated, "there being no further testimony before the Board with
regard to this Petition, the Board will consider the Petition at this time, unless there
is a motion to recess by a member of the Board. There being no motion to recess, the
Chair will entertain a motion with regard to the Petition."
DELIBER7ATION AND RECOMMENDATION
Motion b}- Meyer, seconded by Ekstrom, to recommend to the City Council that
The Petitioner's request for a variance to permit a 1.5 foot corner sideyard
setback encroachment to atlow for the construction of a masonry fireplace and
chimney be granted; and that Table 32, the Approval Criteria for Variances,
�- pa�es 377-378 of the Zoning Ordinance, has been met.
Voting Aye: Doherty, Ekstrom, Meyer, Semrow.
Voting Nay: None.
Not Voting: None.
Abstaining: None.
Absent: Cadotte, Franzen, Howell.
Motion carried 4-0.
ADJOURNMENT
Chairman Semrow stated, there being no further business before the Board with
regard to this matter, this Hearing is adjourned at 7:38 p.m.
