Building & Zoning Committee members present: Chairman Baird and Alderman Bates. Also present were
Director of Building & Zoning Lobaito and City Administrator Peterson.
Resident Observers: Norm Lewis, 910 Bonita Lane, McHenry
Todd Claver, 3219 West Beach Drive, McHenry
Topics of discussion:
1. Building Permit Fees
An "across the board" increase of 50% on all building permit fees was considered by the Committee.
It was noted that the current fee structure is not supporting the Building and Zoning Department. Sorne
adjustment were made; recommendation is attached.
Committee Recommendation: The Committee recommends the City adopt the proposed fee schedule
attached.
2. Monotony Codes
Chairman Baird began the discussion by introducing the two.Resident Observers. He explained they
� were both residents of McHenry Shores and came to talk to the Committee about American Heritage
Development Corporation (Dave Backhaus) and the houses he was currently building in the
neighborhood. The residents feel that too many houses very similar in design and appearance are being
built in McHenry Shores, specifically Bonita Lane. The two residents asked the Committee if there was
anything the City could do to enforce a monotony code to prevent this from continuing throughout
the City.
After listening to the residents' concerns Chairman Baird asked Director Lobaito to relay his experiences
with monotony codes. Lobaito referred the Committee to the hand-out included in the meeting packets
with various monotony codes from around the area. He explained that these codes are typically worded
rather loosely. He said appearance was a very subjective thing, what may be acceptable to one is totally
unacceptable to another. This being the case, it is very hard to enforce a monotony code. He then told
the two resident observers that while he understood their concerns, the houses on Bonita Lane look
quite different from each other. Some garages are up; some back. Some houses have shutters; some do
not. Some of the homes have different roof lines. Lobaito stated that the City would be treading on
thin ice if they tried to start telling builders which color to pick for each house. Director Lobaito also
explained how difficult it would be to keep track of all the different colors, styles, elevations and
location of each new house. It would be virtually impossible.
Lobaito told the Committee and resident observers that he did speak to Dave Backhaus and informed
him of the neighborhood's concerns regarding this issue.
� Chairman Baird expressed his understanding of the residents' situation stating that as more and more
people look to buy a home in that neighborhood they will see the similarities and maybe this will stop
the builders from building the same model over and over again.

Alderman Bates said he also understood the residents' position, however, he explained that a single
builder usually does not have four or five models to choose from when he builds a home. Cities such
as Buffalo Grove have subdivisions built by very large building companies who have a much larger
selection.
Chairman Baird asked the Committee's opinion regarding the example monotony codes. Baird stated
he preferred Buffalo Grove's code. Primarily paragraph 3a., Identical Models with Identical Front
Elevations.
Alderman Bates stated he also preferred Buffalo Grove's code, however, he would like the phrase "or
similardesign"taken from Mundelein's code and somehow incorporated into Buffalo Grove's code; along
with the last sentence, "No building, residence or dwelling unit shall be erected which would be of the same
design or similar design as the residence or dwelling unit directly across the street therefrom. "
Chairman Baird questioned how this code could be enforced, and what would happen if there was a
challenge. Administrator Peterson said Director Lobaito would make all determinations regarding
monotony code compliance. If a builder desired to challenge his decision, or disagreed with an
interpretation, Lobaito would take this challenge to the Z ' s who would in turn
render a report and recommendation to the City Council. ��� �w� �^� �
Administrator Peterson suggested Director Lobaito invite the builders in town to a meeting to give the
`- Committee their comments on the proposed monotony code.
Chairman Baird suggested the City mail copies of the proposed code to the builders and ask for written
comments from them as well.
The Aldermen agreed that the meeting with the builders will be held before the Committee prior to
meeting with City Council.
Director Lobaito said he will call Dave Backhaus from American Heritage Development Corporation
again and see if they can come up with a solution to the concerns of the residents of McHenry Shores.
Committee Recommendation: The committee asked Director Lobaito to put together a monotony code
for the City of McHenry using a combination of the preferred phrases from the Buffalo Grove and
Mundelein codes. Directo"r Lobaito will contact Chairman Baird regarding a date for the next Building and
Zoning Committee Meeting.
Meeting was adjourned at 9:30 p.m.
