Derik Morefield, City Administrator McHenry Municipal Center 333 Green Street McHenry, Illinois 60050 Phone: (815) 363-2100 Fax: (815) 363-2119 dmorefield@ci.mchenry.il.us COMMITTEE OF THE WHOLE AGENDA SUPPLEMENT DATE: May 23, 2016 T0: Mayor and City Council FROM: Derik Morefield, City Administrator John Jones, Chief of Police Ross Polerecky, Director of Community Development RE: Introductory Information for Code Enforcement/Local Ordinance Violation Discussion Agenda Item Summary The Monday, May 23, 2016 Committee of the Whole meeting has been set aside for presentation and discussion regarding the code enforcement activities undertaken by the Department of Community Development and the local ordinance enforcement activities undertaken by the Police Department. Staff will also engage Council in attempt to identify and/or prioritize the code enforcement and/or local ordinance violation issues that are most prevalent community -wide or about which Council receives the most public comments. Code Enforcement The City of McHenry's Community Development Department recognizes the value of setting goals, developing priorities for our objectives and measuring the department's effectiveness. The Code Enforcement Division plays a vital role in maintaining aesthetics, encouraging community pride, preserving neighborhood integrity and protecting public health and the well being of all citizens. Director Polerecky will be presenting Council with more detailed information about the Department's code enforcement processes and objectives as part of Mondays meeting. The City of McHenry is dedicated to providing the citizens, businesses and visitors of McHenry with the highest quality of programs and services in acustomer-oriented, efficient and fiscally responsible manner. Local Ordinance Violations The McHenry Police Department utilizes local ordinance citations as a means to enforce many aspects of violations that the officer encounters on the street. Our means of enforcement, absent criminal complaints, utilized by the Police Department are: Written warnings. Used for minor violations by first time offenders in which we feel that the notice alone will change the behavior. Adjudication citations. Normally used for first time offenders. Adjudication citations provide offenders with an opportunity to correct behavior and to remain out of the state judicial system, keeping the infraction off of their records. Some examples of offenses are curfew, underage drinking/smoking, and minor retail theft complaints. Local Ordinance citations. These citations are sent to the 22"d Judicial District and can remain on an offender's record. Some examples of these violations are dogs running at large, underage smoking, small amounts of cannabis, and drug paraphernalia possession. Parking citations: The McHenry Police Department's parking enforcement is pretty straightforward. If an officer observes a violation, they will issue a citation and place it on the vehicle. If an officer observes a violation that is understood to fall under the enforcement responsibility of the Department of Community Development they (or their supervisor) will forward a short summary of the location and the suspected violation. If the situation necessitates an immediate response the officer can issue an ordinance violation for any code enforcement issue that cannot be forwarded for action at a later time. Chief Jones will be providing Council with a more detailed discussion of Local Ordinance Violations and the process for enforcing these violations at Mondays meeting. In preparation for the Monday, May 23rd Committee of the Whole meeting, Council is asked to prepare by considering the types of code enforcement and/or local ordinance violation issues for which they have received the most concerns from residents or witnessed themselves. A goal of Monday's meeting is to be able to provide staff with clearer direction regarding Council's expectations for code and local ordinance violation enforcement moving forward.
