A brief discussion followed regarding the Roberts and Finkelstein Properties. Director Napolitano stated Staff is recommending that the newly approved Integrated Design District (IDD) be used to develop these properties. Using the IDD would provide diversity and a high- end product on this property, particularly the Roberts Property, which abuts the outflow of the Fox River. It was noted sf�veral parcels have not yet been designated. Discussion occuned resulting in the following suggestions: 1. north Riverside Drive adjacent to Johnsburg boundary—low density residential 2. north of'McCullom Lake Rd, south of Municipal designation—estate. Director Napolitano initiated discussion regarding the unincorporated property east of Crystal Lake Road. He suggested Council look at this area in depth in order to plan for future development as each of the parcels aze annexed to the City. He noted a Sub-Area Plan should be created for this segment of the Plan. The committee concurred. Motion by Glab, seconded by Condon, to direct Staff to make the approved modifications to the map, and to send the revised map to Council for review and direction. Building Code Update Director Napolitano stated in 2000 the City updated the codes used for all construction activity in the City by adopting the following codes: BOCA National Building Code: 1996 CABO One and Two-Familv: 1995 BOCA Fire Prevention Code: 1996 International Mecha.nical Code: 1996 National Electric Code: 1996 Illinois Sta.te Plumbing Code: Current Edition Int. Property Maintenance Code: 1998. Director Napolitano noted in order to stay cunent with newer building trends and evolving building technologies, Staff is recommending that the City again update our building codes as follows: International Building Code: 2000 Intemational Residential Code: 2000 Intemational Fire Code: 2000 Intemational Mechanical Code: 2000 National Electric Code: 1999 International Fuel Gas Code: 2000 Intemational Energy Consv. Code 2000 � Int. Properly Maintenance Code: 2000. Community Development Committee Meeting November 10, 2004 Page 3 � Director Napolitano informed the committee the following codes will remain in effect as they are mandated by the State of Illinois: Illinois State Plumbing Code: Current Edition Illinois Accessibilit�Code: Current Edition. As BOCA merged with the Intemational Code Council (ICC) in late 2000, the International Codes are now considered the industry standard. It is Staff's reco�nmendation the following timeline be followed in order to implement the new codes: • Apn 1 25 — Send out letter to builders, contractors, architects, etc. notifying of proposed upd�ites and requesting comments. • Ma} 6 — Complete review of codes and identification of major cha.nges and provide information to Committee. • Ma} 17 — Final Committee meeting to discuss changes and comments received. Finalize changes. • June 1 — Send completed ordinances and amendments to Illinois Building Commission for revi�w. By Statute, the City is required to receive the blessing from the Illinois Building Conunission before it can adopt new building codes. • July 6—City Council adopts new codes and amendments,with effective date of August 6 (30 a�ys>. Some discussion occurred regarding the possibility of requiring sprinkler systems in all residential construction. Director Napolitano noted the initial cost of installing the sprinkler � system is not nearly as expensive as the cost to maintain the system once it is installed. If the system is not maintained on a regular basis, it is useless, as the piping must be maintained in order to withstand the pressure of water in the system. In response to an inquiry, Director Napolitano stated building inspectors would be certified under the new codes. It was the consensus of the committee to proceed with the timeline for implementation of the new building codes as suggested by Staff. Teardowns-Preliminary Discussion, Issues and Overview Director Napolitano informed the committee the term"teardown" refers to the removal or tearing down of an older home and replacing it with a new, larger home on the site. He noted teardowns typically occur in villages or towns where there is a shortage of vacant land for development. Residents want to have a larger, newer residence without moving from the community. Teardowns are the result. Director Napolitano stated there are several approaches that communities use to address teardowns: 1. Performance Based Performance based standards are the visually related regulations. They usually consist of general statements that are guidelines rather than hard, fast rules. A reviewing authority, such as a Design Review Commissioq has the discretion to determine if a teardown meets the established performance � based standards on a case-by-case basis. Some typical guidelines include: Community Development Committee Meeting November 10, 2004 Page 4 `— + New homes should be harmonious with the scale and character of the neighboring buildings through the use of appropriate size, building materials, lighting and other arclutectural techniques. • Proposed homes should relate to the terrain and to the use, scale and proportions of the neighboring homes. 2. Zoning Based Zoning based regulations are those found in the Zoning Code such as the bulk requirements (i.e., height, setback, coverage, etc). • Requiring upper stories to be smaller than the ground floor. � Controlling the roof pitch based on building and lot characteristics. • Further restricting the building height,yard, lot coverage and FAR criteria. • Requiring side-load garages or grea,ter garage setback requirements. 3. Administrativ�Based Administrative based requirements can include: • Mandatory delay periods before a building can be demolished. • Notification of neighboring properties. • Establishing historic districts. • Requiring additional impact fees. � Director Napolitano stated the City should begin to develop a policy and procedures for teardowns. He noted any of the three methods or a combination derived from them could be used. He stressed it is important for the City to be proactive and create the policy and procedures before teardowns actually begin to occur in the City. Administrator Assistant Martin noted issues which should be considered when discussing strategies and policies include storm water runoff and drainage, maintenance during construction process, fencing to protect neighborhood. Discussion occuned regarding implementing the tree preservation ordinance with teardowns, specifically to prevern removal of large trees in the older part of town. Director Napolitano will work with Staf�to draft a set of teardown regulations for review and discussion by the committee at its nerct meeting.
