To approve the Agreement with Nelson Electronics for a 5 year period. (See ac ed) -SECOND MATTER DISCUSSED: Plan Commission and Zoning Board of Appeals stipends • DECISION OR RECOMMENDATION: Both Plan Commission and Zoning Board of Appeals Chairmen and Members receive same stipend at $30 per meeting for Chairmen and $20 per meeting for Members -THIRD MATTER DISCUSSED: Request by Chief Joyce to attend International Assoc. of Chiefs' of Police Conference DECISION OR RECOMMENDATION: Approve attendance of Chief Joyce at International Assoc. of Chiefs ' of Police Conference. ' , .,: � C� The City of McNenry hereby grants to Nelson Electronics, Inc. , � , Mc-F{errrp; its succe�sors or assigns, the right to continue to operate for a period of five (5) years from ,tlie , date of execution, an alarm monitoring receiving system in the Police Department and Fire District's Communications Center, . hereinafter known as the City. This right is granted under the following conditions: 1 . That positions be available to any subscriber who meets reasonable criteria for application and is approved by the municipality, and enters into a direct Agreement with Nelson Electronics, Inc. 2. That Nelson Electronics, Inc. will maintain the alarm monitoring panel on a twenty-four hour basis, all at no expense to the City. ; 3. The City of McHenry shall not be liable for any loss, damage, or destruction of the alarm monitoring receiving system or any part thereof or for any loss of revenues resulting from any interruption of such services or for any claims associated with any interruption or malfunction of such system; Nelson Elec- . tronics, Inc. shall hold the City completely harmless from any and all claims, lawsuits, �udgments, expenses, costs and damages in any ay relating to the installation, maintenance, operation and removal of the ��ro�said alarm moni- toring receiving system on the premises of the City afores'ai�d. �. In accepting this service from Nelson Electronics, Inc., the City understands that Nelson Electronics, Inc. , will in the future charge other alarm companies � an initial connection fee of �130. Nelson Electronics, Inc., will provide positions on the alarm monitoring equipment for use by the City in sufficient number to allow the supervision of existi�ng municipal connections and a reasonable number of poistions in the future as the need arises. There shall be no charge for these positions. 7. The City further grants to Nelson Electronics, Inc. , the privilege of moni- toring facilities in the City Police Department and Fi.re District�to monitor all burglar, hold-up and fire alarms for a period of five (5) years. �_-- .----_ __-_ - 8. The City acknowledges that all equipment inst,alled in accordance with this Agreement is owned by Nelson Electronics, Inc. , and in the event this Agree- ment is terminated for any reason. Nelson Electronics, Inc. , shall have the right to remove the same upon fifteen days notice. � 9. This Agreement shall be automatically renewed for annual periods unless term- � inated in writing by either party thirty (30) days prior to the expiration date. 10. This Agreement shall be binding upon the heirs, executors, administrators, and assigns of both parties. il . This Agreement incorporates the entire Agreement and understandings between parties and there are no oral agreements, understandings or representations between the parties which are not reduced to writing herein. This Agreement may not be c.hanged, modified or discharged except in writing executed by all parties hereto. We ask further that you acknowledge the conditions of this Agreement by signing and returninq it to Nelson Electronics, Inc.
