The public can listen and view the meeting from the following link: https://cityofmchenry.zoom.us/j/88499429127 3 Proclamation Recognizing the 2022 McHenry Warriors Baseball Team WHEREAS, the McHenry High School Warriors Baseball Team has exhibited consistency, confidence, and perseverance during the 2022 baseball season; and WHEREAS, Brian Rockweiler has provided leadership and guidance as Coach of the Warriors Baseball Team; and WHEREAS, the 2022 Warriors defeated Huntley by a score of 4-3 to win its first sectional championship; and WHEREAS, the 2022 Warriors defeated York by a score of 2-1 to win the Class 4A Northwestern Medicine Field Supersectional to advance to the Class 4A State semifinals; and WHEREAS, we celebrate the 2022 Warriors on their record breaking season by becoming the first McHenry High School baseball team to become sectional champions, super-sectional champions, and advancing to the state championship, finishing with a 30-10 record and 4th Place at State. NOW THEREFORE, I, Wayne Jett , Mayor of McHenry, do hereby proclaim the week of June 20th, 2022, as McHenry High School Warriors Baseball Week in the City of McHenry. I urge all citizens to recognize and extend their admiration to the McHenry High School Baseball Team. FURTHERMORE, a copy of this proclamation shall be presented to Brian Rockweiler and his team to be displayed in a prominent place in recognition of their team effo rts. CONSENT AGENDA ITEM DATE: June 20, 2022 TO: Mayor and City Council FROM: Staff RE: Ordinance for Amendments to Fines and Penalties ATT; Ordinance, Exhibit A table listing fines AGENDA ITEM SUMMARY: Staff has been working to simplify the way fines and penalties are listed in the Code Book. As the Code exists today, fines ar e spread across numerous sections of the book. It can ta ke a lot of searching for somebody to find fines if they are unfamiliar with where to look. This ordinance places the common fines and penalties into one secti on where they are all easily accessible by looking at one table. The benefit for having all fines in one location is threefold: •The adjudication judge, and attorneys in adjudication court, will no longer have to search and flip through the code book to find a fine associated with a specific offense •With all fines in one location, Staff can easily review all fines on a regular basis to ensure that they are fair and just •The public has easy access to all fines and penalties This new ordinance also ties in directly to the new adjudication software solution that is being implemented by the City of Mc Henry. The new software will streamline the way adjudication tickets are written, tracked, paid for, and handled duri ng adjudication court. RECOMMENDATION: Therefore, if Council concurs, it is recommended a motion be made to pass an Ordinance Adding Title 15: Fines and Penalties, and Amending Various Sections of the McHenry City Code relating to Fines and Penalties. 5 ORDINANCE NO. 22- Adding Title 15: Fines and Penalties, and Amending Various Sections of the McHenry City Code relating to Fines and Penalties WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois. Each day that a violation continues shall be considered a separate offense. SECTION 3: Section 1-4A-2: Settlement of Offenses, of the McHenry Municipal Code, shall be amended as follows: 1-4A-2: SETTLEMENT OF OFFENSES: Offenses may be settled according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties. SECTION 4: Section 1-4B-8: Administrative Hearings: Subsection B, of the McHenry Municipal Code, shall be amended as follows: 1-4B-8: Administrative Hearings: B.Open Hearings; Recording: All hearings shall be open to the public, may be recorded, and shall be cond ucted before an Administrative Law Judge. SECTION 5: Section 6-5A -8: Loitering: Subsection C: Penalty , of the McHenry Municipal Code, shall be amended as follows: 6-5A-8: Loitering: C.Penalty: Any person violating this section shall be fined according to the Fines and Penalties found in Title 15, Chapter 1: Fines and Penalties, for each offense and be responsible for the City’s cost of prosecution, including attorney fees incurred by the City. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made to any property damaged or destroyed or person injured. SECTION 6: Section 6-5A -27: Graffiti and Damage to Property, Subsection D: Penalty; Restitution, of the McHenry Municipal Code, shall be amended as follows: 7 6-5A-27: Graffiti and Damage to Property: D.Penalty; Restitution: A violation of this section is an ordin ance violation with a fine according to the Fines and Penalties found in Title 15 , Chapter 1: Fines and Penalties. Restitution by the violator shall also be made to the owner of any property damaged or destroyed. Nothing herein shall preclude such additional civil remedies available to the person whose property has been damaged or destroyed. SECTION 7: Section 6-5A -28: Theft, Defacement, Destruction, Alteration or Removal of Government Signs, Subsection B. Penalty; Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5A-28: Theft, Defacement, Destruction, Alteration or Removal of Government Signs: B.Penalty; Restitution: Any person violating this section shall be punished by a fine according to the Fines and Penalties found in Title 15 , Chapter 1: Fines and Penalties and, in addition thereto, shall be required to make restitut ion for the total material and labor costs of replacing such sign or signs. SECTION 8: Section 6-5A-31: Tobacco Accessories and Use Regulations, Subsection C. 2. Penalty; and Subsection D.2. Penalty; and Subsection E.6. Penalty, of the McHenry Municipal Code, shall be amended as follows: 6-5A-31: Tobacco Accessories and Use Regulations: C.Purchase And Use of Tobacco Products Prohibited: 2.Penalty: Any person violating any provision of this subsection C is guilty of a petty offense and shall be fined according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties, plus costs associated with the City’s cost of prosecution, including attorney fees. D.Possession Of Tobacco Products, Electronic Cigarettes and Their Components, Alternative Nicotine Products or Liquid Nicotine: 2.Penalty: Any person violating any provision of this subsection D is guilty of a petty offense and shall be fined according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties, plus costs associated with the City’s cost of prosecution, including attorney fees. E.Tobacco Accessories, Smoking Herbs, Tobacco Products, Electronic Cigarettes, Alternative Nicotine Products or Liquid Nicotine 6.Penalty: Any person, firm or corporation violating any provision of this subsection E shall be subject to license suspension or revocation, alteration of hours on a temporary or permanent basis, and fines according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties, for each offense committed on each day during or on which a violation occurs or continues, plus reimbursement of legal fees incurred by the City in the prosecution of violations of this subsection E against the licensee. SECTION 9: Section 6-5C-5: Penalty; Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5C-5: Penalty; Restitution: 8 Any person violating this chapter shall be fined according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties, for each offense and be responsible for the City’s cost of prosecution, including attorney fees, incurred by the City. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made for any property damaged or destroyed or to any person injured. SECTION 10: Section 6-5D-3, Persons Responsible for Unlawful Activities on Premises, Subsection B. Violation: Penalty: Restitution, of the McHenry Municipal Code, shall be amended as follows: 6-5D-3: Persons Responsible for Unlawful Activities on Premises: B.Violation; Penalty; Restitution: Any person violating this section shall be fined according to the Fines and Penalties found in Title 15 , Chapter 1 : Fines and Penalties for each offense and be responsible for the City’s cost of prosecution, including attorney fees incurred by the City. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made to any propert y damaged or destroyed or person injured. SECTION 11: Section 6-5E-1: Parental Responsibility, Subsection C. Penalty, of the McHenry Municipal Code, shall be amended as follows: 6-5E-1: Parental Responsibility: C.Penalty: Whoever violates any provision of this section shall be fined according to the Fines and Penalties found in Title 15 , Chapter 1 : Fines and Penalties for each offense and be responsible for the City’s cost of prosecution, including attorney fees, incurred by the City. Each day that a violation continues shall be considered a separate offe nse. Each day that a violation continues shall be considered a separate offense. Restitution by the violator shall also be made for any property damaged or destroyed or person injured. SECTION 13: Section 6-5E-3: Truancy, Subsection F. Penalty, of the McHenry Municipal Code, shall be amended as follows: 6-5E-3: Truancy: F.Penalty: A truant who is thirteen (13) years of age or older, or their parent(s), guardian(s) or legal custodian(s), but not both, who violate the provisions of this section is subject to a fine according to the Fines and Penalties found in Title 15 , Chapter 1: Fines and Penalties. The parent(s), guardian(s) or legal custodian(s) of a truant who i s under thirteen (13) years of age is subject to a fine according to the Fines and Penalties found in Title 15 , 9 Chapter 1: Fines and Penalties if the minor, or their parent(s), guardian(s) or legal custodian(s), violate the provisions of this section. SECTION 14: Section 7-11-8: Voluntary Settlements Regarding Certain Violations of the McHenry Municipal Code, shall be amended as follows: 7-11-8: Voluntary Settlements Regarding Certain Violations: Certain offenses may be settled and compromised by payment to the City according to the Fines and Penalties found in Title 15, Chapter 2 : Parking Fines. SECTION 15: Section 8-3C-11: Penalty, of the McHenry Municipal Code, shall be amended as follows: 8-3C-11: Penalty: Any person, firm or corporation that violates any provision of this article shall be subject to a fine according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties, plus the City’s cost of prosecution, including reasonable attorney fees. Each day that a violation exists and a tree removal permit is not obtained shall constitute a separate offense. Further, a separate offense shall be deemed committed for each tree injured, removed, destroyed or for any undertaking of any procedure, the result of which is to cause the death or substantial destruction of any tree within the City, having a dbh of six inches (6") or greater. SECTION 16: Section 9-2C-4: Reading Meters, Subsection B. Right of Access to Premises, of the McHenry Municipal Code, shall be amended as follows: 9-2C-4: Reading Meters: B.Right Of Access to Premises: The City, its servants, agents and employees shall have a continuing right of access to premises which are served with Municipal water for the purpose of reading water meters and also for the purpose of inspecting, repairing, installing, modifying and replacing water meters. The water supply to any premises may be shut off whenever access has been hindered or denied by the user and/or owner. In addition to such water shutoff, any person, firm or corporation violating this subsection shall be fined according to the Fines and Penalties fo und in Title 15, Chapter 1 : Fines and Penalties, for each day during, or on which such access to the premises has been prevented. SECTION 17: Section 10-2-1: International Building Code; Buildings and Structures, Other than One-or Two-Family Dwellings, Subsections G and H, of the McHenry Municipal Code, shall be amended as follows: 10-2-1: International Building Code; Buildings and Structures, Other Than One- Or Two-Family Dwellings: G.Section 114.4 shall read as follows: Violation Penalties: Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code, shall be punishable by 10 a fine according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties. Each day that a violation continues shall b e deemed a separate offense. H.Section 115.3 shall read as follows: Unlawful Continuance: Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed t o perform to remove a violation or unsafe conditions, shall be liable to a fine according to the Fines and Penalties found in Title 15 , Chapter 1 : Fines and Penalties. Each day that a violation continues shall be deemed a separate offense. SECTION 18: Section 10-6-1: Fuel Gas Code Adopted, Subsection H, of the McHenry Municipal Code, shall be amended as follows: 10-6-1: Fuel Gas Code Adopted: H.Delete Section 108.4 Violation penalties and replace with the following: Violation Penalties: Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code, shall be punishable by a fine according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties. Each day that a violation continues shall be deemed a separate offense. SECTION 19: Section 10-7-1: Mechanical Code Adopted, Subsection G, of the McHenry Municipal Code, shall be amended as follows: 10-7-1: Mechanical Code Adopted: G.Delete Section 108.4, Violation Penalties and replace with the following: Violation Penalties: Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Building Official, or of a permit or certificate issued under the provisions of this Code, shall be punishable by a fine according to the Fines and Penalties found in Title 15, Chapter 1 : Fines and Penalties. Each day that a violation continues shall be deemed a separate offense. SECTION 20: Section 10-22-7: Administration and Enforcement, Subsect ion B, of the McHenry Municipal Code, shall be amended as follows: 10-22-7: Administration and Enforcement B.Penalty: Any person found to be in violation of any provision of this chapter shall be guilty of a separate offense for each day or portion thereof during which such violation is committed, continued or permitted, and each offense may be punishable by a fine according to the Fines and Penalties found in Title 15 , Chapter 1 : Fines and Penalties, and the City’s reasonable attorney fees. 1.Any person, firm or corporation who alters, repairs, relocates or demolishes by neglect any landmark or any structure within a preservation district without complying with the provisions of this chapter shall be required to restore the structure and its site to its appearance prior to the violation. This civil remedy shall be in addition to and not in lieu of any penalty contained in this section. 11 2.In the case of an unauthorized demolition of a landmark or a property within a preservation district, the City may choose not to issue a building permit for the subject property for a period of five (5) years after the date of the demolition. SECTION 21: Section 5-5-3: Revocation of License, of the McHenry Municipal Code, shall be amended as follows: 5-5-3: Revocation of License: Any license issued under the provisions of this chapter may be revoked by the City for any violation of any section or regulation hereof, and such revocation shall be in addition to any fine imposed according to the Fines and Pena lties found in Title 15, Chapter 1 : Fines and Penalties SECTION 22: Section 1-4B-8: Administrative Hearings, Subsection J. Penalties, of the McHenry Municipal Code, shall be amended as follows: 1-4B-8: Administrative Hearings: J.Penalties, Fines Imposed: Upon issuing a determination of liability, the Administrative Law Judge may impose penalties and/or fines that are consistent with applicable provisions of this Code, impose a term of community service, assess costs reasonably related to instituting the administrative adjudication proceeding, if applic able, order the respondent to immediately correct the violation, and impose any other penalties or remedies available at law . Court costs associated with administrative hearings shall be not less than $100.00. SECTION 23: Section 4-2-20: Penalty, of the McHenry Municipal Code, shall be amended as follows: 4-2-20: PENALTY: Any person, firm or corporation violating any provision of this chapter shall be subject to license suspension or revocation, alteration of hours on a temporary or permanent basis and fines of not less than four hundred dollars ($400.00) nor more than two thousand five hundred dollars ($2,500.00) for each offense committed on each day during, or on which, a violation occurs or continues, plus reimbursement of legal fees incurred by the City in the prosecution of Liquor Code violations against the licensee. SECTION 24: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not effect, impair, invalidate or nullify the remainder thereof , which remainder shall remain and continue in full force and effect. SECTION 25: All ordinances, or parts thereof, in conflict herewith are hereby repealed to the extent of such conflict. SECTION 26: This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. 12 SECTION 27: This ordinance shall be in full force and effect from and after its passage, approval and publication, as provided by law. BACKGROUND: The McCullom Lake Road project was an IDOT Surface Transportation Program project which was completed in 2015. This project was completed with the assistance of approximately $1.0 million in Federal Aid. The payment process for these projects is different than a traditional project which is invoiced directly to the local agency fairly promptly after completion of construction that is managed directly by the City. Payments to contractors for these Federally funded projects are issued by the Illinois Treasurer’s Office and then local agencies are invoiced by IDOT after the fact. Lag times between processing of payment estimates and issuance of invoices by the Ill inois Treasurer typically creates a need for local agencies (such as municipalities) to hold carry over balances in their budgets for the time between completion of construction and receipt of the final invoice. At some point since the completion of this project, the outstanding balances for the local share of construction ceased to be carried between fiscal years. A previously issued memorandum informing the City Council of this issue has been attached to this agenda supplement for further clarification. This project was constructed in 2015 and only now is being final invoiced in the amount of $107,691.24. Therefore, in addition to the current need to process the final payment, a supplemental resolution for use of MFT funds is needed. ANALYSIS: Due to the final local share of construction costs being more than the original authorized amount, a supplemental resolution must be passed authorizing the additional funds. A budget amendment is not needed at this time due to MFT balances being available from 2022 Road Program authorized amounts which have not been exceeded. The resolution amount is approximately $70,000 as previously authorized MFT amounts account for all costs to-date on this section number except for $70,000. The current invoice amount is for $107,691.24 and reflects the amounts of billings to-date rather than authorized amounts relative to final amounts. CONSENT AGENDA ITEM DATE: June 20, 2022 TO: Mayor and City Council FROM: David McArdle, City Attorney RE: Push Tax Tolling Agreement ATT: Draft Tolling Agreement AGENDA ITEM SUMMARY: Council is asked to consider author izing the Mayor ’s execution of a proposed Video Gaming Push Tax Tolling Agreement subject to final review and approval of the City Attorney. BACKGROUND/ANALYSIS: The Video Gaming Push Tax was implemented in October 2021 but has been abated through August 31, 2022 due to current litigation pending in Cook and Lake Counties regarding the validity of such a Push Tax and how it is to be collected. The tax was abated to a void the protest and litigation that would necessarily be fi led if the abatement were not in place. In order to avoid having to continue the repeated abatement process and deal with the litigation and, in order to preserve the rights of the City and the vi deo gaming terminal operator, we are proposing putting everything on hold through the implementation of a Tolling Agr eement. In the attached proposed agreement, I have highlighted some of the more pertinent provisions. Through April 30, 2023, the parties will not have to take any action while the pending litigation advances and maybe ends giving us some clarity on the law. As a point of information, other home rule towns we represent; i.e., Villages of Algonquin, Carpentersville, Lake in the Hills, and the City of Woodstock are also considering entering into this same Tolling Agreement with the video gaming terminal operators - J&J Ventures Gaming , LLC, Gold Rush Amusements, Inc., Accel Entertainment Gaming, LLC, Lattner Entertainment Group Illinois, LLC, Eureka Entertainment, LLC, Velasquez Gaming, LLC, Ashiq Gaming, LLC, and Pocket Aces Gaming, Inc. This currently is a draft Tolling Agreement and subject to approval by the video gaming terminal operators. (“Pocket Aces”), an Illinois corporation, hereinafter individually a “Terminal Operator” and collectively the “Terminal Operators.” RECITALS: WHEREAS, the Illinois Video Gaming Act (“VGA”), 230 ILCS 40/1 et seq., governs the operation, licensing, and administration of video gaming in Illinois; WHEREAS, the Municipalities may adopt ordinances regulating video gaming act ivit y within their jurisdictions in accordance with the VGA; WHEREAS, pursuant to Article VII, Section 6(a) and Section 6(i) of the Ill. Const. of 1970 in conjunction with 65 ILCS 5/11 -42-5 of the Illinois Municipal Code, the Municipalities are authorized to impose a tax upon amusements; WHEREAS, the Illinois General Assembly’s HB3136 which passed through both houses on Thursday, October 28, 2021 and was further amended on Thursday, October 28, 2021 , preempts home rule powers if an ordinance imposing an amusement tax on persons who participate in the playing of video gaming terminals was not in place before November 1, 2021; WHEREAS, to preserve its home rule powers, the Municipalities each timely imposed an amusement tax of $0.01 per push upon any person who participates in playing a video gaming terminal within their respective jurisdiction (collectively, the “Push Tax”); WHEREAS, the Push Tax is imposed upon the person who participates in the play of a video gaming terminal, to be collected and remitted by the Terminal Operators monthly; WHEREAS, McHenry has abated its Push Tax through August 31, 2022; WHEREAS, the Municipalities and the Terminal Operators have a genuine dispute relating to the collection and remittance of the Push Tax; 51 2 WHEREAS, there is litigation pending in Cook County Circuit Court, Illinois Gaming Machine Operators Association, et al. v. The Village of Oak Lawn, Case No. 2020CH02928 , and in Lake County Circuit Court, Illinois Gaming Machine Operators Association v. City of Waukegan, Case No. 2020CH0514, regarding the same or similar issues as are disputed between the Municipalities and the Terminal Operators; and WHEREAS, the Municipalities and the Terminal Operators wish to preserve their positions during the pendency of the litigation referenced above, including any appeals, and toll any statute of limitations, statute of repose, and equitable positions including waiver and laches regarding any claims or defenses the Municipalities and Terminal Operators may have against the other relating to the collect ion and remit tance of the Push Tax. NOW THEREFORE , in consideration of the promises and agreements contained in this Agreement, and for other good and valuable consideration, the value and receipt of which is acknowledged by each party hereto, this Agreement is entered into as follows: 1.Recitals. The recitals set forth above are incorporated into this Agreement. However, the recitals are for purposes of this Agreement only and not meant to state any binding position, admission, or defense. 2.Tolling. All applicable time periods or time related matters, including, but not limited to, statutes of limitation, statutes of repose, or equitable positions including waiver or laches, w ith respect to any claims, causes of action, or d efenses the Municipalities and Terminal Operators may have against the other shall be tolled from June 23, 2022 through April 30, 2023 (the “Tolling Period”) with the exception that a party may wit hdraw earlier from this Agreement pursuant to Section 6 of this Agreement . No provision of this Agreement is intended to or shall be deemed to revive any statute of limitation or other applicable time period that has already expired prior to June 23, 2022 and t hat would not otherwise be tolled prior to June 23, 2022. No provision of this A greement is intended to or shall be construed to shorten any applicable statute of limitation, or repose, or other applicable time period that has not expired as of June 23, 2022. 3.No Actions. No Municipalit y nor any Terminal Operator may bring an action on any claim or cause of action against the other until April 30, 2023 or until that specific Municipality or Terminal Operator withdraws from this Agre ement pursuant to Section 6 of t his Agreement. As to any action on any claim or cause of action brought after the expiration of the Tolling Period or any claim or cause of action brought by a party after said party withdraws from this Agreement pursuant to Sect ion 6 of this Agreement , the Municipalities or Terminal Operators may raise any defense based on any time period or time related matters, except that no claim, cause of action, or defense may include the Tolling Period of this Agreement as a basis o f the claim, cause of action, or defense, including but not limited to, st atutes of limitation, statutes of repose, waiver or laches. During the Tolling Period, no Municipality need send any notice of f ailure or deficiency relating to the collection or remit tance of the Push Tax and no Terminal Operator need file any writ ten protest to preserve their respective claims (and the failure to do so shall not act as a bar to any claim or defense). Any written protest filed by any Terminal Operator and any pending ad ministrative proceeding pursuant to said written protest as of the date of this Agreement shall be stayed until the expiration of the Tolling Period or until that Terminal Operator or Municipality withdraws from this Agreement pursuant to Sectio n 6 of this Agreement. Any not ices related to a Push Tax already issued by any Municipality as of the date 52 3 of execution of this Agreement do not need to be responded to by a Terminal Operator, whether by written protest or other similar mechanism, until the expiration of the Agreement or until that Terminal Operator or Municipality withdraws from this Agreement pursuant to Section 6 of this Agreement. 4. Collection, Interest and Penalties. Municipalities are not requiring Terminal Operators to withdraw their receptacles or other means of collection for the Push Tax during the Tolling Period . Terminal Operators can continue to submit tax returns and remit any monies collected for the Push Tax during the Tolling Period ; however, no such submittal nor remittance shall suggest that it is payment in full. In addition, remittances, if any, shall be by check, ACH, or other form of payment authorized by a Municipality. Upon the expiration of the Agreement or upon any Municipality or Terminal Operator withdrawing from this Agreement pursuant to Section 6 of this A greement, t he Municipalities shall have the right to seek any Push Tax they believe were owed during the Tolling Period, but waive the right to seek any accrued interest or penalties against the Terminal Operators for any amount of the Push Tax that is not collected or remitted during the Tolling Period. 5. No Admissions. No party to this Agreement makes any admission, express or implied, as to the existence or validity of any claims, causes of act ion, or defenses which are the subject of this Agreement. 6. Withdrawal. Any party or parties heret o may earlier withdraw from this Agreement upon thirty (30) days written notice to all other parties as provided in Section 9 of this Agreement . Any such wit hdrawal does not alter the validity and enforceability of this Agreement for the remaining parties thereto and the remaining parties shall continue to be bound by this Agreement . 7. Extensions or Amendments. This Agreement may be extended or amended only by the express written agreement of the parties hereto, stating the exact period by which this Agreement will be extended or exact terms of the amendment . 8. Representations and Warranties. The undersigned individuals executing this Agreement on behalf of their respective parties represent and warrant that said individ uals are authorized to enter into and execute this Agreement on behalf of such parties, and that this Agreement shall be binding on the party on whose behalf they are executing thi s Agreement . All terms and provisions of this Agreement shall be binding up on and shall inure to the benefit of the parties hereto and their respective representatives, successors and assigns. 9. Notices. Coffee with the Chief - Meet your Elected Officials discussion Chief Birk opened the informal meeting by introducing all The City Officials that were elected and gave some background on the casual Q&A discussion. Each official stood up and said hello to the residents of McHenry before the question session started. Public Comments: Several Residents of McHenry addressed concerns/questions that they had regarding The City. Below is a summary of some of the topics that were discussed by Chief Birk and The City Council Members present. Some questions were asked regarding the utilization of golf carts/UTVs with the worry of younger children driving them, around the age of 10-12-year-old. The residents wanted to know if there could be more enforcement of the rules. Chief Birk expressed that they are open to getting calls regarding any underage drivers as well as the option to contact the alderman/alderwoman regarding this. Along with that topic Chief Birk talked about the registration of the vehicles and the safety inspections . Another question was asked regarding if there could be police officers on bike patrols again, Chief Birk explained that staffing is hard to do with this because of response time. Every office does do multiple foot patrols to help get the officers out meeting others in the community along with schools as well so it is something that is emphasized by the police department to create relationships within the community. 75 Special Meeting Coffee with the Chief 6.7.22 2 Another topic brought to discussion was how are we reacting to the school safety, per Chief Birk’s annual, and tactical skills are reviewed all the time. There is a standing school safety committee as well lock down drills, and major drills. Question about Hidden Pearl, there is talk about something that there may be a potential patron in there. Question about mowing the right away wondering if it is a City Property we mow it and tickets are going out with those that are not mowing. Speeding down Ramble Road was also address and how much people are speeding, Chief Birk talked about adding a speed radar detector in that area as soon as this week to help with that. Questions about the new garbage company Flood Brothers in August and unlimited curbside yard waste were also explained by Alderwoman Miller. Two options are available for the garbage cart as well. There will still be a sticker program as well. Buyback program for the old stickers to the new. Can purchase own vessel but label it yard waste. Questions about reflective clothing while bikers are out at night. Chief stated that reminders and tips can help remind people to wear that clothing on FB etc. Alderman Glab spoke about what is happening with the road program. Alderwoman Miller talks about the road repairs going on and the amazing amount of progress that The City has come to with that. Grant Application Agenda Item Summary: Art Gurda, owner of McHenry Power Equipment, an existing business located at 3622 W Elm, has submitted for a $20,000 Commercial Tenant Incentive Grant. Analysis: McHenry Power Equipment is seeking a $20,0000 grant to help pay for improvements to their exterior façade, replacement of doors and windows, in excess of $70,000-$80,000. Additionally, part of the funds will be used to purchase computer equipment for his store. Quotes for the work are attached and they have also submitted historical sales numbers to staff. As a point of information and consideration, the majority of McHenry Power Equipment’s sales are out-of-state and their in-state taxable sales alone do not qualify them for the grant, as they are less than $150,000. The bulk of their sales come from transactions on Ebay and are from other states which retain the sales tax therefore the taxable Illinois receipts are minimal. The monthly Ebay sales far exceed the requirement of the $150,000 annual requirement for the grant in accordance with the state sales tax forms provided by McHenry Power Equipment. Therefore , this nuance in the grant requirement is created. The maximum grant they are eligible to receive is $20,000 if their total sales are taken into consideration. This would equate to a 50% matching grant that will not be paid out until fiscal year 2023/2024. Benning (Owner of Record), is requesting approval of a Use Variation to allow the existing 2-unit multifamily residence and detached coach house to remain on the property. The property will also need to receive approval of several zoning variations to accommodate the existing structures. BACKGROUND: The petitioner purchased the property in 2020 with the 2-unit residence and detached coach house fully occupied. The zoning process began when the petitioner was cited for performing work on the coach house without a permit. The petitioner was made aware of the nonconforming status of the property and that the coach house could no longer be used as a residence without a use variation. Staff could not accurately determine how long the 2-unit residence and coach house have existed on the property. Based on the age of the existing water and sanitary sewer lines, the structure has had access to city services since the 1950s; however, this does not indicate if it was used for residential purposes. 120 Department of Community Development McHenry Municipal Center 333 Green Street McHenry, Illinois 60050 Phone: (815) 363-2170 Fax: (815) 363-2173 www.cityofmchenry.org PLANNING & ZONING COMMISSION HEARING: A public hearing was held for the request on December 15, 2021 (minutes attached). A total of seven (7) residents spoke at the public hearing against the proposal. Primary concerns include a desire to return to single-family residential, unsightliness of the structures, desire for less rental property, traffic, and the history of law enforcement calls to the property related to a former tenant that no longer resides on the property. The Commission ultimately voted to recommend approval of the existing 2-flat but denial of the coach house subject to the following conditions: 1. The petitioner shall pave the existing gravel driveway using either asphalt or concrete. 2. The petitioner shall repair or replace any damaged siding. 3. All work shall be completed within one year of approval by City Council. 4. The petitioner shall make any repairs or improvements to the property as determined by the Zoning Administrator. 5. The dwelling unit identified as the detached coach house shall be converted into an accessory structure. CITY ATTORNEY REVIEW: The City of McHenry’s Nonconformities Ordinance requires the amortization of nonconforming uses in residential zoning districts within one (1) year of certified notice by the City. Staff have identified at least four (4) additional properties with coach house units that are fully occupied within the area (1507 N Green Street, 1511 N Green Street, 1625 N Riverside Drive, and 1408 N Richmond Road). Staff requested a review by the City Attorney to determine if denial of the proposed coach house would establish a legal precedent for the other identified properties. The City Attorney confirmed that denial of the request would establish a precedent unless there are unique site-specific circumstances that could be identified on the other properties. STAFF ANALYSIS & RECOMMENDATION: The goal of the Community Development Department has been to achieve compliance with the City’s adopted codes and ordinances. Staff have continued to advocate and support similar requests to improve the health and safety of future occupants. The City Council has historically agreed with Staff and voted in favor of these requests subject to the condition that it met the following criteria: 1) the use has been well established for at least ten (10) years. 2) the property owner agrees to a walkthrough inspection by the City Building Inspector. 3) the property is brought into compliance with all property maintenance and building code issues noted from the inspection. 4) the property owner agrees to make either aesthetic, building code, landscaping or other improvements to the property within one (1) year of approval; and 121 Department of Community Development McHenry Municipal Center 333 Green Street McHenry, Illinois 60050 Phone: (815) 363-2170 Fax: (815) 363-2173 www.cityofmchenry.org 5) all parking is accommodated on site. Staff have discussed the idea of adopting a grandfathering provision within the Zoning Ordinance for similar properties if it met the previously identified criteria. However, the main benefit of the current process allows the City the opportunity to provide additional conditions of approval and to address any site-specific concerns of the neighboring residents during the public hearing process. Given the longevity of the use, the potential establishment of a legal precedent, and the current housing market, staff continues to recommend approval in order to bring the property into conformance with the City’s adopted codes and ordinances. Staff have included two separate ordinances in the agenda supplement. The first would approve the petitioner’s full request (City Council Vote – Super Majority). The second ordinance would approve the 2-flat but deny the petitioner’s request for a coach house. The first ordinance would require a City Council super-majority if the Council were to vote against the Planning & Zoning Commission’s recommendation. If the City Council agrees with the Planning & Zoning Commission recommendation, it is recommended the second ordinance granting a Use Variation and Zoning Variations for the existing 2-flat be approved. Benning Use Variation and Zoning Variations for a 2-Unit Residence and Detached Coach House at 1508 N Green Street Chairwoman Rockweiler called the hearing to order at 7:05 p.m. regarding File No Z-1007 a Use Variation and Zoning Variations for a 2-Unit residence and detached coach house at the subject property, commonly known as 1508 Green Street. Chairwoman Rockweiler confirmed all legal posting requirements have been met. Mr. Gary Benning, 25158 W. Lakeshore Dr. Ingleside IL and Randy Nosalik, contractor, were sworn in. Mr. Nosalik stated Mr. Benning is trying to change his property to be an allowed use for the 2-unit building with a coach house as it was purchased as a 3-flat. That was the way he bought it and wants it to comply and will make it beautiful in the neighborhood. He wants to renovate the existing coach house and continue to use it for rental housing as well. Mr. Nosalik shared history of the property. He stated there are 5 two-flats and three-flats that are on the same block when he looked recently. City Planner Sheriff provided the Commission with the Staff Report regarding this file stating the subject property was recently purchased by the petitioner. Staff is unaware nor do the petitioners know exactly how long the existing 2-flat and coach house have operated on the property. The petitioner desires to renovate the existing coach house and continue to use both buildings on the property for rental housing. In order to receive approval of a Use Variation to allow a 2-flat multifamily residence and a coach house, Planner Sheriff stated the property will also need to receive approval of the several Zoning Variations to accommodate the development, as he outlined in the Staff Report. The subject property is currently zoned RS-4 High Density Single-Family District. A multifamily residence is not permitted within the RS-4 District. Due to how long the property has operated as a multifamily residential use, staff does not believe the request would generate any adverse impacts. In summary, staff believes the proposed use of the property is in substantial conformance with the City’s Comprehensive Plan and Development Policies. The Community Development Department has been working closely with the petitioner and have already performed a walk- through inspection of the existing units. There were no building code violations noted from the walk-through inspection. The safety of the occupants of the building is the number one priority of the Community Development Department. Planner Sheriff stated if the Planning & Zoning Commission agreed with staff’s assessment, then approval of the two separate motions presented was recommended. Chairwoman Rockweiler invited questions and/or comments from the Commissioners. There were no questions from any of the Commissioners. Chairwoman Rockweiler invited questions and/or comments from the Public. Beth Taylor, 1501 N. Green St. in McHenry stated she has lived in her house about 15 years, across the street from this property. There have been no visual improvements since its purchase in 2019. She and her husband looked at the property when it was for sale and could only view the upstairs unit due to tenants in place and they walked away from it due to the extremely poor condition of the portion of the property they could see. She believes the property is an eye sore and only has very mobile renters rather than a well-maintained property and steady renters. There is no dumpster, the driveway is gravel. She does not believe the unit fits the character of the neighborhood and would love to see it returned to a single-family home. She asked why there have been no improvements since they purchased it in December 2019 – 2 years ago. Walt Taylor 1501 N. Green St. was sworn in and stated he has been a McHenry resident since the 1960’s. They have watched the property use and abuse for many years with police activity and other infringements. He opined it is not in harmony with the neighborhood, is very unkept and is asking the zoning commission to think very hard about the use of the property. Many other properties in the neighborhood have all been grandfathered in with the multi-family uses since just after World War II when it was necessary to provide housing for returning veterans and they are not fit for multi-family use any longer. Deborah Laskonis, 1505 Court St. stated she bought her house in September of 2016 and lives behind the subject property. At that time, she said her property was a single-family home turned to a two-flat and back now to single-family home. She was welcomed by the neighbors for really taking care of the home and converting it back to single family. They live in a historical neighborhood in the middle of town and believes that is what defines harmony in the neighborhood. She does not believe the intention of the property owners is pure because they’ve not cleaned it up or made any improvements in the two years they have owned it. Donna Ricordati, 1506 Green St. has lived at her address almost 30 years and has witnessed first-hand the frequent turnover of this property to renters who have taken no care or concern 124 Department of Community Development McHenry Municipal Center 333 Green Street McHenry, Illinois 60050 Phone: (815) 363-2170 Fax: (815) 363-2173 www.cityofmchenry.org for the upkeep of the property and all the owners through the years have seemed to be non- existent in helping maintain the property in a manner consistent with the neighborhood. She believes it is too many rental units on one property. John Hansen, 1507 Court Street stated there is no harmony at the subject property. His family has owned his house for 30 years and described the coach house as a barn that is unkept and garbage. The property has been a continual source of trouble to his family and his home. He has had a knife pulled on him, renters fighting among themselves, and no owner to contact when there are problems. Putting three families on the property is what he and neighbors have the biggest problem with. There have been no improvements to this property for the last 20 years. Once renters get in, they have rights and there is nothing anyone can do. He asks the Commission to consider the other neighbors. Tim McCann, 3507 Broad St. stated he used to have a multi-family rental property next to him that was continually full of problem rental neighbors. The neighborhood is a mix of young and old and the owner-occupied properties are well-kept, but the rental properties are not well- maintained and very easy to identify. The fact that there are other properties with this use grandfathered in the neighborhood does not make it right to continue allowing that use. Lucas Adams, 1509 Court St just recently bought his home. It is his family neighborhood. He has been told since he was 9 years old to stay away from the subject property due to the maintenance and trouble from the renters. It hasn’t changed. These new owners have owned the property for two years and haven’t done one thing to improve it and he opines they are not really going to make appropriate changes to bring it in proper shape to be habitable. Planner Sheriff asked Director Polerecky if he had a history of property violations on property. Director Polerecky stated there is not a full history of violations in his available records. He stated the work done was done without permit and is the reason this hearing is happening. He added, however, that all work done to this point has been done to code and every bit of work done will be inspected. Commissioner Sobotta asked if the coach house was habitable space. Director Polerecky stated it was. Planner Sheriff explained that “grandfathering” does not exist. The property is not lawfully converted to a three-flat which is the need for this hearing. Code compliance is checked for the safety of the occupants and is addressed in walk-through inspections in every manner of building safety. Commissioner Sobotta inquired if other properties have two buildings on one lot? Director Polerecky could not confirm that at this time but assured the property will be inspected for plumbing, gas, and electric code compliance and all units would have to be brought into compliance. Commissioner Bremer asked whether there is parking compliance with current codes. Director Polerecky stated there is plenty of parking, but it is a gravel drive. Chairwoman Rockweiler clarified that the property is currently zoned single-family but since 2003 has been multi-family. She inquired if the motion presented by staff was denied for three units and a third family lived there then would one family be evicted. Director Polerecky verified yes that would be the outcome and eviction and leases were discussed. Director Polerecky did, however, verify there are currently only two families renting in the two-flat and no tenant in the coach house. Director Polerecky also clarified the recently turned in building permit includes upgrades to all utilities. A full description of all upgrades being done was given by the petitioner at the request of Commissioner Bremer. Mr. Nosalik stated he does not believe there have been multiple police reports on the property in the last two years since they’ve owned it. He believes the rental above the garage will be a $1500 per month rental when they are finished renovating. He opined none of the rental units will be low income. He had considered living in the coach house himself. Chairwoman Rockweiler asked for clarification on comments made by all neighbors at the hearing stating no work has been done in the past two years. Mr. Nosalik stated Covid did not allow them to do any work for the past year, but they had made some improvements inside before then. Cody stated conditions can be added in a motion by commissioners as they feel the need, including timelines. Commissioner Bremer asked for clarification on consequences if the timelines are not met. Planner Sheriff confirmed then the use will no longer be allowed. Commissioners asked if they could view photos of the renovations that have been done on the property thus far. Chairwoman Rockweiler closed the public comment portion of the hearing at 7:58 p.m. Chairwoman Rockweiler asked for a 5-minute recess to set up video to be able to view photos of renovations that have already been done on the property. Public hearing re-convened at 8:10 pm. and roll call was taken. Pictures of property renovation were shown to all in the Council Chambers and were put into the public record. Chairwoman Rockweiler clarified that some of the work had been done without a permit, but the building inspectors have been aware and inspecting for awhile now. It is in full construction stage making it not livable at the present time. Mr. Benning stated there were no renovations needed to the sewer system. Commissioner Bremer asked if there were any photos of the two-flat. Mr. Nosalik stated no pictures, those units received just paint, flooring etc. He also stated there is no mold or bugs. Size and number of rooms in each rental unit were discussed. They are hoping to get siding to keep the Victorian charm of the neighborhood. He repeatedly stated the building inspectors have stated how beautiful the improvements are so far. Commissioner Sobotta read the definition of RS-4 zoning. He questioned the proposed motion by staff because it should be for a two-flat multi-family building and detached coach house, not as it was presented. He further stated future land use designation standards and he doesn’t believe the proposal as presented meets standards. Commissioner Davis stated he believes there is evidence they are trying to improve the property, but the question is the coach house. He does want to see the driveway paved and submittal of plans for the roof and siding and replacement or repair of existing damaged siding to the motion. Commissioner Bremer stated she is having a hard time allowing two separate buildings on the property. She would rather like to see just one 2-unit building. Commissioner Smale sees the perspective of staff as to the three units having currently been used but also hears the discussion from the residents. She agrees with Commissioners Bremer and Davis on conditions being added for the driveway and siding. Chairwoman Rockweiler agrees with everything stated but is split on her thoughts on having two or three units on the property. Chairwoman Bremer asked for clarification on the number of bedrooms in each unit. Mr. Nosalik stated there will be two in the coach house, three bedrooms in the downstairs unit of the 2-flat, and 2 bedrooms in the upstairs unit of the 2-flat. Commissioner Bremer stated she believes that would provide a possibility for too many people with children on a small lot. Chairwoman Rockweiler believes this use would provide 15 dwelling units per acre and the future land use standards recommend 4-9 dwelling units per acre. Planner Sheriff verified there is adequate parking for a 2-flat. Commissioner Bremer inquired in what way the coach house could be used if a motion is made to allow two living units rather than three living units on the property. A question was asked if other rental properties in the neighborhood had two or three units on the property already, similar to this. Planner Sheriff stated the problem is they are everywhere and without dedicating time to a study they cannot verify every one of the buildings to rental status of the properties. Discussion ensued regarding all elements surrounding the property in regard to safety, number of habitable units allowable, variances needed and circumstances and consequences. Motion by Bremer seconded by Smale with regard to File No. Z-1007, to recommend amended approval of a use variation for a 2-unit multifamily building at 1508 N Green Street, with the following conditions, as amended: 1. The petitioner shall pave the existing gravel driveway using either asphalt or concrete. 2. The petitioner shall repair or replace any damaged siding. 3. All work shall be completed within one year of approval by City Council. 4. The petitioner shall make any repairs or improvements to the property as determined by the Zoning Administrator. 5. The dwelling unit identified as the detached coach house shall be converted into an accessory structure. and by making said motion, we believe the approval criteria for use variations have been met based upon the discussion of the planning and zoning commission at their December 15, 2021, meeting. Chairwoman Rockweiler stated she agrees with the approval criteria having positive impact on property damage and not being in harmony with neighborhood. Commissioner Bremer agrees with Chairwoman Rockweiler that the motion made better accommodates the harmony of the neighborhood that the motion originally presented. Commissioner Davis agrees with Commissioners Bremer and Rockweiler and stated the motion approval for a 2-unit vs 3-unit building is a good compromise after full discussion. Staff may have additional comments based upon the testimony presented during the public hearing. BACKGROUND & REQUEST SUMMARY The petitioner, Gary A Benning (Owner of Record), is requesting approval of a Use Variation to allow a 2-flat multifamily residence and a coach house at 1508 N Green Street. The property will also need to receive approval of the following Zoning Variations to accommodate the development: 1. Variation to allow a minimum lot area of 8,744.76 square feet in lieu of the required 15,000 square feet. 2. Variation to allow a minimum lot width of 66 feet in lieu of the required 150 feet. 3. Variation to allow a front yard setback of 14 feet in lieu of the required 25 feet for the 2-unit residence. 4. Variation to allow a rear yard setback of 4 feet in lieu of the required 25 feet to accommodate the existing coach house. 5. Variation to allow an interior side yard setback of 0.6 feet in lieu of the 6 feet required to accommodate the existing coach house. 6. Variation to allow a rear yard setback of 4 feet in lieu of the required 6.25 feet for the existing garage. 7. Variation to allow two principal structures on a single lot. 8. Any other variations necessary to accommodate the existing principal and accessory structures. The subject property was recently purchased by the petitioner. Staff is unaware nor do the petitioners know exactly how long the existing 2-flat and coach house have operated on the property. The petitioner desires to renovate the existing coach house and continue to use the property for rental housing. CITY OF MCHENRY ORDINANCES • The petitioner must meet the Approval Criteria for Use Variances, listed in §11-19-6 of the City of McHenry Zoning Ordinance. • The petitioner must meet the Approval Criteria for Variances, listed in §11-19-5 of the City of McHenry Zoning Ordinance. STAFF ANALYSIS CURRENT LAND USE AND ZONING The subject property is currently zoned RS-4 High Density Single-Family District. A multifamily residence is not permitted within the RS-4 District. The surrounding land use primarily consists of RS-4 High Density Single Family with a nonconforming duplex directly west of the subject property. Due to how long the property has operated as a multifamily residential use, staff does not believe the request would generate any adverse impacts. FUTURE LAND USE MAP RECOMMENDATION The future land use map recommends medium density residential (4-9 dwelling units per acre) on the subject property. The subject property currently contains a ratio of 15 dwelling units per acre (3DUs/0.20 acres). The proposed use of the property is not in compliance with the future land use map recommendation. 145 CCOMPREHENSIVE PLAN OBJECTIVES AND POLICIES Overall, staff believes the proposed development is consistent with the City’s Comprehensive Plan objectives and policies. Staff comments italicized. x Land Use, Objective – Allow a mixture of land uses in appropriate areas to promote responsible growth while providing a high quality of life to the residents. o Policy – “Preserve and expand areas of residential land use.” (p. 27) ƒ Approval of the applicant’s request would preserve and expand areas of residential land use. x Neighborhood Character, Objective – Promote Downtown Housing. o Policy – “Approve high-density multi-family residential in conjunction with commercial retail to create a mixed-use area.” (p. 48) ƒ Being within walking distance to the Historic Downtown, approval of the request would promote having multifamily land use within walking distance of commercial businesses. STAFF RECOMMENDATION & ANALYSIS In summary, staff believes the proposed use of the property is in substantial conformance with the City’s Comprehensive Plan and Development Policies. The Community Development Department has been working closely with the petitioner and have already performed a walk-through inspection of the existing units. There were no building code violations noted from the walk-through inspection. From a Code Enforcement perspective, it is difficult for the City to monitor and track these dwellings. Being a nonconforming use, it often discourages property owners from seeking building permits because they believe the City will penalize them. The safety of the occupants of the building is the number one priority of the Community Development Department. Given the longevity of the use and the minimal impact on the surrounding property owners, staff does not object to the petitioner’s request and recommends approval subject to appropriate conditions. If the Planning & Zoning Commission agrees with staff’s assessment, then two separate motions are recommended: 1st MOTION: I motion to approve the petitioner’s request for a use variance to allow a 3-unit multifamily building at 1508 N Green Street. AND by making said motion, I agree with staff’s assessment that the approval criteria for Use Variations have been met as outlined in the Staff Report. APPROVAL CRITERIA FOR USE VARIANCES (§11-19-5) A. Practical Difficulties or Particular Hardship: For reasons fully set forth in the written findings, the strict application of the provisions of this title relating to the use of the buildings or structures, or the use of the land, would result in unnecessary and undue hardship upon the applicant, as distinguished from mere inconvenience. Staff believes the strict application of the provisions of the Zoning Ordinance would result in an unnecessary and undue hardship. B. Reasonable Return: The property cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations in this title for the pertinent zoning district. Staff believes the subject property cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations. 146 C. Unique Circumstance: Special circumstances, fully described in the written findings, exist that are peculiar to the property for which the use variance is sought and that they do not apply generally to other properties in the same zoning district. Staff does believe the request is under special circumstances uniquely for this property because the property has operated for long period of time and have existed in harmony with the surrounding property owners. D. Not Alter Local Character: The granting of the use variance will not alter the essential character of the locality, nor substantially impair environmental quality, property values or public safety or welfare in the vicinity. Staff does not believe approval of the request will generate any adverse impacts on the surrounding area. Bringing the property into compliance with building regulations will have a positive impact on property values. E. Consistent With Title And Comprehensive Plan: The granting of a use variance will be in harmony with the general purpose and intent of this title and of the Comprehensive Plan of the City. Staff believes the overall request is consistent with the Title and Comprehensive Plan of supporting multifamily development near the Downtown. 2nd MOTION: I motion to approve the petitioner’s request for the following zoning variations: 1. Variation to allow a minimum lot area of 8,744.76 square feet in lieu of the required 15,000 square feet. 2. Variation to allow a minimum lot width of 66 feet in lieu of the required 150 feet. 3. Preserves Rights Conferred By District: Staff believes this does not confer a special privilege for the subject property. F. Necessary For Use Of Property: 147 Staff believes that without approval, the petitioner would be denied reasonable use and enjoyment of the property. G. Not Alter Local Character: Staff believes approval of the applicant’s request would not substantially alter essential character of the locality nor have any other adverse impacts. Tonyan and Sons Quote Anderson Architectural Recommendation AGENDA ITEM SUMMARY: Attached to this supplement is a roof quote for the repair and restoration of the Petersen Farm Horse Barn. There are three options with varying price levels. Council should entertain a discussion regarding the project, settle on an option and approve an ordinance for a budget amendment in the corresponding amount to be taken from the Developer Donations Fund. BACKGROUND: A contract with Wm Tonyan and Sons to repair the Petersen Farm Horse barn was ap proved by City Council at the January 17th meeting. The contract addressed the straightening and stabilization of the structure that was hit by a microburst last fall. Foundation, floor, siding, windows and doors were all included in the contract however the final roofing materials were not. Tonyan has presented to city staff a proposal that includes three options for the re -roof of the building. A basic architectural shingle for $30,000, a higher end shingle that is more of a match to the house and similar to the main barn for $39,000 and, finally, a cedar shake option that would mirror original construction materials for $78,000. ANALYSIS: There has been a good deal of discussion regarding the roofing materials with staff and with those from the Landmark Commission and the Colby Petersen Farm Foundati on. Commission and Foundation members would like to see the use of the cedar shake shingles as outlined in the historical architecture report completed on the city’s behalf by Anderson Architects. Staff favors 151 the more price conscious quote of the higher end architectural shingles which will also match the other buildings on the property. The significant price difference, coupled with the fact that the balance of the restoration is not 100% architecturally accurate, and that the only other structure on the property to have cedar shakes are the wooden silos, is the basis for the staff’s recommendation against the wooden roof. The historical architectural recommendations and the desire to display a building in as close to accurate restoration as possible is the contention of the Commission and the Foundation. The project is being funded through the Developer Donation Fund and insurance reimbursement. Whatever direction is chosen will be taken from the Developer Donation Fund and will require a budget amendment in that amount. As a reminder of the overall project costs, the overall quote is $237,152. There was already $100,000 budgeted for the project and $61,000 was added to the project from the Developer Donations Fund. Additionally, the city received approximately $76,000 from the insurance claim. Therefore, based on direction from Council, an addition $30,000 - $78,000 would push the total project cost from between $267,152 to $315,152.
