AGENDA ITEM SUMMARY:
Staff is seeking Council’s authorization for the purchase of four City fleet vehicles for the Police
Department. Staff is present to answer any questions Council may have.
BACKGROUND:
With the supply, demand and delivery issues surrounding vehi cle pur chasing and extremely
high inflation costs, Staff has looked for alternative methods to acquire new vehicles. Ordering
patrol police vehicles has been difficult as currently both Ford and Chevrolet are not accepting
order s and new pricing is not avai lable. Over the last year staff has been actively looking for
alternative options to the Ford Police SUV and Chevrolet Tahoe SUV. The FY23/24 C om munity
Investment Plan identifies six new patrol police vehicles with four of them being mid-size SUVs
and two being large SUVs.
ANALYSIS:
In January of this year staff began the process of evaluating the purchase of four police rated
Dodge Durango SUVs in place of the Ford SUV which is currently unavailable. Part of this
evaluation pr ocess included examining the repair records of the two Durango SUVs we
currently have in our fleet and speaking with in-house mechanics and Sheriff Office mechanics
who also use the Durango has their patrol vehicle. The Durango SUV had a better service
record over the last two years compared to our Ford SUVs.
Staff then met with Sunnyside Dodge Company in McHenry. Sunnyside is the current bid
winner (BID 22-5387) for 2023 Dodge Durango for McHenry C ounty. Because of thi s completive
Bid Award, Sunnyside is able to offer us the identical competitive pricing for the purchase of the
2023 Dodge Durango. Furthermore, Sunnyside is able to place orders for these four vehicles
immediately which would allow staff to take delivery of the vehicles between July and
September of 2023.

Competitive Pricing for these four vehicles is as follows:
Vehicle #1 (black) $39,253.00, Vehicle #2 (black) $39,253.00, Vehicle #3 (black) $39,253.00, and
Vehicle #4 (grey-) $39,609.00. See attached invoice and order forms for full details.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that a motion be ma de to authorize the
order/purchase of these four vehicles now with payment and delivery to be included in
FY23/24, for a total amount not to exceed $157,368.00.

AGENDA ITEM SUMMARY:
Staff requests that the City Council consider adoption of an Ordinance amending Section 8-7-4
Permit Required; Application and Fees , of the McHenry City Code .
BACKGROUND:
In Fall of 2022, staff began coordinating the permitting process for a new internet provider which
will not be a franchised utility and as such will be subject to the City’s existing Right of Way
Ordinances. Upon examination of the ordinances relative to this process , it was determined that
revisions to Section 8-7-4 of the McHenry Municipal Code would be required to reflect the intent
of the permitting process more accurately. The two revisions are summarized as follows:
1. Any permitted work which occurs in a City Right of Way or easement will require a permit.
Prior to this revision, a permit was only required for Right of Ways and Easements which
contained City infrastructure.
2. A typographical error which implied that a permit was required even if a City Right of Way
or easement was not disturbed was removed.
ANALYSIS:
Staff and the City Attorney have prepared and reviewed the proposed revisions and have found
them to be acceptable.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that the City Council adopt an Ordinance
amending Section 8-7-4 Permit Required; Application and Fees, of the McHenry Municipal
Code.

ORDINANCE NO. __________
An Ordinance Amending Section 8-7-4, Permit Required; Application and Fees,
of the McHenry Municipal Code
WHEREAS, the City of McHenry, McHenry Count y, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City’s home rule powers and functions as
granted in the Constitution of the State of Illinois; and
WHEREAS, the City Code includes rules governing access to the City’s right of way and
other property to ensure the protection of the City’s public ways and resources which can be found in
Title 8, Chapter 7 of the City’s Code; and
WHEREAS, the City Council has found that it is appropriate to update Section 8-7-4:
PERMIT REQUIRED; APPLICATION AND FEES to better protect the City’s right of way and to
correct a pre-existing typographical error that will avoid confusion by users.
NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF
McHENRY, McHenry County, Illinois, as follows:
SECTION 1: Section 8-7-4 of the City Code shall be amended as follows (with new language
underlined and deleted text shown as struck-through):
8-7-4: PERMIT REQUIRED; APPLICATION AND FEES:
A. Permit Required: Except as otherwise provided in this chapter, no person, unit of government or
utility shall construct any facility on, over, above, along, upon, under, across or within any City
right -of -way, public utility easement, utility easement or drainage easement that contains existing
City facilities such as potable water, sanitary sewer or stormwater pipes, structures, mains or
equipment which: 1) changes the location of the facility; 2) adds a new facility; 3) disrupts the right -
of -way (or City easement); or 4) materially increases the amount of area or space occupied by the
facility on, over, above, along, under, across or within the right -of -way (or City easement), without
first filing an application with the Public Works Director and obtaining a permit f rom the City. A No
permit shall be required for installation and maintenance of service connections to customers’
premises where there will be no disruption of the right -of -way or City easement .
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and
continue in full force and effect.
SECTION 3: All ordinances or p arts of ordinances in conflict herewith are hereby repealed to
the extent of such conflict.

AGENDA ITEM SUMMARY:
Staff requests that the City Council consider the waiver of competitive bidding and accept a
proposal from Brown Equipment Company for the furnishing and installation of a new water
pump for the Public Works Aquatech vacuum truck.
BACKGROUND:
The Public Works Aquatech vacuum truck recently sustained a failed water pump on the vacuum
unit itself which has rendered the unit inoperable. This unit is a necessary and critical component
of the day-to-day Public Works operations and allows for the Department to respond to sewer
backups. The unit was originally acquired in 2015 and currently has over 5,000 hours of operating
time which is consistent with the need for this repair. The unit was originally sent to Brown
Equipment (who has a location in town) and was disassembled with the intention of an on-site
repair of the existing pump. Upon investigation, it was determined that the pump would need
replacement. This unit was originally serviced at RNow, Inc. in Milwaukee where it was
purchased but staff has since moved the servicing of the unit to Brown Equipment due to service
issues with the supplier. Brown equipment originally struggled to secure a pump with a
reasonable lead time and provided pricing in the amount of $33,457.03 with a one-month lead
time for the part. Other replacement parts had lead times more than 3 months. Staff also
investigated the possibility of utilizing a rental unit; however, this was abandoned as a suitable
unit would rent for over $10,000/month.
Due to the time sensitive nature of the repair and the criticality of the unit, the initial costs were
given to Council for preliminary approval with the condition that the final expenditure be brought
before the Council later for approval. Since the initial estimate was prepared, Brown equipment

has been able to locate another pump at a lower cost of $25,476.81 and shorter lead time which
is now before the Council for consideration.
ANALYSIS:
Because the replacement of this component will allow the overall unit to fulfill its intended
service life, it can be considered a capital item and paid for from capital balances in the Water
and Sewer Fund. Staff has reviewed the current estimate of $25,476.81 and has found it to be
acceptable. The price has been reduced by approximately $5,000 from the original quotation
and shipping expenses are anticipated to be approximately $1,000.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that the City Council waive competitive
bidding and accept a proposal in the amount of $25,476.81 plus shipping (shipping costs
estimated at $1,000) from Brown Equipment Company for the furnishing and installation of a
new water pump for the Public Works Aquatech vacuum truck.

Roll Call: Mayor Jett called the roll call.
Members present Alderman Santi, Alderman Glab, Alderman McClatchey, Alderman Harding,
Alderman Strach-absent, Alderman Devine, Alderwoman Miller, and Mayor Jett. Others
present: Attorney McArdle, Administrator Morefield, Director of Public Works Strange, Director
of Community Development Polerecky, Finance Director Lynch, Director of Parks and
Recreation Hobson-absent, Director of Economic Development Martin, Chief of Police Birk ,
City Planner Sheriff-absent, Deputy Clerk Johnson, and City Clerk Ramel.
Pledge of Allegiance: Mayor Jett led the pledge.
Police Promotion/Oath of Office Ceremony: Promotions of Sgt. Michael Cruz to the rank of
Commander and Officer Jaimie Prather to the rank of Sergeant.
Chief Birk completed the promotions in front of the family and friends of those being promoted.
Mayor Jett congratulated those promoted as well.
Public Comments: None
Public Hearing: Proposed Amended and Restated Annexation Agreement with Meyer Material
(LaFarge/Holcim) – North Property.
Mayor Jett called to order the Public Hearing at 7:07 PM.
Randy Wilie presented the amendment slides to the council regarding the above proposal. The
overview included some history and usage of the company, and property restoration areas.
Public Comment:
Joanne Hajdrowski – a resident, spoke about the noise, mess, and issues with silt, along with
the smell as well. She also spoke regarding other neighbors in the area that were not able to
make the meeting. She asked that these complaints be considered. Mayor Jett asked for her
number to that he can contact her after the meeting.
John Ellieson – a resident, wanted to know if there was an environmental assessment on what
the impact could be.
Dale Mclean – a resident, is concerned about the drinking water, stating that he has some of
the dirtiest water even after utilizing expensive cleaning equipment for it.
Rob Johnson- the Resident, wanted to ask The Council to verify the results of any testing and
it was confirmed by Director Polerecky he has been getting those reports.

This was answered by Randy Willie, who stated that there has been testing and explained what
steps have been taken along with the sweeping services that are being completed as well.
There have been dust and noise studies done by the school as well.
Mayor Jett asked if there will be semi’s going in and out and it was confirmed that no there will
not be. The only trucks would be to help build the brim.
Alderman Santi asked about the east side of 120 it is next to Stonewater, and that was
confirmed.
Alderman McClatchey feels that the breaks should be put on for the gravel and wanted to know
if homes will be built in these areas. The north parcel will be multi-family or single-family homes
with a lake as a redevelopment after they are mined.
Alderman Glab asked about the 5-year extension and would be happy after the 10-year
extension. According to Randy, it has to do with the geological aspect. Also the supply and
demand of what is needed as well. Alderman Glab stated that the extensions need to come to
an end after the 10-year extension so that a subdivision can be built, n ot wanting an extension
after that.
Alderman Devine asked about how things are reclaimed. Randy explained the strategic way
that it is being reclaimed, starting on the east side.
This discussion went on for some time.
A motion was made by Alderman Santi and seconded by Alderwoman Miller to exit
Public Hearing: Roll Call: Vote: 7-ayes: Alderman Santi, Alderman Glab, Alderman
McClatchey, Alderman Harding, Alderman Strach, Alderman Devine, Alderwoman Miller. 0-
nays, 0-abstained. Motion carried.
Motion to adopt an Ordinance Approving Amended and Restated Meyer Material Annexation
Agreement North Property, with the following amendment: To adopt the ordinance and
agreement as submitted with editing paragraph d), removing process and loading and replacing
it with placing the material on the screen and conveying it under Route 120, and maintenance
hours from 5:00 am to 8:00 p.m., and editing paragraph b), where if an extension is requested,

funded through a transfer of funds from the Police Seizure Fund; to accept a change
order quote by the approved Phase 3 general contractor and waive any competitive bid

Community Development to enter into a new Purchase Order Contract with J.H. Freund

AGENDA ITEM SUMMARY:
Staff requests that the City Council consider the approval of a Task Order with Robinson
Engineering, Ltd. for Professional Engineering Services for design for the North Riverside Parking
Lot Construction Project. Additionally, staff is requesting that the City Council consider approval
of a budget amendment for the funding of the design project.
BACKGROUND:
In Summer of 2022, the City of McHenry purchased the property located at 1405 N. Riverside
Drive for the purpose of creating additional municipal parking on Riverside Drive north of Pearl
Street. The property was purchased with a single-family home still standing on the property. In
Fall of 2022, the home was demolished, and all utilities were disconnected . The City is seeking
to construct a new parking lot at this location on Riverside Drive in Fall of 2023, which will require
engineering design services to begin this Winter. As such, Public Works staff released an RFP for
design engineering services in December of 2022 with proposals due in January.
The scope of construction for the project is to include earth excavation, aggregate base course
installation and preparation, hot-mix asphalt pavement, curb and gutter installation, off-site
storm sewer installation, lighting, and pavement markings.
ANALYSIS:
Four (4) firms submitted a proposal, scope of services, and a project schedule that met the
requirements of the RFP. Sealed proposals for Professional Engineering Services were accepted
from the following firms on January 18, 2023:

• Baxter and Woodman, Inc. $59,965
• HR Green, Inc. $49,368
• Robinson Engineering, Ltd. $44,900
• Trotter and Associates, Inc. $49,038
Proposals were examined for conformance with the conditions of the RFP and evaluated based
upon the criteria identified in the RFP. Staff’s recommendation is to proceed with the approval
of a Task Order to Robinson Engineering, Ltd. in the amount of $44,900. As this project was
implemented after the approval of the FY22/23 Budget, these Professional Engineering Services
were not anticipated or included and, therefore, will require a budget amendment. Staff is
recommending that the budget amendment include a contingency for services change orders
such that additional amendments will not be required in the case that additional services are
required during project development. Therefore, the budget amendment amount is $55,000.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended to approve a Task Order in the amount of
$44,900 to Robinson Engineering, Ltd. for Professional Engineering Services for the North
Riverside Parking Lot Construction Project. Additionally, staff is recommending that the City
Council approve a budget amendment in the amount of $55,000 from the General Fund.

Notice to Firms
The City of McHenry is requesting proposals for professional engineering services for the North
Riverside Drive Parking Lot Construction Project. The included Preliminary Scope of Services
provides anticipated items which may be required to perform all necessary engineering work
associated with this project. The City intends to begin work immediately upon execution of the
contract with the selected consultant. It is the intent of the City to complete all design and bidding
work by July 21, 2023. This timetable will allow for a timely contract award and construction of
the proposed improvements in the Fall of 2023.

lot on this parcel in Fall of 2023. The scope of construction is to include earth excavation,
aggregate base course installation and preparation, adjacent curb removal and replacement,
sidewalk replacements, storm sewer installation, lighting, and pavement markings. There is also
a potential for the installation of on-site and off-site storm sewer. Engineering design services are
funded in Fiscal Year 2022/2023 with construction intended to be completed in Fall of 2023.

perform all required professional engineering services in order to complete the proposed project.

Professional Service Agreement
Upon selection of a firm, the City and selected firm shall execute a Task Order for the previously
executed Master Agreement, which serves as the general agreement between each pre-qualified

WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City’s home rule powers
and functions as granted in the Constitut ion of the State of Illinois; and
WHEREAS, the City of McHenry acting by and through its Mayor and City Council has

AGENDA ITEM SUMMARY:
The petitioner, Lucky Poker (CL Quick Stop of Belvidere Inc.), is requesting approval of a
Conditional Use Permit to operate a Tavern/Bar without Live Entertainment at 700 N Front Street
and a Zoning Variation to allow 11 parking spaces in lieu of the required 20 spaces.
BACKGROUND & ANALYSIS:
The subject property has operated as commercial office space for the past 20 years and currently
contains a 2,000 square foot building with 11 parking spaces. Lucky Poker currently occupies a
tenant space in Remax Plaza across the street from the subject property which has shared parking
accommodations. The City’s parking regulations require 10 parking spaces per 1,000 SF for
Bars/Taverns and therefore would require the subject property to provide 20 parking spaces for
the existing 2,000 SF building. Staff felt this was excessive and believes a more comparable option
would be to apply the restaurant standard of 4 parking spaces per 1,000 SF which the site could
easily accommodate without issue. Staff believes there is adequate parking onsite to
accommodate the business.
PLANNING & ZONING COMMISSION DISCUSSION & RECOMMENDATION:
A Planning & Zoning Commission public hearing was held on January 18, 2023. The Planning &
Zoning Commission agreed with staff’s assessment and unanimously reco mmended approval.
There were no objectors present at the hearing.

Chairwoman Rockweiler opened the file at 7:08 p.m. and City Planner Cody Sheriff explained that
the petitioner has met all public notice requirements. Petitioner Kevin Olson and Attorney Nathan
Noble were sworn in by Chairwoman Rockweiler. The petitioner stated that they would like to
move their business across the street in the building for sale. This would make a nicer place for
their business.
Planner Sheriff explained that they currently run as a bar/tavern without live entertainment. This
requires a conditional use permit. It is zoned commercial and has ample parking for their business
in the opinion of Staff. There are no anticipated adverse impacts. The dense row of evergreens
must stay.
Chairwoman Rockweiler opened the public hearing portion of the meeting at 7:12 p.m. With
nobody wanting to speak, she closed the hearing at 7:12 p.m. All members of the Commission
agreed that they have no issues with the request. There seems to be ample parking and no
negative impacts are expected.
A motion was made by Commissioner Bremer and seconded by Commissioner Gleason to
recommend approval of the petitioner’s request for a Conditional Use Permit for a tavern without
live entertainment. And by making said motion, I agree with staff’s assessment that the approval
criteria for Conditional Uses have been met as outlined in the staff report.
Roll Call Vote: 6-ayes: Commissioners Bremer, Rockweiler, Smale, Davis, Riley and Lehman. 0-nay; 0-
abstained; 1-absent: Smale. Motion Carried.
A motion was made by Commissioner Lehman and seconded by Commissioner Riley to approve the
petitioner’s request for a variation to allow 11 parking spaces in lieu of the required 20 spaces. And

Staff Comments
The following comments and conclusions are based upon staff analysis and review prior to this hearing and are
to be considered viable unless evidence is established to the contrary. Staff may have additional comments
based upon the testimony presented during the public hearing.
BACKGROUND & REQUEST SUMMARY
The petitioner, Lucky Poker (CL Quick Stop of Belvidere Inc.), is requesting approval of a Conditional Use
Permit to operate a Tavern/Bar without Live Entertainment at 700 N Front Street and a Zoning Variation to
allow 11 parking spaces in lieu of the required 20 spaces.

STAFF ANALYSIS
CURRENT LAND USE & ZONING
The subject property is currently zoned C-3 Community Commercial District and is currently vacant office
space. Between 2002 and 2005, the existing building was constructed on a formerly vacant piece of land that
adjoined a single-family neighborhood. The site has largely operated as commercial office space. Lucky Poker
currently occupies a tenant space in Remax Plaza across the street from the subject property. The primary
concern is how the land use would impact the adjoining single-family home to the east. Due to the site being
zoned for commercial land use for approximately 20 years, staff does not anticipate the proposed use would
generate any additional adverse impacts.
FUTURE LAND USE MAP RECOMMENDATION
The City’s Future Land Use Map recommends commercial land use. The proposed tavern is in substantial
conformance with this recommendation.
COMPREHENSIVE PLAN OBJECTIVES & POLICIES
Overall, staff believes the proposed development is somewhat consistent with the City’s Comprehensive Plan
objectives and policies. Staff comments italicized.

and affords the City with a sound economic base.” (p. 29)
Staff believes approval of the petitioner’s request would be supportive of promoting a diverse shopping
base which is diverse and affords the city with a sound economic base.

SITE PLAN REVIEW
• Parking. The existing site contains 11 parking spaces or roughly 5.5 spaces per 1,000 square feet of
floor area. As the Commission may recall, the City amended much of its parking regulations a few
months prior. Ironically, taverns were not included in the previous round of text amendments. Current
regulations would require one space per 100 square feet of floor area (20 spaces total). A total of 20
parking spaces for a 2,000 square foot building does appear quite excessive in staff’s opinion. Staff
would feel comfortable with the recently adopted restaurant standard which only requires 1 per every
4 seats or 4 per 1,000 square feet whichever is greater. Using said standards, this would require
approximately 8 spaces for the proposed use as opposed to 20. Overall, staff does believe there is
adequate parking onsite to service the needs of the proposed business.
STAFF SUMMARY ANALYSIS
• Given the longevity of the operation and use of the property as commercial office space, staff does not
anticipate any additional adverse impacts on the surrounding property owners.
• Staff believes the required number of 20 parking spaces to be quite excessive for the proposed use.
Using the restaurant standard instead of the tavern parking standard would only require 8 spaces as
opposed to 20. With 11 spaces already provided, staff does not believe approval of the variance
request to allow 11 spaces in lieu of 20 would generate any adverse impacts.
If the Planning & Zoning Commission agrees with the petitioner’s request, then the following 2 motions are
recommended.
1st MOTION: I motion to recommend approval of the petitioner’s request for a Conditional Use Permit for a
tavern without live entertainment.
AND by making said motion, I agree with staff’s assessment that the approval criteria for Conditional Uses
have been met as outlined in the staff report.
APPROVAL CRITERIA FOR CONDITIONAL USES (§11-15-5). Staff comments italicized below.
A. Traffic: Any adverse impact of types or volumes of traffic flow not otherwise typical in the zoning
district has been minimized.
Staff does not anticipate the type and volume of traffic flow generated in this zoning district would
generate any adverse impacts beyond what is ordinary for the C-3 Community Commercial District.
B. Environmental Nuisance: Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of
light or air, or other adverse environmental effects of a type or degree not characteristic of
permitted uses in the zoning district, have been appropriately controlled.
An existing evergreen screening berm exists between the subject property and the residential property
to the east. Staff believes there is adequate screening between the proposed tavern and the residential
property to the east.
C. Neighborhood Character: The proposed use will fit harmoniously with the existing natural or
manmade character of its surroundings, and with permitted uses in the zoning district. The use will
not have undue deleterious effect on the environmental quality, property values, or neighborhood
character already existing in the area or normally associated with permitted uses in the district.
Given the longevity for commercial use of the property staff does not anticipate further commercial
use would alter the neighborhood character.
D. Public Services and Facilities: The proposed use will not require existing community facilities or
services to a degree disproportionate to that normally expected of permitted uses in the district, nor

generate disproportionate demand for new services or facilities, in such a way as to place undue
burdens upon existing development in the area.
The site is already serviced by City Water and Sewer.
E. Public Safety and Health: The proposed use will not be detrimental to the safety or health of the
employees, patrons, or visitors associated with the use nor of the general public in the vicinity.
Staff does not believe the proposed use will generate any adverse impacts on public safety and health.
F. Other Factors: The proposed use is in harmony with all other elements of compatibility pertinent to
the conditional use and its particular location.
2nd MOTION: I motion to approve the petitioner’s request for a variation to allow 11 parking spaces in lieu of
the required 20 spaces.
AND by making said motion, I agree with staff’s assessment that the approval criteria for variances have been
met as outlined in the staff report.

AGENDA ITEM SUMMARY:
City staff are requesting approval of text amendments to permitted and conditional public uses,
outdoor storage, and automotive repair.
BACKGROUND/ANALYSIS:
Staff has initiated several zoning text amendments to bring them more in-line with neighboring
municipalities. In the City of McHenry, outdoor storage as an accessory use currently requires
approval of a conditional use permit in all non-residential zoning districts. Municipalities such as
Crystal Lake, Woodstock, and McHenry County allow Outdoor Storage as an accessory use subject
to screening standards in most commercial and industrial zoning districts. Several years prior, the
city adopted screening standards for existing conditional uses that would go into effect if any
expansion occurred. Said standards detail the type of landscaping and scree ning required for
outdoor storage as an accessory use. If the requested text amendments for outdoor storage are
approved, these standards would go into effect and outdoor storage would be allowed as a
permitted use in A-1, C-2, C-3, C-5, and I-1.
Staff are also requesting text amendments to automotive repair facilities to allow them as
permitted uses in C-5 Highway Commercial and I-1 Industrial Districts. Automotive repair facilities
are currently only allowed as a conditional use in C-5 Highway Commercial Zoning Districts.
McHenry is one of the few municipalities that does not allow automotive repair in Industrial

Districts in McHenry County. Allowing automotive repair in highway commercial districts and
industrial districts would be similar to what is allowed in other neighboring municipalities. Staff
analyzed zoning requests in McHenry for automotive repair dating back to 2000. Of the 19
requests, not a single automotive repair business has been denied in the C -5 Highway
Commercial District.
Staff is also proposing changes to the City’s definition of permitted and conditional public uses.
Currently, the Zoning Ordinance requires all government institutions to receive approval of a
conditional use for relatively low impact uses such as office space as opposed to private entities
who are allowed office uses in districts such as C-5 and O-1. A conditional use permit is meant to
apply to uses that require additional conditions of approval to mitigate adverse impacts on
surrounding properties. More recently, the City was petitioned by the school districts to relocate
their office at the formerly occupied HRGreen building on IL-31. Although the school districts’ use
of the property is administrative office space which is normally allowed by private entities;
however, the current ordinance would require a conditional use permit since they are a public
agency. Staff felt this was excessive given that administrative office space is relatively low impact.
Staff is recommending changes to the City’s definition of per mitted and conditional uses to allow
government institutions to occupy and utilize property similar to other allowable private uses
within the underlying zoning district.
PLANNING & ZONING COMMISSION DISCUSSION & RECOMMENDATION:
A Planning & Zoning Commission Public Hearing was held on the requested text amendments on
January 18, 2023. The Commission was supportive of the text amendments and unanimously
agreed that automotive repair on highway/industrial properties, outdoor storage subject to the
City’s adopted screening standards, and changes to permitted and conditional public uses were
in-line with recent trends. There were no objectors present and the Commission voted
unanimously to recommend approval of the request.
RECOMMENDATION:
Therefore, if the City Council concurs, it is recommended the attached Ordinance Granting
Various Zoning Text Amendments to the City of McHenry Zoning Ordinance be approved (City
Council Vote-Simple Majority).

Chairwoman Rockweiler opened the file at 10:30 p.m. Planner Sheriff noted that all public
notice requirements have been met. Mr. Sheriff explained that it would be helpful if the City
updated its ordinances for outdoor storage and permitted uses. For outdoor storage, storage
exceeding six feet can be reviewed by the Zoning Administrator and given the approval or
denial. For conditional uses or permitted uses, the Zoning Administrator can permit certain
aspects based on similar or other permitted uses within the underlying zoning district. For
automotive repair, it would be allowed in C-5 and I-1 zones.
A motion was made by Commissioner Lehman and seconded by Commissioner Davis to approve
the Zoning Text Amendments as presented in the staff report.
Roll Call Vote: 6-ayes: Commissioners Bremer, Rockweiler, Gleason, Davis, Riley and Lehman.

ORDINANCE NO 23-
ORDINANCE GRANTING VARIOUS ZONING TEXT AMENDMENTS TO THE CITY OF MCHENRY
ZONING ORDINANCE
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City’s home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, a petition has been filed by the City of McHenry requesting approval of text
amendments to the City of McHenry Zoning Ordinance ; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on January 18, 2023 in the manner prescribed by ordinance and statute, and as a
result of said hearing, the Planning and Zoning Commission did unanimously recommend to the
City Council the granting of the requested text amendments; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zoning Commission and finds that the approval of the request is consistent with the
objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals,
and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That §11-6-20 Outdoor Storage is hereby amended as follows:
“A. Applicability: The following standards apply to outdoor storage as an accessory to a non -
residential use. The storage of construction equipment and materials on properties under
active construction are not subject to these restrictions.
1. All outdoor storage shall be paved with asphalt or concrete unless determined by the
Zoning Administrator to not be necessary.
2. Outdoor storage is prohibited within the required front and corner side yard setback of
the underlying zoning district

3. Outdoor storage of bulk materials is prohibited unless enclosed within a storage
container.
4. All materials stored onsite shall be related to a permitted use of the property and shall be
maintained in a neat and orderly appearance as determined by the Zoning Administrator.
5. No required parking area can be used for outdoor storage.
6. Outdoor storage areas shall be reasonably screened from view off the property by any
combination of buildings, solid fencing, or solid landscaping.
a. The fencing or landscaping shall have a minimum height of six feet (6') at the time of
installation. Storage is prohibited outside the screened area.
b. The Zoning Administrator may require the installation of fencing in addition to solid
landscaping.
c. Storage exceeding six feet (6’) shall require review by the Zoning Administrator who
may give consideration to the type of materials being stored and the impact of the
visibility on the adjacent and surrounding property owners. The Zoning Administrator
may approve, approve with conditions, or deny requests for outdoor storage in excess
of six feet (6’) in height.”
SECTION 2: That §11-3-1 Definitions is hereby amended as follows:
USE, CONDITIONAL PUBLIC:
A. The use of property other than as permitted public uses, as defined herein, by a public
utility, railroad or governmental body for the provision of public utilities or services, including
sewerage, water supply, electricity, gas, public safety, government administration,
transportation, and communications.
B. Conditional public uses shall include power plants or substations; water or sewage
treatment plants, reservoirs or pumping stations; railroad and utility buildings; police and fire
stations, Municipal buildings and local government offices; and public transportation facilities,
including shelters, garages, terminals, parking and turnaround areas, and service buildings. all
other public uses determined by the Zoning Administrator to be similar to other conditional
uses within the underlying zoning district.
USES, PERMITTED PUBLIC: Poles, towers, tunnels, conduits, wires, cables, vaults, laterals, pipes,
drains, mains, valves, hydrants, and similar distribution equipment for public services or utilities;
fire alarms and police call boxes; traffic signals; pay telephones; all other uses determined by the
Zoning Administrator to be similar to other permitted uses within the underlying zoning district.
SECTION 3: That §11-9-7 is hereby amended as follows:

approval, and publication in pamphlet form as provided by law.

Personnel Update
The following personnel have recently completed the respective years of service with the
McHenry Police Department:
• Officer Katelyn Lorenz – 6 years
• Telecommunicator Grant Havens – 6 years
• Telecommunicator Kate Wilbur – 3 years
• Officer Katherine Zajak – 2 years
On January 30th, 2023, Cole Templin was sworn in as a Probationary Police Officer. He
attended William Rainey Harper College, has a bachelor’s degree in Criminal Justice from
National Lewis University and served as a police officer in Winnetka, Illinois. Cole is also the
nephew of retired McHenry Police Officer Doyle Kearns (served 1984 – 2007).
Training
Telecommunicator Gwendolyn Allen attended A Victims Plea; Meeting Expectations. During
this course from the Denise Amber Lee Foundation, students are exposed to a riveting,
emotional roller coaster of critical 9-1-1 failures that occurred the night Denise Lee was
kidnapped, raped, and murdered. Nathan Lee, founder and President of the Denise Amber Lee
Foundation and a 9-1-1 professional, tied together the elements of the Denise Amber Lee
tragedy. The training was hosted by Northern Illinois University.
Officer Alberto Martinez attended 40-Hour Basic Evidence Technician training, hosted by the
Aurora Police Department.
Officer Grahm McClure and Officer Diana Hernandez attended Crisis Communication training,
hosted by the Bensenville Police Department.
Public Relations
On January 24th, 2023, Cub Scout Troop #131 visited the police department. Sergeant Aalto
gave them a brief overview of police forensics and the troop also met Officer Conway and his
partner K-9 Eli.

Field Operations
Winter valve exercising is now completed as is this year’s catch basin vacuuming program. The
2022-2023 sign installation and replacement program is ongoing and will continue throughout
the winter as new shipments of sign materials are received.
Winter Operations
On January 28, the Public Works Department responded to a winter snowfall in excess of 6
inches which required winter operations to be performed over a 24-hour period into Sunday
afternoon the 29th. Response to the event was completed on Sunday afternoon with cul-de-sac
clearing.
2022/2023 Sanitary Sewer Lining Program
All work is now completed and staff are preparing final pay estimates.
North Riverside Parking Lot Construction (1405 N Riverside)
RFP results for design services were received the third week of January with Robinson
Engineering securing the contract for design services. Project design is planned to take
approximately 6 months to complete with the project ready for construction in the fall.
