FINANCE/PERSONNEL COMMITTEE MEETING
December 14, 1998

Finance Chairman Alderman Murgatroyd called the meeting to order at 6:33 p.m.
stating the purpose of this committee meeting is to address the concerns of the
Waters Edge I and Waters Edge III Condominium Associations regarding the
Thornwood Drainage Ditch project.

City Administrator Lobaito presented copies of Boone Valley Plats #13 and #14 for
the committee's review. He noted although Plat #13 depicts an easement, the
dedicated party is not specified, nor does the City have any recorded document
reflecting acceptance of the easement. Boone Valley Plat #14 depicts no
easements whatsoever. City Administrator Lobaito also noted altho Boone Valley
#14 engineering plans reflect a designated easement, this easement was not
transferred to the Final Plat of the development. In response to committee inquiry
City Administrator Lobaito stated the reasons why the easement designation was
not included in the Final Plat are as numerous as they are varied. No written
documentation exists to assist clarification. City of McHenry Staff states as the
easement's benefitted party was not specified on the final plat and no record exists
reflecting the city's acceptance of this easement, the City of McHenry had no
maintenance responsibility prior to the execution of the 1994 Agreement.
A lengthy discussion followed. It is the contention of the Waters Edge
Condominium I Association that as an easement clearly existed on Boone Valley
Plat #13 the association should not have been required to pay their 25%
proportionate share for the Thornwood Drainage ditch improvements in 1994/95.
Waters Edge I and III Condominium Associations are seeking reimbursement.

Mayor Cuda provided the committee with a brief synopsis of the project's inception
and ultimate improvement. Both Mayor Cuda and Northwest Property Management
Director Robert Berglund cited safety hazards and issues as the major concern.
Mr. Berglund also noted the drainage improvement did not only benefit the Waters
Edge I and III Condominium Associations, but all new developments to the east.
Mr. Berglund further explained he and Waters Edge I Condominium Board members
were unaware of the existing easement on Plat #13. The easement's existence
came to light when documents were being prepared to dedicate easement to the
City of McHenry. The maintenance and project agreement would have been
negotiated differently had any Board member been aware of the existence of the
Boone Valley Plat #13 easement.
Alderman Baird expressed his distress with the current stance of Waters Edge I and
III Condominium Association representatives citing the City's willingness to share in
the cost of these improvements in 1994 with no supporting documentation of
responsibility.
In response to committee inquiry Mr. Berglund noted the apparent time lag
`'" between project completion and easement preparation was due, in most part, to
the length of construction time including landscaping renovation in Spring of 1997.
A lengthy discussion ensued. It was the consensus of the committee to permit the
Waters Edge I and III Condominium Associations to investigate the status of these
easements further in an attempt to validate their request for financial
reimbursement.
Motion by Baird, seconded by McClatchey to adjourn the meeting at 7:30 p.m.
Voting Aye: Baird, McClatchey, Murgatroyd
Voting Nay: None
Absent: None
Motion carried.
The meeting was adjourned at 7:30 p.m.
