HomeMy WebLinkAboutMinutes - 6/3/1998 - Public Works Committee PUBLIC WORKS COMMITTEE MEETING � June 3 , 1998 Members Present : Chairman Alderman Bolger, Alderman Baird, and Alderman Glab arrived at 7 : 06 p.m. Alderman McClatchey arrived at 7 :20 p.m. Others Present : City Administrator Lobatio, City Clerk Althoff, Director of Public Works Batt, Mayor Cuda, Matt Fiascone from Inland Real Estate Development The meeting was called to order by Chairman Alderman Bolger at 7 : 02 p.m. Chairman Alderman Bolger stated the purpose of this evening' s committee meeting was to consider Inland' s request to substitute Surety Bonds in place of the Letters of Credit required as part of the annexation agreements for both Olde Mill Pond Subdivision and Inland Business Park. In addition two stop sign re�uests on Oakwood at Kensington and on Oakwood at Royal � Drive would be considered. INLAND SURETY BOND SUBSTITUTION REQUEST AND WEST MCHENRY BYPASSE RIGHT-OF-WAY RESERVATION � Chairman Bolger noted in addition to Inland' s request for the substitution of surety bonds for Letters of Credit which are required as per Inland' s annexation agreements with the City of McHenry; the City of McHenry would like to amend the Business Park annexation agreement with regard to the reservation of right-of-way for the McHenry West Bypass as the annexation agreement deadline is July 20, 1998 . In response to Chairman Alderman Bolger' s inquiry, Mr. Fiascone opined a five year extension of the West McHenry Bypasse right- of-way reservation would be acceptable to Inland. Some discussion followed. It was the consensus of the committee to accept Inland' s offer of a five year extension for the reservation of property for the West McHenry Bypasse project . City Administrator Lobaito noted Council at their May 6 , 1998 regularly scheduled meeting deferred Inland' s request for the substitution of Surety Bonds for Letters of Credit to the Public Works Committee. Inland is making this request in response to Illinois Statute amendments requiring municipalities to accept other forms of surety for public improvements . If Letters of Credit were not specificied in the existing Annexation Agreements with Inland, Inland would be able, statutorially, to exchange the Letters of Credit for Surety Bonds . � Public Works Committee Minutes June 3 , 1998 � Page Two City Administrator Lobaito, in response to Alderman Baird' s inquiry stated City Attorney McArdle had drafted an acceptable Surety Bcnd form which includes provisions protecting the City' s ability to acquire these public improvement funds if necessary. Any monies expended by the City of McHenry in conjunction with the "calling" of the bonds, including legal fees, are reimbursable . Motion by Baird, seconded by Glab to recommend to full council both annexation agreements with Inland Land Appreciation be amended to permit the substitution of Surety Bonds for the required Letters of Credit for public improvements associated with the Olde Mill Pond subdivision and Inland Business Park as well as to amend the Inland Business Park annexation agreement to reflect an extension of five years until July 26, 2003 for the McHenry Bypass right-of-way reservation. Voting Aye : Bolger, Baird, Glab Voting Nay: None Absent : None Motion carried. In response to Alderman Glab' s inquiry, City Administrator � Lobaito stated the process for calling Surety Bonds is somewhat longer than Letters of Credit, however other contacted McHenry County municipalities who accept Surety Bonds have experienced no difficulties . Mr. Fiascone explained Surety Bonds are less stringent for developers . Financial institutions require developers to maintain deposits equal to the Letter of Credit amount which many times is millions of dollars . These monies are typically the funds earmarked to complete the required public improvements . Surety Bonds do not require this restrictive covenant . STOP SIGN REQUESTS Public Works Chairman Alderman Bolger deferred to Alderman Glab explaining these two stop sign requests were placed on the agenda at his direction. Alderman Glab explained both these stop sign requests were vocalized by Ward 2 Whispering Oaks constituents during the 1997 campaign. He noted the Whispering Oaks subdivision was approximately 30 years old and no significant changes have occurred with regard to additional traffic signals . Citing safety issues, Alderman Glab opined the requests for stop sign installations at both these intersections was valid. He stated road configuration, specifically the downhill slope and numerous dips encourages higher rates of speed. In addition the line of vision on Royal Drive is reduced due to the streets curvature . � Public Works Committee Minutes June 3 , 1998 `-' Page Three Alderman Baird stated his support for a stop sign at the Kensington and Oakwood interesection, however he expressed reservations with the installation of a stop sign on Royal Drive at Oakwood, just one block west of the Crystal Lake Avenue and Royal Drive intersection citing possible traffic congestion. Further discussion followed on the need to conduct traffic studies for these intersections. Director of Public Works Batt suggested including the Crystal Lake Avenue and Royal Drive intersection in the traffic studies approved. The committee concurred with his recommendation. The committee also requested information regarding accident reports for this area. Motion by Baird, seconded by Glab to recommend to full council the authorization of staff to conduct traffic studies at the following three intersections : -Oakwood and Kensington -Oakwood and Royal Drive -Crystal Lake Avenue and Royal Drive Voting Aye : Bolger, Baird, Glab � Voting Nay: None Absent : None Motion carried. Alderman Bolger informed the committee he had received a request for the installation of a stop sign at the intersection of Lillian and South Streets . He directed the constituant to submit a petition from area residents . Alderman Baird informed the committee he had received additional complaints regarding dumping at the south end of Cross Trail at Glenbrook. City Administrator Lobaito stated the Community Development Department was currently investigating this issue . Alderman �lab expressed concerns with the cost of maintenance, specifically mowing, for the property off Oakwood designated as a future creek crossing. He requested staff investigate this issue further. City Administrator Lobaito noted the Community Development Department was investigating the status of all City of McHenry vacated areas, stub streets, etc . � Public Works Committee Minutes � June 3 , 1998 Page Four Motion by Baird, seconded by Glab to adjourn the meeeting at 7 :29 p.m. Voting Aye : Bolger, Baird, Glab Voting Nay: None Absent : None Motion carried.
