HomeMy WebLinkAboutOrdinances - 23-29 - 06/05/2023 - Non-Highway Vehicles CITY OF MCHENRY MCHENRY COUNTY STATE OF ILLINOIS Ordinance 23-29 Amending Title 7, Chapter 2, Section 5, Operation of Non-Highway Vehicles on City Streets, of the McHenry City Code Passed by the Mayor and City Council Of the City of McHenry McHenry County State of Illinois June 5, 2023 Published in pamphlet form by authority of the Mayor and City Council of the City of McHenry, McHenry County, Illinois this 6�h day of June 2023 ORDINANCE NO. 23-29 Amending Title 7, Chapter 2, Section 5, Operation of Non-Highway Vehicles on City Streets, of the McHenry City Code WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois. NOW, THEREFORE BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: Title 7, Chapter 2, Section 5, subsection C.1., of the Municipal Code shall be amended as follows: 7-2-5. Operation of Non-Highway Vehicles on City Streets: C.1. An initial safety inspection shall be conducted by the Police Department or a designee authorized by the Chief of Police. Vehicles being renewed by the same owner are not required to be inspected in following years. SECTION 2: Title 7, Chapter 2, Section 5, subsection C.6., of the Municipal Code shall be amended as follows: 7-2-5. Operation of Non-Highway Vehicles on City Streets: C.6. A fee of one hundred dollars ($100.00) shall be paid for the initial annual safety inspection of each non-highway vehicle. A fee of fifty dollars ($50.00) for renewing the same non-highway vehicle under the same ownership each year thereafter shall be paid. SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not effect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 4: All ordinances,orparts thereof,in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 6: This ordinance shall be in full force and effect from and after its passage, approval and publication, as provided by law. Passed this Sth day of June, 2023.
