C.Waive Competitive Bidding for the Purchase of Police Locker Room Lockers (Polerecky)
Due to the limited number of providers and the City’s ability to obtain three (3) competitive
quotes – waiver of the competitive bidding process as set forth in the City’s Purchasing Policies ;
acceptance of a quote from Schoollocker.com in the amount of $30,228.05; and, authorization
for the purchase of lockers for the Police Department Women’s Locker Room in an amount not
to exceed $30,228.05.
D.Budget Amendment and Award of Bid for Veterans Memorial Park Entryway (Hobson)
Approve an ordinance amending the FY23/24 Parks Developer Donation Budget in the amount
of $34,842,00; and, award of bid for the installation of the re-designed entryway at Veterans
Memorial Park in the amount of $204,842.00.
E.Budget Amendment and Approval of Scope of Services Contract for Riverwalk (Hobson)
Approve an ordinance amending the FY23/24 TIF Fund Budget in the amount of $6,440.00; and,
a scope of services contract with HR Green for finalization of Phase 4 Riverwalk plans for that
section of the Riverwalk between Pearl Street and Route 120.

AGENDA ITEM SUMMARY:
Staff requests City Council to consider approval of a supplemental IDOT Resolution for
Improvement authorizing the use of Motor Fuel Tax Funds for the 2022 Rebuild Illinois (RBI) Bond
Funded and Motor Fuel Tax (MFT) Funded Road Program (Section #22-00092-00-RS).
BACKGROUND:
In Spring of this year, City Council approved multiple Resolutions For Improvement for the use of
RBI Funds and MFT Funds for two separate 2022 Road Resurfacing Program contracts. The
program was divided into two separate section numbers (22-00092-00-RS & 23-00000-01-GM).
Section 22-00092-00-RS utilized both MFT Funds and RBI funds and therefore required the
passage of multiple resolutions. However, the second resolution, which was passed for the use
of MFT funds was not processed by IDOT Local Roads due to a correction that needed to be made
regarding the use of the IDOT forms. To avoid further multiple submittals, staff elected defer
approval of the final MFT resolution until final costs were in and a resolution could be passed in
the exact needed amount. Upon completion of the project and utilization of all funds applied to
the project, the final MFT balance is $657,105.06, which is before the City Council for approval.
ANALYSIS:
This resolution will authorize the use of the necessary Motor Fuel Tax Funds to balance final costs
for the project and submit closeout paperwork to IDOT Bureau of Local Roads. The final MFT
expenditure of $657,105.06 is significantly less than the original budgeted figure of $1,200,000.
Staff recommends approval of the resolution and submittal to IDOT Local Roads.

RECOMMENDATION:
Therefore, if Council concurs, it is recommended to approve a supplemental IDOT Resolution
for Improvement authorizing the use of Motor Fuel Tax Funds for the 2022 Rebuild Illinois Bond
Funded and Motor Fuel Tax Funded Road Program (Section #22-00092-00-RS) in the amount of
$657,105.06.

Chapter 9 of the Bureau of Local Roads and Streets Manual (BLRS Manual) for more detailed information. For signature requirements

Agenda Item Summary.
Included in the FY 2022/23 budget was a $170,000 line item for the redesign of the entrance to
Veteran’s Memorial Park. The project was competitively bid and the low bid to the project was
Carmichael Construction in the amount of $201,842. Addit ionally, there was an alternat e for the
archw ay signage in the amount of $3,000, bringing the total request to $204,842. This will also
require a budget amendment to the Parks Developer Donation Fund in the amount of $34,842.
Background.
Many improvement s have been accomplished at Veteran’s Memorial Park over the last 4 years t o
upgrade the centerpiece of the city’s park system. The washroom was expanded and completely
remodeled, all the buildings were re-roofed, the gazebo was repainted, and a brand -new
expanded pavilion was installed.
One major area in need of improvement is the park entryway. Over the last year, city staff
worked with HR Green on a complete re-design that better captures the identity of Veteran ’s
Memorial Park. The plans and the rend ering of the improvements are attached. It retains a
similar feel however gives the military branches more iden tity as does the archway signage. The
land scaping will be completely redone, and the flagpole will be set off by itself to get it more of
it s own prominence.
The project was competitively bid. Six plan packets were distributed , however only two were
submitted (the bid tab sheet is attached). The low bid was provided by Carmichael Construction
in the amount of $201,842. Staff is also recommen ding upgrad ed letting that will along for
backlit lighting of the letters for an additional $3,000.
Analysis.

The upgrade to the park is long overdue with the last improvement s to the park occurring with
the re-d esign in 1986. The design only further cements a park that is the heart of our community.
The bids have been reviewed by HR Green for accuracy and all has checked out . Carmichael
Construction has completed other projects for the city includ ing the gazebos on the Riverwalk
and our current electronic community sign to name a couple.
The bids do exceed the budgeted amount of $1 70,000 and therefore will require a budget
amendment in the amount of $34,842 from the Parks Developer Donations Fund.
Recommendation.
If City Council concurs, then it is recommended to approve the award of bid for the
installation of the re-design of the entryway at Veteran’s Memorial Park in the amount of
$204,842 and to approve a budget amendment to the Parks Developer Donation for an
additional $34,842 to cover the overage from the budgeted $170,000.

AN ORDINANCE AMENDING THE FY202 2/2023 BUDGET FOR THE
FISCAL YEAR ENDING APRIL 30, 20 23
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City’s home rule powers
and functions as granted in the Constitu tion of the State of Illinois; and
WHEREAS, the City of McHenry acting by and through its Mayor and City Council has
previously approved the FY22/23 Annual Budget for the Fiscal Year Ending April 30, 2023 by a
motion at the Regular City Council Meeting held on April 18, 2022; and
WHEREAS, it is necessary and appropriate to delete, add to, or otherwise change certain
line items in said Budget Ordinance as provided in Exhibit A to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: That the amendments to the Budget Ordinance for the Fiscal Year Ending
April 30, 2023 are hereby approved in the form and content as provided by Exhibit “A” which is
attached hereto and made part hereof.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain
and continue in full force and effect.
SECTION 3: All ordinances, or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.

Agenda Item Summary.
Included in the FY2022/23 budget was a $40,000 line item for the engineering services to take
Phase 4 of the Riverwalk from 80% engineered through completion and bidding. A proposal
was submitted from HR Green in the amount of $46,440. With this over the budgeted amount
the execution of the item will require a budget amendment from the TIF in the amount of $6,440.
Background.
Three years ago, the city and the McHenry Riverwalk Foundation continued the process of the
expansion of the Riverwalk and the garnering of the easements to do so. This included
amending the engineering documents to accurately reflect the wishes of the current property
owners and to increase the viability of construction . At the time those documents were
completed to an 80% level.
The last remaining section along the Fox River is the section between the Pearl Street Bridge and
the IL Route 120 Bridge. This section will tie together a continuous walk from Green Street to
Weber Park. Through the course of the last year, the Riverwalk Foundat ion President , John
Smith, has had numerous conversations with the property owners regarding the easements based
on the 80% completed plans. Progressing these plans to 100% would also include the
preparation of easement documents and the designation of a construction easement. The scope
of services that is included would also prepare and put the plans out to bid for potential
construction in 2023.
Analysis.
Completion of the construction documents is an important step towards finishing the Riverwalk
along the Fox River and significant ly increasing the city of McHenry’s residents’ access to the
river and , conversely, the access to our business community from boaters on the river. It is a
step that the city has envisioned for over 20 years.

HR Green is the firm t hat has completed the 80% documents and has all the background to
finalize the plans most efficiently.
The quote does exceed the budgeted amount of $40,000 and therefore will require a budget
amendment in the amount of $6,440 from the TIF Fund.
Recommendation.
If City Council concurs, then it is recommended to approve the Scope of Services Contract
with HR Green for the finalization of the Riverwalk plans for the section of Riverwalk
between the Route 120 Bridge to the southern terminus of the existing Riverwalk under the
Pearl Street Bridge in the amount of $46,440 and to approve a budget amendment to the
TIF Fund for an additional $6,440 to cover the overage from the budgeted $40,000.

THIS AGREEMENT is between City of McHenry (hereafter “CLIENT”) and HR GREEN, INC.
(hereafter "COMPANY").
1.0 Project Understanding
1.1 General Understanding
The CLIENT, working in conjunction with the McHenry Riverwalk Foundation, is looking to
complete the City’s Riverwalk from the north side of the Pearl Street Bridge along the Fox River,
to connect to the existing Riverwalk termination at the north side of the Route 120 Bridge. This
section will commonly be known as Riverwalk Phase 4.
This section of Riverwalk will be designed in accordance with agreements with adjacent
property owners, and will consist of an over-the-water boardwalk and a half on-land, half over-
water boardwalk. A pedestrian access, meeting current ADA standards will be included at the
south side of the Pearl Street Bridge and will extend from the proposed boardwalk to the
existing driveway access behind the Old Bridge Tavern. ADA improvements on the west side of
the driveway will be performed by others.
This phase of the project will be designed and bid with a single bid package with the intent of
obtaining a General Contractor to complete the project.
This project will cover Engineering design, permitting and bidding services.. Construction
Engineering services can be provided under a separate contract.
1.2 Design Criteria/Assumptions
COMPANY will complete a set of Construction documents using the project plan set developed
by COMPANY under a previous contract as a general starting point. Updates/revisions will be
made in accordance with CLIENT direction and easement agreements with adjacent property
owners.
This section of Riverwalk has been updated and is anticipated to include a boardwalk extending
in the Fox River from the termini of the Phase 3A project on the north side of Pearl Street Bridge
to the Boat Company site, then transitioning to a half on land, half in the water section to
connect to the existing Riverwalk at the north side of the Route 120 bridge.
Existing steel seawalls within this project’s limit are anticipated to be replaced with new steel
sea walls.
COMPANY assumes all flatwork, metal railing work, lighting, boardwalk, furnishings, to match
existing materials, installation methods and specifications used on the previous phases of the
Riverwalk. If alternate materials, methods, or vendors are chosen, COMPANY will prepare an
addendum to this contract to prepare the additional details and specifications as necessary.
COMPANY will include work to repair the toe of slope on the west abutment of the Pearl Street
Bridge. The engineering fees and construction costs will be documented separate from the rest
of the project for separate billing to the CLIENT.

The design plans will be completed as a single plan set, with a single set of bidding documents.
The detail sheets for the design plans will be separated by trade but included in the single plan
set.
2.0 Scope of Services
The CLIENT agrees to employ COMPANY to perform the following services:
2.1 Engineering Plan Completion
1. Beginning with the current design plans, and gaining input from the CLIENT, adjacent
property owners, and the Riverwalk Foundation, COMPANY will develop a finalized
layout, construction drawings and details, and specifications included in the drawing
set. Separate project specifications will not be separated into the bidding document
packages.
2. The construction documents will consist of construction drawings and specifications.
This phase provides services to complete design and construction details for all the
improvements within the phase of the project as defined above. The documents will
include the following:
1) Title Sheet with Sheet Index, Location Map, and Project Contact Information.
2) General Notes Sheets with Site/Civil Notes, Project specifications, Erosion
Control Requirements, and Landscaping General Notes as necessary to
provide instruction to the contractor.
3) Site Sheets that will include all the following info:
a. Existing Conditions and required Demolition notes indicating existing
topography, vegetation, hardscape elements, and other available site
infrastructure information as well as any items to be demolished and/or
relocated such as seawall, curbs, boardwalk/piers, signs, benches,
posts, gates, pavement.
b. Layout and Dimensioning information that will indicate layout geometrics
for all of the site improvements listed above.
c. Grading and Drainage information with spot grade elevations as
necessary, erosion control measures and any necessary drainage
improvements. The project will be designed to comply with ADA
requirements.
4) Construction Detail Sheets will provide all of the necessary construction details
to construct the improvements listed above. These sheets will be separated
by project discipline and are anticipated to include the following:
a. concrete seawall top rehab detail
b. concrete jointing detail(s)
c. steel seawall detail

5) Pearl Street Bridge Repairs. COMPANY will provide engineering analysis and
design services for repair of the toe of slope wall on the west abutment of the
Pearl Street Bridge. Construction plans and specifications will be provided and
included within the overall project documents.
6) Landscape Plan indicating all tree, shrub, perennial, and groundcover locations
with species callouts including a material schedule and typical details. For this
phase of the project the landscape plan is understood to only include minor
landscaping and turf restoration in areas of disturbance at the hotel location
and a low maintenance landscape plan at the handicap access just south of
Pearl Street.
7) Lighting Plan. Will be provided by the lighting sub-consultant and coordinated
with proposed layout and dimensioning plan. The Lighting sub-consultant will
be provided by COMPANY as a part of this agreement.

8) Geotechnical Report. Will be provided by others, if necessary.
9) Opinion of Probable Cost (OPC) will be prepared for the project once these
documents are at 90% with a final OPC at completion and prior to bidding the
job.
2.2 Easement Documentation Revision
COMPANY will make revisions to the previously submitted easement exhibits. These
revisions will be provided by the CLIENT.
2.3 Topographical Pick-up Survey
COMPANY will complete any pick-up survey as necessary to complete the design, as
needed, for obtaining the required permits, or completing the easement documents. All
survey will be added to the project’s base drawing files which will be completed in
AutoCAD release 2021.
2.4 Bid Services
The COMPANY will create one (1) comprehensive bid package for this project with the
goal of obtaining a general contractor to complete the work. The front-end documents will
be the CLIENT standard documents used for previous CLIENT projects. This package will
include the following areas of work:
A. Landscape/Restoration
B. Concrete
C. Electrical/Lighting
D. Dock/pier/seawall
E. Railings
Bid package will be provided electronically to CLIENT for posting on web site.
COMPANY will provide a notice to bidders for posting in the local newspaper
COMPANY will provide a pre-bid conference for contractors planning on bidding the
project to become familiar with the site and the construction documents. Detailed meeting
minutes will be provided by the COMPANY to all in attendance.
COMPANY will review questions submitted by potential bidders and provide addenda, as
necessary.
COMPANY will attend the bid opening, provide bid tabulation, and provide a
recommendation to award to the lowest responsible bidder.
2.5 Permitting

COMPANY will provide permit application to the Army Corp of Engineers (ACOE), The
Illinois Department of Natural Resources – Office of Water Resources (IDNR-OWR), and
the City’s Stormwater Permit. All permit fees will be paid for by the CLIENT.
3.0 Deliverables and Schedules Included in this Agreement
A. Meetings/Coordination
The COMPANY anticipates that this project will require up to five (5) meetings with the
CLIENT to complete the required tasks. Design review meetings will occur at the
beginning of the project including easement document discussions, at 60%, 90% design
review, and at final review prior to bidding.
COMPANY shall conduct one (1) meeting with utility company to coordinate and resolve
any utility conflicts with proposed improvements. This does not include time to resolve
any utility conflicts with private business owners.
B. Deliverables
All documents are anticipated to be delivered in electronic PDF format via email of
thumb drive.

include a photometric plan with fixture and electrical layouts, pole and fixture
specifications and installation details (as necessary) for the footing and anchoring. This
cost will be included within this agreement.
6.0 Client Responsibilities
Client responsibilities include:
1. Verify the list of manufacturers and furnishings to be used within the project, per what
was installed on the previous phase.
2. Provide all applicable fees for permitting.
3. Confirm the type of bid document front-end documents to be used
4. All coordination and paperwork required for any unforeseen permitting.
5. Provide COMPANY with new locations for any relocated items (signs, etc.)

7.0 Professional Services Fee
7.1 Fees
The fee for services will be based on COMPANY standard hourly rates current at the time
the AGREEMENT is signed. These standard hourly rates are subject to change upon 30
days’ written notice. Non-salary expenses directly attributable to the project such as: (1)
living and traveling expenses of employees when away from the home office on business
connected with the project; (2) identifiable communication expenses; (3) identifiable
reproduction costs applicable to the work; and (4) outside services will be charged in
accordance with the rates current at the time the service is done.
7.2 Invoices
Invoices for COMPANY’s services will be submitted, on a monthly basis. Invoices will be
due and payable upon receipt in accordance with the Illinois Prompt Payment Act 50ILCS
505. If any invoice is not paid within these timelines, COMPANY may, without waiving any
claim or right against the CLIENT, and without liability whatsoever to the CLIENT, suspend
or terminate the performance of services.
7.3 Extra Services
Any service required but not included as part of this AGREEMENT shall be considered extra
services. Extra services will be billed on a Time and Material basis with prior approval of
the CLIENT.
7.4 Exclusion
This fee does not include attendance at any meetings or public hearings other than those
specifically listed in the Scope of Services. These service items are considered extra and
are billed separately on an hourly basis.
7.5 Payment
The CLIENT AGREES to pay COMPANY on the following basis:

AN ORDINANCE AMENDING THE FY202 2/2023 BUDGET FOR THE
FISCAL YEAR ENDING APRIL 30, 20 23
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City’s home rule powers
and functions as granted in the Constitu tion of the State of Illinois; and
WHEREAS, the City of McHenry acting by and through its Mayor and City Council has
previously approved the FY22/23 Annual Budget for the Fiscal Year Ending April 30, 2023 by a
motion at the Regular City Council Meeting held on April 18, 2022; and
WHEREAS, it is necessary and appropriate to delete, add to, or otherwise change certain
line items in said Budget Ordinance as provided in Exhibit A to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: That the amendments to the Budget Ordinance for the Fiscal Year Ending
April 30, 2023 are hereby approved in the form and content as provided by Exhibit “A” which is
attached hereto and made part hereof.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain
and continue in full force and effect.
SECTION 3: All ordinances, or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.

AGENDA ITEM SUMMARY:
Staff requests that the City Council consider the approval of Change Order #1 for the 2022-2023
Sanitary Sewer Lining Program, which includes the elimination of sanitary sewers located at the
intersection of Illinois Route 31 and Illinois Route 120 and the addition of an emergency sanitary
sewer repair located at a creek crossing on Bull Valley Road.
BACKGROUND:
On September 6th of this year the City Council awarded the 2022-2023 Sanitary Sewer Lining
Program contract to National Power Rodding Corporation of Chicago, Illinois. This project is part
of an annual program included in the 10-year Water-Sewer Capital Improvement Program, which
is funded with Water and Sewer Base Fees. Upon approval, the contract documents were
executed, and a preconstruction meeting was held in Late-September of this year.
The scope of work for this year’s program included the lining of sanitary sewers which are
tributary to and run through the eastern intersection leg of Illinois Route 31 and Illinois Route
120. At the preconstruction meeting the traffic control arrangements for the lining of these
sewers was discussed and it became apparent that the necessary lane closures would not be
feasible during daytime hours and would require permitting the work through IDOT. Therefore,
the contractor was given direction to omit these sewers from the planned scope of work , which
resulted in a $49,640 deduction in the standard items included in the awarded contract.
Additionally, shortly after award of the contract, an emergent failure in the sanitary sewer line
which runs along Bull Valley Road within the McHenry County Division of Transportati on right of
way was discovered. This failure was found through routine cleaning and televising operations

performed by the Public Works Department. It is believed that this failure may have been caused
by an adjacent utility installation, but the specific cause is not able to be determined. The failure
includes a large and leaking crack in the sanitary sewer which has occurred underneath an
unnamed creek just south of Bull Valley Road. Due to the location, an open excavation and point
repair will not be feasible. Upon discovery of the failure, staff reached out to National Power
Rodding and provided the televising record to request a scope and cost for a repair, which
National Power Rodding provided in the amount of $45,000. Due to the difficulty of mobilizing a
contractor who specializes in this scope of repairs, and the opportunity to coordinate this work
with other work National Power Rodding is already under contract for, it is recommended that
this repair work be added to this year’s sewer lining program contract. The increased costs of
the repair will be balanced with the previously referenced deductions resulting in a net deduction
from the contract.
ANALYSIS:
This change order is balanced between additions and deductions and results in a net $4,640
deduction from the contract. The sanitary sewers omitted will be able to be lined at a later date
upon permitting the necessary work through IDOT and making arrangements for necessary traffic
control accommodations. The proposed pricing for the emergency repair has been analyzed by
staff and has been found to be acceptable.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended to approve Change Order #1 for the 2022-
2023 Sanitary Sewer Lining Program contract with National Power Rodding Corporation, which
is a net deduction from the contract of $4,640.00.

An application has been submitted by Diana Holeck for the purpose of holding a block party on
Saturday, October 22, between 3:00 p.m. and 10:00 p.m. They are requesting closure of the
portion of Conway Circle as shown on the attached map.
BACKGROUND:
The City of McHenry allows block parties on all residential streets providing they do not block
intersecti ons, cul-de-sacs, or other roadways. To schedule a block party, City residents submit
an application to the City Administrator’s office. There is no fee for the permit. Once approved,
only moveable barriers (sawhorses) that are dropped off and picked up by Public Works can be
used to control traffic. Blocking streets with vehicles is prohibited.
Please note that all residents will have full access to their driveways for the du ration of the
block party.
RECOMMENDATION:
Therefore, if C ouncil concurs, it is recommended a motion be made to approve the b lock
party request on Conway Circle on October 22, 2022. Public Works will provide barricades
and the McHenry Township Fire Protection District and Police Department will be notified of
t he event.

River Pearl LLC dba The Courthouse has applied for a l iquor license for the former location of
the Town Club, at 1401 N Riverside Drive.
All required paperwork and background checks have been c ompleted.
Please note that the business does intend to apply for a Video Gaming License in the future and
that this will come back to Council for separ ate consideration at some later date.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended a motion be made to approve a Class A
Liquor License to River P earl LLC dba The C o urthouse, located at 1401 N Riverside Drive , and

ORDINANCE NO. 22-
Amending Title 4, Chapter 2, Alcoholic Liquor, Section 6, License Classification
and Fees; Approval Authority; Limitation on Number of Licenses
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 4-2-6, subs ection D-1, of the Municipal Code relating to
liquor license clas sifications , shall be amended as follows :
D.1. Class A (Full Bar) License: Issuance of a Class A license shall authorize the sale of
alcoholic liquor for consumption on the premises, and the retail sale of packaged liquor.
The annual fee for such license s shall be one thousand five hundred dollars ($1,500.00).
A Class A licensee shall be eligible to apply for a catering endorsement for an
additional fee of three hundred dollars ($300.00), which shall permit the servic ing of
alcoholic liquor for off -site consumption as an incidental part of food service, sold at a
package price, as agreed upon under contract. Nonprofit organizations with a Class A
license shall be eligible to pay a reduced fee of five hundred dollars ($500.00) per year
to receive and mainta in a Class A license. No more than forty-two (42) Class A licenses
shall be in force in the City at any time.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of
this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such
judgment shall not effect, impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.

AGENDA ITEM SUMMARY:
On August 1, 2022, the City Council approved an ordinance annexing approximately 148.03 acres
of unincorporated pockets of land. At the direction of City Council, staff initiated the process to
rezone various property based on existing uses and structures on behalf of the property owners.
Property to be rezoned include the McHenry Kindercare Child Daycare Center, several small
agritourism operations on Crystal Lake Road, Taradash Law Offices on IL-31, two public utility
sites, an industrial warehouse facility on the southwest corner of Cunat Drive and Bull Valley
Road, and a variety of property actively farmed along Bull Valley Road. On September 21, 2022,
the Planning & Zoning Commission voted unanimously to recommend approval of the requests.
There were no objectors present at the hearing. A summary of all requests can be found in the
attached Planning & Zoning Commission Staff Report.
RECOMMENDATION:
Therefore, if the City Council concurs, it is recommended that the attached Ordinance Granting
Various Zoning Approvals for Property Recently Annexed by the City of McHenry be approved.

on the lot size. This particular property has been commercial for over twenty years. There is
other C-2 zoning at Royal and Crystal Lake Road.

and went through a rude shock when initially receiving the letter regarding forced annexation.
He did note, however, that Planner Sheriff and his alderman have handled things perfectly. This
was a difficult task and he appreciates the help received from the City. Chairwoman Rockweiler
closed the public hearing portion of the meeting at 7:09 p.m. There was no discussion on the

ORDINANCE GRANTING VARIOUS ZONING APPROVALS FOR PROPERTY RECENTLY ANNEXED BY
THE CITY OF MCHENRY
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the
passage of this Ordinance constitutes an exercise of the City’s home rule powers and functions
as granted in the Constitution of the State of Illinois; and
WHEREAS, a petition has been filed by the City of McHenry requesting various zoning
approvals for property recently annexed by the City of McHenry as identified in “EXHIBIT A”; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on September 21, 2022 in the manner prescribed by ordinance and statute, and as
a result of said hearing, the Planning and Zoning Commission did unanimously recommend to the
City Council the granting of the requested zoning approvals; and
WHEREAS, the City Council has considered the evidence and recommendations from the
Planning and Zoning Commission and finds that the approval of the request is consistent with the
objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals,
and general welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1: That 4717 W Crystal Lake Road (PIN: 09-34-178-001, 09-34-326-006) is hereby
granted a Zoning Map Amendment to C-2 Neighborhood Commercial District, Zoning Variations
to accommodate all existing principal and accessory structures excluding any gravel driveways, a

Staff Comments
The following comments and conclusions are based upon staff analysis and review prior to this hearing and are
to be considered viable unless evidence is established to the contrary. Staff may have additional comments
based upon the testimony presented during the public hearing.
BACKGROUND & REQUEST SUMMARY
The City of McHenry is in the process of involuntarily annexing wholly surrounded tracts of land consisting of
60 acres or less. Property annexed include areas along Crystal Lake Road, Bull Valley Road, IL-31 (south of Bull
Valley), Ponca Street, and Hay Street. According to the City’s Annexation Ordinance and State Statute, the
default zoning upon annexation is the most restrictive form of residential based on lot size. To accommodate
the existing uses and structures, the City of McHenry is requesting approval of various Zoning Map
Amendments and Variations (excluding gravel drives).

ZONING MAP AMENDMENT APPROVAL CRITERIA (§11-5-5) Staff comments italicized below.
A. Compatible With Use Or Zoning of Environs.
This section of the Crystal Lake Road corridor has various commercial and residential uses including
McHenry West Campus High School. The purpose of the Neighborhood Commercial District is to provide
locations for a broad selection of convenience goods and services and a limited selection of shopper
goods serving more than one neighborhood. Located on an arterial road and near several major

employers (DIST 156, Post Office), staff believes the request meets the definition and is compatible with
the surrounding mix of residential and commercial uses.
B. Supported by Trend of Development
Staff believes the proposed request is supported by the trend of development. Commercial property
located at the intersection of Royal Drive and Crystal Lake Road are all zoned C-2 Neighborhood
Commercial. This would indicate a trend of development within the general area.
C. Consistent with Comprehensive Plan Objectives.
Staff believes the request is consistent with the comprehensive plan objectives to encourage annexation
into the City of McHenry as well as to expand/preserve commercial development.
D. Furthers Public Interest
Staff believes the request furthers the public interest by allowing the existing child daycare operation to
continue to provide their services to the community and will continue to allow future commercial uses.
APPROVAL CRITERIA FOR CONDITIONAL USES (§11-15-5). Staff comments italicized below.
A. Traffic:
The childcare center has operated in its present capacity for at least 20 years without adversely
impacting the surrounding property owners. Located near a school, bus pickup and drop off is not out of
the ordinary on this section of Crystal Lake Road.
B. Environmental Nuisance:
Staff does not believe approval of the petitioner’s request would generate any environmental
nuisances.
C. Neighborhood Character:
Given the longevity of the use as a childcare center for approximately 20 years, staff does not believe
the continued operation would be out of character with the surrounding mix of commercial and
residential land use.
D. Public Services and Facilities:
The site has access to City water and sanitary sewer. At the time their well or septic fails, the property
owners will be required to connect to the City’s services as required by the McHenry County Health
Department.
E. Public Safety and Health: The proposed use will not be detrimental to the safety or health of the
employees, patrons, or visitors associated with the use nor of the general public in the vicinity.
Staff does not believe the proposed use will generate any adverse impacts on public safety and health
given the longevity of the use.
F. Other Factors:
VARIANCE APPROVAL CRITERIA (§11-19-5). Staff comments italicized below.
A. Special Circumstances Not Found Elsewhere.
Staff believes the variation request are related to a special circumstance not found elsewhere due to
the property being forcibly annexed and therefore have structures that once were legally constructed
but no longer conform due to the change in jurisdiction.
B. Circumstances Relate to the Property Only.
Staff believes this is a special circumstance as it relates to this property only and not all property within
the C-2 Neighborhood Commercial District.
C. Not Resulting From Applicant Action.
The applicant did not cause the nonconformity, it was due to the City forcibly annexing the property.
D. Unnecessary Hardship.
Staff believes enforcement would create an unnecessary hardship on the applicant due to the
circumstances of the annexation and that any resulting nonconformities were caused by the City’s
annexation of the subject property.

E. Preserves Rights Conferred By District:
Staff believes this does not confer a special privilege for the subject property.
F. Necessary For Use Of Property:
Staff believes that approval of the variations are necessary for the reasonable use and enjoyment of the
property as a childcare center.
G. Not Alter Local Character:
Staff believes approval of the petitioner’s request would not substantially alter essential character of
the locality due to the longevity of operations as a child daycare center for more than 20 years.
H. Consistent With Title And Plan:
Staff believes the request is consistent with supporting commercial development to offer a wide variety
of commercial services.
I. Minimum Variance Recommended:
Staff believes the variations requested are the minimum required.

intersection of Royal Drive and Crystal Lake Road are all zoned C-2 Neighborhood Commercial. This
would indicate a trend of development within the general area.

Recommended Motion: I motion to recommend approval of the petitioner’s request for a Zoning Map
Amendment to C-5 Highway Commercial District for the property located at 908 and 912 S IL-31, Zoning
Variations to accommodate the existing principal and accessory structures, and any other zoning relief
necessary to accommodate the existing law office operations at 908 S. IL-31, and a Use Variation to allow a
single-family residence in the C-5 Highway Commercial District for 912 S. IL-31.
And by making said motion I agree that the approval criteria for Zoning Map Amendments, Use Variations, and
Zoning Variations have been met as outlined in the staff report.
ZONING MAP AMENDMENT APPROVAL CRITERIA (§11-5-5) Staff comments italicized below.
A. Compatible With Use Or Zoning of Environs.
The section of the IL-31 corridor is characterized by highway commercial zoning. Staff believes the
request to rezone the property to the C-5 Highway Commercial district is consistent and compatible
with other property within the area.
B. Supported by Trend of Development
Staff believes the proposed request is supported by the trend of development. Located on a State
Highway, many commercial properties are zoned C-5 Highway Commercial District. Staff believes the
request is consistent with other property within the general vicinity of the subject property.
C. Consistent with Comprehensive Plan Objectives.
Staff believes the request is consistent with the comprehensive plan objectives to preserve and promote
commercial land use and highway commercial zoning along state highways.

D. Furthers Public Interest
Staff believes the request furthers the public interest by supporting the comprehensive plan’s
recommendation for zoning property highway commercial when adjacent to state highways.
APPROVAL CRITERIA FOR USE VARIANCES (§11-19-5) Staff comments italicized below.
A. Practical Difficulties or Particular Hardship: For reasons fully set forth in the written findings, the strict
application of the provisions of this title relating to the use of the buildings or structures, or the use of
the land, would result in unnecessary and undue hardship upon the applicant, as distinguished from
mere inconvenience.
Staff believes the strict application of the provisions of the Zoning Ordinance would result in an
unnecessary and undue hardship upon the property owner due to the circumstances of being forcibly
annexed.
B. Reasonable Return: The property cannot yield a reasonable return if permitted to be used only under
the conditions allowed by the regulations in this title for the pertinent zoning district.
N/A
C. Unique Circumstance: Special circumstances, fully described in the written findings, exist that are
peculiar to the property for which the use variance is sought and that they do not apply generally to
other properties in the same zoning district.
Staff believes the request is under a special circumstance related to the longevity of the use of site as
single family while the City desires to see future commercial growth on IL-31 but due to the uniqueness
of the circumstance related to the annexation the City is willing to accommodate the existing use.
D. Not Alter Local Character: The granting of the use variance will not alter the essential character of the
locality, nor substantially impair environmental quality, property values or public safety or welfare in
the vicinity.
Staff does not believe approval of the request will generate any adverse impacts on the surrounding
area due to the longevity of the property being used for residential.
E. Consistent With Title And Comprehensive Plan: The granting of a use variance will be in harmony with
the general purpose and intent of this title and of the Comprehensive Plan of the City.
Staff believes the overall request is consistent with the Title and Comprehensive Plan of supporting
annexation of property into the City of McHenry and promoting future growth of commercial land use
within this section of the IL-31 corridor.
VARIANCE APPROVAL CRITERIA (§11-19-5). Staff comments italicized below.
A. Special Circumstances Not Found Elsewhere.
Staff believes the variation request are related to a special circumstance not found elsewhere due to
the property being forcibly annexed and therefore have structures that once were legally constructed
but no longer conform due to the change in jurisdiction.
B. Circumstances Relate to the Property Only.
Staff believes this is a special circumstance as it relates to this property only and not all property within
the C-5 Highway Commercial District.
C. Not Resulting From Applicant Action.
The applicant did not cause the nonconformity, it was due to the City forcibly annexing the property.
D. Unnecessary Hardship.
Staff believes enforcement would create an unnecessary hardship on the applicant due to the
circumstances of the annexation and that any resulting nonconformities were caused by the City’s
annexation of the subject property.
E. Preserves Rights Conferred By District:
Staff believes this does not confer a special privilege for the subject property.
F. Necessary For Use Of Property:

Staff believes that approval of the variations are necessary for the reasonable use and enjoyment of the
property as a commercial retail business.
G. Not Alter Local Character:
Staff believes approval of the petitioner’s request would not substantially alter essential character of

AGENDA ITEM SUMMARY:
At the September 6 City Council meeting staff proposed replacing the existing façade grant
program with a new program and a discussion was held during which Council provided input.
The Council was generally in fa vor of the idea however had some comments and suggestions to
improve the program.
ANALYSIS:
Among the comments at the meeting was possibly expanding on the area which the façade
grant program would cover , outside of the immediate downtown. To that end, staff is
recommending the program include the City’s entire TIF district (map attached); Route 120/Elm
Street from Ring wood Road on the west to Chapel Hill Road on the east; Main Street from
Crystal Lake Road on the west to Front Street on the east and on Front Street from Illinois
Route 120 south to Bull Valley/Char les Miller Road (see attached maps). Staff believes these
areas encompass all of the critical places in the City which should be able to benefit from a
prog ram such as this.
Additionally, the Council recommended the faça de grant include languag e prevailing wage
would be required, and this was added to the façade grant guidelines. Staff also included
language in the guidelines stating national franchises and chains are excluded from this
program. It should be noted all the proposed language changes are highlighted on the façade
guidelines sheet. Finally, staff is suggesting that $100,000 be included in the annual budget to
fund this program , beginning in FY23/24. However, for the remainder of FY22/23 (through
April 30, 2023) should ther e be immediate interest in the progra m, staff will accept applications
and bring them to Council for consideration with a budget amendment request in order to

provide immediate access and opportunity for those property owner s and/or businesses that
may be interested.
This program is primarily focused on promoting the renovation of older historic buildings,
improvement of facades and job crea tion and business development. Therefore, staff sees this
program more as an economic development tool than an historic preservation tool. Thus, the
approval process would solely include a staff review and City Council review and approval.
The new façade grant, unlike the existing grant, would be a dollar-for-dollar match and ba sed
on lineal footage, (1-40 feet), (41-80 feet) and (81+ feet) of the building facing a ri g ht-of -way,
alley, courtyard or the McHenry River walk. The grant amount would be based on lineal
footage, $10,000 (1-40 feet), $20,000 (41-80 feet) and $30,000 (81+ feet) and is meant to be an
incentive for property owners to enhance their properties and make improvements to their
facades, particularly along the Riverwalk.
RECOMMENDATION:
Therefore, if the City Counc il concurs with Staff’s review and analysis it is reco mmended a
motion be made auth orizing approval of the new Façade Grant P rogram, as presented .

Program Objectives
1. Support the rehabilitation and renovation of exterior building facades of existing buildings in McHenry.
2. Support job creation and business development in McHenry.
3. Support the renovation of older and historic buildings in McHenry.
4. Support the improvement of exterior facades facing the McHenry Riverwalk.
Program Funding Requirements
Grant provides $1 of City funds for $1 of private funds for eligible expenses (100% match).
Grant maximum is determined by the length of building, measured along the total linear frontage of adjacent
public right of way/McHenry Riverwalk frontage, up to $30,000 per property.
