Planning and Zoning Commission Special Meeting Minutes
July 18, 2018
Chairman Strach called the July 18, 2018 special meeting of the City of McHenry Planning and
Zoning Commission to order at 7:30 p.m. In attendance were the following: Gurda, Sobotta,
Strach and Walsh. Absent: Doherty, Miller and Thacker. Also in attendance were: Director of
Economic Development Martin and Economic Development Coordinator Wolf.
There was nobody in attendance who wished to address the Commission with public comment.
Chairman Strach closed the public comment portion of the meeting at 7:30 p.m.
Approval of Minutes
Motion by Sobotta, seconded by Gurda, to approve the June 13, 2018 Regular Meeting minutes

Conditional Use Permit to allow an assembly use (educational facility), STEAM -based program
for children to learn by doing with a small retail component located at 1112 N. Green Street
Chairman Strach called the Public Hearing to order at 735regarding File No. Z-933 an
application for a conditional use permit to allow an assembly use (educational facility), STEAM -
based program for children to learn by doing with a small retail component for the property
located at 1112 N. Green Street,
Chairman Strach stated Notice of the Public Hearing was published in the Northwest Herald on
July 3, 2018. Notices were mailed to all abutting property owners of record as required by
ordinance. The subject property was posted. A Certificate of Publication and Affidavit of
Compliance with notice requirements are on file in the City Clerk's Office.
In attendance was Joseph Quinn, 9404 Nicholas Lane, Spring Grove, IL 60081 who was sworn in
by Chairman Strach. Mr. Quinn stated he is requesting approval of a special use for his business,

Snapology a STEAM (Science, Technology, Engineering, Art, and Math) based learning and they
each kids using unique methods. STEAM is most know for Legos and Kinects program but utilize
laptops for computer coding and tablets for robotics from simple to complex programs. He
stated that they also use household items to make things such as slime and other types of things
to teach the children viscosity and how things become what they are. He stated this is done by
holding summer camps and after school programs at the center or the schools. Snapology also
does birthday parties and field trips and special events throughout the year. Mr. Quinn is very
excited to bring his business to McHenry.
Director of Economic Development Martin stated that Snapology is a STEAM (Science,
Technology, Engineering, Art, Math) based program which teaches kids by having them do
different activities, similar to what many of the primary schools do. He stated it is a franchise -
based business and the couple is proposing to run the business out of River Place, has the
franchise rights for this area. Director of Economic Development Martin stated they are
requesting an assembly use, due to the number of children/adults that will be in the unit at any
one time (more than 25). He stated an assembly use could be for educational, cultural, spiritual,
social, or recreational purposes and further stated Snapology would require a conditional use.
Director of Economic Development Martin stated all building codes will be met and the building
inspectors have already done a couple of walk-throughs of the unit which is at River Place. He
opined this is a good use of the space. An assembly use for zoning purposes is required due to
the number of people in the unit, which may result in adverse impacts to adjacent land uses.
Director of Economic Development Martin stated he does not have any concerns with this use
and believes it will add to the diversity of uses in the River Place building. He stated he did not
believe there would be any parking or adverse land use impacts.
Director of Economic Development Martin stated Staff Recommends approval of a conditional
use permit to allow an assembly use (educational facility) to locate in 1112 N Green Street.
Staff finds the requirements of Table 31 of the zoning ordinance have been met.
Chairman Strach invited questions and/or comments from the Commission. There were no
questions from commissioners.
There was nobody in attendance who wished to address the Commission regarding this matter.
Chairman Strach closed the public comment portion of the hearing 7:40 p.m.
Motion by Sobotta, seconded by Walsh, to recommend to the City Council with regard to File No.
Z-933, to approve the conditional use permit to allow an assembly use, for the property located
at 1112 N. Green Street:

Chairman Strach closed the Public Hearing regarding File No. Z-933 at 7:40 p.m.
Continuation of the Discussion of the City's Comprehensive Land Use Plan
and Development Policies (Focus on Existing Land Use and Future Land Use Maps)
Director of Economic Development Martin stated that he has prepared amendments to the
zoning ordinance for an Agriculture District and a Mixed -Use District. These would complement
the Agriculture and Mixed -Use Land Use categories on the Future Land Use Map and become
part of the zoning ordinance and would be the regulatory tool to enforce that. He presented the
Al Agriculture District which was taken from McHenry County Zoning Ordinance which states
permitted uses, conditional uses, and bulk and setback regulations. Director of Economic
Development Martin stated that he removed some of the uses that he opined were unnecessary
in the ordinance. He further stated the dimensions for bulk and setback regulations used were
up to 2 acres, 2-3 acres, and 3-5 acres for building height and width for maximum building
coverage.
Director of Economic Development Martin stated the Mixed -Use Zoning District is to allow more
than one use on a property; residential and commercial for example. He stated this was taken
from a model ordinance through the American Platting Association. He stated that it starts out
the same with permitted use, conditional use, and bulk and setback with some unusual
components like the minimum floor to ceiling height and transparency to doors & entrances
which are in place to encourage a downtown development, pedestrian feel.
Director of Economic Development Martin stated that HR Green completed the map of the
southern and eastern quadrants of the city. He stated there is a boundary agreement with Prairie
Grove. He suggested a south boundary down Illinois Route 31 past the Facility Planning Area
where water sewer would be available and stated his first thought was to go no further than
Gracy Road. He stated the land is wet to the east. He inquired if we would want to go to
Wright/Edgewood Road down Illinois Route 31 on the west side where it is vacant and stop at
the residential area and use agricultural zoning.
Director of Economic Development Martin stated looking at the east side by Lakemoor past the
Facility Planning Area on the north (the Weingart Farm), east of Chapel Hill and continue north
to Lincoln Road encompassing the southeast corner of Chapel Hill Road and Illinois Route 120
would be a boundary. He further stated that the City does not have a boundary agreement with
Lakemoor.

Chairman Strach inquired about the south side of Illinois Route 120 if sewer and water were fed
for the new gas station. Director of Economic Development Martin confirmed that there was
sewer and there would be water at that corner. Director of Economic Development Martin stated
the Facility Planning Area line may be a mistake on the map. Chairman Strach opined it would
be wise to include the larger piece at the south east corner of Chapel Hill and Illinois Route 120
into the City. Discussion ensued on properties being inside/outside city limits in that area — some
with water, some with only sewer.
Chairman Strach stated the area off of Green Street (south of the Shores) is not currently in the
City and should stay that way. Chairman Strach stated there would be agriculture zoning south
on Illinois Route 31, both sides of road. Director of Economic Development Martin stated not
too far east or west. Chairman Strach opined there may be some mixed use along Illinois Route
31 but that they may not be small enough for a mixed use category but that most would be
industrial. Chairman Strach opined there could be a strip mall on Illinois Route 31, south of
Morgan Hill. Chairman Strach opined mixed use gives us more options for future use. Chairman
Strach stated the northeast corner of Veterans Parkway and Illinois Route 31 could be mixed use
development due to the adjacent condos, townhomes and detailed access. Director of Economic
Development Martin stated it is presently zoned BP - Business Park and C5 - Highway Commercial.
Director of Economic Development Martin stated that his goal is to put everything together on
one map and then bring it before the Commission to gain acceptance of the general future land
uses of the City and acceptance of the Agriculture and Mixed Use Design District Ordinances
generally. Director of Economic Development Martin stated there is no motion necessary. He
further stated that he will bring back the ordinances for approval at a future meeting with the
suggested changes on all the maps and that after that we would schedule a public hearing and
advertise it for posting so public input can be involved.
Chairman Strach inquired about the Agricultural A-1 minimum lot area and inquired if we should
leave as zero. Chairman Strach stated there needs to be some clear direction and opines there
needs to be a minimum. Director of Economic Development Martin suggested one acre or up to
2 acres. Chairman Strach prefers one acre as the minimum. Discussion ensued. All
commissioners agreed with a one acre minimum lot size.
Chairman Strach stated he is in agreement with the Mixed Use requirements as presented. He
opined the mixed use category would be used primarily in the downtown area.
Director of Economic Development Martin stated that the Landmark Commission has a template
that shows boundaries and guidelines and pictures of houses which he opined is perfect for the
Historic District in the Main/Waukegan area. He stated that it shows architectural styles and
guidelines and stated he would ask the Landmark Commission if they could replicate that for
Riverside Drive and Green Street. He opined the use of those documents for building guidelines
in those areas in the future would be helpful.

Director of Economic Development Martin stated that after the updating is done through HR
Green and reviewed by the commission that there would be a public hearing. Commissioner
Walsh inquired about the content of the maps. Commissioner Sobotta inquired if the public
notice would show the new plan. Director of Economic Development Martin stated the
information would be made public. Commissioner Sobotta inquired if the map could be made
public for resident review. Director of Economic Development Martin stated that possibly the
McHenry Public Library would allow the display of the maps. Chairman Strach stated the annual
review of the maps would be important and opined the best time for review would be in
December, January or February. All commissioners agreed.
Staff Report
Director of Economic Development Martin stated that the August 15, 2018 regularly scheduled
meeting would be held at 7:30 p.m. in the Council Chambers. There are presently three cases
for the August 15 meeting, a minor variance on Ramble Road, the VFW expansion and a skilled
nursing facility on Bull Valley and Ridgeview Drive.

The property is located at 1503 N Ramble Road, northwest corner of Ramble Road and Home
Avenue and is approximately .30 acres

The subject property is zoned RS-2 and contains a home, a deck and an attached garage.
Background and Description of Request
The applicant would like to construct an approximately 264 square foot garage addition to the
west and attached to the existing 528 square foot garage. A variance is required due to an
existing protrusion of the current garage, about 25, and due to the proposed additional six-foot
protrusion into the corner side yard.
A 15-foot corner side yard building setback is required in the RS-2 zoning district. The applicant
will also be completing drainage improvements in addition to the variance request. This is a very
sensitive drainage area and the applicant is installing a system so the water doesn't pond for long
periods of time adjacent to the roadway following a rain.
Analysis
The applicant is proposing to construct a 12' X 22' attached garage addition approximately 9'
from the corner side yard property line off of Home Avenue. A Variance is required because of
the existing garage, as well as the proposed garage addition which would be 6' inside the corner
side yard setback. Currently the existing garage is approximately 2.5' into the corner side yard
setback.

Staff believes the proposed garage addition will not detract or adversely impact neighboring
properties and is appropriately located on the lot. This applicant's driveway comes off of Home
Avenue, and there's a deck to the north with the existing garage to the east.
Table 32, approval criteria for variances, states special circumstances that do not apply generally
to other properties in the same zoning district. This situation may apply to other properties in
this zoning district. It however it certainly does not apply to many. Further, the variance will not
alter the local character and is consistent with the zoning ordinance and comprehensive plan.
Staff Recommendation Prior to Public Hearing
Approval of a Variance to allow a six-foot protrusion in the corner side yard.

Table 32 of the City of McHenry Zoning Ordinance provides that in recommending approval or conditional
approval of a variance, the Planning and Zoning Commission shall transmit to the City Council written
findings that all of the conditions listed below apply to the requested action.

Location and Size of Property
The subject property is located at 3002 W Route 120, east of the Fox River and north of Route
120, and consists of approximately 14.3 acres.

The subject property is currently zoned C-5 Highway Commercial and contains several ballfields,
a gazebo, a couple of sheds and a 11,700 square -foot one-story block and brick building
constructed in 1948.

Background and Description of Request
The applicant, VFW, received approval of a zoning map amendment to C-5 and a conditional
use permit to allow the following uses on the property at 3002 W Illinois Route 120:
recreational institution, outdoor amusement establishment, restaurant serving alcoholic
beverages with live entertainment and dancing. This occurred in 1996, as part of the East of
the Fox River annexation.
Currently the VFW wants to expand their conditional use permit and add outdoor seating,
which is depicted on the schematic in the application packet. They have included a covered
patio which extends directly into their building at the far southern end, which leads to more
outdoor seating. All the seating will be enclosed. Since the VFW is expanding their conditional

use permit they are required to obtain an additional cononal use permit. Therefore they
are requesting a conditional use permit to allow a recreation institution, outdoor amusement,
restaurant serving alcohol, live entertainment and dancing and outdoor seating/with alcohol
and food.
Staff Analysis
The VFW is home to numerous baseball games (see attached survey). Additionally, they host
numerous events within their building, have a full bar and serve food. With this conditional use
people may choose to eat/drink outside within the outdoor seating area, and staff would
recommend all the rules of outdoor seating in the zoning ordinance be followed if this request
is approved, with a few exceptions outlined in the recommendation (see attached). Generally,
there will be no service of food or alcohol outside at the VFW. People may bring it outside but
must remain within the outside seating area delineated on the plan -with the alcohol.
Staff would also recommend that the main access to and from the outdoor seating area be
from the inside bar area and not from the parking lot. The outdoor seating area will definitely
be an enhancement to the property and draw more people to the site. However, with the
outdoor seating regulations and time restriction and other rules and regulations staff believes
the requirements of Table 31 for Conditional Use Permits has been met.
Staff does not believe this will adversely impact the neighboring residential properties as it is
located on the south side of the building and the residential is to the north and west. Staff
supports the request as presented with the recommendations included in the staff report.
Staff Recommendation Prior to Public Hearing
Approval of a Conditional Use Permit to allow a recreational institution, outdoor amusement,
restaurant serving alcohol, live entertainment and dancing and outdoor seating/with alcohol
and food at 3002 W Illinois Route 120 with the following conditions:
• Primary access to/from the outdoor seating area be from the interior of the VFW
building;
• All alcohol consumed outside must remain within the outside seating area delineated on
the plan.
• Regulations in the Outdoor Seating section of the zoning ordinance be followed, with
the exception of the following: "No service of food outside," and "No service of alcohol
outside," and "Outdoor seating must be located on a hard surface such as asphalt
concrete, brick or wood."
• Outdoor seating is developed in substantial conformance with the Preliminary Floor
Plan prepared by Reitan Architects LLC and dated 6/28/18.

Whereas, a written Petition signed by the VFW Veteran's Club President of the Board of
Directors, Thomas Lawson, and the City of McHenry has been filed with the City Clerk of the City of
McHenry, Illinois requesting the following zoning change:
1. reclassification from E Estate Zoning District to CS Highway Commercial District;
2. conditional use permit to allow the following uses on the subject premises: Recreational
Institution, outdoor amusement establishment; restaurant serving alcoholic beverages with

under the provisions of the Zoning Ordinance of the City of McHenry, as amended, for the property
commonly known as 3002 West Route 120, McHenry Illinois, and legally described on Exhibit A

Whereas, a hearing was held before the City of McHenry Zoning Board of Appeals on October
23, 1995, at which time the Zoning Board of Appeals did take evidence and view exhibits presented
thereat by the Petitioners; and,
Whereas, based on evidence heard, the Zoning Board of Appeals found that there was no
overriding reason for not granting the zoning reclassification and conditional use permit as requested;
and,
Whereas, the Zoning Board of Appeals found, and the City Council concurs in that finding, that
it would serve the interests of the City if said reclassiftcation and conditional use permit were granted
for the subject property.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry,
Illinois, as follows:
Section 1: That the following amendments to the City of McHenry Zoning Ordinance are hereby
granted on the property commonly known as 3002 West Route 120, McHenry Illinois 60050, and legaily
described in Exhibit A:
A. reclassification from E Estate Zoning District to CS Highway Commercial District;
B. conditional use permit to allow the following uses on the subject premises: recreational
Institution; outdoor amusement establishment; restaurant serving alcoholic beverages with

Section 2: That the City Council finds that in granting the reclassification, the following criteria
have been proved before this body:
A. The proposed uses are compatible with existing uses or existing zoning of property in the
environs.

B. The trend of development in the general area since the original zoning of the affected
property was established supports the proposed use or zoning classification.
C. The proposed use or zoning classification is in harmony with the objectives of the
Comprehensive Plan of the City as viewed in light of any changed conditions since the
adoption of the Plan.
D_ The proposed use or zoning classification promotes the public interest and not solely the
interest of the applicant.
Section 3: That the City Council finds in granting the conditional use permit, the following
criteria have been proved before this body:
A. Any adverse impact of types of volumes of traffic flow not otherwise typical in the
zoning district has been minimized.
B. Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of light or air,
or other adverse environmental effects of a type or degree not characteristic of permitted
uses in the zoning district, have been appropriately controlled.
C. The proposed use will fit harmoniously with the existing natural or man-made character
of its surroundings, and with permitted uses in the zoning district. The use will not have
undue deleterious effect on the environmental quality, property values, or neighborhood
character already existing in the area or normally associated with permitted uses in the
district.
D. The proposed use will not require existing community facilities or services to a degree
disproportionate to that normally expected or permitted uses in the district, nor generate
disproportionate demand for new services or facilities, in such a way as to place undue
burdens upon existing development in the area.
E. The proposed use will not be detrimental to the safety or health of the employees,
patrons, or visitors associated with the use nor of the general public in the vicinity.
F. The proposed use is in harmony with all other elements of compatibility pertinent to the
Conditional Use and its particular location.
Section 4: All ordinances, or parts thereof, in conflict with the terms and provisions hereof, are
hereby repealed to the extent of such conflict.
Section 5: This ordinance shall be published in pamphlet form by and under the authority of the
corporate authorities of the City of McHenry, Illinois.

o. All sales and transfer of product shall take place inside the building where normal
retail transactions occur.
p. Outside display shall only be allowed when weather conditions are favorable for
this use.
q. The display shall be kept neat and orderly and remain free from trash and debris at
all times.
r. The display shall be immediately removed by the business owner any time the
City Administrator or his designee, determines a clear sidewalk is needed because
of traffic, street cleaning, maintenance, utility work, crowd control, parade,
emergency, or violation of any of the above listed conditions." (MC424059)
Outdoor Seating (MC-15-1113)
a. Application form for an Outdoor Seating Permit shall be submitted which identifies
business name, address, PIN, zoning designation, name/address/phone/fax/email of
applicant and property owner.
b. A dimensioned site plan indicating the number and location of the tables (including
table measurements), chairs, trash receptacles and any other related elements.
c. A separate "Waiver of Liability" form signed by the business owner, and in the case
of leased property, the property owner for outside seating on public property, or
alternatively a "Waiver of Liability" provision shall be included on the Outdoor
Seating Permit Application.
d. Once an Outdoor Seating Permit is issued, it shall remain active until such time as
the requesting business ceases to exist. In other words, it does not have to be
renewed annually. The Outdoor Seating Permit shall include a statement that
authorizes the City to revoke the permit if any of the established conditions are not
met.
e. Establishments with existing outdoor seating and/or with an existing conditional use
permit which addresses outdoor seating, service of food and/or alcohol, outdoor
preparation of food and/or live entertainment and/or dancing may be permitted to
continue to exist however any changes proposed by any of those establishments in the
future will require submittal of an Outdoor Seating Permit application as defined
herein and all conditions included herein shall be met which may include a variance
and/or amendment to an existing ordinance if applicable. (MC-15-1113)
£ Approved ingress and egress to and from a building must be maintained as required
by the City currently adopted building code.
g. Preparation and service of food outside is prohibited.
h. Service and consumption of alcohol outside is prohibited.
i. Outdoor seating must be located on a hard surface such as asphalt, concrete, brick or
wood.
j. Outdoor seating is prohibited within a required landscape island or area.

k. Outdoor seating located adjacent to a vehicular parking area or driving aisle shall be
separated by a physical barrier (fence, gate, landscape planter, etc.)
1. A $25 permit fee shall be required for any establishment seeking an Outdoor Seating
Permit in accordance with the recommended provisions included herein.
m. An inspection shall be required following Outdoor Seating Permit review and prior to
use of outdoor seating.
n. Sidewalks shall not be reduced to a clear usable width of less than 484nches.
o. Pedestrian and motor vehicle vision clearance must not be blocked at intersections,
driveways, doors and signage. This includes the use of appurtenances (umbrellas,
etc.)
p. Tables, chairs and other related items utilized in conjunction with an outdoor seating
area shall be appropriately secured in the case of high winds.
q. Operation of outdoor seating area is only permitted when the business for which the
Outdoor Seating Permit was issued is open but in no instance prior to 7:00 AM or
after 10:00 PM. (MG154113)
r. Outdoor seating on public property must be removed during hours that it is not being
utilized.
s. The use of signage, pennants, banners, flags (other than American), lighting, electric
amplification or noise -making devices is prohibited.
t. No electrical appliances or open flame devices shall be located or utilized within the
outdoor seating area however the use of "infrared -style" heaters is permitted in
accordance with any applicable testing organization (UL) or other listing and in
accordance with the manufacturer's specifications.
u. Outdoor seating on public property shall be immediately removed by the business
owner any time the City Administrator or his/her designee, determines that a clear
sidewalk is needed because of traffic, street cleaning, snow or ice removal,
maintenance, utility work, crowd control, parade, emergency, or in the case of
violation of any of the above conditions included in this section.
I. SPACING OF SERVICE STATIONS
No automobile service station shall be located within 600 feet of any other automobile service
station.
J. ADULT BUSINESSES
1. Intent and Purpose: It is the intent of this Section to protect and preserve the health, safety,
welfare and morals of the citizens of the City by regulating adult business within the City.
2. General Standards
A. A separate conditional use permit must be issued for each adult business as defined in
Section XIX herein.
B. Location Restrictions: No adult business shall be operated within 1,000 feet of a
residential zoning district or within 1,000 feet of the properly boundaries of any
school, day care center, cemetery, public park, public housing, nursing home, rest
home, sheltered care facility and place of religious worship. The distance limitation
shall be measured in a straight line from the lot lines of said adult business and
applicable residential zoning district, school, day care center, cemetery, public park,
public housing, nursing home, rest home, sheltered care facility and place of religious
worship.
C. Only one adult business shall be permitted per block face.

the first significant upgrades to our facilities since 1992. In the first phase of our planning we
would like to build an addition on the South side of the building. This addition will include:
-New lounge area
- New outdoor seating
- Complete remodeling of the bathrooms in our bar
- Installation of a new sprinkler system
- Installation of a new walk in cooler

Table 31 of the City of McHenry Zoning Ordinance provides that in recommending approval or
conditional approval of a Conditional Use Permit, the Planning and Zoning Commission shall transmit to
the City Council written findings that all of the conditions listed below apply to the requested action.
Please respond to each of these conditions as it relates to your request.
1. Traffic
Any adverse impact of types or volumes of traffic flow not otherwise typical in the zoning district has
been minimized.
We do not expect any changes to the current traffic environment
2. Environmental Nuisance
Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of light or air, or other adverse
environmental effects of a type or degree not characteristic of permitted uses in the zoning district have
been appropriately controlled.

3. Neighhborhood Character
The proposed use will fit harmoniously with the existing natural or man-made character of its
surroundings and with permitted uses in the zoning district. The use will not have undue deleterious
effect on the environmental quality, property values, or neighborhood character existing in the area or

We are not going to adversely impact the surrounding neighborhood.
