AGENDA ITEM SUMMARY:
The purpose of this agenda item is to provide the City Council with information needed for the
establishment of the 2022 Property Tax Levy amount and for the adoption of a resolution
identifying levy amount to be requested and establishing Monday, December 19th at 7:00p.m. as
the date and time for the conducting of the Property Tax Levy Public Heari ng and consideration
of the 2022 Property Tax Levy Ordinance.
BACKGROUND/ANALYSIS:
General Fund Revenues provide the funding source for operating and capital improvement costs
for all municipal departments except for the Water and Sewer Divisions of Public Works (water
and sewer receipts and base fees) and the Recreation Center (members fees). Examples of
capital improvement costs are facility maintenance and vehicle and equipment replacements.
The table below is provided as a reminder of the sources of revenue that comprise the General
Fund, along with the budgeted dollar amounts and corresponding percentages for Fiscal Year
22/23. Again, all General Fund revenues are accounted for in one of the line items below. As
Council can see, $21,118,366 (79.64%) of General Fund Revenues are comprised of four prima ry
sources – Property Tax, State Sales Tax, Local Sales Tax, and State Income Tax (shaded rows). Of
these four primary sources of funding, the municipality only has the ability and authority to adjust
two – Property Tax and Local Sales Tax. These two sources represent just 31.36% of General
Fund Revenues.

With this information, and as Council considers setting the Property Tax Levy amount moving
forward, it is important to identify that the City Administration has developed the Community
Investment Plan, and revenues to address the needs within this plan have been identified
through the recently adopted Electric and Gas Use Taxes. With this in mind, the remaining
revenues listed above are now truly for the operations of the City and staff has committed to
only recommending property tax increases when operating revenues do not meet operating
expenses. Additionally, since the City Administration develops a General Fund operating budget
that estimates expenditures and revenues conservatively, any surplus revenues are transferred
to the to the Capital Improvements/Equipment Funds for future capital projects that are not
funded with the recently established Use Taxes – for example the unfunded Streetscape
Program.
When the FY21/22 audit is presented to the City Council, it will be identified that the General
Fund operating expenses have been met and that the General Fund Balance has increased to a
level above the 120 reserve balance of $9,051,837, leaving a balance to transfer to the Capital
Improvements/Equipment Fund.
Despite the fact that as a “Home Rule” community the City of McHenry is no longer subject to
the Property Tax Extension Limitation Law, or PTELL - which limits increases to residents’ property
taxes by preventing a local government’s property tax levy from growing at a faster pace than
the rate of inflation, or 5%, whichever is less - the City has continued to follow PTELL guidelines
for establishing the property tax levy. In fact, for the years 2011-2015 the City chose to maintain
a flat property tax levy request at the amount that was requested in 2010. In 2016, Council chose

to decrease the property tax levy request by 3%. And in 2017-2020 the levy was again maintained
flat from the 2016 reduced amount. 2021 was the first year that property taxes were increased
to the limited extension or 2.6%.
Unfortunately, while the City has attempted to have an impact on reducing or limiting increases
to property taxes through these actions, a reduction to the City’s portion of the property tax levy
has not resulted in reductions to property tax bills. Change in EAV also drives change in the
property tax bill. When the EAV declines the tax rates must go up in order to fully fund the
property tax levy because the same amount of money needs to be collected across the new lower
values as requested by all taxing districts. For 2020, the EAV increas ed for the fifth consecutive
year so the tax rates for the City went down slightly lowering the City’s portion of the tax bill. In
fact, in 2020 that portion of a resident’s tax bill directed to the City of McHenry was only 6.3% of
the total amount. However, this does not take into consideration actions taken by the other
taxing jurisdictions that comprise the total property tax bill. As an example, in 2015 the City of
McHenry kept its portion of the property tax bill the same as 2014, but the amount of property
tax paid by the owner of a $200,000 home actually increased by $43.51 due to levy increases by
other taxing bodies.
TAX LEVY RECOMMENDATION:
Based on the totality of th e information that has been reviewed in this memorandum, staff is
forwarding a recommendation to leave the property tax levy that is flat for 2022. It is important
to note with the issuance of the Pension Obligation Bonds the City will have a separate lev y for
the annual bond costs. The 2022 Pension Obligation Levy is $1,665,073. With this being said, the
2022 levy will actually be set at $3,072,868 in order for the total levy (Pension Obligation Bond
levy and City Levy) to equal the 2021 Value.
If City Council concurs, a motion should be made to adopt the attached Resolution establishing
the date and time of Monday, December 19, 2022 at 7:00p.m. for conducting a Public Hearing
for establishing the 2022 City of McHenry Property Tax Levy in the amou nt of $3,072,868 and,
upon closing the Public Hearing, the consideration of the 2022 Property Tax Levy Ordinance in
the amount of $3,072,868.

RESOLUTION DETERMINING THE AMOUNT OF FUNDS TO BE LEVIED FOR THE 2021
TAX YEAR THROUGH REAL ESTATE TAXES FOR THE CITY OF MCHENRY, MCHENRY
COUNTY, ILLINOIS
WHEREAS, the City of McHenry has historically levied taxes for the purpose of
conducting City business for its residents and local businesses; and
WHEREAS, the City of McHenry has worked diligently on behalf of its residents and
local businesses to reduce expenditures while attempting to provide the same high quality of
programs and services; and
WHEREAS, the City of McHenry has, for the following years (2011, 2012, 2013,
2014, 2015, 2016, 2017, 2018, 2019, 2020), forgone an increase or decreased the Property Tax
Levy thereby keeping proposed levy amounts equal or less than the amount approved in 2010;
and
WHEREAS, the City of McHenry passed a 1.4% increase to the proposed levy amount
of $3,073,069 to be collected in 2022; and
WHEREAS, the City of McHenry proposes a 0% increase to the proposed levy amount
of $3,072,868 to be collected in 2023; and
WHEREAS, a Public Hearing will be held on December 19, 2022, at 7:00 p.m., at which
date and time the public will have an opportunity to comment on said proposed levy; and
WHEREAS, the date of the Public Hearing will be published in the Northwest Herald
newspaper and posted in the McHenry Municipal Center.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City
of McHenry, McHenry County, Illinois go on record establishing the date and time, December
19, 2022, at 7:00 p.m. for the Public Hearing to consider the proposed 2022 Property Tax Levy
in the amount of $3,072,868.

Authorization to host the McHenry ShamRocks the Fox event to include 1) temporary use permit
to allow an event tent at 1202 Riverside Drive (Miller Point) and live music on Friday 3/17,
Saturday 3/18 and Sunday 3/19; 2) special event liquor license for the sale of beer, wine and malt
beverages; 3) permit open carry of alcoholic beverages in plastic cups throughout Green Street
and Riverside Drive areas; 4) closure of certain sections of Kane Ave, Green Street Pearl Street,
Riverside Drive, Broad Street, Park Street and Court Street from 11:45 AM to approximately 1:00
PM for the St. Patrick’s Day Parade; 5) closure of Pearl Street from Riverside Drive to River Road
from 10:00 AM to 1:30 PM during the dyeing of the Fox River and the parade; and, 6) Tourism
Fund budget amendment not to exceed $10,000.
BACKGROUND:
This city has partnered with local service organizations for a several years for the 5K “Shamrock
Shuffle” and a St. Patrick’s Day Parade. The Kiwanis Club Shamrock Shuffle begins and ends at
East Campus High School and has kicked off the day at 7am, typically lasting 2 hours. The parade
is organized by the City of McHenry staff. For the last few years, the parade has been on Kane
Avenue and stepped off at 12pm. The parade heads north on Green Street turning east on Pearl
Street, north on Riverside Drive, wraps around and returns to Veterans Memorial Park via Broad
Street.
The City is the only community in McHenry County that offers a St. Patrick’s Day Parade. The
parade has gained the city some notoriety, which has led to the opportunity for expanding the

event and accomplishing the city’s goal of increasing awareness of our downtown and utilization
of the Fox River.
The city is once again proposing to partner with Blarney Island to dye the Fox River green on St.
Patrick’s Day between Weber Park and the Route 120 Bridge. The only other river dyeing event
occurs in the City of Chicago. This opportunity lends itself to creating a festival atmosphere
throughout the Green Street and Riverside Drive areas and for the city to create an epicenter for
the event at Miller Point. “Event central” would include a large tent with heaters, bar, sound,
stage and lighting. Live music would be in the tent on Friday 3/17 from 5pm – 11pm, Saturday
3/18 from 11a m – 11pm and on Sunday 3/19 from 12 – 6:30pm. Alcohol service of beer, wine
and malt beverages would be available on Friday from 5pm – 10:45pm, Saturday from 11am to
10:45pm and on Sunday from 12pm to 6:45pm.
A key element of the event is the open carry of alcohol in the areas delineated by the Riverwalk
to the south, Pearl Street to the north, Green Street between Waukegan Road and Pearl Street,
and River Road between Pearl/Lincoln and Route 120 to the west. Proposed hours for open carry
are 11:00 AM to 6:00 PM on Saturday and 12:00 PM to 6:00 PM on Sunday. This would allow the
flow of event patrons throughout downtown, encouraging businesses to have specials similar to
the annual Taste of McHenry currently sponsored by the Downtown Business Association three
times each year.
ANALYSIS:
Identified in the Strategic Plan completed by the City in the fall of 2013, were seven opportunities,
two of which correlate to this proposed event - Utilization of the Fox River as a marketing tool
and Public Event Coordination. This event provides the City with the opportunity to draw visitors
to the downtown area and businesses.
Building on solid partnerships and strong events, the City can become a weekend destination
through the introduction of this event. McHenry will become a destination that people will
return to repeatedly to visit our restaurants and shops. Often the challenge is to get visitors here
for the first time. Staff believes that “McHenry ShamRocks the Fox” is an event accomplish this.
Although the City would be the lead organizer for the event, the development of partnerships
that has already begun and taking advantage of each partner’s strengths, will lead to a successful
event.

The parameters for this event were established utilizing standards from city partnerships in other
events. Event times mirror those for Fiesta Days and Blues, Brews and BBQ’s, as does the concept
of the alcohol service. In this instance, instead of volunteers serving, staff from Blarney Island
who are trained and BASSET certified would staff the bar. Mr. Rob Hardman, owner of Blarney
Island would also organize the live music in the tent and the City has reached out to local
restaurants to identify food vendors in the tent.
Open carry of alcoholic beverages is a key component to the success of the event. It takes
advantage of a concept the city currently allows for the Sidewalk Sales portion of Fiesta Days and
the Chamber of Commerce’s popular Downtown Uncorked Wine Walk. The goal of allowing
patrons to move throughout the downtown business area during the hours of 11:00pm to
6:00pm on Saturday and 12:00 PM – 6:00 PM on Sunday is to create a flow that introduces new
visitors to the many great businesses located in the downtown areas. It encourages businesses
to have specials that could be advertised in the main event tent and create new partnerships.
Police Chief Birk has been consulted and is supportive of this concept. Officers would be
positioned at key intersections to ensure vehicular and pedestrian safety throughout the
downtown areas.
Staff has discussed the event with multiple downtown businesses with the message that the city
is not looking to detract from their St. Patrick’s Day offerings or compete with them in anyway.
The goal is to partner with businesses wherever possible to create a long-lasting and sustainable
event that takes advantage of the Fox River and the Riverwalk and downtown areas, and an event
that will draw many new visitors to McHenry. To be clear, the city is not looking to profit from
this event, only to cover costs and bring new visitors to McHenry.

There were over $60,000 in expenses to host the event in 2022 however the event was extremely
successful with a bottom line profit after all expenses of over $7,000. This money was returned
to the Tourism Fund. With the impact of last year’s event and timing, it would be hopeful to
garner more sponsorships for the event and its aspects this year. The one cost that was
significant new introduction to the event this year was a small scale fireworks show to conclude
the event on Sunday. The 15 minute show costs are once again estimated around $10,000. With
additional sponsorship opportunities and surplus from last year’s event, staff if not anticipating
to run the event at a deficit including the fireworks show, however a budget amendment to
include $10,000 from the Tourism Fund is requested in the event of overruns.
As a note, the street closures associated with the parade are typical. One exception is the
additional closure of what amounts to the Pearl Street Bridge for spectators to view the dyeing
of the river as safely as possible.
In summary, this is a rare event opportunities. Event planning has brought together many local
groups and partners, including the McHenry Area Chamber of Commerce, the McHenry
Downtown Business Association, the McHenry Kiwanis Club, the McHenry Rotary Club, Visit
McHenry County and several individuals who want to help and be a part of something special
that will be built on in future years. This event can make McHenry a destination in Northern

RECOMMENDATION:
Therefore, if Council concurs, it is recommended that a motion be considered to approve: 1)
temporary use permit to allow an event tent at 1202 Riverside Drive (Miller Point) with live
music on Friday 3/17 from 5pm to 11pm, Saturday 3/18 from 11am to 11pm and Sunday 3/19
from 12pm to 6:45pm; 2) special event liquor license to permit the sale of beer, wine and malt
beverages at Miller Point on Friday 3/17 from 5pm to 10:45pm, Saturday 3/18 from 11am –
10:45pm and Sunday 3/19 from 12pm to 6:30pm; 3) open carry of alcoholic beverages in plastic
cups throughout Green Street and Riverside Drive Areas on 3/18 from 11pm – 6pm and on 3/19
from 12pm – 6pm; 4) street closures of Kane Avenue from Center to Green, Green Street from
Kane Avenue to Pearl Street, Pearl Street from Green Street to Riversid e Drive, and on Riverside
Drive from Pearl Street to Broad Street and Broad Street to Court Street in conjunction with
the St. Patrick’s Day Parade from 11:45 am to approximately 1pm); 5) closure of Pearl Street
from Riverside Drive to River Road from 10 am to 1pm to allow pedestrians to view the river
dyeing; and, 6) budget amendment in the Tourism Fund for an amount not to exceed $10,000.

Roll Call: Mayor Jett called the roll call.
Members present Alderman Santi, Alderman Glab, Alderman McClatchey, Alderman Harding,

Pledge of Allegiance: Mayor Jett led the pledge.
Public Comments: Carl and Kim Eckel – Residents having issues with parking with their
business. They share around 5 parking spots for both businesses and want people to be able
to shop at their stores if there is not enough parkin g for them, would like to implement/have
enforcement to park on the streets, and came to the council for some help. Mayor Jett stated
that he will be in touch with them, and asked for them to leave their number with Deputy Chief
Johnson.
Consent Agenda: Motion to Approve the following Consent Agenda Items as presented:
A. Resolution adopting the schedule of City Council Meetings for the period January 1, 2023 ,
to December 31, 2023.
C. Ordinance amending the FY22/23 Budget in the amount of $364,000.00; and ,
Ordinance authorizing the purchase, acceptance, and execution of a real estate
contract for 3519 Elm Street, McHenry, Illinois.

B.Ordinance authorizing the Mayor’s execution of a Revocable License and Management
Agreement between the City of McHenry and McHenry Area Chamber of Commerce for the
Riverwalk Shoppes.
Alderman Glab wanted to know where this whole project is going with the city his biggest
concern is how much property tax will be paid on this. Per Director Hobson, they are currently
looking into this at this time.
Attorney McArdle did talk with the council regarding this and talked about addressing it as well.
A Motion to authorize Mayor Jett to sign if there is no cost/risk to The City of McHenry if there
is a potential for risk/cost to bring this back this item back.

Motion to approve an Economic Incentive Agreement between the City of McHenry and
1325 Riverside Drive dba Whiskey Diablo , located at 1325 Riverside Drive, in an amount
not to exceed $45,000.
Alderman Santi notices the address is within the TIFF district and wanted to know how much
time is left in 2025, discussions have been started with Senator Wilcox per Director Hobson,
doing what they can to get it extended.
Alderman McClatchy asked how long the extension would be , it was confirmed as 12 years
and it can only be requested for a one-time 12-year extension per Administrator Morefield.
Alderman Glab likes seeing progress however would like to see more selection as to what
businesses are being brought in the future. No public comment.

Alderman Glab would not like there to be too many electronic boards, he is against it but
understands the situation here. Alderwoman Miller stated there really is no space and
unfortunately, there are not any other options for them. Alderman Santi stated that things are
looking nice at that facility and hopes he develops even more business.

Alderman Santi stated from conversations with Director Polerecky it looks like it’s a smaller
area because of the restrictions it will cover up what is being stored, up against the parking lot,
there is not a visual facing 120.

Mayor Jett asked if there were any questions from The Council regarding this. Erick Cook was
in attendance for Mr. Justen who was not able to be here at the meeting. Would like to have

options as a business to help offer other options to families.
Alderwoman Miller asked if this would expand the business as of right now Mr. Cook was not
able to give a certain answer regarding this. Would like to grow and expand his business to
help maybe support the celebration of life process.
Alderman Santi wanted to know if any families have ever catered for food/beverages in the
room, but Mr. Cook was not able to answer that. Alderman Santi has some concerns.
Alderman Glab thinks it is an interesting avenue and is open to hearing where this could go.
Alderman McClatchey stated that he has no problem with this it is a good avenue.
Alderman Harding stated that he has no problem with it, licenses were designed to help.
Alderman Devine stated that people are there for grieving we have turned down hair salons,
and barber shops and he is not comfortable with it.
Alderman Strach is not comfortable with the license choice, open to a different style or class of
license. The discussion of hours was brought up and the regulation as well.
B. 2023 Road Resurfacing Program Update (Strange)
Director Strange explained the supplement that was broken up into 3 sections. There was some
discussion regarding projects and updates to those.
This discussion went on for some time many were concerned about streets in the areas that
are in dire need of repair etc.

Staff reports are provided at the first meeting of each month.
Mayor’s Report: None
City Council Comments: Alderwoman Miller talked about the conference that she attended
and thanked those involved.
Alderman Glab wanted to talk about the leaf pick-up and stated this is a severe problem with
the delays, however, wanted to know where they are at, etc. He also knows that Director
Strange has been working on it. Wanted a report to give to residents etc. Per Mayor, Jett will
be meeting with Director Strange to get answers for residents.
Alderman Strach thanked Director Strange for all the work he is doing to help with the questions
regarding this.
Alderman McClatchey said the holiday lights look great in the park.
Executive Session for the setting of a price for the sale or lease of property owned by the
public body (5 ILCS 120/2(c)(6).)

AGENDA ITEM SUMMARY:
The Community Development Department received a fence variance request from Knapheide
Equipment Company 2600 Illinois Route 120 . The request is to allow a 0’ corner yard setback
along Adams Drive in lieu of the 15’ required setback.
BACKGROUND:
Knapheide Equipment Company purchased the former Adams Trailer located at 2600 Illinois
Route 120 earlier this year. Over the course of the last few months staff has worked with
Knapheide on upgrades and expansions of the site. City Council approved a conditional use to
allow the expansion of the facility to include outdoor storage of trailers and vehicles. Knapheide
has also submitted building permits to completely upgrade the interior of the buildings. Part of
the upgrades include updating the perimeter fencing around the property to not only secure the
site but also meet the conditions outlined in our ordinances and their CUP.
ANALYSIS:
The applicant is requesting a reduction in the corner side yard setback for fences from the
required 15’ to a 0’ setback. This request is only for the area in front of the existing detention
pond depicted in Exhibit A. Knapheide is asking for the variance to be able to fully surround the
property with a fence for security purposes. If the fence was required to be at the 15’ setback it
would need to dive into the bank of the detention pond still allowing persons to get around the
fence and onto the property. All other areas within the property currently do or will abide by the
fence standards set forth in the municipal code.

AGENDA ITEM SUMMARY:
Attached i s an application for a façade grant for the property located at 1251-1253 Green
Street, The Cottage Boutique (apartments above). The east façade fronts Green Street and is
the façade where the work is being done. The scope of the work is included along with the
façade application.
ANALYSIS:
The approximate cost of all the work is roug hly $5,420. The total lineal frontage of all facades
facing public ways is about 30’ therefore the applicant is requesting $2,710 for 40 feet or less of
lineal frontage. The grant is a dollar for dollar match up to $10,000 at this lineal footage. The
application includes the various cost estimates for the work.
RECOMMENDATION:
If the City Counc il conc urs with staff’s review and analysis, it is reco mmended a motion be
made approv ing an ordinance amending the FY2022/2023 budget fo r the fiscal year ending

AGENDA ITEM SUMMARY:
Due to ongoing struggles to perform leaf collection services as outlined in the City Refuse
Collection Contract, which was awarded on March 7, 2022, to Flood Brothers Disposal of
Oakbrook Terrace, Illinois, representatives from Flood Brothers are in attend ance tonight to
provide the City Council with an update regarding the leaf collection program, answer questions,
and inform the Council regarding steps they are taking to address the ongoing deficiencies.
BACKGROUND:
In January of 2022, Public Works Staff released a contract proposal and scope of services for the
purposes of the City securing a new refuse hauler. The options for scope of services were
prepared for consideration and discussed in detail over several City Council meetings. The final
scope of services was recommended for issuance by the City Council and the request for
proposals was issued in January. On February 9, 2022, the City received two (2) proposals for
refuse hauling services and after staff evaluation, a recommendation was made to award the
contract to Flood Brothers Disposal.
On August 1, 2022, Flood Brothers began collection services for the City of McHenry and has been
performing refuse hauling services for the past three months. Included in the scope of services
was curbside leaf vacuum collection services during the months of October and November. This
service was initiated at the beginning of October by Flood Brothers and to date , Flood Brothers
has struggled to perform this service in accordance with the standard defined in the contract.
These deficiencies in performance have generated a tremendous number of inquiries to staff and
elected officials regarding the hauler’s performance to date as well as both the hauler’s plan and
the City’s plan to address such deficiencies. Representatives from Flood Brothers are present
tonight to provide an update to Council on the status of the program and to inform them of
ongoing reforms to the program, as well as proposed reforms for the 2023 calendar year. This
item is being presented as a discussion item to allow for a forum for the City Council to raise

concerns regarding the performance of the program to date and to gain assurances from Flood
Brothers regarding its commitment to rectify the ongoing performance issues and fulfill the terms

BACKGROUND/SUMMARY:
In FY2022-23, the City Council budgeted $200,000.00 for the development of a new
Comprehensive Plan to replace the City’s current Comprehensive Planning & Development
Policies adopted in 2008. Staff have planned to release a Request for Qualifications (RFQ) in
December 2022 to seek qualified firms for the development of a new Comprehensive Plan in
2023. With the City’s recent investment in the Downtown - which includes Miller Point, the
Streetscape Plan, and recent property acquisition - staff is recommending for City Council’s
consideration expanding the scope of work to include a Downtown Area Plan update. Staff will
present to City Council an overview of the Comprehensive Planning Process and facilitate a
discussion for the requested expansion. If the City Council concurs with Staff’s assessment, staff
will amend the project scope of work and plan to budget for the creation of a new Downtown
Area Plan in the next fiscal year (FY2023-2024).

RE: Dead and Diseased Trees and Bushes
The purpose of this discussion item is to determine if the city should draft a new ordinance that
would require ALL dead trees and shrubs to be removed from private property regardless of it
constituting a potential hazard to life, property or other trees and plants. The current ordinance
listed below gives the city the right to have a dead tree removed if indeed it constitutes a hazard
to life, property, or other trees. Determination of the hazard is done by one o f two certified
arborists that the city has on staff. If a dead or diseased tree is deemed a hazard the code
enforcement department will send notice to the property owner stating this and that the tree is
required to be removed. If the property owner refuses to remove the dead tree after notice is
sent the city, through adjudication court, has the right to contract the removal and lien the
property to recoup costs associated with the removal.
Since 2014 there have been roughly 123 enforcements relate d to dead and or diseased trees, in
all but one that were determined to be a hazard the property owners removed the hazard from
the property.
Staff researched many other municipalities, and most municipalities have a similar ordinance to
ours which requires the tree to be deemed a hazard for it to be removed. Two municipalities
were found to have language that required the dead trees to be removed regardless of there
being a hazard or not.

8-3A-19: PRIVATE PROPERTY TREE CARE AND REMOVAL:
The City shall have the right to cause the removal of any dead or diseased tree on private
property within the City when such trees constitute a hazard to life or property, or harbor insects
or disease which constitutes a potential threat to other trees or plants within the City. Removal

shall be done by said owners at their own expense. In the event of the failure of the owners to
comply with such provisions, the City shall have the authority to remove such trees and the
owner shall immediately reimburse the City for the expense of such removal.
8-3A-12: REMOVAL OF VEGETATION LIKELY TO FALL ON PUBLIC WAYS:
Any tree or limb of a tree which has become likely to fall on or across any public way or place
shall be removed by the owner of the premises on which such tree is growing or stands.
If Council feels the need to change the ordinance to require all dead or diseased trees to b e
removed from a private property, then staff will work to bring that new ordinance to Council for
approval at a future meeting.
