Regular Board Meeting
Thursday,August 5,2021
Roll Call
A meeting of the McHenry County Municipal Risk Management Agency was called to order by Chair
Sandi Rusher representing the Village of Spring Grove on Thursday, August 5, 2021, at 9:13 a.m. at the
City of McHenry City Hall, 333 S Green St, McHenry, IL 60050.
Present: Stephen Bechler,Village of Fox River Grove; Deborah Schober, City of Woodstock; Sandi
Rusher, Village of Spring Grove; Ann Campanella, City of McHenry, Dennis Murray, Village of Island Lake.
Others present: Recording Secretary Monte Johnson; Paul Christensen; Board Consultant Michael
Nugent; Richard McLaughlin, Mayor of Village of Island Lake; and Lori Mittelstaedt,John Zaborowski,
and Josie Davis of CCMSI. Members absent: Todd Walker, Village of Algonquin, Mike Hill, Woodstock

There were no members of the public to offer comment.
Service Provider Discussion
There was no discussion regarding service providers.
Approval of the Minutes of the June 8 2021 Regular Meeting
A motion was made by Member Bechler and seconded by Member Campanella to approve the
minutes of the meeting of June 8 2021. Roll call: Vote: 5-ayes: Fox River Grove, McHenry, Woodstock,
Island Lake, and Spring Grove. 2-absent:Algonquin, Woodstock Fire & Rescue; 0-nays, 0-abstained.
Motion carried.
Chairman's Report
There was no report from the Chairman.
Approval of the Treasurer's Report
Paul Christensen reported that we have a net income of$122,131.97, but that is still unaudited. There
could be some adjustments put into place.This should be considered a very good year. Mr. Nugent
explained that given the increase in insurance cost and the year to year comparisons, we have done very
well. We are almost$1 million ahead of last year. A motion was made by Member Campanella and
seconded by Member Bechler to approve the Treasurer's Report as presented Roll call:Vote: 5-ayes:
Fox River Grove, McHenry,Woodstock, Island Lake, and Spring Grove. 2-absent:Algonquin, Woodstock
Fire & Rescue; 0-nays, 0-abstained. Motion carried.
Insurance Consultant's Report
Mr. Nugent reported that the training schedule for the next 12 months should be in the packet. An email
was sent out about the next training on August 24th.There were also a number of documents included
that illustrated the different coverages from various insurers.
Attorney's Report
Attorney Tom DiCianni's reported that a presentation was given a few weeks ago regarding the Safety
Act.A number of presentations have also been given to several police departments.The act is evolving,
however, and some items are not clear. His firm is able to review policies that are created by police
departments to make sure they comply with the act.The whistleblower policy is still an outstanding
issue and it covers not only police departments, but also the entire municipality.Questions are still
being asked about the auditor requirements as well.
Attorney DiCianni also explained a recent Supreme Court decision regarding a wrongful conviction claim.
Although the case was won by his firm at all levels, it came back to the State Supreme Court and was
reversed the second time. This decision was bad for police departments moving forward.
Executive Session
A motion was made by Member Schober and seconded by Member Campanella to enter into
Executive Session at 9 31 a.m. for the purpose of discussing litigation(5 US 120/2(c)(11).).. Roll call:
Vote: 5-ayes: Fox River Grove, McHenry,Woodstock, Island Lake, and Spring Grove. 2-absent:
Algonquin,Woodstock Fire & Rescue; 0-nays,0-abstained. Motion carried.
Reconvene
Chair Sandi Rusher reconvened the meeting back into open session at 10:28 a.m. Present: Stephen
Bechler,Village of Fox River Grove; Deborah Schober, City of Woodstock; Sandi Rusher,Village of Spring
Grove;Ann Campanella, City of McHenry, Dennis Murray,Village of Island Lake.
Approval of Executive Session Actions
A Motion was made by Member Campanella and seconded by Member Schober to approve the
settlementfor Schroeder v.Woodstock Fire Protection District asdiscussed inclosed session.Roll call:
Vote: 5-ayes: Fox River Grove, McHenry,Woodstock, Island Lake, and Spring Grove. 2-absent:
Algonquin,Woodstock Fire & Rescue; 0-nays,0-abstained. Motion carried.
A Motion was made by Member Campanella and seconded by Member Bechler to approve the
settlementfor Beatty v.Woodstock Fire Protection District asdiscussedin closed session.Roll call:Vote:
4-ayes: Fox River Grove, McHenry, Island Lake, and Spring Grove. 2-absent: Algonquin,Woodstock Fire
& Rescue; 0-nays, 1-abstain: Woodstock. Motion carried.

& Rescue; 0-nays,0-abstained. Motion carried.

for Villarreal v. Village of Island Lake asdiscussed inclosed session Roll call: Vote: 5-ayes: Fox River

Rescue; 0-nays,0-abstained. Motion carried.
CCMSI Reports
Lori Mittelstaedt reported that we only had$743,178 in workers compensation claims this past fiscal
year compared to$1,449,127 the year before.Total incurred costs for FY 20/21 were$905,871 copared
to$1.8 million the year before.There have been 13 workers comp settlements in the past year for
$959,825.36.
Other Business
The next meeting will be held October 7, 2021.
