HomeMy WebLinkAboutMinutes - 5/21/2001 - Community Development Committee COMMUNITY DEVELOPMENT COMMITTEE MEETING Wednesday, May 21, 2001 Aldermen Conference Room 6:30 p.m. `.- In Attendancc: Aiderman Glab, Aldernian Low, Alderman Wimmer, Alderman Murgatroyd, 11Tayor Althoff, Director of Community Development Napolitano, City Clerk Jones, City Attorney:VlcArdle, City Administrator Lobaito, Assistant Administrator Maxeiner Members of the Community in attendance: Donald Butler 903 Wiltshire Dr#2 The meeting was called to order by Chairman Alderman Wimmer at 6:34 p.m. Discussion regarding District 156 West Campus Ezpansion Project Chainman Alderman Wimmer invited comments from those in attendance regarding continuing the discussion��f open issues of the District 156 West Campus E�ansion Project. Alderman Glab opined that the District 156 West Campus Expansion Project brings into question limitations placed on the property at the time the West Campus property was platted as part of a Planned Unit Development (PUD}in 1965 by City ordinance. Discussion ensued concerning state statutes versus City ordinance and inquiry was made as to whether or not the issues concerning the berm and drainage had been concluded. It was determined thaz the berm and the drainage issues had been resolved. � Aldennan Glab stated that the driveway was still a concern and it is his contention that any peripheral roadway shouId follow due process. The school district should apply for zoning and be approved by the City of McHenry, like any other entity. The City Attorney noted tha.t in 1965 the school district was given a right to develop a large parcel of property. The City of McHenry controls zoning and the school district must be in compliance. It was opined that District 156 is in compliance because they are not making any amendments to the original agreement. Alderman Glab queried as to whether it was possible to give District 156 restrictive use of the street. The City Attorney stated that use cannot be restricted. Aldern�an Glab inquired about creating an ordinance. He stated that any changes in use of land is a zoning issue. The City Attorney opined that what District 156 wants to do is not a modification of the ordinance and does not violate their PUD. The zoning ordinance is not an issue and is not being changed. Issues concerning the driveway were discussed at length and it is the consensus that the driveway is an adjustment and not a zoning issue. It was opined that the other outstanding issues concerning District 156 have been resolved, that the only open issue concerns the driveway, and if so decided, the driveway issue should be the only item that returns to council for a vote. � Page 2 Community Development Committee May 21, 2001 L Some discussi��n occurred regazding the impact on the adjacent condos and the possibility of action to address any complaints. City Administrator Lobaito noted Staff is working with the School District regarding providing screening from adjacent properties for both East and West Campus facilities in light of current building projects and expansion of facilities. Director of Community Development Napolitano noted Sta.� will be reviewing the plans to be sure they comply with Czty ordinances, as far as water/sewer connections are concerned. Alderman Low opined that it is appazent that Staff is working elosely with the school district, Motion by Low, seconded by Wimmer that the Community Development Comrnittee take no action with regard to the District 156 Building Project. Voting Aye: Low, Wimmer. Voting Nay: Glab Absent: None. Motion carried. Motion by Glab, seconded by Wirruner to adjourn the meeting at 7:35 p.m. All Ayes. Motion carried.
