CITY OF MCHENRY MCHENRY COUNTY STATE OF ILLINOIS Ordinance 23-13 ORDINANCE GRANTING FINAL PLAN AND PLAT OF SUBDIVISION APPROVAL AND VACATING PUBLIC RIGHT-OF-WAY FOR THE RESIDENCES AT FOX MEADOWS PLANNED UNIT DEVELOPMENT LOCATED ON THE NORTHEAST CORNER OF IL-31 AND VETERANS PARKWAY Passed by the Mayor and City Council Of the City of McHenry McHenry County State of Illinois March 6, 2023 Published in pamphlet form by authority of the Mayor and City Council of the City of McHenry, McHenry County,Illinois this 7th day of March 2023 ORDINANCE NO 23-13 ORDINANCE GRANTING FINAL PLAN AND PLAT OF SUBDIVISION APPROVAL AND VACATING PUBLIC RIGHT-OF-WAY FOR THE RESIDENCES AT FOX MEADOWS PLANNED UNIT DEVELOPMENT LOCATED ON THE NORTHEAST CORNER OF IL-31 AND VETERANS PARKWAY WHEREAS,the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois; and WHEREAS, a petition has been filed with the City by Cunat Inc. ("PROPERTY OWNER"), requesting final plan and plat approval for the Residences at Fox Meadows Planned Unit Development located on the northeast corner of IL-31 and Veterans Parkway legally described in "Exhibit A", attached hereto and incorporated herein; "SUBJECT PROPERTY"; and WHEREAS, the City Council has reviewed and determined that the submitted Final Plans and Plat of Subdivision for the Residences at Fox Meadows Planned Unit Development are consistent with the Preliminary Plans and Plat approved by City Council on September 6, 2022; and WHEREAS,the public right-of-way, commonly known as Patriot Drive and American Way, located on the northeast corner of the intersection of IL State Route 31 and Veterans Parkway, legally described and depicted on the Plat of Vacation attached hereto and incorporated herein by reference as "EXHIBIT B", is located entirely within the corporate limits of the City of McHenry and is subject to the sole jurisdiction of the City of McHenry; and WHEREAS, upon proper public notice and hearing, the Corporate Authorities of the City of McHenry have determined, pursuant to 65 ILCS 5/11-91.1, that the public interest will be subserved by vacating this right-of-way; and WHEREAS,the City Council finds that the approval of the requests are consistent with the objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals, and general welfare of its residents. NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: The right-of-way legally described and depicted on EXHIBIT B shall be vacated. No compensation shall be due to the CITY for the benefits that will accrue to the PROPERTY OWNERS by the vacation. SECTION 2: That the final plat of subdivision entitled, "Final Plat of Subdivision of Residences at Fox Meadows" prepared by V3 Engineers, Scientists, and Surveyors, and bearing the date November 2, 2022, attached hereto ("EXHIBIT C") and incorporated herein by reference, be and the same is hereby approved. SECTION 3: That the SUBJECT PROPERTY is hereby granted Final Plan Approval for the Residences at Fox Meadows Planned Unit Development subject to the following conditions: 1. All development on site shall be in substantial conformance with the plans attached hereto as "EXHIBIT D". 2. The PROPERTY OWNER shall agree to enact a backup Special Service Area (SSA) for the maintenance of said regional Stormwater Retention Pond within one (1) year of approval. Said SSA shall encompass all property that is serviced by said regional Stormwater Retention Pond. Failure of the property owner(s) currently serviced by the Regional Stormwater Retention Pond on Lot 2 of Prairie Pointe Business Park Resubdivision to agree to the enactment of said SSA, shall absolve the Property Owner of the Residences at Fox Meadows from enacting said SSA. 3. The PROPERTY OWNER shall be responsible for the replacement of any damaged or destroyed landscaping, screening facilities, and recreational equipment within 30 days of notification by the City of McHenry or other reasonable timeframe at the discretion of the Zoning Administrator. 4. The PROPERTY OWNER shall provide a monetary contribution to the property owners of 4100 Veterans Parkway in the amount of$12,500.00 for a fence of their choosing or for no fence if so desired. 5. All other federal, state, and local laws shall be met. SECTION 4: In granting said Final Plan approval for the Residences at Fox Meadows Planned Unit Development,the City Council finds that the submitted plans are consistent with the Preliminary Plans approved on September 6, 2022. SECTION 5: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 7: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law. Passed this 6th day of March, 2023.
