Motion by Ekstrom, seconded by Cadotte to appoint John Howell temporary Chairman of the Zoning Board of Appeals. Voting Aye: Cadotte, Doherty, Ekstrom. Voting Nay: None. Not Voting: None. Abstaining: Howell. Absent: Franzen, Meyer, Semrow. Motion carried 4-0. � Temporary Chairman Howell called the hearing to order at 7:30 p.m. The following persons were in attendance: 1. Zoning Board Members: George Cadotte, Steve Doherty, Darick Franzen <arrived at 7:38 p.m.), Paula Ekstrom, John Howe11. Absent: Meyer, Semrow. 2. Attorney for Zoning Board: David McArdle. 3. Recording Secretary: None. 4. City Planner: Phillip Maggio. 5. Petitioner: Tom Carey, Carey Electric, 3309 Waukegan Road, McHenry I L 60050. 6. Attorney for Petitioner: Cowlin and Cowlin, represented by Jim Cowlin, 4108A West Crystal Lake Road, McHenry IL 60050. 7. City Council Members/Staff: None. 8. Court Reporter: None. � 9. Publisher's Certificate of Publication is on file with regard to this matter in the City Clerk's Office. Notices were mailed to abutting property owners. An affidavit of service via certif�ed mailing is on file in the Office of the City Clerk. L�CATION The location of the subject property is 3309 West Waukegan Road, McHenry. SUMMARY The Petitioners are requesting the subject property be granted a variance to permit a 0' sideyard setback along the east property line. TESTIMONY Temporary Chairman Howell swore in the following witnesses for the Petitioners: 1. Tom Carey, 3909 West Waukegan Road, McHenry Il. 60050 2. Rick Watson, Condor Construction. Petitioner Carey stated the subject property is owned by Harris Bank Trust No. 1167. He stated the Carey Family, owners of Carey Electric industrial electric contractors, are beneficiaries of the trust. Carey Electric has been in business since 1923. The `„ subject property is currently zoned 0-1 Local Office District. The building located at 3309 West Waukegan Road contains both business offices and storage of electrical materials and trucks. The main office is located at 3407 West Waukegan Road. The building located at 3309 West Waukegan Road was constructed in 1958. The Petitioners own the adjacent property to the south and west of the subject property. The property to the east is owned by Ken Bruce and is the site of the Riviera Yacht Basin Marina. Attorney Cowlin noted the property to the east would be impacted by the Petitioner's request as it abuts the proposed 0' setback. The Petitioner stated he has spoken with Mr. Bruce regarding the proposed variance. Petitioner Carey stated the use of the property would not change if the variance is granted. QUESTtONS BY MEMBERS OF THE BOARD Ekstrom asked the exact location of the proposed addition on the property. Mr. Watson stated the addition would extend 80' to the south of the existing building. CLOSING STATEMENT BY PETITIONER Attorney Cowlin asked the Board to recommend the variance be granted for a 0' setback on the east property line as stated in the Petition. Temporary Chairman Howell said, "there being no further testimony before the Board L, with regard to this matter, the Chair will entertain a motion with regard to the Petition, unless there is a motion to recess by a member of the Board. There bein� no motion to recess, the Chair will entertain a motion with regard to this Petition." Page 3 � ZBA-Carey 4/3/00 � DELIBERATION AND RECOMMENDATION Motion by Doherty, seconded by Cadotte, to recommend to the City Council that the Petitioners' request for a variance to permit a 0' setback along the east property line, to allow an 80' addition to the existing building located at 3309 West Waukegan Road; and that Table 32, the Approval Criteria for Variances, pages 377-378 of the Zoning Ordinance, has been met. Voting Aye: Cadotte, Doherty, Ekstrom, Franzen, Howell. Voting Nay: None. Not Voting: None. Abstaining: None. Absent: Meyer, Semrow. Motion carried 5•0. ADJOURNMENT Motion by Cadotte, seconded by Doherty, to adjourn the hearing at 7:50 p.m. Voting Aye: Cadotte, Doherty, Ekstrom, Franzen, Howell. � Voti ng Nay: None. Not Voti ng: None.
