A Public Hearing before the City of McHenry Zoning Board of Appeals was held on Monday,
June 4, 2001. Chairman Semrow called the Public Heazing to order at 7:50 p.m. with the
following persons in attendance:

Semrow. Absent: Meyer.

Notices were mailed to all abutting property own.ers and the subject property was posted as
required by City ordinance. An affidavit of service is on file in the Office of the City Clerk.
LOCATION
The s roperty is located at 502 S. Route 31, is currently improved with a vacant single
family dwelling, and zoned Agriculturai pursuant to the McHenry County Zoning Ordinance.
SUMMARY
The Petitioner is requesting reclassification from A1 Agricultural to CS Highway Commercial
upon annexation to the City of McHenry.
TESTIMONY

Chairman Semrow swore in the following witnesses for the Petitioner:

Ms. Swierk stated she is seeking CS Highway Commercial Zoning upon annexation to the City.
It was noted there is a vacated residence currently on the site. It is the intent of the Petitioner to
demolish the residence and convert the site for additional parking for Direct Design and/or white
Hen Earpress, as well as providing access between the three lots. Upon the demolition of the
residence, it is the intent of the Petitioner to close the curb cut onto Route 31. There would no
�`— longer be direct access to Route 31 from this lot.

\.. QUESTIONS BY MEMBERS OF THE BOARD
Lovett asked if the subject properry would be utilized to provide an internal connection between
White Hen Express and Direct Design. Ms. Swierk responded in the affirmative. In response to
Board inquiry, Ms. Swierk noted the subject property would be filled to bring the elevation
closed to the adjacent pazcels, Direct Design and White Hen Express. Onsite detention will be
provided.
In response to Board inquiry, Ms. Swierk noted there will be a frontage-type roadway between
the three parcels to create better internal traffic flow on these three properties. Howell inquired if
the site would then be landscaped. Ms. Swierk affirmed the landscaping would be done in
keeping with that already installed on Direct Design and White Hen E�ress properly.
In response to Franzen's inquiry, Ms. Swierk stated the traffic pattern at the east boundazy of the
three properties will be one-way from south to north.
CLOSING STATEMENT BY PETITIONER
In closing, Ms. Swierk asked the Boazd to recommend the reclassification of the subject praperty
from A1 Agricultural to CS Highway Commercial upon annexation to the City of McHenry.
Chairman Semrow said, "there being no further testimony before the Board with regard to this
ma.tter, the Board will consider the Petition at this time, unless there is a motion to recess by a
member of the Board. There being no motion to recess, the Chair will entertain a motion with
� regard to this Petition."
DELIBERATION AND RECOMMENDATION
Motion by Franzen, seconded by Howell, to recommend to the City Council that
The Petitioners request for reclassification to CS Highway commercial Zoning District
upon annexation to the City of McHenry be granted; and that Table 33, the Approval
Criteria for Map Amendments,page 401 of the zoning ordinance, has been met.

LOCATION
The subject property is located at 2205 North Richmond Road, Lot 8 of Meijer/Home Depot
subdivision, currently vacant and zoned CS Highway Commercial
SUMMARY
The Petitioners are requesting the granting of a conditional use permit to allow a fmancial
institution with a drive-through facility on the subject premises.
TESTIMONY
Chairman Semrow swore in the following witnesses for the Petitioners:

`, Attorney Curran stated the subject property is located within Rubloff's Meijer/Home Depot
Subdivision on the west side of Route 31. It is currently zoned CS Highway Cornmercial.

� Attorney Curran noted Crystal Lake Bank and Trust has branched out into McHenry and has
opened a temporary facility at 3322 West Elm Street. The bank is anticipating moving into a new
permanent fac;ility on the subject premises at 2205 North Richmond Road. The request this
evening is for a conditional use permit to allow a drive through facility on the site.
Ms. Diana Malacar, architect, stated the proposed building is 10,000 square feet in size. It would
be a one-story bank facility and include three drive-through lanes. The third lane furthest away
from the building would also have an ATM machine. Ms. Malacar stated adequate pazking and
stacking room have been provided on the site plan. T'here will be no direct access from Route 31.
Customers will gain entry on the west side of the lot, internally from the Meijer/Home Depot
Subdivision. Ms. Ma.lacaz noted 27% of the site would have landscaping. Surface water runoff
will drain to the large detention pond on Miejer's property.
Attorney Curran went over the approval criteria for conditional uses as stated in the text of the
Petition.
Mr. Phillip Oeffling, President of McHenry Bank and Trust, an affiliate of Crystal Lake Bank
and Trust, stated the McHenry Bank and Trust hopes to bring a hometown flavor to McHenry
residents. He noted there are currently 6 employees, each with a vast amount of local banking
experience.
QUESTIONS BY MEMBERS OF THE BOARD
In response to Board inquiry, Mr. Oei�ling stated bicycle parking would be provided. Ekstrom
� asked the purpose of the basement. Mr. Oei�ling responded the basement would be utilized for a
vault, storage, mechanical equipment, employee lounge, safe deposit boxes, and community
room.
Chauman Semrow said, "there being no further testimony before the Board with regazd to tlus
matter, the Board will consider the Petition at this time, unless there is a motion to recess by a
member of the Board. T'here being no motion to recess, the Chair will entertain a motion with
regard to this Petition."

Motion by Lovett, seconded by Cadotte,to recommend to the City Council tha.t
The Petitioners request for a conditional use permit to a11ow a drive-through facility on
the subject premises be granted; and that Table 31, the Approval Criteria for Conditional Uses,
pages 357-358, has been met.

Hardware at the southeast corner of the intersection of Crystal Lake Road and Elm Street.
SUMMARY
The Petitioner is requesting a conditional use permit to allow outside storage of construction
equipment. The property is currently zoned I1 Industrial.
TESTIMONY
Chairman Semrow swore in the following witnesses for the Petitioner:

Attorney Gottemoller stated the Petitioners aze requesting a conditional use permit to allow
� outdoor storage of construction materials at 4030 West Main Street. He noted Portable Tool

� presented a request before the Zoning Board on March 20, 2000 for a location adjacent to Knox
Pazk on Route 31. Subsequently, the Petitioner never went forward with implementing the
conditional use on that property. Since that time, Portable Tool has purchased the subject
property and is hereby requesting the granting of the conditional use on this property at 4030
West Main Street.
Attorney Gottemoller noted the surrounding uses, each of which include outside storage without
screening from adjacent properties. He pointed out the Petitioners, as per Staff recommendation,
would be required to screen the outside storage from visibility at the street. This appears to be
inconsistent with existing conditions on adjacent properties, especially since abutting properties
are all either commercial or industrial zoning districts.
Attorney Gottemoller went over the Approval Criteria for Conditional Uses as stated in the
Petition.
QUESTIONS BY MEMBERS OF THE BOARD
In response to Board inquiry, Attorney Gottemoller stated there would be no refueling of
equipment on the premises. Servicing of vehicles and equipment would be done inside the
buildings on the premises. In response to further inquiry, Ms. McKevitt stated waste oil will be
stored in 55-gallon drums and will be removed from the premises by a licensed waste hauler.
A lengthy discussion occurred regarding the slatted fencing inserts versus no slatted fencing
inserts to accommodate screening requirements of the City codes.

In response to Boazd inquiry, the Petitioner responded access to the site would be gained solely
from Main Street. Further discussion ensued regazding the portion of the property boundazy
which should be screened from public view. It was the consensus of the Boazd there should be
some screening along Crystal Lake Road. The Board suggested screening up to the northwestern-
most point of the northern building along the Crystal Lake Road property line.
Franzen suggested the grassy/gravel area along Main Street be paved. In addition to the six
conditions of approval suggested by Staff in the Agenda supplement, the Board suggested
including the paving of the grassy/gravel azea in addition to prohibiting direct access from the
site onto Crystal Lake Road .
CLOSING STATEMENT BY PETITIONER
In closing, Attomey Gottemoller asked the Board to recommend the granting of a conditional use
permit on the subject property and note that all approval criteria have been met.

member of the Board. There being no motion to recess, the Chair will entertain a motion with
regard to this Petition."
DELIBERATION AND RECOMMENDATION
� Howell stated he could not support the granting of the conditional use permit as the City has a
unique opportunity to improve the area, specifically along Route 120. He stated he would vote

� nat so the City could have the opportunity to bring something more aesthetically pleasing to this
location.
Motion by Cadotte, seconded by Lovett,to recommend to the City Council that
The Petitioners request for a conditional use permit to allow the outside storage of
constr��ction equipment be granted subject to the following:
■ A detailed plan be provided for the installation and maintenance of screening
(landscaping, wood or chain-link fence with nylon privacy mesh) along Crystal Lake
Road to Staff for review prior to final approval. The screening shall e�ctend at least
13:� feet to the north of the principal building along Crystal Lake Road, as depicted on
the latest site plan included with the application.
■ Outdoor storage shall be limited to particular types of equipment, as defined by the
applicant prior to final approval, and shall not include bulk material or inoperable
equipment.
■ All equipment service shall be performed within enclosed buildings, and shall not be
permitted in the outdoor storage area.
■ No equipment refueling shall be conducted on the property; all fueling shall be done
at off-site locations.
■ Direct access to the property from Crystal Lake Road shall be prohibited.
■ The graveUgrass area at the southeast corner of the property along Main Street shall
be paved within 120 days of approval;
and that Table 31, the Approval Criteria for Conditional Use Permits, pages 357-358 of
the zoning ordina.nce, has been met.
