REPORT OF THE
ZONING BOARD OF APPEALS TO THE
CITY COUNCIL, CITY OF MCHENRY, ILLINOIS
A Public Heazing before the City of McHenry Zoning Board of Appeals was held on Monday,
November 20, 2000. Chauman Semrow called the Heazing to order at 7:30 p.m. with the
following in attendance:
1. Zoning Board of Appeals Members: Cadotte, Ekstrom (arrived at 7:35 p.m.), Franzen,
Lovett,Meyer(arrived at 7:35 p.m.), Semrow. Absent: Howell.
2. City Attorney: David W. McArdle.
3. Recording Secretary: Deputy Clerk Kathleen M. Kunzer.
4. City Planner: Phillip Maggio.

PUBLICATION
Notice of this Public Hearing was published in the Northwest Herald on November 4, 2000.
Notices were mailed to all abutting property owners. Certified receipts are on file in the Office of
the City Clerk. The subject property was posted as required by ordinance.
LOCATION
The subject property is located at 917 North Front Street, McHenry IL.
SUMMARY
■ The Petitioner is seeking a conditiona.l use permit to allow an open sales lot for the

TESTIMONY
Chairman Semrow swore in the following witness for the Petitioner:
■ Bernie Matchen, 3808 West Maple Avenue, McHenry IL 60050.
Mr. Matchen stated three years ago he closed his automobile repair, sales and service business at
917 North Front Street. He leased the property to another business. Mr. Matchen stated he would
like to re-establish his business at this location. He stated the current zoning of the subject
property is C-5 which would permit an open sales with the granting of a conditional use permit.
Board Members Meyer and Ekstrom arrived at 7:35 p.m.
QUESTIONS BY MEMBERS OF THE BOARD
Chairman Semrow asked if the sign/light pole would remain on the south property line. Mr.
Matchen responded he did not intend to remove the pole. Semrow asked where on the property
the display area would be located for the open sales lot. Mr. Matchen noted the portion of the
property in front of his building would be dedicated to the display of vehicles. Semrow asked the
distance between the southern wall of the building and the south property line. Mr. Matchen
responded 25'-30'. In response to Chairman Semrow's inquiry, Mr. Matchen stated he has no
plans to alter the building structu.re on the subject premises. Semrow noted Staff has
recommended a fence be installed along the south property line to assure automobile placement
on Mr. Matchen's property. Mr. Matchen stated he is opposed to the installation of a fence as it
� would restrict an already small commercial lot which has only a 60' frontage on Route 31.
In response to Staff inquiry, Mr. Matchen stated he would prefer the conditional use permit be
granted to the property and not specifically to him and/or his business.
Meyer inquired if the residence is located on the subject property. Mr. Matchen responded the
residence is on another lot which was previously sold off from the subject property.
Discussion followed regarding the installation of a fence along the south property line to prevent
bleeding over of vehicles onto the adjacent property. Mr. Matchen noted he has never hindered
. on-site tr�c flow to adjacent properties.
In response to Meyer's inquiry, Mr. Matchen stated approximately 60-70% of his business would
be wholesale in which vehicles would be sold at auction. The remainder would be retail sales. In
response to an inquiry regarding the access to Route 31 from the site, Mr. Matchen said the
access drive would not be changed.
Cadotte inquired if parking spaces would be striped for potential shoppers. Mr. Matchen replied
in the negative stating he did not anticipate much retail sales traffic on the lot. Meyer asked if
additional parking lot lighting is contemplated. Mr. Matchen responded no additional lighting
would be installed. Cadotte asked if the display area would be paved. Mr. Matchen responded the
lot is paved.

�-- Chairman Semr��w stated, "there being no further testimony before the Zoning Board of Appeals,
the Chair will eritertain a motion with regard to the Petition, unless there is a motion to recess by
a member of the Board. There being no motion to recess, the Chair will entertain a motion
regazding this Petition". �
DELIBERATION AND RECOMMENDATION
Motion by Meyer, seconded by Franzen, to recommend to the City Council that
The Petitioner's request for a conditional use permit to allow an open sales lot for the sale
of automobiles l�e granted; and that Table 31, the Approval Criteria for Conditional Uses, pages
357-358 of the�;oning Ordinance, has been met.
DISCUSSION ON MOTION
In response to �taff inquiry, Chairman Semrow noted the Petitioner would prefer to have no
restrictions attached to the granting of the conditional use with regazd to property ownership.

Voting Aye: Cadotte, Ekstrom,Franzen, Lovett,Meyer, Semrow.
Voting Nay: None.
Not Voting: None.
Abstained: None.
Absent: Howell.
