HomeMy WebLinkAboutMinutes - 8/19/1998 - Community Development Committee '� COMMUNITY DEVELOPMENT COMMITTEE MINUTES August 19, 1998 Memk�ers Present : Chairman Alderman McClatchey, Alderman Bolger, Alderman Murgatroyd arrived at 7 : 15 p.m. Others Present : Mayor Cuda, City Clerk Althoff, City Administrator Lobaito, Director of Community Development Napolitano, Alderman Glab, David Backhaus of American Heritage and Roger Gerstad of Gerstad Builders Community Development Committee Chairman Alderman McClatchey called the meeting to order at 7 : 02 p.m. He noted this evenings meeting would be to continue discussion regarding the Gerstad Builders sign at the U. S . Route 120 and Crystal Lake Road intersection. GERSTAD BUILDERS ADVERTISING SIGN AT U.S. ROUTE 120 AND CRYSTAL LAKE ROAD � City Administrator Lobaito reminded the committee the status of this advertising sign had been discussed by the City Council at meetings in March and April of 1998 . The Council denied Gerstad Builder' s request for an off-site temporary sign for the Boone Creek Subdivision, however no formal action was taken regarding the existing advertising sign at U. S . Route 120 and Crystal Lake road. Gerstad Builders changed the advertising copy of the sign to promote Boone Creek Subdivision as opposed to the original advertising copy for the Trails of Winding Creek Subdivision. The sign at Route 120 and Crystal Lake road was permitted under the terms and conditions of the original Backhaus/Brackmann annexation agreement in 1979 . This agreement was valid for ten years and due to litigation was extended to September 12 , 1996 . In 1992 the City of McHenry entered into negotiations to amend the original annexation agreement . The amended agreement was approved and executed on June 11, 1992 . City of McHenry Staff opines the amended agreement contains no provisions for the display of this advertising sign. Mr. Gerstad contends the amended agreement approved in 1992 extends the life of the original agreement which contains provisions for the display of an advertising sign at this location. Some discussion followed. Mayor Cuda reminded the committee Mr. Gerstad had verbally agreed � to removing the sign if Council would grant an 18-month e�tension. Community Development Committee Meeting Minutes � August 19, 1998 Page Two Mr. Gerst:ad made the following two proposals : 1-tc> remove the sign by July 31, 1999 In response to the committee' s inquiry, Mr. Gerstad explained the July date corresponded to the typical home buyers market between March and June . OR 2-to remove the sign within a specified period of time subject to the council' s granting of two 8'x 8' signs advertising both AmeYican Heritage and Gerstad Builders developments one to be located at the Crystal Lake and Bull Valley Road intersection and one to be located at the Draper and Route 120 intersection. In respor.se to council inquiry, Mr. Backhaus of American Heritage Homes stated his support of the proposal . Some discussion followed. Alderman Murgatroyd arrived at 7 : 15 p.m. Chairman Alderman McClatchey updated Alderman Murgatroyd reiterating Mr. Gerstad' s sign propcsals . � In response to Chairman Alderman McClatchey' s inquiry, Director Napolitano stated the City of Crystal Lake and the Village of Algonquin did not permit off-site advertising signs for developers . Alderman Glab recommended prohibiting any mention of Dartmoor Avenue and Crystal Lake Road as entrance routes to the developments . He stated he' d support proposal number two subject to this c�ndition. In response to further discussion Mr. Gerstad and Mr. Backhaus agreed to double sided signs at both locations . Some discussion followed �n the timeframe needed to remove the advertising sign at U. S . R�ute 120 and Crystal Lake Road. It was the consensus of the committee to stipulate the signs removal by no later than October l, 1998 . In response to Alderman Glab' s request the committee agreed to permit Mr. Backhaus replace his 4' x 8' temporary sign at the northwest corner of Bull Valley and Crystal Lake Road until the two new 8 ' x 8' signs were installed. � Communit�T Development Committee Meeting Minutes � August 12 , 1998 Page Three Motion by Bolger, seconded by Murgatroyd to recommend to full council the approval of a sign request permitting two 8 ' x 8' double sided signs advertising both Gerstad Builders and American Heritage Boone Creek Subdivision to be renewed on an annual basis, one to be located at the intersection of Crystal Lake Road and Bull Valley, the other to be located at the intersection of Draper Road and U.S . Route 120 subject to: .no reference to either Dartmoor Road or Crystal Lake Road as entrance vehicles to the subdivision . the removal of the advertising sign at U.S . Route 120 and Crystal L�ke Road no later than October 1, 1998 . the installation of a 4 ' x 8' American Heritage temporary advertisi�g sign at the intersection of Bull Valley Road and Crystal Lake Road to be removed no later than October 1, 1998 . a minimum one time notification to be served to both developers if either sign is in violation of city maintenance requirements prior to the denial of the annual renewal permit based on the violation of the maintenance requirements. Mr. Gerstad requested the committee rescind the $25 code violation ticket issued Gerstad Builders on Friday, August 14 , 1998 . Ch�iirman Alderman McClatchey stated the matter would be presented to full council for consideration and action.
