Regular Board Meeting
Thursday,October 7, 2021
Roll Call
A meeting of the McHenry County Municipal Risk Management Agency was called to order by Chair
Sandi Rusher representing the Village of Spring Grove on Thursday, August 5, 2021, at 9:13 a.m.The
meeting was held remotely via Zoom in compliance with the Open Meetings Act due to the COVID-19
pandemic.
Present: Stephen Bechler,Village of Fox River Grove; Deborah Schober, City of Woodstock; Sandi
Rusher,Village of Spring Grove; Ann Campanella, City of McHenry, Dennis Murray,Village of Island Lake.
Others present: Recording Secretary Monte Johnson; Paul Christensen; Board Consultant Michael
Nugent; Board Counsel Tom DiCianni; and Lori Mittelstaedt,John Zaborowski, and Josie Davis of CCMSI.
Members absent:Todd Walker,Village of Algonquin; Mike Hill,Woodstock Fire & Rescue

Service Provider Discussion
Ann Campanella thanked all service providers for doing a good job.
Approval of the Minutes of the August 5 2021, Regular Meeting
A motion was made by Member Campanella and seconded by Member Schober to approve the
minutes of the meeting of June 8, 2021. Roll call:Vote: 5-ayes: Fox River Grove, McHenry, Woodstock,
Island Lake, and Spring Grove. 2-absent: Algonquin, Woodstock Fire & Rescue; 0-nays,0-abstained.
Motion carried.
Chairman's Report
There was no report from the Chairman.
Officer Elections
Mr. Nugent explained that Ed McGinty was the Vice-Chair, and we need to do elections for each of our
officer positions.
Mr. Nugent opened nominations for Chair. Member Schober nominated Sandi Rusher as Chair.There
were no other nominations, and Mr. Nugent closed nominations. Roll call vote for Sandi Rusher as Chair:
Vote: 5-ayes: Fox River Grove, McHenry,Woodstock, Island Lake, and Spring Grove. 1-absent:
Algonquin; 0-nays, 1-abstained: Woodstock Fire & Rescue. Motion carried.
Clerk's Note: Mike Hill from Woodstock Fire& Rescue joined the meeting at 9:03 a.m. He came in during
the vote for Sandi Rusher for Chair, and abstained on that vote as he was not here for that discussion.
Mr. Nugent opened nominations for Vice-Chair. Member Schober nominated Dennis Murray as Vice-
Chair. There were no other nominations, and Mr. Nugent closed nominations. Roll call vote for Dennis
Murray as Vice-Chair: 6-ayes: Fox River Grove, McHenry, Woodstock, Island Lake, Spring Grove,
Woodstock Fire & rescue. 1-absent: Algonquin. 0-nays; 0-abstained. Motion caried.
Mr. Nugent opened nominations for Treasurer. Member Campanella nominated Paul Christensen as
Treasurer.There were no other nominations, and Mr. Nugent closed nominations. Roll call vote for Paul
Christensen as Treasurer: 6-ayes: Fox River Grove, McHenry, Woodstock, Island Lake, Spring Grove,
Woodstock Fire & rescue. 1-absent: Algonquin. 0-nays;0-abstained. Motion caried.
Approval of the Treasurer's Report
Mr. Nugent shared his screen to show the treasurer's report. He said this report was misleading because
we haven't yet paid the insurance premiums, which were up significantly. When we look at the report in
December it will look much closer to the budget. Claim payments are up significantly but there is
nothing surprising. A motion was made by Member Murray and seconded by Member Bechler to
approve the Treasurer's Report as presented Roll call:Vote: 6-ayes: Fox River Grove, McHenry,
Woodstock, Island Lake, Spring Grove, Woodstock Fire & rescue. 1-absent: Algonquin; 0-nays, 0-
abstained. Motion carried.
Approval of 2021 Year-end Audit
Mr. Nugent shared his screen to show the audit. Mr. Christensen discussed page 12 which showed the
revenues and losses.The left column shows the current year and the right column shows the previous
year. Member contributions were up a bit. Incurred claims were down significantly due to COVID. Excess
premiums were bumped up for the year. Mr. Nugent explained that during a normal investment year
we would have broken even. Despite losses over the last two years,we are still in a healthy cash
position.The fund balance is at$1.1 million. A look at the loss report will give a good view of the bad
years we had in the past.A motion as made by Member Hill and seconded by Member Campanella to
approve the 2021 Year-end Audit Roll call:Vote: 6-ayes: Fox River Grove, McHenry, Woodstock, Island

carried.
Approve WC Lien Waiver Process
Attorney DiCianni added to Section 5 of the policy manual that deals with claims administration.Section
5.1 deals with discretionary authority. He broke those into 5.1.A and 5.1.6, with the new subsection
giving authority to the Member to approve the lien or waiver reduction with advice of MCMRMA's claim
administrator and defense attorney handling the worker's compensation action.A motion was made by
Member Schober and seconded by Member Murray to approve the WC Lien Waiver Process Roll call:
Vote: 6-ayes: Fox River Grove, McHenry, Woodstock, Island Lake, Spring Grove,Woodstock Fire &
rescue. 1-absent: Algonquin; 0-nays, 0-abstained. Motion carried.
Insurance Consultant's Report
Mr. Nugent reported that we are back to doing trainings but there was not much interest in the recent
trainings. The next one will be in late October or early November for winter safety. We got through the
insurance renewal but will need Marsh to start work now to get ready for 2022 since the entire market
keeps getting worse. We made it through the storm season but the liability market is still terrible. We
may have allocation numbers ready for the December meeting.There is an online demonstration later
today for Safety National Map system.
Attorneys Report
Attorney Tom DiCianni's reported that Doug Sullivan has left their office, so anybody that was dealing
with him on matters can talk to Rob Bush or Attorney DiCianni to transition those cases. Courts are open
and functioning fairly well, but jury trials have not resumed much. We expect many cases will be
backlogged and not tried for two or three years.
CCMSI Report
Mr. Nugent shared his screen while Lori Mittelstaedt reviewed the report. We have eight claims so far
for$9,450. Payments are about the same as last year, with a McHenry property damage claim being the
biggest influence.The variance is small compared to last year.There are two settlements for
$67,754.93, recoveries of$2,853.82, and reimbursements of$360,154.86.The report lag has been good.
Current savings charges were$185,054.23 with a total savings of$94,338.13.The big medical costs were
for surgery and physical therapy.
Executive Session
A motion was made by Member Murray and seconded by Member Schober to enter into Executive
Session at 9:24 a.m.for the purpose of discussing litigation (5 US 120/2(c)(11) ) Roll call: Vote: 6-
ayes: Fox River Grove, McHenry,Woodstock, Island Lake, Spring Grove, Woodstock Fire & rescue. 1-
absent:Algonquin; 0-nays, 0-abstained. Motion carried.
Reconvene
Chair Sandi Rusher reconvened the meeting back into open session at 10:10 a.m. Present: Stephen

Review and Approval of Executive Session Actions
This item will be tabled until the next meeting as members have not had the opportunity to review
closed session minutes for approval.A determination will also need to be made to see what minutes
must still remain closed for confidentiality.
Other Business
Chief Mike Hill introduced the new Deputy Fire Chief who will serve as an alternate representative to
the MCMRMA board.
