Agenda Item Summary:
Staff is requesting authorization of the City Administrator to sign all necessary forms and
application for the City to participate in the National Opioids Settlement of pending class action
settlement . Staff is present to answer any questions Councils may have .
Background:
On Wednesday, July 21, 2021, the National Prescription Opiate Litigation MDL Plaintiff ’s
Executive Committee, several State Attorneys general and major defend ants announced
agreement on terms of a proposed nationwide settlement s to resolve all Opioid litigation brought
by states and local political subdivisions against the three largest pharmaceutical distributors:
McKesson, Cardinal Health and AmerisourceBergen (“Distributors”), and manuf acturer Janssen
Pharmaceuticals, Inc. and its parent company Johnson & Johnson (collectively, “J&J”). These
settlements will provide substantial funds to states and subdivisions (municipalities) for
abatement of the Opioids epidemic across the country and will impose tran sformative changes in
the way the settling defendants conduct their business.
If the proposed settlements are fully adopted by states and subdivisions nationwide the
Distributors will pay a maximum of $21 billion over 18 years, while J&J will pay a maximum of
$5 billion over no more than nine years, with approximately $22.8 billion in settlement proceeds
payable to state and local subdivisions. Of the funds going directly to participating states and
subdivisions, at least 85% must be used for a batement of the Opioid Epidemic, with the
overwhelming bulk of the proceeds restricted to funding future abatement efforts by state and
local governments.
These are not class action “opt out” settlements. Instead, these settlements require that a critical
mass of both state and local governments “opt in ”. The extent of this participation will
determine whether the settlement agreements take effect. The Distributors and J&J on the o ne
hand, and the states and subdivisions on the other, each have options to walk away if they are not
satisfied with levels of participation. Participation levels also affect how much money settling
part ies will receive because about half of the abatement funds are in the form of “incentive

payments” and certain other settlement provisions also provide incentives for higher levels of
participation. Put simply, the greater the level of participation, the more funds will ultimately be
paid out for abatement . The full settlement agreement can be found at

Analysis:
The City of McHenry has no foreseeable intent to lead any future litigation against these
pharmaceutical companies, making participating in these settlements a proper course of action.
The deadline to “opt in” is January 26, 2022. Settlement amounts for the City cannot be
calculated at this time. Any funds received from the settlement will be restrict ed for use in
combating the effects of opioid use.
Recommendation:
Therefore, if Council concurs, it is recommended a motion be made to adopt the attached
resolution authorizing the City Administrator to complete, sign and submit all necessary f orms
required for the participation in the Opioid Settlement prior to January 26, 2022.

CITY OF MCHENRY
RESOLUTION: 22 –
A Resolution, Approving and Authorizing the Execution of all documents necessary for the
City of McHenry to participate in the National Opioid Settlement
WHEREAS, various States and local governments are party Plaintiffs in federal litigation
against various pharmaceutical manufacturers and distributors (collectively “Defendants”)
regarding the national opioid crisis; and
WHEREAS, the City of McHenry and its residents have suffered harm as a result of the
opioid crisis; and
WHEREAS, on July 21, 2021, a National Opioids Settlement (“Settlement”) was
proposed, to resolve all opioid litigations brought by the State and local governments against said
Defendants; and
WHEREAS, the Settlement, if agreed and adopted, will, among other things, provide
substantial funds to states and local governments for abatement of the opioids epidemic in their
respective communities; and
WHEREAS, in order to participate in the Settlement, the City is required to register,
execute and submit certain documentation to be considered a “participating” governmental entity
within a limited timeframe, specifically by January 2 6, 2022; and
WHEREAS, the Mayor and City Council, pursuant to the City’s home rule powers and all
other powers provided to it by Article VII, Section 6 of the Constitution of the State of Illinois,
and all other statutory authority, have determined that it is in the best interest of the City and its
residents to execute all documents necessary to allow it to participate in the National Opioid
Settlement;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the City
of McHenry, McHenry County, Illinois, as follows:
SECTION 1: RECITALS. The facts and statements contained in the preamble to this
Resolution are found to be true and correct and are hereby adopted as part of this Resolution.
SECTION 2: EXECUTION OF DOCUMENTS. The City Administrator is hereby
authorized and directed to execute and attest, on behalf of the City, all necessary agreements and
forms, to allow the City to participate in the National Opioid Settlement, and other documents
related thereto, upon receipt by the City Clerk.
SECTION 3: EFFECTIVE DATE. This Resolution will be in full force and effect from
and after its passage and approval as provided by law.

Resolution 22-
A Resolution Adopting Regulations Relating to the
Collection of the Amusement Push Tax Imposed
Upon the Playing of a Video Gaming Terminal within the City of McHenry
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of
this Resolution constitutes an exercise of the City’s home rule powers and functions as granted in the
Constitution of the State of Illinois;
WHEREAS, the City on October 31, 2021, by Ordinance No. 21-56, imposed a one cent ($0.01)
tax upon the amusement of playing a video gaming terminal within the City (“Push Tax”);
WHEREAS, the City does not wish to cause any undue operational hardship on its businesses and
the deadline imposed by the state legislature provided Video Gaming Terminal Operators limited time to
begin collecting and remitting the Push Tax; and
WHEREAS, the City desires to adopt regulations relating to the collection of the Push Tax, with
the Push Tax remaining in effect as imposed, effective October 31, 2021.
Now Therefore, be it Resolved by the City Council of the City of McHenry, Illinois, as follows:
Section 1: The City is authorized by Title 4, Business and License Regulations, Chapter 6, Video
Gaming Terminals, Section 4-6-7, Push Tax Imposed, to adopt, promulgate, and enforce any additional
rules and regulations pertaining to the interpretation, collection, administration, and enforcement of the
Push Tax.
Section 2: The City hereby adopts said regulations relating to the Push Tax and authorizes the
abatement of collection and remittance of the Push Tax through the end of 2021. The Push Tax will remain
in effect as imposed, effective October 31, 2021, however, Video Gaming Terminal Operators are not
responsible for collecting the Push Tax until January 1, 2022, with remittance for the month of January
2022 being due February 20, 2022, and with each successive month’s Push Tax remittance being due on
the 20th of the following month. Further, the City hereby adopts said regulations relating to the Push Tax
and authorizes the Mayor to abate collection and remittance of the Push Tax from time to time, in writing.
Section 3: This Resolution be in full force and effect forthwith upon its adoption.

AGENDA ITEM SUMMARY:
Included in the FY 2021/22 budget is $100,000 for the repair of the Colby-Petersen Farm Horse
Barn. During the process of selecting a contractor for the job through an RFP process the barn
was hit with a severe windstorm knocking the building from its foundation and twisting the
structure. Staff stabilized the structure and sought bids from qualified contractors to complete
full repairs. At this time, Staff is requesting permission to waive the bidding process and proceed
with emergency repairs to the structure by Wm. Tonyan and Sons in the amount of $237,152.
This will also require a budget amendment in the amount of roughly $61,152. The budgeted
amount and an insurance claim of $76,000 are deducted from the total.
BACKGROUND:
The Petersen Park Farm Horse Barn has fallen into disrepair. The Parks and Recreation
Department partnered with an architect with experience in analyzing and making
recommendations for these historic structures. This analysis was complete, and staff began to
research contractors specializing in barn restoration through a Request for Proposal process in
December of 2020. Eventually a contractor was identified and the price negotiation for the
restoration began as is the process.
It was during this time that work constraints, and a labor shortage in particular, from COVID
caused the contractor to back out of the job. This occurred in August of 2021. Staff reopened
the search for contractors and during this time a severe storm hit the barn, shifting it of f its
foundation and twisting the entire structure.

Staff immediately began working with our insurance company to provide an analysis of the
damage through their assessors and a local contractor. Wm. Tonyan and Sons came on site and
offered their analysis and itemized quote for the work to be completed.
Work repairs could not begin until the insurance claim had been finalized. Just last week, the
claim was settled, and the City received $76,000 to put toward repairs.
ANALYSIS:
The horse barn was found to be over 110 years old. It is an integral part of our history as a
community. The repairs will allow the structure to be safely used both in demonstrations and
gatherings like the annual “Day at the Petersen Farm”.
The storm increased the amount of damage to the barn and it put the structure in a situation
where time is not on the City’s side. Repairs must proceed as soon as possible as the barn
continues to slightly shift. If the repairs are not completed, there is a high probability that the
structure will be lost altogether.
Wm. Tonyan and Sons is a trusted local contractor who has experience with these structures.
They have been a huge asset to the city in assisting in the insurance process, providing
independent structural analysis and an itemized quote that they are holding for the city as the
insurance process plays out.
The overall quote is $237,152. There was already $100,000 budgeted for the project.
Additionally, the city received approximately $76,000 from the insurance claim. The $61,152
balance remaining will require a budget amendment that will come from the Parks Developer
Donations Fund.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that a motion be considered to approve an
Ordinance amending the FY21/22 Parks Developer Budget in the amount of $61,152; and, to
approve a quote with Wm. Tonyan and Sons in the amount of $237,152 for the repair and
renovation of the horse barn on the Colby-Petersen Farm.

AN ORDINANCE AMENDING THE FY2021/2022 BUDGET FOR THE
FISCAL YEAR ENDING APRIL 30, 20 22
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City’s home rule powers
and functions as granted in the Constitu tion of the State of Illinois; and
WHEREAS, the City of McHenry acting by and through its Mayor and City Council has
previously approved the FY21/22 Annual Budget for the Fiscal Year Ending April 30, 2022 by a
motion at the Regular City Council Meeting held on April 19, 2021; and
WHEREAS, it is necessary and appropriate to delete, add to, or otherwise change certain
line items in said Budget Ordinance as provided in Exhibit A to this Ordinance;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: That the amendments to the Budget Ordinance for the Fiscal Year Ending
April 30, 2020 are hereby approved in the form and content as provided by Exhibit “A” which is
attached hereto and made part hereof.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain
and continue in full force and effect.
SECTION 3: All ordinances, or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its passage,
approval and publication, as provided by law.

Arby’s would like to open at this location, conditional use per all drive throughs. Left turn lane
East Bound will be added and timing configuration with traffic. Alderman Santi wanted to
confirm will this function as a four-way section, that is correct per Director Polerecky. Dan Havlir
is the Civil Engineer on the site and explained how this would be configured, approval pending

by IDOT. Alderman Glab has reservations on the impact on Crystal Lake Road, the traffic
amounts and the approval of apartments on Mill Street as well. No public comments.

The Vixen has submitted an application for a Class A Liquor License. This is for the McHenry
Downtown Theater at 1208 N Green Street.
Background checks are being completed on all individuals with 5% or higher ownership.
If approved, an ordinance needs to be passed to increase the number of C lass A liquor licenses
to 40.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended a motion be made to approve a Class A

ORDINANCE NO. 22-
Amending Title 4, Chapter 2, Alcoholic Liquor, Section 6, License Classification
and Fees; Approval Authority; Limitation on Number of Licenses
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 4-2-6, subsection D -1, of the Municipal Code relating to
liquor license classifications , shall be amended as follows:
D.1. Class A (Full Bar) License: Issuance of a Class A license shall authorize the sale of
alcoholic liquor for consumption on the premises, and the retail sale of packaged liquor.
The annual fee for such licenses shall be one thousand five hundred dollars ($1,500.00).
A Class A licensee shall be eligible to apply for a catering endorsement for an
additional fee of three hundred dollars ($300.00), which shall permit the servic ing of
alcoholic liquor for off -site consumption as an incidental part of food service, sold at a
package price, as agreed upon under contract. Nonprofit organizations with a Class A
license shall be eligible to pay a reduced fee of five hundred dollars ($500.00) per year
to receive and maintain a Class A license. No more than forty (40) Class A licenses
shall be in force in the City at any time.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of
this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such
judgment shall not effect, impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.

SUMMARY:
Public Works staff is bringing the current City of McHenry Honorary Street Sign policy before the
City Council for discussion to gain direction regarding how to enforce or implement the existing
program, or if further revisions to the policy need to be made.
BACKGROUND:
The Honorary Street Sign program was implemented in the City of McHenry in 200 5 as a way of
honoring members of the community who have contributed to or made a significant impact on
the community. To date, there have been 33 Honorary Signs approved and installed.
The program was originally implemented with the approval of a policy by the City Council but not
with the adoption of an ordinance and inclusion of the ordinance in the M unicipal Code. The
original policy did not identify a time limit for when the signs would be taken down but rather
stated that the honorary signs would be displayed in perpetuity. In 2016 , the program was
reformed, and the policy was revised to include a ten-year time limit for all signs. Prior to the
revision in the policy, there were 17 honorary signs which were approved with no time limit
specified. Since the revision of the policy to create a time limit for all honorary signs, there have
been questi ons by members of City Council and the public regarding whethe r the time limit will
be enforced and signs that are ten years old be removed. Currently, one of the challenges staff
ha s encountered is that many of the commonly requested locations for honorary street signs
already have signs installed and applicants are having to seek alternate locations or multiple signs
are being installed at opposite corners of intersections.

Staff, at the request of the Mayor, was directed to begin removing signs in Spring of 2021.
However, upon beginning the process of contacting applicants, friends, and loved ones of
honorees, staff became aware of some of the underlying challenges associated with t he removal
of existing signs. For families and loved ones of the honorees, the removal of the honorary signs
can be a deeply personal experience and up until 2016, these families and loved ones were not
given any indication that the signs would ever be re moved. Because of these challenges
associated with the removal of existing signs, staff has brought the current policy forward to the
City Council for discussion and direction.

AGENDA ITEM SUMMARY:
Staff is seeking direction from City Council regarding the approval of Honorary Street Signs for
the 2022 calendar year.
BACKGROUND:
The Honorary Street Sign program provides citizens of the City of McHenry with an opportunity
to honor people and/or family members who have made significant contributions to the City. To
be considered, the proposed honoree is required to meet the fol lowing criteria: historical and/or
cultural influence on the City; proof of significant association to the City; clear geographical
relationship of street to the area of interest of the candidate; known to be of good moral
character and clearly defined community or public contribution made by the honoree.
The following Honorary Street Sign applications (attached) have been submitted in the past year
for consideration:

the Honoree on the acquainted with hundreds of business owners. He became well respected with a
City reputation for hard work,fairness, honesty and going the extra mile. Marcie being an
excellent seamstress,started to build a customer base of her own. From hems to
bridals gowns.

was playing. She was a planner and organizer.And always with a smile

Clrearly Defined Pamela J.Althoff was born November 22, 1953 in Chicago, IL. She earned a
Community or Public bachelor's degree in Education at Illinois State University in 1975 and a master's
Contribution Made by degree in Education at Northeastern Illinois University in 1978.She was a Special
the Honoree Education teacher from 1975-1981. During her last year as a teacher,she took her
first public role as Assistant Administrator with the McHenry Area Chamber of
Commerce,from 1980 to 1982. She then became a Sales and Marketing
Representative at Kepper,Tupper and Company from 1982 to 1994.She served as
McHenry City Clerk from 1994-2001 until she was elected as the first female City of
McHenry Mayor. In 2003 she was appointed to fulfill the term of Illinois State
Senator D. Klemm. She was again the first female to occupy this position from the
county of McHenry and served until retirement in September of 2018.She served as
the Republican Caucus Whip during the 97th General Assembly and as the
Republican Caucus Chair in the 98th and 99th General Assemblies.
In 2017,Althoff announced she would run for the McHenry County Board,as well as
that she would not run again for re-election in 2018. She resigned early from the
Illinois Senate on September 30,2018.

Cultural Infulence of from the jewelry store Harold Steffan opened in 1946. People had little money for
the Honoree on the jewelry in the 1940's so every piece was treasured.After Harold, Marie Diedrich, his
City daughter and successor,crafted new and kept time ticking by repairing everything
that needed fixing.
Suzanne started working alongside her mother when she was 12 years old.
Together,they tended to the needs of people in McHenry and shared in great family
legacies. By 1992,Suzanne owned the business,and the jewelry business became
a McHenry treasure.Whether our Steffan's memory is on our finger,wrist or hanging
from our neck,we can agree that Steffan's has been a piece of McHenry's finest
history.Today, her son Max continues the work of his great grandfather,
grandmother and mother linking jewelry to joy.
